NEBRASKA RESOLUTION: SPECIAL USE PERMIT FOR COMMERCIAL RECREATIONAL AREA - Weddins and Events VALA'S FARM WEDDINGS AND EVENTS: 0 S 80ft Street WHEREAS, pursuant to Neb. Rev. Stat. $ 3-04, the County has the power to do all acts in relation to the concerns of the County necessary to the exercise of its corporate powers; and, WHEREAS, pursuant to Neb. Rev. Stat. $ 3-03, the powers of the County as a body are exercised by the County Board; and, WHEREAS, the County Board of Commissioners has the authority to adopt a Zoning Regulation, which shall have the force and effect of law pursuant to Neb. Rev. Stat.$ 3-l4; and, WHEREAS, said Zoning Regulations require the County Board of Commissioners to approve Special Use Permits and all amendments thereto; and WHEREAS, Vala's Pumpkin Patch has operated under a Special Use Permit since 993 as a commercial recreation operation, with the most recent updated amendment to the Special Use Permit approved at Resolution0l4-63 which covers Vala's fall pumpkin patch activities with specific dates and times of operation; and, WHEREAS, Vala's Farm Wedding and Events has applied for a separate Special Use Permit to allow for wedding and events in the spring and summer months beginning in 06 on the property generally located southwest of l80th Street and Schram Road and legally described as follows: Tax Lots 7 and 8 in Section 5, Township 3N, Range E of the 6th P.M. Sarpy County, NE. NOW, THEREFORE, BE IT RESOLVED BY THE SARPY COI.INTY BOARD OF COMMISSIONERS that this Board makes the following findings of fact: L II. A public hearing regarding the Special Use Permit application was held before the Sarpy County Planning Commission on September 4,05 and the Planning Commission gave their recommendation, A public hearing regarding the Special Use Permit Application was held by this Board. III. Notice of each of the Public Hearings described above was published at least ten (0) days prior to each respective public hearing as required by Neb. Rev. 2 IV. The Planning Department has made a recommendation as noted in the attached Exhibit "A", which Exhibit "A" includes the Planning Department report, Operational Plan, and the site plan. V. The Special Use Permit Application is in compliance with the Comprehensive Development Plan and the Zoning Regulations. FURTHER BE IT RESOLVED THAT this Board in light of the above recited findings of fact, after due deliberation and consideration, approves the Special Use Permit as described within the Planning Department report and the Operational Plan, on the property described above, subject to the following conditions: L Applicant will reimburse Sarpy County 00% of the cost for dust control applied due to the operation.. The attractions of the train, jumping pillows, hayrack rides, big slide, and ball throw operate no later than 0 p.m. The above Resolution was approved by a vote of the Sarpy county Board of.t. II. BACKGROUND INFORMATION A. EXISTING CONDITION OF SITE: The site is currently developed with various buildings and attractions, parking areas, and growing fields that are used as a Seasonal Commercial Recreational Operation known as Vala s Pumpkin Patch pursuant to a special Use permit approved by Resolution

GENERAL VICINITY AND LAND USE North and East: Open agricultural land with acreage developments known as Country Estates and Murray s Rusty Rose Ranchettes South: Interstate 80 and OPPD Substation West: Open agricultural land C. RELEVANT CASE INFORMATION: Existing Special Use Permit (SUP) was originally approved by Sarpy County in 99 for the operation of a seasonal commercial recreational business. This SUP was amended in 99, 994, 995, 997, 000, 003, 0, and 04 due to permit expirations, changes in the operational plan and expansion of attractions/buildings. The most recent SUP, approved by Resolution 04-63, allows for the operation of a Seasonal Commercial Recreational Area being operated as Vala s Pumpkin Patch under the following provisions: ) Operational dates from September to November 30 each year; ) Operational hours: Sunday through Thursday 9AM to 9PM and Friday; through Saturday 9AM to 0PM with all guests off the property by PM; 3) Parking limited to 4,964 vehicles; 4) Uses and Structures compatible with existing uses and structures and only located within the Future Phase and areas; 5) 00% reimbursement to Sarpy County for applied dust control; 6) Verification of exemption to regulations or approval by Nebraska Department of Environmental Quality Control, Nebraska Department of Health and Human Services, Gretna Fire Department and State Fire Marshall; 7) Permit valid for as long as Tim Vala, Jan Vala, or one of the daughters owns and operates the business as Vala s Pumpkin and Farm and Fall Festival, Inc. D. APPLICABLE REGULATIONS: Sarpy County Comprehensive Development Plan Sarpy County Zoning Regulations: Section 9, Agricultural Farming District Section 4, Special Use Permits III. ANALYSIS / STAFF COMMENTS A. COMPREHENSIVE PLAN: The Comprehensive Plan shows the area as future Mixed Use Center development and Business Park (Figure 5.) B. TRAFFIC AND ACCESS: Access to the subject property is from Schram Road, 500 feet west of 80 th Street intersection. Applicant plans to improve an existing exit and access road alongside the main entrance road on Schram Road. All traffic will enter and exit along Schram Road. The exit gate along 80 th Street will be gated. C. OTHER ENCY REVIEW/COMMENTS: The applications were sent to area jurisdictional agencies or departments that may have an interest. At the time of this staff report, no comments or objections to the application had been received.

GENERAL: The applicant desires to expand their business to allow for wedding and events in the spring and summer months beginning in 06 as Vala s Farm Weddings and Events for as long as Tim Vala, Jan Vala, or their daughters own and operate the business. The Operational Plan submitted by the applicant proposes the following: o Events will be booked with a starting time as early as 9AM and run as late as AM from May through August o A maximum of two events occurring simultaneously, potentially twice a day o Events will take place in existing buildings now known as the Pie Barn, the Pavilion and the Country Bakery. Restrooms will also be utilized. o Maximum number of guests will be 50 for the Pie Barn and 50 for the Pavilion which includes outdoor spaces o Applicant has requested approval to open some attractions if requested by the parties such as the train, jumping pillows, hayrack rides, the Bid Slide Ride and the ball throw. o Music will stop at midnight with all guests off the property by AM Events will be catered by Vala s or by an outside caterer Vala s will obtain a liquor license and each party will be responsible for hiring a responsible bartender. No outside alcohol will be permitted. Access and exit road will be improved from Schram Road and the 80 th Street gate will be closed. Existing parking facilities will be utilized and no additional parking will be added. Parking lot attendants will be staffed when attendance is over 00 guests For evening events, any parking lot lighting will face west away from the adjacent nearest neighbors Security will be staffed for every 00 guests on the property Four part-time employees will be responsible for booking and preparing for the events with additional employees assisting with catering and clean-up Emergency equipment access will be the same as what is established for the fall season. Staff has the following comments regarding the request: ) Staff recommended that a special use permit for the spring/summer season use (Vala s Farm Wedding and Events) be submitted for consideration separate from the fall use (Vala s Pumpkin Farm and Fall Festival) primarily due to the use of alcohol at scheduled events, but also for enforcement reasons. ) Staff feels the use of the additional attractions such as the train, jumping pillows, hayrack rides, big slide, and ball throw could create enforcement issues such as noise. If the use of the additional attractions is permitted, staff would suggest limiting the operational hours of such attractions. 3) Adding the new use will add an additional four months of traffic which may require additional applications of dust control. IV. PLANNING COMMISSION RECOMMENDATION: The Planning Commission held public hearings on these applications at their September 5, 05 meeting and recommended APPROVAL to the County Board.

6 MOTION: Bliss moved, seconded by Torczon, to recommend Approval of the Special Use Permit for the operation of a commercial recreational area known as Vala s Farm Weddings and Events pursuant to the operational plan submitted and subject to, ) the additional attractions having limited hours ending by 0 p.m. and, ) any dust control that may be required due to the new use that will add an additional four months of traffic be at the expense of the applicant. This recommendation is being made as this request is consistent with the Comprehensive Plan and meets the Zoning Regulations of Sarpy County. Ballot: Ayes Bliss, Huddleston, Ackley, Whitfield, Malmquist, Fenster, Torczon and George. Nays: None. Abstain: None. Absent: Davis, Lichter, and Sotak. Motion carried V. STAFF RECOMMENDATION: Staff recommends APPROVAL of the Special Use Permit for the operation of a commercial recreational area known as Vala s Farm Weddings and Events pursuant to the operational plan submitted with consideration of limited operating hours for additional attractions as requested by the applicant. 9 Vala's Pumpkin Patch & Fall Festival 80 Schram Road Gretna NE Weddings & Special events Spring/summer Overview Vala's Pumpkin Patch wishes to expand our business to include weddings and events in the spring and summer, what we will call Vala's Farm Wedding and Events, beginning in 06. We plan to book events for families and corporations, potentially 9am to am, May through August. We will host a maximum of two events simultaneously, potentially twice a day, in two already existing facilities: The Pie Barn and The Pavilion. The maximum number of guests will be 50 at The Pie Barn and 50 at The Pavilion (including outdoor spaces). Parties will have outside catering brought in or use Vala's on-site catering. Vala's will obtain a liquor license and parties will be required to hire a bartender to serve alcohol responsibly. Other facilities on the Vala's Pumpkin Patch property that we will be using are: The main restrooms, the south restrooms (near the Pie Barn) and The Country Bakery. Some attractions will be open upon request from parties, including: the train, jumping pillows, hayrack rides, the Big Slide Ride and the ball throw area. We also have three fire pits by The Pavilion that we may light upon request, for roasting hot dogs and marshmallows. Vala's will meet all health department requirements for water. Traffic and Parking: - Parking will be restricted to the already approved Vala's Pumpkin Patch parking lot, and no additional parking spaces will be added. - We have handicap parking available. - For guests needing assistance to their event sites on the farm we will shuttle them in golf carts or Gators. - We will improve an exit and access road alongside our main entrance road. All traffic will enter on Schram Rd. as normal but also exit along Schram Rd., to the east of the current main exit. Our Exit on 80th St. will be gated off so guests to the farm will not be using 80th St. south of Schram Rd. - For two events totaling 400 guests, we estimate that the maximum number of cars that will be in our parking lot at one time is When over 00 guests are expected at one time we will have parking attendants monitoring and directing traffic as necessary.

10 Noise and Lighting: - For evening and nighttime events, all parking lot lighting will be facing west, away from our nearest neighbors. - Noise should not be excessive. The Pie Barn at Vala's Pumpkin Patch is an estimated, 00 feet from our closest neighbor, and the Pavilion is over,00 feet. Between the venues and the nearest houses there is landscaping, trees and hills that will block most of the sound. - All music will stop at midnight and guests will be off the premises by am. Security and Staffing: - We will have one security guard on duty at all times for every 00 guests on the farm. They will closely monitor guests and watch for excessive or underage drinking. - When parties intend to serve alcohol they must hire a bartender who will check IDs and watch for excessive drinking. No outside alcohol will be permitted. - Four part-time employees will be in charge of booking and preparing for the events, and other Vala's employees will help with duties like catering and clean-up. We estimate about 5 to 0 employees may be working at each event, depending on the services provided. Safety: - All emergency services will have the same access points to Vala's Pumpkin Patch as have been established during our fall season. Anticipated Typical Party: - We anticipate our venues being popular wedding ceremony and reception venues for parties of around 00 people, May through June. Typically they would reserve the spaces on Saturday evenings. Guests would arrive around 5pm, dinner would be served around?pm and dancing and music will continue until pm or midnight. All guests will be off the premises by am; our staff would clean up both after the party and the next morning.
