There are also some very specific wer disclosures that you are required by statute to make. For example, wers are required to disclose iformatio o lead based pait i homes built prior to 1978 ad wers must provide a state approved Pool Safety Notice if the property icludes a pool or spa. If the teat asks you about a aspect of the property, you should disclose the iformatio, regardless of whether or ot you cosider the iformatio material. However, a wer does ot geerally have a legal obligatio to correct defects i the property, as log as the defect: (1) does ot reder the property uihabitable; (2) does ot pose a real or potetial threat to the teat s health or safety; ad (3) as log as the existig defects are disclosed. Ay correctio of the defects is a matter of cotract egotiatio betwee you ad the teat. The Arizoa Associatio of REALTRS Residetial Lease wer s Property Disclosure Statemet is desiged to assist you i makig these disclosures ad to avoid iadvertet odisclosures of material facts. You should complete this form by aswerig all questios as truthfully ad as thoroughly as possible. You may use the blak lies to explai ay aswers. If you do ot have the persoal kowledge to aswer a questio, it is importat ot to guess use the blak lies to explai the situatio. The form is divided ito five geeral sectios: (1) wership ad Property: This sectio asks for geeral iformatio about the property, such as locatio, owership ad occupacy. Ay wer, whether or ot that wer has actually lived i the property, should be able to aswer most, if ot all, of the questios i this sectio. (2) Buildig ad Safety Iformatio: This sectio asks for iformatio regardig the physical aspects of the property. You should disclose ay preset problems with the property. You are also asked specifically to disclose ay kowledge of scorpios or other possible pests have ever bee preset o the property. Although may wers will aswer affirmatively to these questios, full disclosure is the best way to avoid complaits. (3) Utilities: You are asked whether the property curretly receives the listed utilities, ad if so, to idetify the provider. The water source ad ay kow iformatio about drikig water problems should also be disclosed. (4) Evirometal Iformatio: A variety of evirometal iformatio is requested. I additio to questios regardig evirometal hazards, you are asked to disclose ay issues relatig to soil settlemet/expasio, draiage/grade, or erosio; oise from the surroudig area icludig airport ad traffic oise; ad ay odors or other uisaces. As a result of recet lawsuits ad potetial health cocers, you are asked specifically if you are aware of ay past or preset mold growth o the property. Mold spores are everywhere ad whe mold spores drop i places where there is water damage or excessive moisture, or where there has bee floodig, mold will grow. Thus, you are asked to disclose ay coditios coducive to mold growth, such as past or preset dampess/moisture, floodig, ad water damage or water leaks of ay kid. (5) Additioal Iformatio: These blak lies provide space for you to provide ay other importat iformatio cocerig the property.
