13 Structure and ownership Secure your piece of paradise All properties in the project have there own title deed, called a chanote in Thai language. The title deed is the ownership document of the property. While is it not possible for foreign nationals to own land on a freehold basis, most foreign nationals secure their piece of paradise with the right of superficies (pronounced su-per-fi-shez). Superficies is essentially a right which can be granted to an individual, irrespective of nationality, to own on the land the buildings, structures or plantations. A right of superficies may be created either for a period of time or for life of the superficiary. The process of registering superficies is similar to any other property transfers in Thailand. Foreign nationals with a Thai partner can transfer the property in their Thai partners name. We still recommend you to consult a competent property lawyer to understand your rights with or without a Thai partner. We work with competent lawyers for all the purchasers and have negotiated a very reasonable rate on your behalf. Our lawyers will be happy to answer any questions you may have regarding the legal status of the project or the legalities of owning a property in Thailand.
