1 THE CORPORATION OF THE TOWNSHIP OF MADAWASKA VALLEY BY-LAW NUMBER Being a By-Law establishing a Schedule of for The Corporation of The Township of Madawaska Valley. WHEREAS Section 390 and Section 391 of the Municipal Act 2001 authorizes the Council and Local Boards to pass by-laws imposing fees or charges for services or activities provided or done by or on behalf of the municipality or the Local Board and for the use of its property; AND WHEREAS the Council of The Corporation of the Township of Madawaska Valley deems it advisable to up-date the Schedule of for the Corporation of The Township of Madawaska Valley. NOW THEREFORE the Municipal Council of The Corporation of the Township of Madawaska Valley enacts as follows: 1. THAT attached hereto as Schedule A to this By-Law is an up-dated Schedule of hereby ratified and imposed for The Corporation of the Township of Madawaska Valley from the effective date and ensuing years and will remain in effect until such time as it is amended in part by Resolution or by By-Law. 2. THAT all fees and charges set out in this by-law shall be payable prior to the provision of the service unless an agreement is made to the contrary and approved by the municipality. 3. THAT in the event any fee or charge imposed herein remains unpaid after provision of the service or is otherwise in arrears, such fees or charges may be added to the Tax Roll (when possible) for any real property in the municipality, the owner of which is responsible for paying the fee or charge and shall be collected in like manner as municipal taxes. 4. THAT the Chief Administrative Officer/Clerk is hereby delegated as the authority to administer such fees and charges and approve such forms and procedures as may be required for the efficient administration of the fees and charges. 5. THAT By-Law Number is hereby rescinded and replaced by this By-Law. 6. THAT this By-Law shall be deemed to have come into force and effect as of the 26 th day of January, including any resolution which has been passed by Council.
