1 PALM GARDEN CONDOMINUM ASSOCIATION, INC. RULES, REGULATIONS AND POLICIES 1. ALTERATION(S) TO COMMON AREA Alterations of any type, to the common areas of the complex without written approval of the Board of Directors is prohibited. Cost required to bring the alteration(s) back to its original state may be born by the unit owner or resident. Alteration (s) for the purpose of this rule, include accident damage to common areas created by the unit owners, residents, guest thereof and contractors/realtors/repairmen, etc. not contracted by the Board of Directors. Air conditioning units on the building roofs belong to individual unit owners. When these units are repaired or replaced, any damage to the common areas is the responsibility of the unit owner. The primary concern is that proper care be taken to protect the roof membrane. As a means of protecting the roofing membrane, the entrance to the roof in both buildings is kept locked. Board members have keys to the roof and you can check the bulletin board for their names and phone numbers. Rubber sole shoes must be used when on the roof. To obtain a roof key you must contact a board of director member or management 24 hours prior. The Board of Directors has the right to grant emergency access with reasonable request. Do not plant any new plants or foliage on common ground. Do not throw seeds of any kind including grass seed on any common area. No items of any kind like potted plants or personal items are to be stored under stair ways or any common area. No window a/c units are allowed. Apartment unit doors must be closed at all times. You must install a screen door to meet HOA specifications and approval in order to have a front door remain open. Any group of 3 or more people getting together outside the unit must do so in the designated area by the BOD, which is the pool deck during open pool hours. The Board of Directors has the right to change that location from time to time with proper notice. 2. ANIMALS No animal (s) or pets shall be kept in any unit without the written consent of the Board of Directors. A form is provided for this specific request and must be completed, signed and approved prior to a pet residing on the premises. Any pet causing or creating a nuisance or disturbance shall be permanently removed upon a three (3) day written notice form the Board. Animal litter left on the condominium property is example of a nuisance to all residents. No more than two (2) small breed domesticated pets (cats, dogs and birds) are allowed per unit and no pet over 25 lbs is permitted. All pets must be approved by the board prior to being brought in. All dogs/pets must be on a leash at all times. All pets/cats must be indoor only. All 1

2 owners are required to have a plastic bag and clean up properly after the pet at all times. Litter boxes should be dispose in a closed plastic bag and should not be dump directly in the dumpster. If trash bag breaks or leaks on walkways please clean up. 3. BARBECUING/GRILLING No propane gas or charcoal grills are allowed on any common areas, porches or balconies. Only smokeless electric grills used on your units porch is permitted. No propane gas tanks, gas tools, landscaping machine, gasoline tanks or containers can be stored in any unit, or porch or storage unit. Only electric smokeless grills be stored inside the unit at all times when not in use 4. BUILDING & GROUNDS MAINTENANCE All hallways/walkways must be kept clear at all times. No bushes, plants or flowers may be planted or cut on the condominium property. All grounds are common areas and recommendations or requests for change must be brought before the Board of Directors. No personal items should be left on common areas, or hung over railings. There should not be any items left outside your door with the exception of a doormat. A decorative door hanger or wreath is allowed. Any broken window must be fixed within 10 (ten) days of incident without delay. No items may be left on common area unless approved by the Board of Directors with the exception of what is stated on previous paragraph. No one can landscape, fertilize, irrigate or make any changes to the property or tamper alter or change any setting for any equipment without the written permission from the Board of Directors. No cigarette butts, unwanted mail or any garbage items can be left in any common area bin including but not limited to the laundry room, storage rooms, pool deck and other community areas. No loitering in parking lot or common ground areas. Please do not spit over the balcony railing. Do not hang any items over the balcony railings or leave any items on the walkways ad it is hazardous and looks aesthetically unappealing and it is against Fire Marshall rules and HOA rules. 5. CHILDREN Pedestrians have the right of way while on condominium property. All vehicles are expected to be utilized at speeds of 5 miles per hour or less. This is to help keep our children and older residents safe. Small children should be under direct supervision of an adult. No walking, running or playing on the grass. Children must be supervised at all times on common areas. No bouncing balls or running on sidewalks, balconies, or against the walls. No riding bicycles skate boards, rollerblades, rollerskates, or other ride-on toys on sidewalks, balconies or grass 2

3 6. CLUBHOUSE The clubhouse is a common area available for the exclusive enjoyment of residents and their guests. The clubhouse is available for use by reservation. The use of the clubhouse does not include the pool. Residents will not be denied used of the pool when the clubhouse is occupied. In order to maintain distinct separation, the sliding glass doors facing the pool must remain closed when the clubhouse is in use. As a safety issue alone, access to the pool from the clubhouse must be restricted from children. $ deposit is required in the form of a money order or bank check, $ of this deposit will be refunded upon satisfactory inspection. Use of clubhouse only not to include use of pool is limited to 35 people during the hours of 9:00 AM to 11:00PM. Event is limited to 4 hours with 30 min setup and 30 min cleanup before and after the event respectively. The deposit will be refunded once an inspection of the clubhouse has been completed and it is found clean and without damage. Clubhouse rental form is available through the BOD or the management company and it must be signed by an approved resident. 7. METER ROOM No personal items, including bicycles to be stored in meter rooms. Meter room must have a clear access to utilities at all times by law. Do not use meter or laundry room as a power source for personal use. 8. DISPOSAL OF LARGE ITEMS Large items such as appliances, doors, tec., must be discarded by placing them on designated bulk trash area.it is the responsibility of the owner to inform JNE management by calling or them at jne@jnemanagement.com with description of items left on bulk trash. Please do not leave any items next to the dumpster as the garbage collection service will not dispose of any items that are not inside the dumpster. Pick up day for bulk trash is Wednesday. Anyone who overloads dumpster be it the owner or tenant and causes additional pick up charges to the association will be responsible for those charges. 9. GARBAGE/TRASH/RECYCLING Please seal your trash in a plastic bag prior to placing in the dumpster. Please use your kitchen disposal as much as possible. If you don not have a disposal, please put any food in a leak proof plastic bag before putting it into the dumpster, if your trash bags leaks or breaks on your way to dumpster please clean up spill including cat litter. Improper handling of garbage is a sanitation issuing creating a potential health hazard and the smell, when spoiled, is at the least, offensive to everyone. Pick up days for trash are Mondays and Thursday. Pick day for recycle is Monday. 3

4 There is also a recycling container provided for newspapers and another for plastic, glass and alcoholic containers. 10. GARAGE SALES/OPEN HOUSES Garage or yard sales are prohibited on the premises due to increased risk of liability, additional traffic, parking issues, possible disturbance to residents and potential damage to common areas. There are no garage sales or open house permitted at any time. 11. POOL & LAUNDRY ROOM KEYS If lost or stolen, replacement gold keys are available from the Board of Directors or management company at a cost of $ LAUNDRY FACILITIES Repairs to equipment, due to normal wear and tear, abuse or carelessness (overloading) diminish the availability of funds. The use of the laundry facilities is restricted to the hours of 7:00 a.m. to 11:00 p.m. Please clean the lint receptacle after each use of the dryer and dispose of laundry soap containers in the dumpster. The costs of the wash and dryer is to be determined by the BOD and is subject to change. Do not leave any laundry soap or any other container, or garbage anywhere in the laundry room. Do not leave laundry unattended. Dryers must not be pushed all the way back against the wall as this collapses the lint pipe and causes the dryer to overheat and turnoff. Absolutely no adding of additional water to washer. If additional water is needed then your laundry load is to large to accommodate the load capacity. Facilities are for the use of residents only. Please turn off lights when leaving laundry room and lock the door. 13. PARKING/STORAGE/WASHING REPAIR OF VEHICLES Each unit owner is assigned one parking space. Units with two permanent vehicles may also use a visitor space. Due to limited parking, we cannot arbitrarily approve 3 or more permanent spaces for any unit owner. No motorcycles, motorscooters or motorbikes. Parking of motor homes, commercial trucks or any vehicle with signage on vehicles, boats and trailers are prohibited from the parking area. Storage in the parking area for any item, including long term storage of non-functioning vehicles is also prohibited. No loitering in the parking lot. Do not leave vehicle unattended when it is parallel parked along parking lot or blocking sidewalks. Cars parked illegally or not properly park between the lines will be stickered and towed. Please notify if you are having overnight guest to avoid cars being stickered. Residents may wash vehicles on the property. Please pull your vehicle parallel to the building near the hose. Please do not use caustic solutions as this may adversely affect the landscaping and pavement. Please do not wash vehicles in the parking spaces as damage could occur to another vehicle. Please keep your vehicle off the grass as this could cause damage to the 4

5 sprinkler system. Please place hose back with nozzle on the rack after each use. If any area is damaged, the resident will be responsible for the costs to return it to normal condition. Return your vehicle to assign parking space after washing it. Do not wash vehicles while landscapers or other vendor are on property performing work that will hinder their ability to work. Any unit owner, tenant or guest is responsible for any damages to condo property or any other unit caused by using the water hose outside or inside their unit. Emergency automobile repair is acceptable. Emergency repairs are limited to windshield repair and tire changes due to flat tire. Please do not change your oil or transmission fluid in the parking area. When spilled, the oil and transmission fluid damages to pavement. If there is a noticeable leak or stain in your parking space (assigned to your unit) you will be billed for the repair of that portion of the driveway repair. If you park in a guest space and drainage or stains are noticed, you will be notified and/or be responsible for any and all repairs. Please do not park cars on the asphalt that are leaking gas or oil. Guest spaces are not assigned. You must use your numbered parking space. Parking along the side of the building or parking lot is not permitted. All vehicles must fit in one spot and between the parking lines. No backing into parking spaces permitted. No abandoned, unregistered, or expired tags, unlicensed inoperable vehicles are permitted on property at any time. Vehicles in violation are subject to tow at owners expense. No parking, driving or backing up on the grass. 14. POOL Rules for the use of the pool are posted at the pool side. The pool is available from 7:00.a.m. to 10:00 p.m. Guests are required to be accompanied by a resident. Children under the age of 12 must be accompanied by an adult at all times. No running on deck and no glass is permitted. Please only bring plastic glasses, bottles or containers to the pool area. Please keep the gates locked and help keep the restrooms clean. Please do not leave any containers or trash in pool area. Animals are not allowed within the pool enclosure. The owner will be asked to remove the animal permanently from the premises if this is done purposely. No alcoholic beverages permitted. Proper attire/cover up is required at all times while at the pool and walking back and forth from the unit. No person may be unclothed while on the property at any time. 15. STORAGE Each unit owner has been assigned a storage area in the laundry room on the same floor as their unit. The Association takes no responsibility whatsoever for the loss of any item stored in these areas. Residents should place a lock on their storage bin. Residents may not store personal possessions in the meter room on the first floor of each building. 5

6 Please put a lock on your storage unit. The Association is not responsible for any lost or stolen items from any storage units. All items must be stored within your storage unit. Any item found outside a storage unit or in laundry room will be remove and discarded. 16. BICYCLES/SKATEBOARDS/ROLLERBLADES/SKATES Please store skateboards, roller blades, scooters, bicycles and roller skates in your own units. They cannot be used or stored on the sidewalk or common areas. 17. FLOORING& ALTERATIONS A noise barrier such as cork or similar material must be laid under tile or other noise producing flooring on the second floor. This buffer will help eliminate complaints from the unit owner underneath and is required by the condo association. Prior to installing new flooring you must have materials approved by the board. All changes to unit structure such as windows, doors and flooring must be approved and meet condo association specifications. 18. BUYING OR LEASING OF UNITS There is $ fee for the application. Any potential owner, renter or lease must complete an application and be approved by the Board prior to moving into any unit. The BOD has the right to amend the application from time to time and is subject to change. Unit owners must get board approval prior to allowing unit occupancy. One rental per unit per 12 month lease period is permitted. No sub-leasing allowed. All residents must be approved. All unapproved residents are subject to evicton at the expense of the owner of the property and will not receive HOA approval No moving trucks, vans or delivery vehicles allowed to park on grass. Moving in is allowed on weekdays between 8am and 6pm. Weekends between 10am-8pm. No moving in on Christmas, New Year, Thanksgiving or Easter. One small moving truck is allowed, one overnight stay only. Guests are permitted to visit an approved resident or owner and stay as guests under the following conditions. No guest can stay for more than 30 consecutive days. Any guest still there after 30 days is deemed a resident for Association purposes and shall be considered unapproved. Any resident that is deemed an unapproved resident shall not be granted an opportunity to apply for approval. No guest can visit more than 2 times a month. Any guest visiting the property on a third occasion in the same calendar month should be considered a resident and deemed unapproved by the Association. Any guest that refuses to leave will be evicted by the Association and the attorney costs and fees shall become the responsibility of the owner of the condominium. The Association Board of 6

7 Directors shall be the sole decision making body of the determination of guest days and number of occurrences. No guest may park a car in a guest spot for more than 24 hours without relocating it or moving the vehicles to a rotating spot. 19. SIGNS Unit owners and residents are not permitted to post any signs at the property for any reason. NO signs on building or windows. 20. FIREWORKS Unit owners and residents are not permitted to use fireworks or any explosives at any time for any reason or event. 20. BOARD OF DIRECTORS, ANNUAL AND SPECIAL MEMBER MEETINGS All BOD and community meetings are allowed to be attended by any member of the Association. Any member is also permitted to record or videotape the meetings with 24 hour written notice to the Association management company or registered agent. No one can interfere or disrupt the business of the Association for any reason. Any member in violation of this will be asked to leave or removed by the local police. 21. FINES/VIOLATIONS The violations committee will hear any hearing and suggestion to the BOD about any fines that are to be issued for any violation in accordance with the process below: I. 1 st Offense Final Warning letter issued to resident or unit owner in violation II. 2 nd Offense Notice of Violation and Fine with right to request a hearing within 14 days III. 3 rd Offense Notice from Association attorney with expense to the Unit owner of all legal fees and costs needed to get the compliance. Fines subject to $100 per day up to $1000 for whatever the Florida statue states. 7
