4 Co-ordination of Notified Bodies Equipment for use in potentially explosive atmospheres on Council Directive 94/9/EC (ATEX) 4. -Meeting 8/9 June 2000 Brussels Page 3 Minutes 4th Meeting on Co-ordination of Notified Bodies ATEX () 8/9 June 2000, Brussels Attendance list see Annex 1 1 Opening and Introduction 1.1 Approval of the Agenda 1.2 Observers Mr Brénon as Chairman opened the 4th meeting of, taking place once more in Brussels, and warmly welcomed the participants. In particular he welcomed Mr David Eardley of the EU Commission/Enterprise DG as the successor to Mr Wolfgang Schneider, who had assumed other functions in the Commission and who had been a member of for the first three years. The meeting was also attended by various guests and observers, including from the Commission and from EOTC, who intended to make presentations with respect to certain items on the agenda, as well as an observer from the Czech Republic. There had been changes in personnel for various organisations, and in addition some organisations were new to. For this reason the Chairman asked those present at the meeting to introduce themselves and their organisation briefly one after the other.

It was important in this connection that there were different interests and different rules of arbitration between the Notified Body and its customers in the individual countries. The aim would be to achieve a harmonised arrangement from to apply in every country. The following was resolved: - Mr Brénon would drawn up a proposal on the Procedure and Board of Arbitration and forward it to the members for their comments. - Since the Rules were at present only available in an edition dated July 1997 (in the minutes of the 1st meeting), but there were also now changes and additions or these were being drawn up, it was intended to prepare a new edition (with edition number) in due time with the cooperation of EOTC. 1.4 Report of the Chairman to the Standing Committee Discussion document: Annex 2 The Chairman Mr Brénon had reported to the Standing Committee at its meeting on 9 March 2000 in Brussels among other things on the following work of : - Modification of the Rules - Working Groups - Clarification Sheets - Compulsory presence of NB at meetings

6 Co-ordination of Notified Bodies Equipment for use in potentially explosive atmospheres on Council Directive 94/9/EC (ATEX) 4. -Meeting 8/9 June 2000 Brussels Page Communication to Enterprise DG III Discussion document: none Mr Eardley reported on the following details of the work of Enterprise DG: - Meeting of the Standing Committees held on 9 March The main topic was the ATEX Guidelines, which were adopted after a compromise was reached on the definition of an atmosphere. The Guide was soon to be published on the Internet (Note: During the meeting EOTC distributed the valid first edition / document EOTC/00/031); translations into other languages were being prepared and the German and French translations would soon be available. - ATEX Workshop on 10 March 2000 in Brussels On this matter Mr Eardley provided CD-Rom; the event had been a complete success. - Enterprise DG was preparing to attend an exhibition providing information on the ATEX Directive for March Furthermore a report was given on the delinitation of the ATEX and Machinery Directives with regard to non-electrical equipment and ignition risks. 1.6 Communication of Employment and Social Affairs DG V Discussion document: none Mr Eardley reported for the Eggehard Rother, the competent colleague in DG V, that the Directive 1999/92/EU had now been adopted and published. A guide for the practical application of the Directive is to be prepared.

Details of the CIRCA Project can be found in the annex attached. It it still necessary to clarify how far CIRCA can be used for the Group, its working parties, its members etc. CIRCA tool would well adapted to provide informations that have validated or noted by the Standing Committee. 1.8 Presentation of the EOTC Tools for Group of NBs / Possible Use by NBs Discussion document: Annex 4 Mr Correia of EOTC presented the data system developed by EOTC for the Machinery Directive. EOTC tool would be well adapted to provide current informations such as clarification sheets, meetings date, arrangents etc. Some papers would be attached to the system by EOTC by October 2000 so that could consider the use of the tool. 2 Documents 2.1 ATEX Guidelines (First Edition), Brief Presentation by DG III Discussion document: EOTC/00/031 Since the first edition now available had already been discussed several times, it was not necessary to give an explanation of its content and structure. The Guidelines now had to be tried in practice and the NBs were asked to pass their experience on to the Commission for the purpose of future editions. 2.2 ATEX Directive, Related Issues at DG III

8 Co-ordination of Notified Bodies Equipment for use in potentially explosive atmospheres on Council Directive 94/9/EC (ATEX) 4. -Meeting 8/9 June 2000 Brussels Page ATEX Directive Implementation by NBs/ / Discussion: The Methodology of NBs Conducting Work in respect of Annex IV und VII Discussion document: Annex 5 Mr Turton explained that the questionnaire he had sent had been answered and returned by numerous NBs and he asked for those who had not yet returned it to do so. The general view to date showed that the methods applied by the NBs were partly very different. After detailed discussions it was resolved to assign the following Working Group: WG/00/10 Convenor: Quality Modules Methodology Mr Turton. The members of the WG are listed in the annex and further nominations were desired. The WG's working programme and the questionnaire are also attached. 3 Working Group Report 3.1 WG/98/5 Devices with measuring function for explosion protection Discussion document: See item 4.16 Dr. Jockers reported that the Working Group had not convened any more because there had been no further enquiries or tasks. A Draft Clarification Sheet had been drawn up in the past year and this was dealt with under item The Working Group was in abeyance until further tasks emerged.

9 Co-ordination of Notified Bodies Equipment for use in potentially explosive atmospheres on Council Directive 94/9/EC (ATEX) 4. -Meeting 8/9 June 2000 Brussels Page WG/98/9 Non-electrical Equipment/Different Decision Sheets Discussion document: Annex 6 The Working Group WG/98/9 had adopted two Decision Sheets at its last meeting on in Essen and had submitted them to through EOTC for discussion. Dr. Jockers gave some brief remarks on the participants and the course of the first meeting. In particular he dealt with the description of tasks for this WG (see annex 6, minutes of this meeting). Details are dealt with under items and A third DS had already been sent to all NBs by the BAM, see Clarification Sheets The following was laid down: - Clarification Sheets (CS) would be launched by the members and dealt with in technical terms by means of a survey in or in a WG; in particular this involved questions of clarification in connection with the standards. - The Decision Sheets (DS) involved questions of clarification outside the standards. - Where relevant it would be necessary to amend the Rules in this respect. - All surveys regarding CS would be conducted by EOTC; EOTC would also collect the answers; the contact person at EOTC was Ms Estelle Desmit. - The numbers for CS/DS would be established by the Technical Secretariat.

Replies had to be sent to EOTC within the 1-month deadline. 4.2 Battery enclosures Discussion document: Annex 8 (/99/026) Mr Sinclair reported that three comments had been received from KEMA, IBExU and Sira on the Draft CS; further comments were called for. Then the revised Draft CS would again be sent via EOTC for comments. 4.3 Selection of HOTL Decisions Valid Today Discussion document: Annex 9 Mr Shearman reported that the Working Group WG/98/8 had provisionally concluded its discussions and a collection of 42 earlier HOTL decisions was now available (document circulated at the meeting). The members were asked to submit any objections to Mr Walsh, Sira within the 1-month deadline. 4.4 Luminaire Starter with EExe Terminals Discussion document: Annex 10 Dr. Remesal/LOM reported on this Draft CS, for which 7 sets of comments had been received. Since the present version had been circulated at the meeting and there had thus been no time for preparation, a number of those present did not find it possible to agree to the CS. It was agreed that LOM should correct the Draft CS on the basis of the applicable standards or standardisation work and send it to Mr Brénon. CENELEC SC 31-4 was

Since the interest in this subject was not very great at the present time in, it was resolved not to deal with it any further. The matter could be taken up again at a later date when an member submitted a discussion document. 4.6 Test for Cells and Batteries Discussion document: Annex 11 (EOTC/00/015) The question was: Is it necessary to define the test for cells and batteries in greater detail? Dr Wenzel explained that 5 comments had been received on the available Draft CS (IBExU, Sira, SP, KEMA and CESI), they had be distributed by EOTC, but unfortunately they were still not known to all members. After detailed discussion Dr Wenzel expressed his willingness to draw up a new CS on the basis of all the documents and to forward it to the members via EOTC for their comments within the 1-month deadline. 4.7 Rating of Components Associated with Galvanic Isolation Devices Discussion document: Annex 12 (/98/030) Mr Balaz/CESI stated that CENELEC TC 31/WG3 was also concerned with this matter and so consultation would be required. Notwithstanding this, the Draft CS was approved and CESI would arrange for the CS to be finalised.

12 Co-ordination of Notified Bodies Equipment for use in potentially explosive atmospheres on Council Directive 94/9/EC (ATEX) 4. -Meeting 8/9 June 2000 Brussels Page Verification of CTI for "i" Discussion document: Annex 14 (/99/007) Mr Bremer explained that comments had been received from KEMA and Sira on the present document and a revised CS had now been drawn up. The new Draft CS was now to be circulated through EOTC for comments with a 1- month deadline (Short-time) Temperature Rise of Motors during Starting Discussion document: Annex 15 Mr Sinclair reported that a comment had been received from KEMA on the Draft CS essentially signifying its approval. It was the general view that the CS could be approved provided the title was mode more precise: Short-time Temperature Rise of Ex p Motors during Starting. The CS was thus approved Acceptance of Test Results of Manufacturers Discussion document: Annex 16 Dr. Jockers briefly explained the present Draft CS and the comments received from Sira and BAM. Both organisations agreed to it and no comments rejecting it had been received. It was also pointed out that a set of German guidelines was available in which this matter was also dealt with. The German Government would make the guidelines available to the EU Commission.

13 Co-ordination of Notified Bodies Equipment for use in potentially explosive atmospheres on Council Directive 94/9/EC (ATEX) 4. -Meeting 8/9 June 2000 Brussels Page 12 This EC Type Examination Certificate relates only to the design, examination and tests of the specified equipment or protective system in accordance with the Directive 94/9/EC. Further requirements of the Directive apply to the manufacturing process and supply of the equipment or protective system. These are not covered by the certificate Faulty Equipment Discussion document: Annex 18 (CS 99/081/P) Dr. Jockers explained the revised question: What should a Notified Body do in the case where it gets knowledge of faulty equipment but it is neither engaged in the module for EC type examination nor in a module for surveillance of the manufacture and if there is no immediate danger? A revised CS had been despatched, a number of approving comments had been received and one proposed change had been incorporated. The CS was accepted in the version presented Instructions and EC Type Examination Discussion document: Annex 19 (CS 99/082/P) The question was: Which measures should a NB take concerning examination of the instructions? Dr. Jockers explained the document and the related comments rejecting it. He also read out the comments of the Commission on the same questions in Directive 89/686/EU Personal Protective Equipment. Orgalime also had no objections to the formulation presented and so the CS was approved.

14 Co-ordination of Notified Bodies Equipment for use in potentially explosive atmospheres on Council Directive 94/9/EC (ATEX) 4. -Meeting 8/9 June 2000 Brussels Page Marking of Associated Apparatus to EN Marking of Electrical Equipment in Special Cases Corrigenda of documents: - Marking of associated apparatus to EN 50020: EOTC/00/003 corresponding with CS/99/11/075 - Marking of Electrical Equipment in special cases: EOTC/00/009 corresponding with CS/99/06/057 Dr Wenzel reported that the 4 pages with related drawings given as examples in document CS/99/11/075 had to be attached to document CS/99/06/ Apparatus with a Measuring Function for Explosion Protection See also item 3.1 Discussion document: Annex 20 (CS 99/084/P) The question was: How may apparatus with a measuring function for explosion protection be certified? Dr. Jockers reported that two sets of comments had been received from Sira and BAM on the former draft of the CS. These had been taken into account in the new version. The CS was approved in the present version. Additional questions on this matter, such as surveillance of production function etc., were to be dealt with in a new, additional CS. BAM and DMT were preparing another documents concerned with such apparatus located completely outside the explosive atmosphere.

15 Co-ordination of Notified Bodies Equipment for use in potentially explosive atmospheres on Council Directive 94/9/EC (ATEX) 4. -Meeting 8/9 June 2000 Brussels Page Handling and Storage of the Dossier for Non-electrical Equipment Discussion document: Annex 22 (CS 99/086/P) The question was: What should an NB do concerning handling and storage of the dossier for non-electrical equipment Category M2 and 2 according to annex VIII, paragraph 3? Dr. Jockers explained the CS available and stated that it could only be a recommendation. According to Article 8 (b) ii of the Directive 94/9/EC the manufacturer must communicate the dossier to an NB, which shall acknowledge receipt and shall retain it. The CS was approved in the present version Flame Arresters (Autonomous Protective System), Assessment of the Results obtained under Unstable Detonation Conditions See also item 3.3 Discussion document: Annex 23 (EOTC/00/025) It was resolved that the NBs forward their comments within a month to Dr Förster, PTB, via EOTC Flame Arresters (Autonomous Protective System), which are Tested under Non-atmospheric Conditions See also item 3.3 Discussion document: Annex 24 (EOTC/00/027) After a detailed discussion it was resolved that Dr Grätz/BAM should resolve the document and forward it via EOTC to the NBs for their comments; the 1-month

16 Co-ordination of Notified Bodies Equipment for use in potentially explosive atmospheres on Council Directive 94/9/EC (ATEX) 4. -Meeting 8/9 June 2000 Brussels Page 15 Discussion documents: Annex 26 (/99/022 (Draft CS 99/088/P) and EOTC/00/023) The discussion documents contained the draft CS and comments to it. The question was: For constructions with cemented gaps, such as epoxy bushings, is pressure tightness according 15.3/EN after the tests on thermal endurance ( /EN 50014) indispensable? Dr Wenzel explained the CS and the 4 sets of comments received from EECS/negative, INERIS, KEMA and LCIE (all approving). Despite a detailed discussion it was not possible to achieve a unified view, and so Dr Wenzel was asked to revise the CS. CENELEC TC 31 and the national standards organisations were also to be involved in the discussion Treatment of Dust Layers for Apparatus Categories 2D and 3D Discussion documents: Annex 27 (/99/023 (Draft CS 00/089/P) and EOTC/00/024) The discussion documents contained the draft CS and comments to it. The question was: Are, for the determination of the maximum surface temperature, the fault conditions to be taken into account for category 2D (one fault) and 3D (normal use) respectively sufficient for use of the apparatus in dust layers of excessive thickness in Zone 21 and 22 respectively? Dr Wenzel explained the draft CS and the comments on it received. It was resolved to prepare a revised CS on the basis of all the documents (including EN Part 3) and to forward it to the members via EOTC; the comments were to be forwarded to EOTC within the 1-month deadline.

17 Co-ordination of Notified Bodies Equipment for use in potentially explosive atmospheres on Council Directive 94/9/EC (ATEX) 4. -Meeting 8/9 June 2000 Brussels Page 16 Discussion document: Annex 29 (EOTC/00/018 (CS 00/091/P)) The questions were: Question 1: Is it correct that in 7.6 d for surface temperature classification all semiconductors can experience a failure such that they dissipate maximum power? Question 2: Is it correct that in 7.6 h there is no reference to infallible inductors? Dr Wenzel explained the draft CS and the comments received. Since it was not possible to achieve a unified view after further discussion. Dr Wenzel was to prepare a new proposal in collaboration with the other organisations (1-month deadline for the comments) EC Type Examination Certificate for Category 3 Products Discussion document: Annex 30 (EOTC/00/032 including a collation of statements) The question was: Is it possible to issue an EC Type Examination Certificate (as defined in Annex III of Directive 94/9/EC) for Category 3 products. This would be achieved by application of Annex III EC Type Examination to Category 3 products, at the request of the manufacturer. After detailed discussion it was agreed that it is not possible to issue an EC Type Examination Certificate for Category 3 products. The inspection and certification bodies could issue certificates on a voluntary basis, however. But this was not part of the ATEX Directive and hence also not a topic for discussion in. Mr Eardley explained that, in the case of a voluntary certification of Category 3 Products and non-electrical Category 2 products, the certification body may not give

18 Co-ordination of Notified Bodies Equipment for use in potentially explosive atmospheres on Council Directive 94/9/EC (ATEX) 4. -Meeting 8/9 June 2000 Brussels Page Trade Agents Discussion document: Annex 31 (EOTC/00/033 including a collation of statements) The question was: Is it possible for a manufacturer to affix the name and address of a "trade agent" to the product instead of that of the manufacturer? The comments received and the discussion showed that there were major differences of opinion. The relevant Directives 94/9/EC, 76/117/EEC and 82/130/EEC as well as the ATEX Guidelines, standards and other explanatory documents did not give a clear answer. It was resolved to submit this important question to the Standing Committee at its next meeting on EEx e Test Procedure according to EN and EN Discussion document: Annex 32 (EOTC/00/028) Mr Brénon stated that he had received this question as Chairman of from ABB Motors Oy with the request for clarification in. After detailed discussion in which the NBs explained their testing procedures, it was still not possible to formulate a unified answer to ABB and so the following was resolved: - On the basis of the letter, Mr Sinclair would prepare a questionnaire in collaboration with a small group to clarify the practise of all NBs. - The NBs were asked to answer the questionnaire within the 1-month deadline. - The group would then draw up a Decision Sheet.

19 Co-ordination of Notified Bodies Equipment for use in potentially explosive atmospheres on Council Directive 94/9/EC (ATEX) 4. -Meeting 8/9 June 2000 Brussels Page Collaboration with Bodies outside the EU Discussion document: Annex 34 Dr. Jockers explained the question: Which conditions have to be met when including bodies outside the European Union in the assessment procedure? The draft CS had already been sent by EOTC. Sira had agreed to the CS, no disapproval or comment had come from other NBs, and DMT had sent an editorial addition. Dr. Jockers would send the approved CS to Mr Brénon once again. 5 New questions No new questions of special significance which would have to be specially dealt with were put forward. Furthermore other, partly new problems were dealt with under item 4 Clarification Sheets and 9 Miscellaneous. 6 List of Working Groups of Survey of the operative and cancelled Working Groups of : WG/97/1 Wording of Quality Assurance Notification Document Convenor: Mr Turton (WG cancelled; continuing the task in WG/98/6)

Sinclair EECS and Dr. Bothe PTB 7 Cooperation with Bodies outside EU Discussion document: none Mr Brénon reported on the following written contacts. - The Australian organisation AUS-EX was in favour of a close collaboration with

21 Co-ordination of Notified Bodies Equipment for use in potentially explosive atmospheres on Council Directive 94/9/EC (ATEX) 4. -Meeting 8/9 June 2000 Brussels Page 20 8 Communications 8.1 CENELEC Communication Discussion document: Annex 35 and Annex 36 Mr Czyz, Chairman of CENELEC TC 31, reported that, from the extensive working programme of TC 31 and its subcommittees, 16 harmonised standards had now appeared. A survey of the electrical standardisation with respect to the Directive 94/9/EC is given in Annex 35. TC 31 and also agreed through their Chairmen to work close together, see Annex 36. With regard to the Interpretation/Clarification/Decision Sheets, the following agreements were made: - Simply to officially confirm the agreement of TC 31 with documents whenever possible, or, - Based on documents, to issue CENELEC Interpretation Sheets which would be based on the corresponding documents whenever necessary, or, - To incorporate documents in EN standards whenever possible and necessary, or, - Possibly to propose a different interpretation from that of the documents. In this case, it is agreed that the documents remain applicable until the CENE-LEC's own interpretation sheets is published. No decision had been taken as yet regarding the general publication of the Interpretation/Clarification/Decision Sheets on the EOTC or CIRCA, or possibly the Orgalime website. Since members were at the same time members of TC 31 or its subcommittees, they were being asked for their approval and support for the

The following figures were used to illustrate this: - About 700 standards had been or were being drawn up for the Machinery Directive, - About 70 of these also concerned the ATEX Directive, affecting about 20 Technical Committees (TC). - A further 44 or 23 draft standards were under discussion which also concerned the ATEX Directive. These overlaps involved delays in the standardisation work. CEN was now in contact with the Enterprise DG III of the Commission because the delays in the schedule could trigger penalties from the Commission. As Mr Eardley stated as representative of the Commission, at the present time an answer and a list of the necessary work are being drawn up (Annex 37). Mr O'Riordan and Mr Bezen, as CEN/CENELEC Consultant and CEN representative respectively, gave a brief presentation of the work of CEN TC 305; a detailed description is given in Annex ORGALIME Communication Discussion document: none As the representative of Orgalime, the European manufacturers' federation, Mr Heyse explained that the involvement in was especially important. As the umbrella organisation for national trade organisations throughout Europe, Orgalime represented about companies, of which a not insubstantial proportion was concerned with the ATEX Directive. Orgalime had its own ATEX Working Group with its own secretariat. Membership differed, ranging from around persons according to the task and subject. This also explained why different individuals from Orgalime attend each of the meetings.

Mr Eardley referred to the CIRCA Project as a possible database. 9.2 Non-Electrical Equipment Dr. Bothe reported on the new draft standard on Basic Method and Requirements for Non-Electrical Equipment for Use in Potentially Explosive Atmospheres; the objections procedure was currently in progress. When this standard was published, it would be possible to withdraw the CS. The standard contained the same marking for different types of protection ("d" and "p"), one in the electrical and one in the non-electrical field. Dr Bothe would clarify this problem in a survey to be conducted among the members and would possibly pass on comments to the Chairmen of TC 31 and TC Further information from the Commission / Mr Eardley - The ATEX Guide was being translated into 11 languages and would appear on the Internet. - Some CD-ROMs on the ATEX Workshop held on in Brussels were available for distribution; they contained, among other things, all the important ATEX documents. - A discussion was to be conducted with EOTC and Mr Brénon regarding the flood of paper and use of electronic media. - The Commission had drawn up a document regarding market surveillance for

Brénon, le Président, ouvre la 4ème réunion de, tenue une fois de plus à Bruxelles, et souhaite la bienvenue aux participants. Il souhaite plus particulièrement la bienvenue à M. David Eardley de la Commission UE / DG Entreprises, en sa qualité de successeur de M. Wolfgang Schneider, qui occupe dorénavant d'autres fonctions au sein de la Commission et qui a été un membre de pendant les trois premières années. Cette réunion accueille également divers hôtes et observateurs, notamment de la Commission et d'eotc, qui prévoient de faire des présentations concernant certains points de l'ordre de jour, ainsi qu'un observateur venant de la République Tchèque. Les représentants de diverses organisations ont changé, et certaines nouvelles organisations ont rejoint l'. Pour cette raison, le Président invite tous les participants à se présenter et à présenter brièvement leurs organisations.

L'objectif serait de parvenir à une solution harmonisée par applicable dans chaque pays. Le groupe adopte la résolution suivante: - M. Brénon rédigera une proposition pour la Procédure et le Conseil d'arbitrage et la transmettra aux membres du pour commentaires. - Parce que les règles n'existent que dans leur édition de juillet 1997 (compte rendu de la 1 ère réunion ), mais que des changements et des ajouts ont également été élaborés, il est envisagé de préparer une nouvelle édition (numérotée) dans les meilleurs délais en coopération avec l'eotc. 1.4 Compte rendu du Président au Comité Permanent Document de travail: Annexe 2 Le Président, M. Eardley présente un rapport des travaux suivants de la DG Entreprises: - Réunion des Comités Permanents tenue le 9 mars Le sujet principal étaient les lignes directrices ATEX, adoptées après qu'un compromis ait été atteint sur la définition d'une atmosphère. Le guide sera prochainement publié sur Internet (note: EOTC a diffusé en séance la première édition / document EOTC/00/031); les traductions dans d'autres langues sont en cours de préparation et les traductions allemande et française seront disponibles prochainement. - Atelier ATEX le 10 mars 2000 à Bruxelles M. Eardley présente le CD-Rom ; la manifestation a été un succès complet. - La DG Entreprises s'apprête à participer à une exposition présentant des informations sur la Directive ATEX en mars En outre, un rapport est présenté sur la délimitation des Directives ATEX et Machines en ce qui concerne les appareils non électriques et les risques d'ignition. 1.6 Communication de la DG V Emploi et Affaires sociales Document de travail: néant M. Eardley rapporte au nom de Eggehard Rother, le collègue compétent au sein de la DG V, que la Directive 1999/90/UE a été adoptée et publiée.

L'accès et la navigation dans cet espace virtuel se fait à l'aide d'un logiciel de navigation Internet (Netscape, Internet explorer ), et requiert l'obtention d'un nom d'utilisateur et d'un mot de passe pour accéder au groupe d'intérêt. Les détails du projet CIRCA sont présentés dans l'annexe. Il faut encore clarifier dans quelle mesure CIRCA peut être utilisé pour le groupe, ses groupes de travail, ses membres etc. L'outil CIRCA est particulièrement adapté pour fournir des informations validées ou notées par le Comité Permanent. 1.8 Présentation des outils EOTC pour le Groupe des NB / Possibilité d'emploi par les NB Document de travail: Annexe 4 M. Correia d'eotc présente le système de données développé par l'eotc pour la Directive Machines. L'outil EOTC est bien adapté pour la fourniture d'informations courantes telles que les fiches de clarification, dates de réunions, détails d'organisation etc. Certains documents seront ajoutés au système par EOTC avant octobre 2000 et l' peut étudier la possibilité d'utiliser cet outil. 2 Documents 2.1 Lignes directrices ATEX (1 ère édition), brève présentation par la DG III Document de travail: EOTC/00/031 Parce que la première édition, désormais disponible, a déjà fait l'objet de plusieurs discussions, il n'a pas été nécessaire d'expliquer son contenu et sa structure. Les

Turton explique que le questionnaire a été diffusé et que de nombreux NB l'ont complété et renvoyé; il demande à ceux qui ne l'ont pas encore renvoyé de le faire. Le dépouillement a révélé à ce jour que les méthodes appliquées par les NB diffèrent considérablement sur certains points. Après une discussion approfondie, le groupe décide de constituer le groupe de travail suivant: WG/00/10 Animateur: Méthodologie des modules de qualité M. Turton. Les membres du groupe de travail sont repris dans l'annexe et des nominations supplémentaires sont souhaitées. Le programme de travail du groupe ainsi que le questionnaire figurent également en annexe. 3 Comptes rendus des travaux des groupes de travail 3.1 WG/98/5 Appareils avec fonction de mesure pour la protection contre l'explosion Document de travail: voir point 4.16 Le Dr Jockers rapporte que le Groupe de travail ne s'est plus réuni parce qu'il n'y avait pas eu d'autres demandes ou tâches. Un projet de fiche de clarification avait

Le Dr Jockers a présenté quelques remarques succinctes concernant les participants et le déroulement de la première réunion. Il a notamment abordé la description des tâches de ce WG (voir annexe 6, compte rendu de cette réunion). Les détails sont abordés sous les points et Une troisième DS a déjà été adressée à tous les NB par le BAM, voir Fiches de clarification Les participants ont arrêté ce qui suit: - Les fiches de clarification (CS) seront initiées par les membres de l' et traitées sur le plan technique par voie d'enquête au sein du ou d'un WG; cela s'applique notamment aux questions de clarification liées aux normes. - Les fiches de décision (DS) portent sur des questions de clarification non couvertes par les normes. - Le cas échéant, les règles devront être modifiées dans ce sens. - Toutes les enquêtes concernant des CS seront menées par l'eotc; l'eotc se chargera également de collecter les réponses; la personne de contact auprès de l'eotc est Mme Estelle Desmit.

Turton (EECS), pour produire l'édition 3.0 ( ). M. Turton a approuvé cette version modifiée, qui peut donc être approuvée à présent. Parce que le document n'était pas disponible pour tous les membres, l'eotc l'enverra à nouveau. Les réponses devront parvenir à l'eotc dans un délai d'un mois. 4.2 Revêtements de batteries Document de travail: Annexe 8 (/99/026) M. Sinclair rapporte que trois commentaires ont été reçus de KEMA, IBExU et Sira sur le projet de CS; d'autres commentaires sont souhaités. Ensuite, le projet de CS révisé pourra être à nouveau diffusé par l'eotc pour commentaires. 4.3 Sélection de décisions HOTL en vigueur aujourd'hui Document de travail: Annexe 9 M. Shearman rapporte que le groupe de travail WG/98/8 a provisoirement clôturé ses discussions et qu'un recueil de 42 anciennes décisions HOTL est désormais disponible (document diffusé en séance). Les membres sont invités à soumettre toutes objections à M. Walsh, Sira, dans un délai d'un mois. 4.4 Starters d'applique lumineuse avec terminaisons EExe Document de travail: Annexe 10 Le Dr Remesal / LOM a présenté un rapport concernant ce projet de CS, pour lequel 7 séries de commentaires avaient été reçus. La version précédente ayant été

Sinclair rapporte qu'aucun questionnaire n'a été rédigé sur ce point, et qu'il était impossible de lancer une enquête. Parce que le sujet bénéficie actuellement de peu d'intérêt au sein du, il a été décidé de ne pas le traiter davantage. La question pourra à nouveau être abordée ultérieurement lorsqu'un membre du soumettra un document de travail. 4.6 Essai pour cellules et batteries Document de travail: Annexe 11 (EOTC/00/015) La question était: est-il nécessaire de définir plus en détail les essais pour cellules et batteries? Le Dr. Wenzel explique que 5 commentaires sur le projet de CS ont été reçus (IBExU, Sira, SP, KEMA et CESI); ils ont été diffusés par l'eotc mais malheureusement tous les membres n'en ont pas encore pris connaissance. Après une discussion détaillée, le Dr Wenzel s'est dit prêt à rédiger une nouvelle CS sur la base de tous les documents et de transmettre ce document aux membres par l'intermédiaire de l'eotc afin d'obtenir leurs commentaires dans un délai de 1 mois. 4.7 Évaluation des composants associés aux appareils d'isolation par galvanisation Document de travail: Annexe 12 (/98/030) M. Balaz / CESI estime que CENELEC TC 31/WG3 est également concerné par cette matière et qu'une consultation est nécessaire. Indépendamment de ce

Délai pour commentaires: 1 mois. 4.9 Vérification de CTI pour "i" Document de travail: Annexe 14 (/99/007) M. Bremer explique que des commentaires sur le document actuel ont été transmis par KEMA et Sira, et qu'une CS révisée a été élaborée. Le nouveau projet de CS doit à présent être diffusé par l'eotc pour commentaires dans un délai d'un mois Hausse (brève) de la température des moteurs au démarrage Document de travail: Annexe 15 M. Sinclair rapporte qu'un commentaire a été reçu de KEMA sur le projet de CS; ce commentaire portait essentiellement sur son approbation. De l'avis général, cette CS peut être approuvée moyennant un titre plus précis: hausse brève de la température des moteurs Ex p au démarrage. La CS a été approuvée Acceptation des résultats d'essais de fabricants Document de travail: Annexe 16 Le Dr Jockers explique brièvement le présent projet de CS et les commentaires reçus de Sira et BAM. Les deux organisations approuvent le projet et aucun commentaire défavorable n'a été reçu.

Les autres exigences de la Directive s'appliquent au processus de fabrication et à la fourniture de l'équipement ou du système de protection. Ces derniers ne sont pas couverts par le certificat Équipements défectueux Document de travail: Annexe 18 (CS 99/081/P) Le Dr Jockers explique la question révisée: que doit faire un Organisme notifié dans le cas où il a connaissance d'équipements défectueux mais qu'il ne participe ni au module de l'examen CE de type, ni au module de surveillance de la fabrication et lorsqu'il n'y a pas de danger immédiat? Une CS révisée avait été diffusée, un certain nombre de commentaires favorables ont été reçus et une proposition de changement a été adoptée. La CS a été approuvée dans la version présentée Instructions et examen CE de type Document de travail: Annexe 19 (CS 99/082/P) La question était: Quelles mesures un NB doit-il adopter concernant l'examen des instructions? Le Dr Jockers rapporte que deux séries de commentaires ont été présentées par Sira et BAM sur le projet précédent de la CS. Ces commentaires ont été pris en compte dans la nouvelle version. La CS est approuvée dans sa version actuelle. Des questions complémentaires en la matière, dont la fonction de surveillance de la production et autres, devront être traitées dans une nouvelle CS complémentaire. BAM et DMT préparent d'autres documents concernant ces appareils situés totalement hors de l'atmosphère explosive.
