4 C: Charges Register continued rights of light and air for the benefit of the Retained Land as the Vendor would be entitled to if the property and the Retained Land were in separate ownership and indefeasible rights of light and air as then enjoyed in respect of the Retained Land had been acquired under the Prescription Act 1832 or the Rights of Light Act 1959 Provided Always that the Purchaser (upon giving the Vendor at least 28 days notice in writing and at the cost to the Purchaser) shall have the right with the approval of the Vendor (such approval not to be unreasonably withheld) to vary the route of any such ducts conduits pipes drains channels water-courses services wires and cables or other conducting media within the Property but upon the condition that the Purchaser shall at all times maintain the free and uninterrupted passage and running of water soil gas electricity telephone and other services using all or any such conducting media from and to all the buildings on the Retained Land all such works to be carried out in a good and workmanlike manner with the Purchaser making good any damage caused to the Vendor arising from the variation of any such conducting media (b) The full and unrestricted right at any time hereafter and from time to time to erect or permit to be erected any buildings or other erections and to alter any building or other erection then standing or thereafter to be erected on any part of the Retained Land in such manner as to obstruct or interfere with the passage and access of light and air to any buildings which are then or may thereafter be erected on any parts of the Property and so that all privileges of light and air then or thereafter to be enjoyed of any part of the Retained Land by or in respect of the Property shall be deemed to be so enjoyed by the licence or content of the Vendor and not as of right (c) All such quasi-easements and other rights in the nature of easements (including rights of way) as are then or usually enjoyed by any part of the Retained Land over through or from all or any part of the Property."
