38 Marketing Program for Exclusive Listings Upon execution of an exclusive representation agreement, the following sequence of events is initiated: Entry of Information into the Marcus & Millichap System Immediately following the execution of an exclusive representation agreement, a marketing brochure is prepared and distributed to every office of Marcus & Millichap via our intranet. The Agent Representing the Seller The salesperson representing the seller is responsible for promoting the property to the sales agents. In addition to promoting the property, the agent representing the seller will minimize the seller s time involvement by screening and presenting offers, showing the property, arranging financing, coordinating inspections and reviewing escrow documents. Initial Buyer Contacts Qualified investors who are actively working with agents of Marcus & Millichap are contacted first. Such clients include investors who are motivated to conclude an exchange by purchasing a larger income-producing property. Advertising When authorized, the property will be discreetly promoted in appropriate publications. The purpose of our advertising is to elicit inquiries and create a pool of qualified investors which increases the probability of our being able to effectively market properties. On-Site Inspections The presentation of the property is done in such a way as to minimize disrupting the tenants, and to maximize the probability of the potential investor recognizing the benefits of the investment. a. Showings are conducted only by prearranged appointments. b. The on-site manager is coached on how to present the property. c. Potential investors will be accompanied by a salesperson. d. Showings are only scheduled for pre-qualified investors. List Price and List Terms Agents of Marcus & Millichap are taught the importance of the fiduciary responsibility that they assume in exclusively representing the owner. Our policies and procedures reward agents for selling at list and encourage them to expand their efforts in persuading buying clients to pay the listed price. Each of our agents believes that the listed price should be looked upon as the selling price, not as the starting point for negotiations. Upon removal of inspection contingencies, every effort will be made to make the buyer s deposit non-refundable in the event of a buyer default. Financing Our agents will assist in securing the financing for the buyer by: a. Identifying the most likely lenders for the particular type of transaction with help from Marcus & Millichap Capital Corporation. b. Preparing the Lender s Package, including the Buyer s Loan Application. c. Assisting the lender s appraisers by showing them through the property, providing rent comparables and providing reasons to the lender as to why the loan requested is reasonable. Other Brokers It is the option of the seller to decide if and when outside brokers will be asked to help market the property. We initially recommend restricting cooperation with other brokers to limit the possibility of a property being over-shopped. If the seller agrees that it is prudent, we encourage cooperation with all qualified brokers during the second half of the listing period. Other Advisors In each market, Marcus & Millichap has developed a list of specialists who understand how to facilitate the close of a transaction and protect the rights of the respective parties. By being able to recommend select attorneys, CPAs, contractors, title personnel, escrow personnel, lenders, insurance agents and management companies, an agent for Marcus & Millichap can work with these other advisers to successfully conclude a transaction. Creation of Value For every property that is offered for sale, there are only a limited number of buyers. That limited number of buyers becomes even more limited as the price of the property approaches the high end of what is considered the market. Marcus & Millichap has demonstrated that it can seek out this very limited investor population if it has the cooperation of the seller in formulating a controlled and promotional marketing effort. When a seller and an agent for Marcus & Millichap enter into an exclusive representation agreement, Marcus & Millichap will commit all its resources and personnel in seeking out and presenting to that investor a complete and promotional summary of benefits of owning that particular income-producing property. We have found that buyers need to be sold and that if a property sells itself, it is probably under-priced.
