RECOMMENDATION: OPTION 1 THAT the Regional Board support and authorize the application to proceed to the Agricultural Land Commission as the proposal is consistent with the Official Community Plan. OPTION 2: THAT the Regional Board refuse authorization for the application tp proceed to the Agricultural Land Commission LAND USE POLICIES AND REGULATIONS OFFICIAL COMMUNITY PLAN (OCP): Agriculture, PRRD South Peace Fringe Area Official Community Plan 2048, 2012 ZONING: A-2 (Large Agricultural Holdings Zone) PRRD Bylaw No. 1343, 2001 AGRICULTURAL LAND RESERVE (ALR): Within BUILDING INSPECTION AREA: Within the voluntary building permit area SITE CONTEXT The subject property is located east of the Village of Pouce Coupe on the north side of Briar Ridge Road. The Pouce Coupe river forms most of the boundary on the western side of the property. The wider area consists of mainly ¼ section parcels; however residential use is becoming more prevalent. SITE FEATURES LAND: Based on aerial photograph interpretation, the majority of the subject property appears to be fully forested. STRUCTURES: There is one 5 year old house, a pole shed, one shop and an old barn on the property. ACCESS: The subject property is accessed from the Briar Ridge Road. SOIL: Class 7t and 6t.. Class 6 soils are capable only of producing perennial forage crops, and improvement practices are not feasible. Class 7 soils have no capacity for arable culture or permanent pasture Subclass T denotes topography. Raaen LEGAL: NE ¼ Section 33, Township 77,Range 14 W6M, PRD PROPOSAL: To subdivide a 2.2 ha parcel from the property. DECISION: ALC approved the subdivision by Resolution #760/89 on August 15, 1989 COMMENTS AND OBSERVATIONS APPLICANT ALR: OCP: ZONING: IMPACT ANALYSIS Page 2 of 6 It is the intent of the landowners to subdivide a 10 acre parcel from the parent property in order to create a separate homesite for themselves. The subject property lies within the Agricultural Land Reserve. Therefore, Agricultural Land Commission approval is required. Note: Pursuant to the Agricultural Land Commission Act, an application may not be considered by the ALC unless the Regional Board authorizes the proposal to proceed to the ALC. This is intended to provide local governments with latitude to consider and weigh the local community interests of each application, in addition to its zoning and official community plan. Should the Regional District forward the application to the ALC, the information and recommendation offered by the Regional District is taken into consideration by the Commission but should not be construed as being binding on the Commission s opinions or decisions. The subject property is designated Agriculture within the South Peace Fringe Area OCP Bylaw No. 2048, This designation has minimum parcel size of 63ha (155 acres), however Section Policy C(v) states the minimum parcels size does not apply if: the subdivision is being made for the purpose of providing residence to the landowner, or a relative of the landowner, the subdivision is limited to not more than one lot per parent parcel, such a subdivision may be approved on a one time only basis per parent parcel, subdivision or land use proposals will be examined and considered in areas designated Agriculture, subject to the factors as set out in this document. Therefore an amendment to the OCP is not required. The subject property is designated as A-2 (Large Agricultural Holdings Zone) within PRRD South Peace Fringe Area Zoning Bylaw No. 1334, This zone has a minimum parcel size of 63 ha (155 ac), however should the proposal meet the requirements of subdivision under Section 946 of the Local Government Act, a zoning amendment would not be necessary. AGRICULTURE: The proposal should have minimal impact on the agricultural productivity of this parcel because there has been no use of this parcel for agricultural practices prior to making this application. Most of the parent parcel contains class 6 and 7 soils and suffers from topographical constraints. CONTEXT: This area consists essentially of large parcels of the quarter section size however there are a number of rural residential parcels in close proximity to the parent parcel, particularly to the south and west across the Pouce Coupe River. POPULATION & The proposed subdivision could increase the population of the area by 2.7 people
