1 THE CORPORATION OF THE TOWN OF PENETANGUISHENE BY-LAW Being a By-law to Amend By-law , as amended, a By-law to Establish and Approve the Fees and Charges of the Town of Penetanguishene (Administration Fees & Recreation Fees) WHEREAS pursuant to section 9 of the Municipal Act, 2001 S.O. 2001, chapter 25 a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHEREAS pursuant to section 8. (1) of the Municipal Act, 2001 S.O. 2001, chapter 25 the powers of a municipality under this or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate to enhance the municipality s ability to respond to municipal issues; AND WHEREAS the Municipal Act, 2001 S.O. 2001, Chapter 25, Section 391(1) provides that despite any Act, a municipality and a local board may pass by-laws imposing fees or charges on any class of persons; (a) for services or activities provided or done by or on behalf of it; (b) for costs payable by it for services or activities provided or done by or on behalf of any other municipality or local board; and (c) for the use of its property including property under its control: AND WHEREAS notice was given in accordance with the Town of Penetanguishene Procedures for Notice By-law for an amendment to the Composite Fee Schedule By-law with respect to fees. NOW THEREFORE be it enacted and it is hereby enacted by the Council of The Corporation of the Town of Penetanguishene as follows: 1. That Sections 1 and 2 of By-law , as amended being the Administration Fees shall be rescinded and replaced with Schedule A attached hereto and forming part of this By-law. 2. That Sections 9 of By-law , as amended being the Parks, Recreation & Culture Fees shall be rescinded and replaced with Schedule B attached hereto and forming part of this By-law. 3. That all other provisions of By-law No , as amended remain in full force and effect.
2 4. That this By-law shall take force and effect upon passage hereof except where otherwise specified in this By-law or in the Schedules attached hereto and forming part of this By-law.
