1 n C ORDINANCE NO AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GLENDALE, CALIFORNIA, AMENDING SECTIONS , , , , , , , , AND OF TITLE 30 TO THE GLENDALE MUNICIAL CODE, 1995 RELATING TO ESTABLISHING STANDARDS FOR ACCESSORY DWELLING UNITS (CASE NO. ZC ) BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GLENDALE: WHEREAS, the City f Glendale adoted Ordinance No for the urose of rohibiting second dwelling units in the residential zones of the City of Glendale on July 2, 1996; and WHEREAS, Government Code Section (a)(4) was amended by AB 2299 (2016) to rename second dwelling units as accessory dwelling units and to deem null and void any existing ordinance that fails to rovide an aroval rocess that includes only ministerial rovisions for the aroval of accessory dwelling units and that shall not include any discretionary rocesses, rovisions, or requirements for those units; and WHEREAS, Section H of the Glendale Municial Code rohibits second units which is now in conflict with state law; and WHEREAS, Government Code Section ermits local governments to establish standards for ministerial review of accessory dwelling units and directs that accessory dwelling units be aroved subject to minimal state standards when no local standards or rocess for accessory dwellings has been established; and WHEREAS, an urgent interim ordinance was adoted on February 7, 2017 to establish criteria and rocedures for ministerial aroval of accessory dwelling units because the state rocess for ministerial arovals does not recognize Glendale zoning regulations that are necessary for maintaining community character including, but not limited to, residential setbacks, residential arking standards, local design review standards requiring that new construction maintain a consistent architectural character, and rovisions to address local historic roerties and local historic districts; and WHEREAS, the City of Glendale adoted Housing Element of the General lan on January 28, 2014 and this Element was certified by the State Deartment of Housing and Community Develoment on February 24, 2014; and WHEREAS, Government Code Section declares that accessory dwelling units on a lot develoed with a single-family dwelling in a single-family residential or multifamily residential zone do not exceed the allowable density for the lot uon which the accessory dwelling unit is located, and that accessory dwelling units are a residential use that is consistent with the existing general lan and zoning designation for the lot; and WHEREAS, Housing Element , Chater 6 age 13 notes that second units are rohibited by Ordinance No and that said Ordinance has been made ineffective by State action; and 1

2 CD CD WHEREAS, the ermission for accessory dwelling units was not anticiated in Housing Element , however, allowing accessory dwelling units will further local, regional and state goals for meeting the RHNA requirement exressed in Housing Element rovided the City has a mechanism to allow tracking of accessory dwelling units; and WHEREAS, Housing Element , contains: olicy 1.9 Encourage flexibility in the Zoning Ordinance to romote a wide range of housing tyes ; olicy 1.2 Assure that affordable housing is disersed throughout the City while recognizing the otential for the integration of market-rate and affordable units within individual rojects ; olicy 2.10 Resect scale, historic continuity, and a sense of community in new residential develoment ; and, olicy 6.10 Encourage the use of sustainable building ractices in residential develoments, and ermitting accessory dwelling units imlements these olicies; and WHEREAS, the Greener Glendale lan for Community Activities was adoted by the City Council of the City of Glendale on March 12, 2012 for the uroses of romoting sustainable ractices and establishing greenhouse gas reduction strategies in accordance with AB 32 (2006) and SB 375 (2008); and WHEREAS, the Greener Glendale lan for Community Activities Objective UD4 directs Glendale to continue to romote infill develoment to increase sustainability and livable environments and ermitting accessory dwelling units is consistent with that objective. NOW THEREFORE, the City Council of the City of Glendale does ordain as follows: SECTION 1. The City Council of the City of Glendale finds that the above recitals are true and correct and are hereby incororated by reference. SECTION 2. The City Council of the City of Glendale finds and declares that the rohibition against second units, also known as accessory dwelling units, discussed in Ordinance No. 5120, in Glendale Municial Code Section (H), and in Housing Element , Chater 6, age 13 is no longer in force and that this ordinance establishing reasonable standards for ermitting accessory dwelling units ministerially is consistent with the City s Housing Element , with state housing law and olicy, and with Glendale s adoted greenhouse gas reduction strategies. SECTION 3. follows: Section of the Glendale Municial Code, 1995 is hereby amended as Zoning Districts Regulations A. ermitted rimary Uses and Structures. The urose of the sectional listing of ermitted rimary uses and structures contained within each zone regulations is to identify all rincial uses and structures that are allowable on a lot within that zone as a matter of right. Subject to the rovisions of the zone, excet as otherwise rovided, no building, structure or land shall be used and no building, structure or use shall be established excet the listed ermitted rimary uses and structures. 2

3 n B. ermitted Accessory Uses and Structures. The urose of the sectional listing of ermitted accessory uses and structures contained within each zone regulations is to identify uses and structures that are allowable when they are integrated with and clearly incidental to a rimary use on the same lot. All buildings and structures shatl conform to the develoment standards of the zone. C. Temorary Uses and Structures. The urose of the sectional listing of temorary uses and structures is to identify those uses that may be allowable within a given zone for a limited amount of time and under certain secified conditions. 0. Conditional Uses and Structures. The urose of the sectional listing of conditional uses and structures is to identify those uses and structures which must first obtain ermission for their establishment within the zone by a conditional use ermit. The secific conditional uses and structures which are listed are considered to be tyical of uses which require individual review as to their articular characteristics and location, and ones that may require secial conditions to their establishment in order to rotect the health, safety and general welfare. E. Comliance with Laws. Notwithstanding any rovision in this code to the contrary, any establishment that engages in or carries out any activity contrary to federal, state or local laws shall be rohibited. F. Develoment Standards-General. The develoment standards contained within this title and the various zones have been established in order to assure adequate levels of light, air and density of develoment, to maintain and enhance locally-recognized values of community aearance and to romote the safe and efficient circulation of edestrian and vehicular traffic. The standards are in furtherance of the goals and objectives of the comrehensive general lan and are found to be necessary for the reservation of the community, health, safety and general welfare. G. Site Requirements-General. The area and dimensions of all building sites shall be sufficient to accommodate the anticiated density of develoment, oen saces, setbacks and arking saces. H. Density. The density of develoment has been established for each zone in accordance with the comrehensive general lan in order to romote the orderly, efficient and most aroriate growth within the city, consistent with the lanned caability of services and infrastructures. Density shall be calculated from the area of the lot before any ublic right-of-way dedications are made. An accessory dwelling unit on a lot develoed with one dwelling unit is deemed a residential use consistent with the existing general lan and zoning designation 3

4 n 0 for the lot, as rovided for in the Government Code of the State of California, Section I. Lot Size. Where minimum lot sizes or dimensions required within the zone standards, they have been established in order to romote the tye and scale of develoment envisioned in the comrehensive general lan. Where existing lots with lesser size and dimensions are existing in a zone, an excetion has been made in some zones for such lots when their develoment would not be harmful to the achievement of the overall goals and objectives of the lan..i. Coverage. Maximum coverage requirements contained within certain zone standards have been established to rovide minimum oen saces for light, air and ventilation and to reserve adequate area for oen saces, setbacks and other amenities. Coverage shall be calculated from the area of the lot after any ublic right-of-way dedications are made. K. Height. Height standards are reflective of intensity and scale of develoment. In order to maintain a sound lan and comatibility with surrounding uses, the structural height of buildings must be regulated and intensities directed to their most aroriate location. Factors taken into consideration in the establishment of height criteria are shade/shadow effects; Tight, air and ventilation; scenic vistas; and intensity of develoment and ability to serve. L. Unit Size. Minimum unit sizes as may be established in the various zones are for the urose of assuring accetable living areas, the control of overcrowding and the rovision of conditions conducive to a decent, safe and sanitary environment. M. Setbacks, Oen Sace and Landscaing Requirements. The urose of setbacks, oen sace and landscaing requirements is to assure that an effective searation is rovided between roerties and uses to foster comatibility, identity, rivacy, light, air and ventilation and rovide for landscaed areas in the living and working environments for visual relief and recreation. Setbacks and required landscaing shall be calculated from the roerty lines or area of the lot after any ublic right-of-way dedications are made. N. Medical Marijuana Disensary, marijuana disensary, marijuana cultivation, marijuana rocessing, and delivery or distribution of marijuana or medical cannabis roducts as rohibited uses. Notwithstanding any other rovision of this code, a medical maruuana disensary, marijuana disensary, marijuana cultivation, marijuana rocessing, and delivery or distribution of maruuana or medical cannabis roducts, as these terms are defined in section , are 4

5 n rohibited in all zones, including all secific lan areas, excet where the city is reemted by federal or state law from enacting a rohibition of any such rohibited uses, or is reemted by federal or state law from enforcing any of these rohibitions. SECTION 4. follows: Section of the Glendale Municial Code, 1995 is hereby amended as Residential District Land Uses and ermit Requirements A. ermitted rimary Uses and Structures. No building, structure or land shall be used and no building, structure or use in the residential zoning districts shall be erected, structurally altered, enlarged or established excet the following ermitted uses, buildings and structures identified with a in Table A. B. Conditional Uses and Structures. The following uses and structures identified with a C in Table A may be ermitted in the residential zoning districts subject to aroval of a conditional use ermit (Section 30.42). The develoment standards of this zone shall aly excet as otherwise rovided herein. C. Temorary Uses. Temorary uses (identified with a T in Table A), allowed subject to aroval and comliance with all alicable rovisions of this Zoning Code. D. ermitted Accessory Uses and Structures. Accessory uses, buildings and structures shall be ermitted in zones identified with a in Table A. E. Wireless Telecommunications Facilities. Wireless telecommunications facilities, identified with a W in Table A may be ermitted subject to the aroval of a wireless telecommunications facility ermit as set forth in Chater of this Code. F. Standards for Secific Uses. Where the last column in the following tables ( See standards in Section ) includes a section number, the regulations in the referenced section aly to the use; however, rovisions in other sections of this Zoning Code may aly as well. G. Historic Resources. Uses listed as ermitted or conditionally ermitted within a historic resource included on the Glendale Historic Register only (identified in Table A) are ermitted or conditionally ermitted only within a designated historic resource on the Glendale Register of Historic Resources. 5

SECTION 9. follows: Section of the Glendale Municial Code, 1995 is hereby amended as Accessory Dwelling Units A. Intent and urose. This Section is intended to rovide for the creation of accessory dwelling units in a manner that is ministerial and nondiscretionary consistent with State Law. 1. Accessory dwelling units (also known as second units or granny flats ) are located on lots develoed with one dwelling unit and can rovide an imortant source of affordable housing. For uroses of this Section, the existing one residential dwelling shall also be known as the rimary dwelling. 2. Accessory dwelling units, when aroriately sized and located, have little imact on neighborhood quality of life or uon real roerty that is listed, or identified on a historic survey as otentially eligible on the National Register of Historic laces, California 30

31 n 0 Register of Historical Resources, Glendale Register of Historic Resources, and in a City of Glendale designated or nominated Historic District. 3. Establishing reasonable regulations for accessory dwelling units is an aroriate mechanism to roerly balance the need for additional affordable housing with the need to maintain existing architectural character, community character and neighborhood quality of life. 4. Accessory dwelling units are not considered for uroses of General lan density calculation. 5. Accessory dwelling unit ermits are necessary to enable tracking of affordable housing and to ensure review and comliance with zoning, fire, and life safety standards contained in state and local law. B. Alicability 1. This Section shall aly to all zones on lots develoed where only one residential dwelling unit exists on the lot excet for a lot created through a small lot subdivision where no accessory dwelling unit is ermitted. 2. A lot develoed with one dwelling unit may have either one accessory living quarters or one accessory dwelling unit, but not both. An accessory living quarters may be converted to an accessory dwelling unit. C. Standards for an Accessory Dwelling Unit 1. An accessory dwelling unit that meets all of the following standards shall be aroved. A roosed accessory dwelling unit that does not meet all the following standards shall be denied. a. Where two (2) or more contiguous lots in the same ownershi are develoed as one (1) building site with one residential dwelling and where an accessory dwelling unit is roosed, a lot line adjustment or arcel ma shall be required to create one lot by relocating or eliminating existing lot lines. b. Excet as identified in this Section, accessory dwelling units are subject to the same zoning standards for setbacks, floor area ratio, height, lot coverage, minimum lot size and landscaing as the rimary residential dwelling. However, in no case shall new construction of an accessory dwelling unit be located between the rimary residential dwelling and the street front setback line or the rimary residential dwelling and the street side setback line. c. An accessory dwelling unit may have a maximum square footage of u to 600 square feet. d. At all times, the roerty owner shall comly with one of the following requirements: (i) the roerty owner must be an owner-occuant and reside in either the residential dwelling or in the accessory dwelling unit, or; (ii) if the roerty owner does not reside in either the residential dwelling or the accessory dwelling unit, then the roerty owner shall only rent or lease the roerty as a single rental roerty and 31

For uroses of this Section, owner-occuant shall mean natural erson(s) who have an ownershi interest in the roerty, or non-natural business entities including, but not limited to, trusts, cororations, artnershis or limited liability comanies. If a trust is the roerty owner, the owner-occuant required to reside in either the residential dwelling unit or the accessory dwelling unit, for uroses of this Section, shall be one or more of the trustees or the beneficiaries of the trust. If a business entity, such as a cororation, a artnershi, or a limited liability comany, is the roerty owner, the owner-occuant required to reside in either the residential dwelling unit or the accessory dwelling unit, for uroses of this Section, shall be a erson authorized to bind such entity in real estate matters. e. Short-term rentals less than thirty (30) days are rohibited for both the residential dwelling and accessory dwelling unit on the lot. f. The accessory dwelling unit cannot be sold searately from the residential dwelling. g. A detached accessory dwelling unit shall not exceed 15 feet in height, or the height of the rimary residence, whichever is lower, excet that a conversion of a detached accessory garage may add a second story which shall not exceed 25 feet in height (lus 3 feet for any roofed area having a minimum itch of 3 feet in 12 feet) rovided that new construction has a least a five-foot interior setback. h. No assageway shall be required between an entrance of the accessory dwelling unit and the street right-of-way as defined in State Law. An accessory dwelling unit must include: i. A bathroom. N. A kitchen. Hi. iv. Indeendent access. Comly with building codes, including sufficient setbacks for fire safety as determine by the Fire Deartment. v. May not be smaller than identified in Section of the California Health & Safety Code. vi. Must be served by utilities, including sewer, water and electric. j. Fire srinklers shall be required for the accessory dwelling unit if fire srinklers are required for the residential dwelling. k. The roerty owner shall ay all sewer, water, school district, and other alicable fees, including develoment imact fees. 32

The roerty owner shall install new or searate utility connections between the accessory dwelling unit and the utility, and ay all alicable connection fees or caacity charges, excet if the accessory dwelling unit is located within the existing sace of the residential dwelling and has indeendent access or is located within an existing, ermitted accessory structure. m. Notwithstanding the above rovisions, accessory dwelling units shall have setbacks sufficient for fire safety as determined by the Fire Deartment. D. Criteria for Accessory Dwelling Units An accessory dwelling unit that meets all of the following criteria shall be aroved. A roosed accessory dwelling unit that does not meet all the following criteria shall be denied. 1. For an accessory dwelling unit within an existing residential dwelling, where no additional floor area is roosed, that accessory dwelling unit may be aroved so long as the addition of the accessory dwelling unit does not change the building façade, or add a door directly facing a street. 2. For an accessory dwelling unit with an exterior addition to an existing residential dwelling. a. The addition shall be a single-story, and b. There shall be no change to the building façade, including the addition of a door directly facing a street. 3. Detached accessory dwelling units may be located within an existing, ermitted accessory building, such as inside an existing ermitted garage, with non-conforming interior setbacks. 4. Detached accessory dwelling units involving any new construction, or additions to existing ermitted accessory buildings, must maintain minimum five-foot interior setbacks. Any accessory dwelling unit located above a detached garage shall be suorted solely by the rimary walls of the existing garage building. 5. Accessory dwelling units that involve exterior modifications to an existing rimary residence or to a ermitted accessory building that increase floor area shall be architecturally comatible with the existing rimary residence and must use matching aint, matching or comlementary building materials, maintain consistent rooflines, and conform with the comatibility standards set forth in Section B. 6. For roerties listed, or identified on a historic survey as otentially eligible on the California Register of Historic laces, Glendale Register of Historic roerties, or any roerty in an adoted or nominated historic district overlay zone, any exterior changes to an existing roerty to create an accessory dwelling unit shall not be visible from the ublic street or sidewalk right-of-way immediately adjacent to the roerty and shall not alter any defining historical characteristic. E. arking Criteria to Arove an Accessory Dwelling Unit 33

34 1. Off-street arking for an accessory dwelling unit and relacement arking for the rimary residential dwelling when the garage, carort or covered arking structure demolished, altered or converted to construct the accessory dwelling unit shall comly with the following standards: C a. Relacement saces for the rimary residential dwelling shall be rovided on-site and shall be the same number of saces currently required by the zoning code. b. An accessory dwelling unit shall rovide one off-street arking sace, excet as otherwise rovided in this section. c. Each uncovered arking sace shall have a minimum width of 8 feet and a length of 18 feet. d. Relacement saces may be located in any configuration on the same lot as the accessory dwelling unit, including covered saces, uncovered saces, or tandem saces, or by the use of mechanical automobile arking lifts. e. If a mechanical automobile arking lift is used, it shall be enclosed and may not be located within any setback area. f. An uncovered arking sace may be located within setback areas on an existing driveway and shall not encroach on the ublic right-of-way. g. A covered or enclosed arking sace shall comly with zoning standards. 2. An accessory dwelling unit shall share the driveway with the existing rimary residential dwelling. The driveway to the rimary residential dwelling may be modified to accommodate onsite arking and shall comly with Section A searate driveway for the accessory dwelling unit shall not be rovided, excet where the lot is adjacent to an alley, in which case a driveway to the alley may be added to serve the accessory dwelling unit. 3. On shared driveways that rovide access for multile lots, such as flag lots, arking shall not be ermitted on ortions of the driveway that are used to rovide access to more than one lot. 4. No onsite arking is required for an accessory dwelling unit when one or more of the following alies: a. The roerty is located within one-half mile of a ublic transit sto. b. The roerty is listed on the National Register of Historic laces, California Register of Historical Resources, Glendale Register of Historic Resources, or any roerty in an adoted historic district overlay zone with a building identified as a contributing building or structure in an adoted historic resources survey. c. When the accessory dwelling unit is located within the existing rimary residence or accessory living quarters. 34

35 n n d. When on-street arking ermits are required but not offered to the occuant of an accessory dwelling unit. e. When there is a car share vehicle lot, such as ZI car, located within one block of the accessory dwelling unit. F. Covenant and Agreement A covenant and agreement shall be executed by the roerty owner and shall be recorded rior to the issuance of a building ermit for an accessory dwelling unit, and shall contain the following: 1. The accessory dwelling unit shall not be sold searately from the rimary residential dwelling. 2. All required onsite arking for the lot identified in the accessory dwelling unit ermit shall remain available for the rimary residential dwelling and accessory dwelling unit and shall not be rented searately to non-residents. 3. At all times, the roerty owner shall comly with one of the following requirements: (i) the roerty owner must be an owner-occuant and reside in either the residential dwelling or in the accessory dwelling unit, or; (N) if the roerty owner does not reside in either the residential dwelling or the accessory dwelling unit, then the roerty owner shall only rent or lease the roerty as a single rental roerty and shall not rent or lease the residential dwelling and accessory dwelling unit searately from each other. In any event, the lease or rental agreement between the roerty owner and the tenant of either the residential dwelling or the accessory dwelling unit, shall contain a rovision rohibiting the sublease by the tenant of either the residential dwelling or the accessory dwelling unit. The form of the lease or rental agreement shall be submitted to the city for review for comliance with this rovision rior to the execution of the covenant and agreement. 4. Short-term rentals less than thirty (30) days are rohibited for both the rimary residential dwelling and accessory dwelling unit. 5. The accessory dwelling unit covenant and agreement shall run with the land and be binding and enforceable on future roerty owners as long as the accessory dwelling unit exists on the roerty. 6. The accessory dwelling unit shall be removed at the exense of the roerty owner if the accessory dwelling unit ermit is terminated or uon violation of this chater or uon cessation of the rimary land use as a single-family residential dwelling. SECTION 10. follows: Section of the Glendale Municial Code, 1995 is hereby amended as Alicability The rovisions of this Chater shall aly to the following: 35

36 fl A. New buildings and structures, exterior remodeling and exterior changes of or to existing buildings and structures for which a building ermit is required; B. Any exterior change to an existing building or structure visible from the ublic street or sidewalk immediately adjacent to a roerty in an adoted historic district overlay zone, if that building or structure has been identified as a contributing building or structure in an adoted historic resources survey. This shall include the street-facing façade, and any ortions of the side and rear facades visible from the ublic street or sidewalk immediately adjacent to a roerty. For the uroses of this Section, an alley is not considered a ublic street. For the uroses of this Section, any ortion of a building which is not visible due to landscaing, walls, fences or any other natural or man-made obstruction which is not a art of a contributing building or structure shall be considered to be visible from the ublic street or sidewalk. C. For the ROS, Ri R, and Ri zones, any fence or wall of more than three feet of exosed height visible from the ublic street or sidewalk immediately adjacent to the roerty. D. Sign rograms; E. Creative signs; F. Murals; and S. Exemtions. Notwithstanding the above rovisions and subsection 0.5. below, the Director of Community Develoment may exemt the following buildings, hysical imrovements and site develoments from design review by a review authority: 1. Interior design and interior modifications to buildings or structures, whether or not floor area is added; 2. Buildings and structures, including wireless telecommunications facilities, in the CD and SR zones (lans and roosals in the CD Zone shall be reviewed by the Director of Community Develoment, in accordance with and according to the rocess in Chater 30.12; lans and roosals in the SR Zone shall be reviewed by the lanning Commission, in accordance with and according to the rocess in Chater 30.15); 3. In zones other than ROS, Ri R and Ri: a. Remodeling rojects, rovided that such remodeling does not involve a change in the architectural style of the building or structure and is otherwise in keeing with the intent, urose and standards of this article. Such remodeling may include, but shall not be limited to, window and door frees and oenings, automatic teller machines, handrails, stairways, fences and walls which may be ermitted under Chater 30.21, decks with a maximum overall height of eight (8) feet, or decks which are terraced to follow the natural terrain, not visible from other roerties or are otherwise unobtrusive on the hillside and do not adversely imact neighboring roerties, atio covers, trellises, gazebos, mechanical equiment screening (both roofto and ground mounted), satellite dish antennas and screening (both roofto and ground mounted), trash and recycling enclosures and ermanently affixed layground 36

37 n 0 equiment. Major or substantial exterior changes which are roosed in accord with the City s earthquake ordinance shall be reviewed by the review authority for comliance with the rovisions of this Code. The Director of Community Develoment shall determine if a seismic ugrade change is of such minor nature as to not require review authority review. Notwithstanding the above, any remodeling in the HDU Historic District Overlay Zone which is visible from the ublic street or sidewalk immediately adjacent the subject roerty is not exemt from design review, unless the Director of Community Develoment determines that the roosed remodeling is consistent with the general intent of the city-wide Historic District Design Guidelines, and any sulements to those guidelines, or any guidelines for non-residential buildings as may be adoted by the City Council for the Historic District Overlay Zone; b. For all multile residential, commercial or industrial buildings and structures excet for buildings which have been found to be contributing structures in an adoted Historic District Overlay Zone, remodeling rojects including additions which roose less than five hundred (500) square feet of additional floor area, rovided that such remodeling does not involve a change in the architectural style of the building or structure; c. All building additions and alterations to any existing one (1) residential dwelling, where there is only one (1) dwelling on a lot, and the addition or alteration does not cumulatively exceed, within a two (2) year eriod, a seven hundred (700) square foot limit excet for such alterations and additions to buildings which have been found to be contributing structures in an adoted Historic District Overlay Zone; d. A new detached residential garage, or additions or alterations to a detached residential garage, rovided that the garage is comatible with any existing dwelling(s) on the same lot through the use of colors and materials, roof style and general architectural style and treatment and, in an adoted Historic District Overlay Zone, such new detached garages or additions or alterations to detached residential garages that can or will be seen from the ublic street or sidewalk immediately adjacent the subject roerty that are comatible with the Historic District Design Guidelines; e. Wireless telecommunications facilities. Wireless telecommunications facilities ermits shall be reviewed by the review authority named in Section and according to the standards in Chater 30.48; f. Accessory buildings that do not exceed five hundred (500) square feet that are comatible with any existing dwelling(s) on the same lot through use of colors and materials, roof style and general architectural style and treatment or, in an adoted Historic Overlay Zone, accessory buildings that do not exceed five hundred (500) square feet that can or will be seen from the ublic street or sidewalk immediately adjacent to the subject roerty that are comatible with the Historic District Design Guidelines. g. In the MS, Medical Service, zone any additions and alterations to any existing hosital building or related hosital building, and temorary mobile medical trailers are subject to the review of the Director of Community Develoment. 37

38 C 4. In the ROS, Ri R, and Ri zones: a. All new fences and walls constructed of ermitted materials which are comatible with buildings and structures on the roerty, decks with a maximum overall height of eight (8) feet, or decks which are terraced to follow the natural terrain, not visible from other roerties or are otherwise unobtrusive on the hillside and do not adversely imact neighboring roerties, atio covers, trellises, gazebos, and all mechanical equiment screening (both roofto and ground mounted), satellite dish antennas and screening (both roofto and ground mounted) or other similar structures that do not include floor area; b. All new buildings or alterations, or additions to any existing building which roose an increase in floor and/or garage area less than seven hundred (700) square feet and do not roose an additional story and/or a change to a facade directly facing a street which includes an increase in floor area, measured horizontally, greater than two hundred (200) square feet. Alications for building additions shall not cumulatively exceed, within a two (2) year eriod, the seven hundred (700) square foot limit without first receiving review authority aroval; c. Accessory buildings that do not exceed five hundred (500) square feet that are comatible with any existing dwelling(s) on the same lot through use of colors and materials, roof style and general architectural style and treatment or, in an adoted Historic District Overlay Zone, accessory buildings that do not exceed five hundred (500) square feet that can or wifl be seen from the ublic street or sidewalk immediately adjacent the subject roerty that are comatible with the Historic District Design Guidelines; and d. A new detached residential garage, or additions or alterations to a detached residential garage, rovided that the garage is comatible with any existing dwelling(s) on the same lot through use of colors and materials, roof style and general architectural style and treatment and, in an adoted Historic District Overlay Zone, such new detached garages or additions or alterations to detached residential garages that can or will be seen from the ublic street or sidewalk immediately adjacent the subject roerty that are comatible with the Historic District Design Guidelines. 5. Notwithstanding the above exemtions, any new building or structure, or alteration or addition to an existing building or structure determined by staff as being incomatible with the surrounding neighborhood character or with existing buildings or structures on the lot shall not be exemt from design review by a review authority. In making their determination of incomatibility, staff shall consider evidence such as neighborhood redominance of street front setback, roof styles, use of eaves and overhangs, variation in lane (both horizontal and vertical), building location on the site, massing, scale, use of colors and materials and other architectural treatments which, if otherwise ignored, could be injurious to surrounding roerties. The review authorities and staff shall be guided by the intent and urose of Section and shall ensure that any roosed roject will not conflict with the orderly and harmonious develoment of the neighborhood in which it is roosed. Neither the review authorities nor the staff shall discourage originality in site lanning, architecture, landscaing or grahic exression, or mandate any one articular decorative style of develoment. 38

39 6. Notwithstanding the above exemtions, any new walls, fences, decks, atio covers, trellises, gazebos, mechanical equiment, satellite dish antennas and screen or other similar structures, any addition or alteration in the HD Historic District Overlay Zone, regardless of size, which is visible from the ublic street or sidewalk immediately adjacent the subject roerty, are not exemt from design review, unless the Director of Community Develoment determines that the roosed roject, addition or alteration is in accordance with the city-wide Historic District Design Guidelines, and any sulements to those guidelines and any guidelines for non-residential buildings as may be adoted by the City Council for the Historic District Overlay zone. The Director of Community Develoment may determine that routine maintenance and reair in accordance with the Historic District Design Guidelines, any alicable adoted sulements to those guidelines, or any adoted guidelines for non-residential buildings, is exemted from design review. 7. roerties that are listed in the Glendale Register of Historic Resources or the Historic reservation Element. 8. Any roerty in a redeveloment roject area shall be reviewed in accordance with the olicies adoted by the City of Glendale or the Glendale Redeveloment Agency and in accordance with the design standards in the Glendale Municial Code or other adoted design guidelines. 9. Solar energy equiment, as defined in this Title. 10. Community gardens. 11. Accessory dwelling units (ADU5) are exemt from Design Review but must comly with the comatibility standard set forth in Section SECTION 11. follows; Section of the Glendale Municial Code, 1995 is hereby amended as Definitions, A. The following definitions are in alhabetical order: Accessory building or structure. Accessory building or structure means a detached subordinate building or structure the use of which is customarily incidental to that of the main building(s) or use(s) located on the same lot. For the uroses of this Code, buildings and structures which are accessory to a residential use include: cabanas; detached garages; dressing rooms; flagoles; gazebos; the following non-commercial buildings and structures: greenhouses, workshos, recreational buildings and restrooms, saunas, sas and swimming ools, and tennis, addleball, badminton, volleyball and similar courts, together with any enclosures; and other similar accessory buildings and structures determined by the Director of Community Develoment. Accessory buildings and structures do not include accessory living quarters and/or guest house or accessory dwelling units, which are searately defined. Accessory dwelling unit. Accessory dwelling unit means an attached or detached residential dwelling unit which rovides comlete indeendent living facilities for one or more ersons. It shall include ermanent rovisions for living, sleeing, eating, cooking, and sanitation on the same lot as one residential dwelling. An accessory dwelling unit may be ermitted where only one residential dwelling unit exits on the lot. Such unit may not be sold searately from the rimary residence. 39

40 0 0 Accessory living quarters andlor guest house. Accessory living quarters and/or guest house means living quarters within an accessory building for the sole use of ersons emloyed on the remises or members of the household living in the main building. Such quarters have no cooking facilities and are not rented or otherwise used as a searate dwelling. Accessory use. Accessory use means a use customarily incidental to, related and clearly subordinate to a rincial use established on the same arcel, or within the same tenant sace/business, which does not alter the rincial use. Accessory wireless equiment. Accessory wireless equiment means any equiment associated with the installation of a wireless telecommunications facility including but not limited to cabling, generators, air conditioning units and equiment cabinets. Adult business uses. Adult business uses means any adult bookstore, adult hotel or motel, adult motion icture arcade, adult motion icture theater, cabaret, sexual encounter center as defined in Chater Alcoholic beverage sales. Alcoholic beverage sales means the sale, service or consumtion of beer, wine, and/or other alcoholic beverages for on- or off-remises consumtion regardless of whether it is subordinate to another use. Alley. Alley means an unnamed ublic or rivate right-of-way where there are no street addresses as recognized by the Building Official and which is less than or equal to twenty five (25) feet in width in tangent sections, with increased widths ermitted, as required by the City Engineer, to accommodate horizontal curvatures. Alteration or altered. Alteration or altered means any change or modification in the construction of a building or structure other than for reairs. Ambulance services. Ambulance services means the activity, business or service, for hire, rofit, or otherwise, of transorting one or more ersons by ambulance on or in any of the streets, roads, highways, alleys, or any ublic way or lace. This use does not include any services rovided by the Glendale Fire Deartment. Amhitheaters. Amhitheaters means an outdoor structure where the resentation of concerts, lays, films, or other dramatic erformances occur with seating around an arena or central oen sace. Antenna. Antenna means any system of wires, oles, rods, reflecting discs, anels, microwave dishes, whi antennas or similar devices used for the transmission or recetion of electromagnetic waves, including antennas relating to ersonal Wireless Services as defined by the federal Telecommunications Act of 1996, when such system is either external to or attached to the exterior of a structure (building-mounted or roofto-mounted), or ground-mounted. Antennas shall include devices having active elements extending in any direction, and directional beam-tye arrays mounted uon and rotated through a vertical mast or tower interconnecting the beam and antenna suort, all of which elements are deemed to be a art of the antenna. Antenna array. Antenna array means a grou of antenna elements located on the same geometric lane. 40

41 0 0 Antenna classes. Antenna classes means the various classes in which wireless telecommunications facilities and their attendant accessory wireless equiment are categorized based on observed aesthetic imacts. Antenna classes are as follows: Class 1 antenna. Class 1 antennas include the following: 1 Antennas mounted on a building or structure and fully screened using camouflage design techniques so that the antenna anels are not visible to the general ublic. Tyical examles include but are not limited to: building-mounted antennas behind a visually oaque screen designed to ass radio frequency signals that match or comlement existing exterior surfaces of the building, or antennas designed to be incororated within a vertical architectural feature of a building such as a steele, cross, or other integral vertical elements. 2. Antennas mounted behind screens designed to relicate natural features such as rocks and shrubbery and mounted in hillside areas or other natural areas where the screen effectively and fully blends into the surrounding vegetation or toograhy so that the Antenna is not visible. Tyical examles include but are not limited to a monorock or monoshrub, as those terms are defined herein. Class 2 antenna. Class 2 Antenna means an antenna collocated on an aroved or existing wireless telecommunications facility and mounted in the same manner and with the same camouflage design techniques as the aroved or existing wireless telecommunications facility. Class 3 antenna. Class 3 antenna means an antenna no larger than 3 cubic feet and associated equiment system that is a temorary (not more than 90 days) or mobile unit intended to rovide coverage on an interim basis until a ermanent facility to rovide coverage for the same general area is oerational, or in connection with a secial event of a temorary duration (not more than 30 days). Tyical examles include but are not limited to: cell-on-wheels mobile antennas. The definition of Class 3 antenna does not include temorary emergency use antennas ursuant to Section Class 4 antenna. Class 4 antenna means a monoole or an antenna mounted on an existing sorts field light standard or utility lattice tower. Class 5 antenna. Class 5 antenna means an antenna mounted within the cylinder of a flagole or other cylindrical vertical structure that utilizes the diameter tyical of the flagole or other similar vertical element that the antenna relicates. Class 6 antenna. Class 6 antenna means (i) an antenna mounted on a building or structure that is treated with camouflage design techniques, but with only the antenna anels still visible, or (N) an antenna mounted on the exterior of a freestanding structure that has been secifically built for the sole urose of suorting a wireless telecommunications facility using camouflage design techniques that only artially hide or disguise the antenna anels but leave them artially visible. Tyical examles of a Class 6 antenna would include but not be limited to: antennas mounted on the exterior of the building or fixed to the side of some other structure such as an above-ground water storage tank, so that the antenna anels are artially visible but are ainted to match the color of the building or structure, and monoines or monoalms. 41

42 0 0 Class 7 antenna. Class 7 antenna means an antenna mounted on the interior of a freestanding structure for the redominant urose of housing a wireless telecommunications facility antenna. Said structure shall be; comatible with other surrounding structures and facilities; has been built solely for the urose of suorting the wireless telecommunications facility using camouflage design techniques so that the wireless telecommunications facility is fully enclosed within the structure and the antenna anels are not visible. Tyical structures used to enclose the freestanding facilities may include but not be limited to; signs, clock towers, lighthouses, water towers, camanile (bell tower), windmill, or other suitable vertical structures. Antenna suort. Antenna suort means any ole, telescoing mast, tower, triod or any other structure that suorts a wireless communication antenna. Aiaries. Aiaries means a lace where bees and beehives are ket. Aquariums. Aquariums means a lace for the ublic exhibition of live aquatic animals and lants. Arboretums and botanical gardens. Arboretums and botanical gardens means a facility where trees and shrubs are cultivated for exhibition. Arcade establishment, Arcade establishment means any lace of business containing five (5) or more arcade devices or a combination of arcade devices and billiard tables as defined in Section of this Code totaling five (5) or more, exceting there from any billiard establishment containing less than five (5) arcade devices. Artificial turf. Artificial turf means a man-made surface manufactured from synthetic materials which simulate the aearance of live turf, grass, sod, or lawn. Assisted living center. Assisted living center means multi-family congregate housing for the elderly and/or handicaed living in searate dwellings units in which all units, other than those used for the secific urose of managing and oerating the roject, are occuied by a household in which all ersons, or at least one souse of a married coule, is 65 years old or older, or the household is headed by a erson with a hysical imairment which is exected to be of a long duration and which substantially imedes the erson s ability to live indeendently. The assisted living center must have a common eating area and rovide food service to residents. Attached. Attached means any building that has a wall or roof in common with another building or structure and is less than 5 feet at the closest oint. Auditoriums. Auditoriums means a hall which contains a ermanent stage and which is rimarily used for ublic meetings or erformances. Automobile suly stores. Automobile suly stores means stores that sell new automobile arts and accessories. Aviaries. Aviaries means a building in which the rimary use is the keeing of un-caged birds for breeding, and/or dislay. 42
