4 MINUTES OF A REGULAR MEETING OF FREDERICTON CITY COUNCIL TUESDAY, OCTOBER 9, 2018 Minutes of the Regular Meeting of Fredericton City Council held on Tuesday, October 9, 2018, at 7:30 p.m. in the Council Chamber, City Hall, Fredericton. The poem was entitled Silent Letters. 4

5 Regular City Council Meeting Tuesday, October 9, 2018 page 2 APPROVAL OF AGENDA Approval of Agenda Moved by Councillor Dan Keenan, seconded by Councilor Bruce Grandy THAT the October 9, 2018, City Council Agenda be approved with the following amendments: The addition of agenda item 7.2 entitled Freedom of the City of Fredericton March & Ceremony ; The addition of agenda item 8.6 entitled Bell Wireless Micro Cell in Fredericton Public Library ; and The addition of agenda item 8.7 entitled Smart Cities Challenge Agreement. CARRIED UNANIMOUSLY APPROVAL OF MINUTES Approval of Minutes Moved by Councillor Mark Peters, seconded by Councillor Kevin Darrah THAT the Minutes of the Regular City Council meeting of July 9, 2018, be approved as circulated. CARRIED UNANIMOUSLY PROCLAMATION Proclamations His Worship, Mayor Michael O Brien read the following proclamations: KNIGHTS OF COLUMBUS DAY OCTOBER 9, 2018 WHEREAS The Knights of Columbus is a Charitable Service Organization having 1,808,671 members world wide; and, Knight s of Columbus Day Proclamation October 9, 2018 WHEREAS WHEREAS THEREFORE The Knights of Columbus are named after the world renowned explorer Christopher Columbus who discovered the new world in 1492; and, There are over 250,000 members in all of Canada with 14,600 members in New Brunswick, being the third ranked province behind Ontario and Quebec; and, I, Mike O Brien, Mayor of the City of Fredericton, the Capital City of New Brunswick, declare the 9 th of October 2018 as Knights of Columbus Day in Fredericton. 5

6 Regular City Council Meeting Tuesday, October 9, 2018 page 3 COMMENTS FROM SHARON WATTS, EXECUTIVE OFFICER OF THE FREDERICTON REAL ESTATE BOARD AND VOLUNTEERS FROM KAT S KITCHEN Sharon Watts, Executive Officer of the Fredericton Real Estate Board thanked Mayor and Council for recognizing October 11 th, as Realtor s Day in the City of Fredericton. Comments from Sharon Watts, Executive Officer of The Fredericton Real Estate Board and Volunteers from Kat s Kitchen Ms. Watts indicated that as a thank you to the community for supporting the real estate industry, the Real Estate Board gives back by hosting various fundraising events in the community throughout the year, along with one large fundraising event annually. She noted that last year s annual large fundraising event raised $12, and all proceeds were donated to Liberty Lane Inc. She advised that this year s large fundraising event will include a magic show at Picaroons Roundhouse, on Thursday, October 11 th, 2018, with all proceeds being donated to Fredericton High School s Kat s Kitchen program. Student volunteers, Jamie Little, Christine Zhang and Matei Marica from the Kat s Kitchen food initiative program were in attendance to personally thank the Fredericton Real Estate Board for their generosity. It was noted that Kat s Kitchen was formed to provide breakfast and lunch to students in need and also provide a leadership opportunity for students wanting to volunteer. The program currently feeds 120 students breakfast and 100 students lunch daily. The program cost approximately $20,000 per year to operate and all contributions come from volunteers. Currently there are 80 students and 30 teachers who volunteer their time to make the program a success. REALTORS DAY OCTOBER 11, 2018 WHEREAS REALTOR Day will be observed on October 11, 2018 and the observance of REALTOR Day reminds the community of the service REALTORS perform in their day to day work and their volunteer efforts.; and Realtor s Day Proclamation October 11, 2018 WHEREAS REALTORS are committed to the REALTOR Code, actively updating their education and have access to their Board s MLS System which facilitates the cooperate sale of properties to benefit consumers; and 6

They give thousands of dollars a year to charitable organizations through fundraising and donations. They also volunteer many hours of their time to many charitable organizations. I, Mayor Michael O Brien, hereby proclaim October 11, 2018 as REALTOR Day in the City of Fredericton. BY-LAW NO. T-1.98, A BY-LAW TO AMEND BY-LAW NO. ZONING AMENDMENT - BY-LAW NO. Z Adoption of Terms & Conditions Moved by Councillor Henri Mallet, seconded by Councillor Greg Ericson THAT the following terms and conditions be adopted pursuant to Section 39 of the Community Planning Act in regards to an application from Kithsiri Jayasuriya to amend the Residential Zone Two (R-2) to permit a second kitchen in a single detached dwelling at 276 Rainsford Lane, as laid out in draft By-law No. Z : 276 Rainsford Lane (Kithsiri Jayasuriya) Zoning Amendment By-law No. Z Adoption of Terms & Conditions a) That the second kitchen not generate any noise, vibrations, heat, smoke or odours, beyond what is typical for a kitchen in a single detached dwelling; b) That no external storage of materials associated with the business take place on the property; and, c) The property owner enters into a Section 59 Agreement with the City of Fredericton to ensure compliance with the terms and conditions and that the use of the second kitchen on the property is restricted to the Applicant and is not transferable. Moved by Councillor Henri Mallet, seconded by Councillor Greg Ericson THAT By-law No. Z-5.157, A By-law to Amend By-law No. Z-5, A Zoning By-law for the City of Fredericton, be given third reading by title. By-law No. Z Given Third Reading On the Question: Councillor Henri Mallet commented that this zoning amendment is a touchy subject within both the neighbourhood and the community. He noted that in the primary application by the Applicant, it was made clear that the second kitchen would be solely a one year temporary solution in which he would in one year s time find an alternate location. Councillor Mallet advised that he would not be supporting this zoning amendment. Councillor Eric Megarity asked the Application to consider the Cultural Center as a viable option. He indicated that many upgrades were made at the Cultural Centre kitchen with this type of start up in mind. Councillor Megarity advised that he would not be supporting this motion. Councillor Mark Peters commented that although he voted in favour at the Planning Advisory Committee, he would not be supporting the zoning amendment any further as it does open an entire new avenue for catering. Councillor Stephen Chase advised that he would not be supporting the motion to approve the zoning amendment because the Applicant gave an undertaking to the neighbourhood that this was a one year temporary venture and now he s seeking to make it permanent. Deputy Mayor Steven Hicks commented that he would not be supporting the motion as he fears it would set a precedent. The original Motion was then put to vote and declared DEFEATED UNANIMOUSLY (Councillors Henri Mallet, Mark Peters, Eric Price, Eric Megarity, Greg Ericson, Stephen Chase, Kate Rogers and Deputy Mayor Steven Hicks voting nay ) (Councillors Bruce Grandy and Kevin Darrah were absent when the vote was taken) 10

11 Regular City Council Meeting Tuesday, October 9, 2018 page 8 Councillors Bruce Grandy and Kevin Darrah returned to the meeting at 8:19 p.m. FREDERICTON MARATHON 2019 Fredericton Marathon 2019 A request was received from Bruce MacFarlane, Race Director, on behalf of the 2019 Fredericton Marathon Committee, for permission to host the 41 st Annual Fredericton Marathon on Saturday May 11 th, 2019, for a kid s fun run and on May 12 th, 2019 for the main event. Moved by Councillor Kate Rogers, seconded by Councillor Bruce Grandy THAT City Council adopt the following resolution: BE IT RESOLVED that approval be given to the Fredericton Marathon Committee to hold their Annual Fredericton Marathon and Kids Race on Saturday, May 11 and Sunday, May 12, 2019 (along the recommended routes) subject to staff recommendations; and BE IT FURTHER RESOLVED that the City Solicitor be authorized to draft the appropriate by-law to effect a temporary stop up and partial closure of Aberdeen Street between St. John Street and the trail just past Church Street from 1:30 p.m. to 3:00 p.m. on Saturday, May 11, 2019; and BE IT FURTHER RESOLVED that the City Solicitor be authorized to draft the appropriate by-law to effect a temporary stop up and partial closure of St. Anne s Point Drive between its terminus at Queen Street and Regent Street to Smythe Street from 3:30 p.m. to 5:00 p.m. on Saturday, May 11, 2019; and BE IT FURTHER RESOLVED that the City Solicitor be authorized to draft the appropriate by-law to effect a temporary stop up and partial closure of the Westmorland Street Bridge between Queen Street and Maple Street from 8:00 a.m. to 10:30 a.m. on Sunday, May 12, 2019; and BE IT FURTHER RESOLVED that the City Solicitor be authorized to draft the appropriate by-law to effect a temporary stop up and partial closure of the Marysville Bridge between McGloin Street and Mill Street from 8:30 a.m. to 10:00 a.m. on Sunday, May 12, 2019; and BE IT FURTHER RESOLVED that the City Solicitor be authorized to draft the appropriate by-law to effect a temporary stop up and partial closure of St. John Street from Aberdeen Street to Queen Street, Queen Street from St. John Street to Regent Street, St. Anne s Point Drive from Queen Street to the Westmorland Bridge on ramp, Westmorland Street Bridge to 11

12 Regular City Council Meeting Tuesday, October 9, 2018 page 9 Union Street off ramp, Union Street to Friel Street, and Friel Street from Union Street to the trail system from 7:45 a.m. to 10:30 a.m. (or sooner, as soon as the last participant has finished this portion of the course) on Sunday, May 12, 2019; and BE IT FURTHER RESOLVED that the City Solicitor be authorized to draft the appropriate by-law to effect a temporary stop up and partial closure of Aberdeen Street between its terminus at the trail and the intersection with St John Street; St John Street from Churchill Row to McLeod Avenue; McLeod Avenue from St John Street to Beaverbrook Street; Church Street from Churchill Row to Aberdeen Street from 7:00 a.m. to 3:00 p.m. on Sunday, May 12, 2019; and BE IT FURTHER RESOLVED that the public notice requirements of Section 187(6) of the Municipalities Act be fulfilled; and that the regular Council meeting of Monday, October 22, 2018 at 7:30 p.m. at the Council Chamber, City Hall, be set as the time and place for the consideration of objections to the proposed by-law. CARRIED UNANIMOUSLY FREEDOM OF THE CITY OF FREDERICTON MARCH & CEREMONY (ADDITIONAL ITEM) A joint request was received from Lieutenant Leah P. O Keefe, on behalf of the Royal Canadian Navy and Jamie Watson, on behalf of the City of Fredericton, for permission to host The Freedom of the City of Fredericton March and Ceremony on Saturday, October 20 th, The Freedom of the City ceremony is part of the National Sea Cadet Centennial Celebrations for Freedom of the City of Fredericton March & Ceremony (Additional Item) Moved by Councillor Eric Price, seconded by Councillor Eric Megarity THAT City Council adopt the following resolution: BE IT RESOLVED that approval be given to the provincial cadet corps and city of Fredericton to hold the Freedom of the City march and ceremony on Saturday, October 20, 2018 beginning at 2:00 p.m. along the route as requested, subject to recommendations from City staff being met. 13 Regular City Council Meeting Tuesday, October 9, 2018 page 10 HUMAN RESOURCES TACTICAL PLAN Moved by Councillor Greg Ericson, seconded by Councillor Stephen Chase THAT City Council adopt the following resolution: Human Resources Tactical Plan BE IT RESOLVED that the Council of the City of Fredericton adopts the pillars and policies contained in the Human Resources Tactical Plan. CARRIED UNANIMOUSLY The following reports from the October 1, 2018, Council-in-Committee meeting were presented: UNIVERSAL BUS PASS PROGRAM ST. THOMAS UNIVERSITY Universal Bus Pass Program St. Thomas University Moved by Councillor Kevin Darrah, seconded by Deputy Mayor Steven Hicks THAT City Council adopt the following resolution: BE IT RESOLVED that the Council of the City of Fredericton hereby authorizes and approves the agreement among the City of Fredericton, the Students Union of St. Thomas University, Inc. and St. Thomas University ( Agreement ) for a term of one (1) year, from September 1, 2018 to August 31, 2019 with respect to the Universal Bus Pass Program at the per pass rate of $ per student; and BE IT FURTHER RESOLVED that the Council of the City of Fredericton authorizes the Mayor and City Clerk to execute the Agreement on behalf of the municipality and such further legal documents as required to facilitate the resolution. CARRIED UNANIMOUSLY UNIVERSAL BUS PASS PROGRAM UNB GRADUATE STUDENTS ASSOCIATION 2018/2019 Moved by Councillor Kevin Darrah, seconded by Deputy Mayor Steven Hicks THAT City Council adopt the following resolution: Universal Bus Pass Program UNB Graduate Students Association 2018/2019 BE IT RESOLVED that the Council of the City of Fredericton hereby authorizes and approves the agreement between the City of Fredericton and the Graduate Student Association of the University of New Brunswick Inc. ( Agreement ) for a term of one (1) year, from September 1, 2018 to August 31, 2019 with respect to the Universal Bus Pass Program at the per pass rate of $ per student; and 13

14 Regular City Council Meeting Tuesday, October 9, 2018 page 11 BE IT FURTHER RESOLVED that the Council of the City of Fredericton authorizes the Mayor and City Clerk to execute the Agreement on behalf of the municipality and such further legal documents as required to facilitate the resolution. On the Question: Councillor Kate Rogers commented that this is a wonderful program and many students are very reliant on the program. She noted that in addition to it being helpful to the students, it s also hopefully spawning future bus riders and that there will be more students as they become adults, choosing to ride public transit as opposed to purchasing cars. Councillor Rogers noted that at a recent Community/Post-Secondary Relations Committee meeting there were representatives in attendance speaking about how important this program is to students in deciding where they live, work, etc. She further noted that there were institutions besides St. Thomas and UNB that sit on the committee who expressed an interest in also participating in the program. Councillor Rogers commented that she looks forward to working with other institutions to also enter this program. The original motion was then put to vote and declared CARRIED UNANIMOUSLY SERVICE AGREEMENT WITH EXPEDITION TECHNOLOGIES INC. FOR READY PASS PILOT PROGRAM Moved by Deputy Mayor Steven Hicks, seconded by Councillor Kevin Darrah THAT City Council adopt the following resolution: Service Agreement with Expedition Technologies Inc. For Ready Pass Pilot Program BE IT RESOLVED that the Council of the City of Fredericton hereby authorizes and approves the Service Agreement between Expedition Technologies Inc. and the City of Fredericton with respect to a transit mobile app for a period of one (1) year, commencing on October 9, 2018 and expiring on October 8, 2019; and BE IT FURTHER RESOLVED that the Council of the City of Fredericton authorizes the Mayor and City Clerk to execute the Service Agreement on behalf of the municipality and such further legal documents as required to facilitate the resolution. CARRIED UNANIMOUSLY Councillor Mark Peters declared a Conflict of Interest in relation to the Aquilini Properties Agenda Item and retired from the meeting at 7:57 p.m. 14

15 Regular City Council Meeting Tuesday, October 9, 2018 page 12 REQUEST FROM AQUILINI PROPERTIES FOR PERFORMANCE PAYMENT Moved by Deputy Mayor Steven Hicks, seconded by Councillor Greg Ericson THAT City Council adopt the following resolution: Request from Aquilini Properties for Performance Payment WHEREAS the Developer, Aquilini Properties LP, failed to meet the completion, opening and occupancy date of May 1, 2018, as prescribed by the Development Agreement, as amended; BE IT RESOLVED that the Council of the City of Fredericton will not repay the Performance Payment to the Developer, Aquilini Properties LP in the amount of $250, On the Question: Councillor Bruce Grandy commented that he is struggling with his decision on whether to support or vote against this motion. Councillor Grandy expressed concern that contractors are faced with challenges and delays that are often outside of their control. He made mention of the force majeure section in the contract and acknowledged that it could be interpreted different ways by different lawyers and therefore he understands how it could be viewed from different perspectives. Councillor Grandy further expressed concern that by supporting this motion, the wrong message could be sent to developers in that the City of Fredericton will penalizes people on a go forward basis. Councillor Grandy commented that clearly in the end, the contractor did meet the objective; otherwise this matter would not be before Council. Councillor Eric Megarity commented that if the situation was reversed and the City of Fredericton was under contract and it didn t make its time limit on its performance, the City would have been on the hook for a quarter million dollars. Councillor Megarity agreed that this is a tough decision because the contractors did build a great hotel, but his rationale is based on the question, did the City face a quarter million dollars in damage and performance. Councillor Megarity acknowledged that it would be hard to prove that on the city s behalf, however, the small businesses in the area might have a case and it would be nice to get that money in their hands. Councillor Megarity advised that he would be supporting the motion as is and suggested that in the future perhaps Council could have a discussion about further contracts. CARRIED UNANIMOUSLY SMART CITIES CHALLENGE AGREEMENT (ADDITIONAL ITEM) Moved by Deputy Mayor Steven Hicks, seconded by Councillor Bruce Grandy THAT City Council adopt the following resolution: Smart Cities Challenge Agreement (Additional Item) BE IT RESOLVED that the Council of the City of Fredericton authorizes and approves an Agreement between the Her Majesty the Queen as represented by the Minister of Infrastructure and Communities, the City of Fredericton and Saint Mary s First Nation with respect to the Preparation of a Final Proposal for the First Competition of the Smart Cities Challenge ( Agreement ) terminating on March 5, 2019 or upon delivery of the Final Proposal (whichever comes first); and further authorize the Mayor and City Clerk to execute the Agreement on behalf of the municipality without any further legal documents or reciprocal agreements. On the Question: Councillor Bruce Grandy commented that this is an exciting agreement in which the winner will win ten million dollars. Councillor Grandy gave a shout out to Adam Bell who is leading this negotiation and challenge as well as Kim Nash-McKinley from Saint Mary s First Nations. He noted that it is a great partnership and he is very optimistic that a top notch proposal will be submitted for our chance at the ten million dollar prize. 16

COMMENTAIRES DE SHARON WATTS, CADRE DE DIRECTION DU FREDERICTON REAL ESTATE BOARD ET DES BÉNÉVOLES DE KAT S KITCHEN Sharon Watts, cadre de direction du Fredericton Real Estate Board, remercie le maire et les conseillers de reconnaître le 11 octobre Journée des courtiers et agents immobiliers à Fredericton. Commentaires de Sharon Watts, cadre de direction du Fredericton Real Estate Board et des bénévoles de Kat s Kitchen Elle ajoute que le Real Estate Board tient à exprimer sa reconnaissance envers la communauté qui appuie l industrie de l immobilier en organisant diverses activités de collecte de fonds tout au long de l année et un grand événement annuel. Les activités-bénéfices de l année dernière ont rapporté $ au profit de Liberty Lane Inc. Elle précise que la grande activité-bénéfice de cette année consistera en un spectacle de magie qui aura lieu au Picaroons Roundhouse le jeudi 11 octobre 2018, au profit de Kat s Kitchen de Fredericton High School. Jamie Little, Christine Zhang et Matei Marica, trois élèves qui font du bénévolat pour l initiative alimentaire Kat s Kitchen sont ici pour remercier personnellement le Real Estate Board de sa générosité. Ils soulignent que Kat s Kitchen a été mis en place pour fournir un déjeuner et un diner aux élèves dans le besoin en plus de procurer une expérience de leadership à des élèves bénévoles. Tous les jours, le programme nourrit 120 élèves le matin et 100 le midi avec un budget annuel d environ $ provenant uniquement de contributions bénévoles. Actuellement, 80 étudiants et 30 enseignants donnent de leur temps pour faire du programme une réussite. JOURNÉE DES COURTIERS IMMOBILIERS : 11 OCTOBRE 2018 ATTENDU QUE la journée des courtiers et agents immobiliers sera observée le 11 octobre et qu elle a pour but de rappeler à la communauté les services qu ils rendent dans leur travail quotidien et leurs activités de bénévolat; Proclamation de la Journée des courtiers et agents immobiliers 11 octobre 2018 QUE QUE les courtiers et agents immobiliers suivent un code professionnel et tiennent à jour leur formation et qu ils ont accès au système MLS qui facilite la coopération dans la vente des propriétés, le tout à l avantage des consommateurs; les courtiers et agents immobiliers sont soucieux de la communauté. Ils donnent des milliers de dollars par année à des organismes de bienfaisance autant par des collectes de fonds que par des dons. Ces femmes et ces hommes pensent à leur communauté, 20

Il fait remarquer que la première demande faite à ce sujet énonçait clairement que la deuxième cuisine se voulait une solution temporaire sur une période d une année qui donnerait au demandeur le temps de trouver une solution de rechange. M. Mallet annonce qu il n appuiera pas cette modification de zonage. Le conseiller municipal Eric Megarity suggère au demandeur de considérer le Centre culturel comme une option viable. Il indique que de nombreuses rénovations y ont été faites en pensant à ce genre d entreprise en démarrage. M. Megarity annonce qu il n appuiera pas cette motion. Le conseiller municipal Mark Peters commente que, bien qu il ait voté en faveur de la modification à la réunion du Comité d urbanisme, il n appuiera pas la modification de zonage, car elle permet un mode de fonctionnement entièrement différent pour un service de traiteur. Le conseiller municipal Stephen Chase annonce qu il n appuiera pas la motion d approbation de la modification de zonage parce que le demandeur s était engagé auprès du voisinage à n en faire qu un essai temporaire d une année et qu il tente maintenant de le rendre permanent. Le maire adjoint Steven Hicks déclare qu il n appuiera pas la motion parce qu il craint qu elle crée un précédent. À ce sujet, La conseillère municipale Kate Rogers commente qu il s agit d un programme formidable sur lequel beaucoup d étudiants comptent. Elle fait remarquer qu en plus d être utile aux étudiants, il prépare de futurs usagers de l autobus à la fin de leurs études. M me Rogers ajoute que des représentants ont assisté à une réunion récente du Comité des relations entre la communauté et les établissements postsecondaires où ils ont parlé de l importance de ce programme pour les étudiants quand ils décident où vivre, travailler, etc. D autres établissements que l Université St. Thomas et l UNB sont représentés à ce comité et ont exprimé de l intérêt pour une participation au programme. M me Rogers conclut en disant qu elle espère collaborer avec d autres établissements pour les aider à adhérer à ce programme. La motion initiale est alors mise aux voix et est déclarée ADOPTÉE À L UNANIMITÉ ENTENTE DE SERVICE AVEC EXPEDITION TECHNOLOGIES INC.
