4 Schedule of restrictive covenants 1 The following are details of the covenants contained in the Conveyance dated 31 May 1916 referred to in the Charges Register:- "And the Purchaser for himself his heirs executors administrators and assigns doth hereby covenant with the Vendors and the persons deriving title under them and also with the person or persons for the time being entitled to the benefit of the restrictions and stipulations hereinafter mentioned or any of them that the Purchaser and the persons deriving title under him will henceforth at all times hereafter observe and perform All and singular the restrictions and stipulations contained in the Schedule hereto Provided always that the Purchaser or other the owners for the time being of the hereditaments hereby conveyed shall as regards any of the aforesaid restrictions and stipulations which are restrictive of the user of the land be liable only in respect of breaches which occur while he or they shall respectively be owner or owners of the land or any part thereof THE SCHEDULE above referred to 1. The Purchaser shall not build more than 2 houses upon any one plot (as originally laid out for building purposes) and each house shall not be of less value than The Purchaser is to erect (if not already erected) and maintain a boundary fence on the side of the land marked T on the plan within the boundary line. 3. No public house tavern beerhouse or house used for the sale of intoxicating liquors shall be built or opened on the land hereby conveyed and no public Elementary School shall be built or opened on the said land under a penalty of 1000 to be recovered by Horace Slade (a predecessor in title of the Vendors) his heirs executors or administrators as and for liquidated damages in respect of each and every breach of this Stipulation." NOTE: The "T" mark referred to in clause 2 above affects the south western boundary of the land tinted blue on the title plan. 2 ( ) The following are details of the covenants contained in the Conveyance dated 29 May 1916 referred to in the Charges Register:- COVENANT by Purchaser with Vendors and persons deriving title under them and also with person or persons for time being entitled to benefit of restrictions and stipulations therein mentioned or any of them that Purchaser and persons deriving title under him would thenceforth at all times thereafter observe and perform all and singular restrictions and stipulations contained in First Schedule thereto PROVIDED ALWAYS that Purchaser or other owners for the time being of hereditaments thereby conveyed should as regards any of aforesaid restrictions and stipulations which are restrictive of user of the land be liable only in respect of breaches which occur while he or they should respectively be owner or owners of land or any part thereof. The Purchaser shall be entitled to connect the drains of any house or building erected on the land coloured green on the plan with the common system of drainage indicated on the plan.
