The following rules and regulations have been compiled from our governing documents and adopted by the Board of Directors for the benefit of our community. Your cooperation in observing these will make our community one that we can all enjoy while ensuring the value of our community and your investment is upheld. These rules and regulations may be amended from time to time at the discretion of the Board of Directors. Dues, Late Charges, Fees Monthly HOA dues are due the 1 st of every month and are considered late if they are received after 10 days. You can mail or bring your payment to PML, Inc. at 1155 South Main Street, Longmont, CO If you are going to mail your payment, only mail a check, money order, or cashier s check payable to Sunnyvale Condominium Association or PML, INC. You can also make an on line payment by using your Tenant Portal for your account. To utilize this feature please send an to janetpaul@pmlinc.net Payments not received by PML, Inc. by the 10th of each month will have a $10.00 late fee assessed to your account. Any insufficient funds payment will be assessed a late fee, a $20.00 NSF charge, and that form of payment may no longer be accepted. If dues are not paid, collections of the outstanding balance will be pursuant to the Sunnyvale Condominium Association Policies, Policy #7 Procedures for Collections. An outstanding balance on your account will prevent you from being able to vote at the Sunnyvale Annual Meeting or any special meeting. Insurance Owners are strongly encouraged to purchase Condo insurance (HO6 endorsement) at their expense for their residence including but not limited to furnishings, carpet, window coverings, appliances, wall coverings, etc. It is the individual owner s responsibility for any damage caused to their unit, neighboring units or common areas from their negligence. Common Area Maintenance Please report any repairs or damage to the common areas to our management company, even if you think someone else has already done so. Rentals If you are renting your unit you must comply with the following guidelines. All leases must be in writing and must be for the entire unit for not less than 30 days. Within 10 days of lease signing for your unit, you must provide PML, Inc. with a copy of the lease and the completed Landlord Packet. Any violations of these rules and regulation or the governing documents for Sunnyvale Condominium Association including any fines are the responsibility of the homeowner. PML, Inc. will not provide tenants with parking passes, pool keys or pool passes, the homeowner or their property manager is responsible for getting these from PML, Inc. Page 1
2 Laundry Room Coin operated washers and dryers are located on ground level at the south end of B building. The laundry room does not belong to the HOA, it is privately owned and residents are granted access to use. To continue to have use of these facilities, everyone needs to respect the facility and report any problems immediately. If you lose money in the machines or the machines are malfunctioning please contact the number posted in the laundry room. The laundry room door is to remain closed at all times. Please be considerate of others, do not leave your clothing in the machines longer than necessary. The laundry room is cleaned but everyone needs to do their part and throw their trash away in the trash containers. DO NOT overload the machines as they do not work properly if they are overloaded. Do not use any sort of tints or dyes in any of the machines The HOA, PML, Inc. and the owner of the laundry room are not responsible for damage, loss or theft of items from machines or in the laundry room. Pets Per the covenants each unit may only own ONE PET. VISITING PETS ARE NOT ALLOWED AT ANY TIME. Pets must be registered with PML, Inc. There is a $10.00 per month dog fee added on to your dues if you own a dog. Dogs can only be of small size when FULLY GROWN, no more than 18 tall at the shoulders, can weigh no more than 35lbs and not be a restricted breed listed below. Your pet must be on a leash and with you at all times when outside your residence. You are responsible for cleaning up any pet waste immediately. The following is a list of restricted breeds and pets that are NOT allowed at the Sunnyvale Condominiums at any time which include but are not limited to: American Pit Bull Terrier, American Staffordshire Terrier, Staffordshire Bull Terrier, German Shepherd, Rottweiler, Akita, Alaskan Malamute, Boxer, Chow Chow, Great Dane, Siberian Husky, Doberman Pinscher, Golden or Labrador Retrievers, or any breed mixed with the above, any other similar breeds larger than 35 lbs/18 tall or breeds that are perceived as potentially aggressive. Wild and non-domesticated or vicious animals, reptiles, exotic species, chickens and ducks are not allowed as pets. Aquarium tanks cannot be more than 50 gallons. Trash Trash dumpsters are strategically located throughout our community, for the exclusive use of the residents and their normal household garbage. All trash must be put inside the trash dumpster and not set beside it. Please break down all cardboard boxes before putting it in the trash or recycling container. If the trash dumpster nearest your building is full, please put your trash in a different dumpster. DO NOT use the smaller trash cans around the complex for your household trash. DO NOT LITTER THE GROUNDS OR WALKWAYS. If you see trash or debris please take a minute and pick it up and properly dispose of it. Items not considered normal trash including but not limited to tires, mattresses, furniture, appliances, etc. These items are the responsibility of the homeowner to remove and are not to be placed in the trash enclosure for disposal. If you need help with the removal of these items, please contact PML, Inc. for assistance. Guests Guests are not allowed to use the facilities unless they are accompanied by the resident. It is the responsibility of the residents to inform their guest of the HOA and see that they abide by them while in the Sunnyvale Community. Page 2
3 Parking & Parking Spaces You are assigned one parking space with a corresponding parking pass when you purchased your residence. The parking pass with the parking space number on it must be visible from the front windshield of your vehicle at all times and must correspond with the parking space the vehicle is parked in. If you lose your parking pass, a replacement pass is available at PML, Inc. for $5.00. If your pass is broken or damaged, bring it to PML, Inc and exchange it, the majority of the pass must be turned in to exchange it. Extra parking spaces are available from the HOA via PML, Inc. for $20.00 per month. If you are interested in an additional parking space, the Owner needs to contact PML, Inc. to lease a parking space. If the extra parking space is no longer needed the parking pass must be returned to PML, Inc. to remove the $20.00 per month charge. If you have additional vehicles and do not want to pay for an extra parking space you must park on the street. If you sell your residence you must give the parking pass to the new owner at the time of closing. There are spaces designated for visitor parking. These spaces are for guests or deliveries and have a 24 hour parking limit. They are not to be used for extra parking spaces. No boats, campers, trailers and oversized trucks are not to be stored on the premises or occupy parking spaces. If you are moving in or out of a unit, please make every effort not to block access to someone else s parking space or impede traffic flow in the parking lot. All vehicles must be licensed with current tags and be operational. Vehicle repairs are not allowed except for minor maintenance items such as changing tires, battery installation or adding fluids. Vehicles improperly parked in no-parking areas, designated handicapped areas, in the wrong parking space or without a Sunnyvale Condominium Parking permit may be towed at vehicle owner s expense. If a vehicle is parked in your parking space and does not have a parking permit you can contact Northside Towing at to remove the vehicle from your space. Front Door Entrances, Patios, Balconies, Steps and Walkways Front door entrances, patios and balconies are to be maintained in an attractive, orderly, safe, clean and sanitary condition by the resident living there. These areas are to be free from litter/debris and are not to be used for storage. Items that are not to be stored include but are not limited to household appliances, discarded household items, toys, broken furniture of any type, interior furniture, tires, batteries, gas cans and bicycles. Only acceptable furniture for the patio or balcony is furniture specifically designed for exterior use. Please make sure if you have something setting on your balcony it is secure and will not fall off and hurt someone below. No item should be placed to obstruct any stairs or walkways in the community. Doors, Windows, Window Coverings and Screens All window and patio door window coverings are to be white or alabaster blinds and must be visible from the exterior. Interior window treatments are allowed provided they cannot be seen from the common areas. Sheets, towels or blankets are not allowed at any time and residents are not allowed to store items on the window ledges. Repair, replacement, and maintenance of the doors, storm doors, patio doors, patio screens, windows, window coverings and screens are the responsibility of each homeowner and must be repaired or replaced when they are damaged. When replacing these items they must be replaced with like items. All windows, patio doors, window screens and patio door screens must be made with dark brown frames. If you replace your front door it needs to match the other doors in the community and be painted the body color of the building. If you want to add a new storm door or front door, you must submit a modification request form and receive written approval from the HOA prior to installation. Any winterize or weatherize of doors or windows must be done on the interior of the window/door and not on the exterior of the building. Page 3
4 Trees, Fences, Shrubs, Flowers and All Utility Equipment NO climbing, attaching to or hanging of swings, planters etc. on the trees. Do not climb or play on the fences, gates, utility meters or high voltage boxes. Please keep pets & children out of the shrubs and flower. Improvements If you want to install any item to your unit that would change the exterior or interior structures of the building, you need to submit a modification request form and receive written approval from the HOA prior to making the change. Changes include but are not limited to the installation of satellite dishes, antennas, air conditioners, washer and dryers, etc. The HOA will make every effort to accommodate all requests, but permission does not have to be given. Homeowners wanting to make a change are responsible for all permits, safety requirements, all maintenance for the improvement and any damage to the HOA property due to the installation or removal of the requested item. If you have a washer and/or dryer in your unit you are responsible for the routine cleaning and maintenance of the dryer vent. Satellite dishes must not be larger than 24 in diameter, be discretely located and all cables be secured to the building. At the time of move out satellite dishes must be removed and any damage repaired. Air conditioners must be installed so they do not cause damage to the exterior of the building and when they are winterized it must be done so using the proper cover and making sure that it is securely fastened. Garbage bags or blankets are not proper air conditioner covers. Personal Conduct, Parties and Noise No open alcoholic containers are allowed anywhere in the community. The consumption of alcoholic beverages is confined to the inside of your unit by individuals who are of legal age only. Residents and their guests should make every effort to be considerate of all residents. Sound equipment should be kept at a level that is not audible outside of your residence. All noise must be discontinued after 10:00 pm per City ordinances. Residents must not congregate in the walkways, breezeways, sidewalks or parking lots in a fashion that impedes pedestrian or automobile traffic. Please do not hang over, or throw trash or cigarettes over the railings. These areas are not designed to entertain groups of people. Sunnyvale is a community with residents of all ages and loud, inconsiderate or crude behavior, including but not limited to, spitting, foul language, or drunken and disorderly conduct is expressly forbidden and will not be tolerated. Children Children must be under the supervision of an adult at all times. Children may use the facilities on the property when they are under the direct supervision of an adult. Absolutely no child is allowed in the pool at anytime without being accompanied by an adult. All toys are to be kept inside of the residence unless in use. Any toys/items left outside in the common areas will be considered trash/debris and may be disposed of. Bicycles, Skateboards, Roller Skates/Blades Bicycling, skateboarding, roller-skating/roller-blading are not allowed in the common areas included but not limited to the stairways, walkways, decks, parking areas or around the buildings. Bicycles are to be stored in the bike racks provided. If you choose not to use the bike rack, you may store your bicycle inside you unit ONLY. You may not store it on your balcony, patio or front door entry. Please be careful when transporting your bicycle up or down the stairs. If any damage is done to the walls or stairs you will be charged for the repairs. The HOA and PML Inc. are not be responsible for bicycles, skateboards, skates, toys, etc. which are left outside the units. Page 4
5 Pool Area The pool area is the fenced-in area enclosing and consisting of the swimming pool, outdoor furniture and concrete deck hereinafter referred to as the pool area. Prior to use of the pool all owners and tenants must sign a waiver. PLEASE NOTE: Your compliance with this policy is mandatory and if not followed, violators are subject to fines, banned from use of the pool and/or can cause the pool to be closed all together. The pool is open from around Memorial Day until around Labor Day depending upon weather. Pool hours are 8 am to 7 pm. Adult Only swim times are M, W, F from 7pm to dusk, T, TH from 5pm to dusk, and Saturday/Sunday 10 am to 2pm. You must have a key and a pool pass signed out from PML, Inc to enter the pool area. There is one key and pass per unit, and if it is lost, the replacement key and pass will be $75.00 each. USE OF THE POOL AREA IS AT YOUR OWN RISK. There is NO LIFEGUARD ON DUTY. Use of the pool area is a privilege, not a right. The Board reserves the right to close the pool area and ban any person from use of the pool area at any time for any reason, without notice. You must be able to show your pool key and pass when asked. Life preservers are for emergency use only. They are not to be used in the pool as floats. NO glass, toys, pets, alcoholic beverages, food, horseplay, running around pool area, foul language or nudity is allowed. Resident s children under the age of 18 years may use the pool area only under the direct supervision of their parent at all times. The pool area is to be used only by residents and their invited guests. Guests are limited to two guests per unit (or 1 adult and 2 children). When in the pool area, guests must be accompanied by a resident at all times. When using the swimming pool you must wear proper swimming attire made to be worn in chlorinated water. Cut-offs, T-shirts or street clothes are not permitted. No oils, bubble bath or other such liquids are allowed in the pool. Large flotation devices such as rafts are not permitted. Keep noise at a low level at all times when in or around the pool area as a courtesy to the other residents. Pick up after yourself. If you bring it with you, take it with you. If you see rocks in the water or around the pool area, please make the effort to pick them up and put them where they belong. NO climbing on fence or gate. NO crawling under fence or sneaking into pool. IF YOU CHOOSE TO IGNORE THESE POLICIES, YOU ARE SUBJECT TO FINES AND LOSS OF THE USE OF YOUR POOL PRIVILEGES. Miscellaneous Absolutely no grill or barbecue is to be stored or used on any patio, balcony or walkway. Holiday decorations can be put up no earlier than 30 days before the holiday and must be removed by no later than 30 days after the holiday. The rocks in the common area are for decorative purposes and should be left in the rock beds. Fireworks are not allowed within the City Limit. If residents are lighting off any type of fireworks the police department will be contacted. When you replace your water heater you are strongly encouraged to install a water heater drip pan under the water heater. Installing the drip pan under the water heater prevents potentially damaging water leaks. Each owner is responsible for the cleaning and maintenance of their chimney. Owners are required to have a professional chimney sweep inspect annually and clean as determined. Residents are encouraged to turn on their front entry light and balcony or porch light at dusk. This is one of the most effective ways to provide a safer community for all of us. Page 5
6 Miscellaneous Continued If you see a building or parking lot light out please contact PML, Inc. and let them know the location of the light so it can be replaced or repaired. If you see anything suspicious please contact the police, even if you think someone else has called it in, please call them. Please notify PML, Inc. or a Board Member of the incident to let them know what happened. If a homeowner or their tenants, guests, invitee, family, friends or pet are found to be responsible for any damage to the property as a result of negligence, carelessness or misuse, that homeowner will be responsible for the cost for the repair. Violation Procedure Violations of the governing documents of Sunnyvale Condominium Association can result in fines being imposed upon the Owner pursuant to the Sunnyvale Condominium Association Policies, Policy #6 Enforcement of the Rules & Regulations and Covenants. Owners are responsible for violations made by them, tenants or guests and will be held liable for any costs incurred due to the violations. Failure to pay fines will result in the Association taking collection actions pursuant to Policy #7 Procedures for Collections. Covenant Enforcement Fine Schedule First Offense: Courtesy Letter. A Courtesy Letter is sent to the Owner identifying the violation and stating they have 14 days to correct the violation. If after 14 days, the violation is not corrected it is upgraded to a second offense. Second Offense (Same Violation): Continued Violation Letter. A Continued Violation Letter is sent to the Owner identifying the violation has not been corrected and stating they have 14 days to correct the violation, submit a written dispute that includes a reasonable explanation for the dispute or request a hearing in writing and includes a warning of a fine. If after 14 days, the violation is not corrected and the Owner fails to do one of the three listed actions, the violation is upgraded to a third offense. Third Offense (Same Violation): Continued Violation Letter is sent to the Owner identifying the violation has not been corrected, assessed a $25.00 fine plus any cost for damages and warning of additional fines. If after 14 days, the violation is not corrected it is upgraded to a fourth offense. Fourth Offense (Same Violation): Continued Violation Letter is sent to the Owner identifying the violation has not been corrected, assessing a $50.00 fine plus any cost for damages and warning of additional fines. If after 14 days, the violation is not corrected it is upgraded to a repeat violation. Repeat Violations: Each repeat violation will be assessed a $ fine plus any cost for any damages and the Owner is given 14 days to correct the violation. Each violation will have a violation timer. This violation timer will be used to track repeated offenses and will only reset if there are no repeated violations for one calendar year. These are subject to revision at the discretion of the Board of Directors. Page 6
