1 THE CORPORATIO OF THE TOW OF WHITCHURCH-STOUFFVILLE BY -LAW UMBER FI BEIG A BY-LAW to establish fees or charges for services or activities provided by the Town of Whitchurch-Stouffville (General Fees and Charges) and to repeal By-laws FI and F1. WHEREAS Section 391 of the Municipal Act, 2001, provides that a Municipality may pass by-laws imposing fees or charges for services; AD WHEREAS Section 69 of the Planning Act provides that a Municipality may establish a tariff of fees for the processing of applications; and AD WHEREAS Section 7 of the Building Code Act, 1992 authorizes a municipal Council to pass by-laws concerning the issuance of permits and related matters, and AD WHEREAS Section 33 of the Funeral, Burial and Cremation Service Act, 2002 requires that an owner of a cemetery shall file with the Registrar a price list of all interment rights and cemetery services and supplies that may be sold and all charges that may be made by that owner; and AD WHEREAS it is deemed necessary to establish a general fees by-law for The Corporation of the Town of Whitchurch-Stouffville. OW THEREFORE THE COUCIL OF THE CORPORATIO OF THE TOW OF WHITCHURCH-STOUFFVILLE EACTS AS FOLLOWS: 1. THAT this by-law may be referred to as the "Fees and Charges By-law." 2. THAT the fee structure of The Corporation of th~ Town of Whitchurch Stouffville, general fees for the various departments and organizations of the Town of Whitchurch-Stouffville, including Whitchurch-Stouffville Public Library shall be attached hereto and shall form part of this By-law: Finance Clerk's Fire & Emergency Services Public Works W/S Public Library Planning/Building & Engineering - General Planning and Building Services - Planning Planning and Building Services - Building Planning and Building Services - Downtown Farmer's Market Leisure Services Cemeteries Schedule A Schedule B Schedule C ScheduleD Schedule E Schedule F Schedule G Schedule H Schedule I Schedule J Schedule K 3. THAT should any section of this by-law be declared invalid by court of competent jurisdiction, such section shall be construed as being severed herefrom and the remainder of the by-law shall continue in full force and effect. 4. THAT By-laws FI and F1 are hereby repealed. 5. THAT this by-law shall come into effect on the 15th day of April, 2013, or as otherwise stated in the schedules. 24 SCHEDULE "G" DEPARTMET: PLAIG & BUILDIG SERVICES SERVICE AREA: PLAIG Unit of Measure 1 Consultants Costs The Town may engage consultants to review and evaluate studies, retain solicitors and similar professional services in which case the costs incurred will be charged back to the applicant, plus 7.5% administrative fee. The Town will require an initial deposit of $20,000 at the time of filing the Planning Application for major developments [;:: 0.20 ha land area; ;:: 465 sq.m for ICI developments; ;:: 5 residential units] or $10,000 in all other examples. The peer review deposit for residential (single detached, semidetached, townhouse and duplex) within the Heritage Area as defined by By-law SI shall be $3, If the cost of the peer review services exceeds this threshold, the Town will stop all review work until additional funds are secured. 32 SCHEDULE"H" DEPARTMET: PLAIG & BUILDIG SERVICES SERVICE AREA: BUILDIG Unit of Measure Admin Cost HSTat 13% 1 Calculation of Fees as it relates to administration and enforcement of the Building Code Act, 1992: a) Pursuant to the Building Bylaw, the Permit fees payable shall be the product of the fixed fees and/or fee multipliers prescribed in this by-law. Permit fees are determined by using the appropriate class of construction in combination with the appropriate measure of the floor area of the project. Except as exempted elsewhere in this by-law, the calculated gross floor area shall be determined by all potentially usable floor and/or roofed areas bounded by the exterior faces of the structure including stairways, elevator shafts, mechanical areas, atriums, basements, garages, porches and decks. For certain classes of construction the fee is a flat rate. b) c) d) e) Where there is no clearly defined category in this Bylaw, the Chief Building Official may determine the appropriateness of fees, based on charging at rate of 1% the value of construction and/or having regard to the complexity and the amount of service required. Except as exempted elsewhere in this by-law, all fees and charges are due at the time of application or where no permit is applicable, at the time when the service has commenced. As per Section 398 of the Municipal Act, fees and charges imposed by this Bylaw constitute a debt on a property owner and shall entitle the Town to add the amounts to the respective tax roll for any uncollected outstanding balances which are past due. Where the Chief Building Official refuses to accept a valuation for the purposes of establishing any permit fee and substitues another value, and the owner or applicant disputes the decision, the owner or applicant shall pay the fee(s) under protest and within six months of the project completion shall submit an audited accounting statement of the actual costs by a recognized financial accountant. If the audited costs are less than the original valuation, the Chief Building Official shall authorize a refund. otwithstanding this corporate "Fees and Charges Bylaw", no fees shall be charged for Town owned projects. Only legal land owners, currently not benifiting from an agreed upon recognized energy and resource conservation Town initiative, will be entitled to apply for a rebate from the total monies collected for this purpose annually. All proposed and agreed upon recognized energy and resource conservation initiatives must noticeably exceed the standards established by the Building Code, as determined by the Chief Building Official. Owners participating in this program, through a written agreement, shall be entitled to a fee rebate upon satisfactorily verified completion of the project. g) h) i) otwithstanding the fees and/or charges required elsewhere by this Bylaw, a charge of $ shall be levied against the owner of a building used as an illicit grow-operation and/or a clandestine chemical laboratory to recover the administrative costs associated with the building evaluation and enforcement. otwithstanding fines levied against any person, every owner of a property for which an Order is issued under the Building Code Act, shall pay an administrative fee of $250.00, unless the Chief Building Official determines that the Order had no merit. Where a change of occupancy from one classification to another classification is proposed, the fee multiplier for the proposed occupancy applies. Except for temporary buildings on construction sites for storage, administrative and/or supervisory purposes, fees shall be charged for temporary buildings, including tents and sales trailers at the rate specified elsewhere in the "Service Area: Building" of this Bylaw. Where an applicant declares that an application is complete in all respects, but the application is subsequently determined to be incomplete by the Chief Building Official, an administrative charge of 10% shall be levied in addition to the fees that would otherwise be payable pursuant to this Bylaw for the purposes of redirecting and relabelling the file into the incomplete permit stream.
