2 Section 5.1 urpose Statement ARTICLE 5. ZONING DISTRICTS In accordance with the requirement of NCGS 160A-382 that zoning regulation be by districts, the City, as shown on the Zoning Map, is hereby divided into the following districts which shall be governed by all of the uniform use and dimensional requirements of this Ordinance. The purposes of establishing the following zoning districts are: To implement adopted plans; To promote public health, safety, and general welfare; To provide for orderly growth and development; To provide for the efficient use of resources; To facilitate the adequate provision of services. To establish and protect industrial areas. To establish standards for industrial development. Section 5.2 Interpretation Zoning districts have uses specified as permitted by right, uses permitted with supplemental regulations, and conditional uses. Detailed use tables are provided in Section 5.5 showing the uses allowed in each district. The following describes the processes of each of the categories that the uses are subject to: ermitted by Right: Administrative review and approval subject to district provisions and other applicable requirements only. ermitted with : Administrative review and approval subject to district provisions, other applicable requirements, and supplemental regulations outlined in Article 6. 14 [1] Sufficient square feet on second floor to meet accumulated minimum square footage. [2] R-3, R-4, R-5, and R-6 no minimum SF required for second floor. [3] Minimum SF for second floor is 800. [4] All dwellings constructed within residential districts R-1, R-2, and all stick-built and modular homes constructed in zoning districts R-3, R-4, R-5, and R-6 shall have a minimum roof pitch of Five (5) foot rise on a twelve (12) foot horizontal run (or 5" rise on a 12" run) and the gable overhang shall be in accordance with the most recent edition of the North Carolina Residential Code. [5] The fifty (50) foot setback requirements shall be changed to forty (40) feet, front and rear on a seventy (70) by one hundred fifty (150) foot lot in residential districts R-1, R-2, R-3, R-4, and R-6, but not to include waterfront property which will stay fifty (50) feet front and rear. [6] The maximum building height for accessory building in all zoning districts except R-3 shall be 28 feet. Accessory building heights in R-3 shall be limited to 20 feet. [7] The roof pitch for all manufactured homes shall be in accordance with Section 6.6 of this Ordinance. [8] Maximum impervious coverage allowed is 30% of lot size without engineered solution. age 5-14

16 [1] A minimum of one (1) acre (approximately 200 feet frontage by 218 feet deep) is required for all lots being platted on hydric soil, i.e., soil that has a high concentration of water. Land which has been determined by the City s inspection department or the Brunswick County staff on the basis of engineering or other expert surveys, to pose an ascertainable danger to life or property by reason of its unsuitability for the use proposed, shall not be platted for that purpose unless the property owner/subdivider has taken the necessary measures to correct said conditions.
