Call to Order PAA Chair Ms. Mindy Moran called the meeting to order at 11:13 a.m. Attending were: Ms. Margaret H. Approval of October 2014 Minutes Ms. Melinda Moran requested a motion to approve the October 2014 minutes. Mr. Tom Schwartzwelder moved that the minutes be approved. Mr. Matt Walker seconded the motion. Ms. Melinda Moran, Chair, asked for any discussion. Motion carried by unanimous vote. 3. Approval of March 2015 Financial Report Ms. Melinda Moran, Chair, requested a motion to approve the March 2015 financial report subject to audit. Mr. Tom Schwartzwelder moved that the minutes be approved. Mr. Matt Walker seconded the motion. Ms. Melinda Moran, Chair, asked for any discussion. Motion carried by unanimous vote. 4. Public Comment None. 5. Presentation of the June 2014 Year End Audit Ms. Beth Johnson presented the findings of the June 2014 year end PAA audit. Due to separating the PAA finances from the MPPDC finances last year, the PAA is now required to perform annual audits. This first audit for the PAA was clean and had no findings. Mr. Tom Schwartzwelder complimented staff on the audit. Mr. Matt Walker made a motion to accept the audit as presented. Mr. Chris Hutson seconded the motion. Ms. Melinda Moran, Chair, asked for any discussion. Motion carried by unanimous vote. 6. Virginia Interactive Reservation System Mr. Lawrence updated the Board on the Virginia Interactive Reservation System. The first 6 months of the online reservation system saw a (not unexpected) decrease in revenue. Customers of the PAA need time to learn about the new reservation tool. Users generally liked the design but asked that the PAA enhance the system with three items: Seasonal Passes; information only inventory items (items that cannot be reserved but are 1

3 PAA owned or managed); and a mechanism to reserve areas that have no cost. Mr. Lawrence showed the Board the proposal in the Agenda Packet that was presented by Virginia Interactive. This proposal would cost up to $10, to implement, but Mr Lawrence felt that the work could be completed for closer to $6,000 and would address the three user requests listed above using a variety of approaches. There was a lengthy discussion concerning the uses of these items, including Mr. Walker s question of: Is the PAA interested in managing properties for Counties? How? What level? Other questions posed included if the reservation system could be used for parking; who would enforce the parking/reservations; is the PAA a reservation agency or an enforcement agency?. Mr. Lawrence advised the Board that the PAA has recently been funded to develop a Regional PAA Strategic plan by the Coastal Zone Management Agency. The grant, which will attempt to answer the questions posed, will start in October, Ms. TheBerge pointed out that the reservation system was a tool that needed to be refined with the above changes so that the reservation system would be a robust tool for the PAA to utilize as the Board directed. Mr. Schwartzwelder made a motion to approve the staff recommendation to offer up to $10, to Virginia Interactive to complete their proposal to make the improvements to the reservation system. Mr. Matt Walker seconded the motion. Ms. Melinda Moran, Chair, asked for any discussion. Motion carried by unanimous vote. 7. Essex County a. CZMA Altruistic Giving Proposal Update This project is designed to encourage private donations of waterfront land for public benefit. Staff updated the Board that the grant period has started and asked the Board if they had an opinion on what geographical area of Essex County should be covered. Mr. Davis indicated that she would like to see the lower part of Essex County pursued so that more public access areas to the water could be opened up in that area. 8. Gloucester County a. Cpt. Sinclair Recreation Area Update i. Lands End Subdivision Road US Postal Service and Road Maintenance Discussion the discussion of how to maintain the road continues. Staff was directed to send the Gloucester County Attorney a list of questions to clarify who owns the subdivision road and who has maintenance responsibility for the streets created under the approved 1967 subdivision. ii. Draft VCU Adaptive Reuse Plan and Presentation Schedule: A full presentation on this proposal is set for May. The board may have to convene an off-schedule meeting for the presentation. iii. CNU Proposal for Living Shoreline: Mr. Lawrence announced that Christopher Newport University is applying for funding to build a high energy Living Shoreline on the Cpt. Sinclair Recreation Area. If funded, the project would protect the eroding marsh and provide a site for research on high energy Living Shorelines. 2

4 iv. Contract Approved for Kayak Pier and Songbird Habitat: Staff informed the Board that the contract for the Kayak Pier and Songbird Habitat is funded. The project should be completed within the year, but hopefully by the Fall of v. Pool House Rental: Staff was approached by a person who was interested in renting the Pool House. The PAA Board discussed the request and decided to table the discussion until a later date. b. Perrin Wharf sticker reservation strategy for wharf: Mr. Lawrence discussed the continual failure to sell stickers for the PAA wharf. Income is needed to help maintain the wharf. The next option to pursue would be to have Mr. Jeremy Bonniville manage the sticker system. Mr. Bonniville is the owner of Crabs Express and buys the majority of the seafood that comes into the Perrin Wharf. The Board agreed that this would be a good avenue to try. c. Commissioner of Revenue: Tax Exempt Status Update: Mr. Lawrence discussed the issue of continuing to receive tax notices from the Gloucester County Commissioner of Revenue on property owned by the PAA in Gloucester County. The letter from Delegate Hodges to the Commissioner of Revenue (Gloucester) that is included in the Agenda Packet was referenced. Delegate Hodges stated that he has not received a response from the Commissioner of Revenue. The concern is that the Treasurer of Gloucester County may put PAA properties for sale for back taxes. The PAA Board discussed the issue at length. It was decided that an opinion from the Department of Taxation on this matter would be a good next step. Mr. Swatzwelder made a motion to request an opinion for the Virginia Department of Taxation, with a formal letter signed by Delegate Hodges and PAA Chair, Mindy Moran. Mr. Walker seconded the motion. Ms. Melinda Moran, Chair, asked for any discussion. Motion carried by unanimous vote. Mr. Hutson stated that he would update the Gloucester County BOS of the issue at the next meeting. d. Motion : Change of resolution for the South Garden property to include phrase: Tolar Nolley, agent for South Garden International, LLC and Oyster Company of Virginia, LLC desires to donate 2 parcels of land in the Abingdon District in Gloucester County, Virginia identified in the land records of Gloucester County as parcel 47-11E and further described in Plat Book 22, Page 171, Tax Map AP 3010 PG 0146 and ; 9. King and Queen County a. Middle Peninsula Regional: Take a Kid Fishing: Mr. Lawrence discussed the plan to apply for funding from the VMRC Recreational Fishing Fund for a Regional Children s fishing day. The proposal would be presented at the next RFP by VMRC. The following Counties have partnered with organizations so far: Essex County the Rotary Club Middlesex County Kiwanis Gloucester County Ruritan 3

5 King and Queen County Ruritan and the Fire/Rescue Squads Mathews and King William are still pursuing partners. 10. Mathews County a. Hall Donation Site Update (Mathews Heritage Park); Staff advised the PAA Board of the reversion clause (copy included in Agenda Packet) in the Deed of Gift for the Hall Donation. If the Mathews County BOS is not able to direct the PAA on a use for the property that satisfies the Deed restrictions, the PAA may have to donate the property to a Non-profit that will manage the property according to the donor s wishes. No action was taken. b. Williams Wharf Update: Staff advised the PAA Board of a request to have the PAA co-hold a second easement on the property. No action was taken. c. New Donations: Mr. Lawrence advised the Board that 3 new parcels in Mathews County (parcels 40A (1) 22; 40A (1) 50; and 40A (1) 51, further described in Plat Book 4 Tax Map 40, Page 196A) have been offered to the PAA. Mr. Swartzwelder made a motion to accept the deed of gifts with the resolution provided by Mr. Lawrence. Mr. Edwards seconded the motion. Ms. Melinda Moran, Chair, asked for any discussion. Motion carried by unanimous vote. 11. Middlesex County a. Update on MOU for public access management services Mr. Lawrence discussed that the MOU with Middlesex County is still work in progress, but many ideas concerning how to work the relationship are being discussed. No final MOU has been drafted at this time. The MPCBPAA Board will be updated as this process reaches drafts for discussion. 12. Other Business a. Tractor Bucket Mr. Lawrence stated the need for a tractor bucket on the MPPDC tractor so that movement of dirt and gravel could be achieved for maintaining roads. The cost is $ Mr. Swatzwelder made the motion to have the PAA buy the tractor bucket. Mr. Edwards seconded the motion. Ms. Melinda Moran, Chair, asked for any discussion. Next Meeting The Next Middle Peninsula Chesapeake Bay Public Access Authority Meeting is scheduled for April 10, 2015 at 11:00 am in the Middle Peninsula Planning District Commission s Regional Board Room. 15. Program: Mathews Heritage Park (Billips Creek Access) $0 Description: This program will continue to use grass roots, citizen driven strategies to work towards the development of a partnership between Mathews County citizens and youth and the Mathews County Scouts that will result in the proposal of a plan to utilize the Mathews Heritage Park as a camp for the youth in Mathews County. Responsibility: Regional Planner Support: Coastal TA 6. Program: Haworth, Clay and Lands End Tract Timber Management Restricted: $41,600 Description: Activities: This program will work on maximizing the natural resources on PAA public land for habitat and recreational improvements. a. 17 May 8, 2015 RESOLUTION ALLOWING THE PAA TO ACCEPT A DEED OF GIFT FROM DAVID AND DOROTHY DEA FOR PROPERTY LOCATED ALONG ADAMS CREEK IN GLOUCESTER COUNTY, VIRGINIA WHEREAS, the Middle Peninsula Chesapeake Bay Public Access Authority was created by the General Assembly in 2003 and recognizes that shorelines are high priority natural areas are critical for accessing water; and WHEREAS, the Middle Peninsula Chesapeake Bay Public Access Authority is regional leader in addressing public access needs thought the region, it is authorized to accept and receive gifts of real estate pursuant to the provisions of Title Counties, Cities and Towns- Chapter 66 Middle Peninsula Chesapeake Bay Public Access Authority Act ( thru ), Code of Virginia; and WHEREAS, DAVID H. DEA AND DOROTHY A. DEA desire to donate a 9.2 acre parcel of land on Adams Creek in Gloucester County, Virginia identified in the land records of Gloucester County on Tax Map # 0215 E; WHEREAS, the Middle Peninsula Chesapeake Bay Public Access Authority is desirous of acquiring said property with declaration of restrictions for public benefit; NOW THEREFORE BE IT RESOLVED that the Middle Peninsula Chesapeake Bay Public Access Authority, pursuant to the above cited statutory authority, hereby accepts the offer from DAVID H. REDD desire to donate a 2.0 acre parcel of land in Gloucester County, Virginia identified in the land records of Gloucester County as parcel TB and further described in Deed Book 79, Page 417, Deed Book 76, Page 179, and Deed Book 261, Page 157; and WHEREAS, the Middle Peninsula Chesapeake Bay Public Access Authority is desirous of acquiring said property with declaration of restrictions for public benefit; NOW THEREFORE BE IT RESOLVED that the Middle Peninsula Chesapeake Bay Public Access Authority, pursuant to the above cited statutory authority, hereby accepts the offer from M.W.
