4 WORKSHOPS Friday, September 23rd Exam Prep Track 1: Fundamentals of Surveying (FS) & Principles and Practice (PS) Exams 8:00 AM - 5:30 PM This comprehensive and intensive exam preparation course is intended for prospective land surveyors who already possess the skills and knowledge required to qualify to sit for the professional land surveyors licensing exam. The course will cover topics encountered on the NCEES Fundamentals of Surveying exam and NCEES Principles and Practices of Surveying exam. Emphasis will be placed on topics that are included on the NCEES exams but are not encountered regularly in surveying practice. Handouts will be provided in a three ring binder that can be used for the professional land surveyors licensing exam. Participants should bring an NCEES approved Calculator (HP33s or HP35s is recommended). The course will also cover: Exam format Study techniques Study resources Reference material organization Sample exam questions Test taking strategies It is recommended that participants also purchase the following reference materials: Definitions of Surveying and Associated Terms (ACSM) NCEES Sample Questions Fundamentals of Surveying 8 A-Level CPC Over 250 Years of Uncertainty: The Deakins Line and the Virginia/West Virginia and Maryland Boundary Don Teter & David Lee Ingram, RLS 8:00 AM - 12:00 Noon In 1910, the U.S. Supreme Court settled a long-running controversy over the line between Garrett County, Maryland, and Preston County, West Virginia. The position of the Fairfax stone that controls its southern end, and the various surveys of the Deakins line, provides interesting stories from a historical perspective. However, the relevance to surveyors goes well beyond history the case offers insight on senior rights, riparian rights, prescription, acquiescence, and following in the original surveyor s footsteps. Dave Ingram will explain the origin of the boundary between Maryland and Virginia (including West Virginia), early attempts to map and define the boundary, the survey and rulings that settled the Fairfax Stone as the head fountain of the Potomac, and the subsequent Supreme Court rulings affecting the states along the Potomac. Don Teter will discuss the 1788 Deakins survey, relevant land grant surveys, the 1859 Michler survey, and other attempts to pin down the 36-mile long state line, wrapping up with the Supreme Court decision that settled the question. The legal issues with continuing relevance to surveyors will be discussed throughout the presentation. GPS-101- A Look at How We Obtain Accurate Positions from the Satellites William Henning, Professional Land Surveyor 8:00 PM - 12:00 Noon Since even before 1995, when the Global Positioning System operated through our Department of Defense reached full operational status, we have been relying on satellites 12,000 miles away broadcasting signals with less power than a 40 watt light bulb to obtain trustworthy coordinates for our survey and engineering work. This workshop will likely leave you with an awed appreciation of the outstanding science and hardware that were put in place to aid our military forces, and eventually the civil community. Did you realize that without accounting for special and general relativity (thank you Dr. Einstein) we wouldn t be achieving survey accuracies? Did you know that the civil community cheated the system to be able to get better than mapping grade positions? The basics of GPS operation will be discussed, showing how the GPS black box works, and especially what could affect the results that you obtain from the field. Monumental Surveyors Surveyors in Monumental Carvings, and Surveyors Working on Them Don Teter 1:30 PM 5:30 PM Many surveyors are aware that Mount Rushmore depicts Three Surveyors and One other Guy, but most know little about the surveying work of Presidents Washington, Jefferson, and Lincoln. This seminar provides an overview of that work, and also delves into the story of the other guy, Teddy Roosevelt, with an exploration of his opinions about and relationships with surveyors. No trip to Mount Rushmore would be complete without a visit to the nearby 4

5 WORKSHOP Saturday, September 2 Crazy Horse monument, which is still being carved. Following that link, we will examine the interactions between the Rushmore presidents and Native Americans, and between surveyors and Natives, including Crazy Horse. Moving beyond the famous people in the carvings, we will study the surveying methods that have guided the sculpture work. After looking at the techniques Gutzon Borglum used to guide his earlier work at Stone Mountain, Georgia, we will move on to the work at Rushmore. The discussions of methodology will wrap up with a look at how the ongoing work at Crazy Horse is being guided and analyzed by the surveyors of today, using modern technology that includes laser scanning, and how that technology is helping manage and preserve Mount Rushmore. GPS 202- Dealing with Field Conditions to Obtain Accurate Positions William Henning, Professional Land Surveyor 1:30 PM 5:30 PM Building on the GPS-101 workshop, this session will discuss satellite positioning in more depth. Various field methods, such as real-time and post-processed will be contrasted and compared showing what statistical information is important for confidence in the results. Use of tools such as the varieties of the NGS Online Positioning User Service (OPUS) application will be examined by examples and contrasted to other methods we may chose to get our coordinates. Future developments in Global Navigation Satellite Systems (GNSS) will be previewed to see what we can expect in the coming years. Additionally, we will take a look at the new national geometrical and geopotential datums coming on line in about 10 years and see how they will affect our work. We may ask: Is it important that we are aligned to the National Spatial Reference System (NSRS), and how will we access it in the near future? Exam Prep Track 2: Maryland Law and Ethical Issues; Road Grade & Storm Drain Design 8:00 AM - 5:00 PM This comprehensive and intensive exam preparation course is intended for prospective land surveyors who already possess the skills and knowledge required to qualify to sit for the professional land surveyors licensing exam. It is not a course in the basics of road grade and storm drain design or Maryland land surveying law. The course will cover topics encountered on the Maryland state specific Law & Ethical Issues exam and Road Grade and Storm Drain Design exam. Handouts will be provided in a three ring binder that can be used for the professional land surveyors licensing exam. Participants should bring an NCEES-approved calculator (HP33s or HP35s is recommended). The course will also cover: Exam format Study techniques Study resources Reference material organization Sample exam questions Test taking strategies It is recommended that participants also purchase the following reference materials: Definitions of Surveying and Associated Terms (ACSM) Maryland State Highway Administration Drainage Manual 8 A-Level CPC Recent Developments in MD Law Related to Surveying - Part 1 James Demma, Esq. 8:00 AM - 12:00 Noon Recent developments in Maryland s case law concerning mechanics liens, including a discussion of the mechanics lien statute as it applies to the land surveyor, and the important related appeals court cases; and recent developments in Maryland s statutory laws, concerning in particular, the most recently enacted land surveyor s statute of repose, and in general, the history, policy and important case studies on the statutes of repose and limitations, and surveyor s liability. Having a copy of Statutory Laws of Maryland Relating to Land Surveyors (the Red Book ) would be helpful for this discussion. 5

6 S 4th Situational Ethics for the Land Surveyor David Lee Ingram, RLS 8:00 AM - 12:00 Noon INTRODUCTION - Ethical considerations of business and professional practice have always been of concern to surveyors, but in recent years surveyors have seen an increasing emphasis on the need to understand and put into practice positive ethical attitudes. Attempts are made to impose ethics on surveyors from several directions including legal, professional and moral. An understanding of the implications of each is important. PURPOSE - The purpose of this workshop is to promote positive attitudes about ethics for surveyors, stimulate discussion and personal thought about ethics, and develop an understanding of ethical requirements placed on surveyors. TOPICS OF DISCUSSION - There will be several focus areas during the seminar that will involve many different aspects of the surveyors practice. These areas of discussion will include professional practice, business practices, client relations, and personnel relations. All will be examined from different directions of imposition and degrees of importance. Special attention will be directed to the Maryland State Code of Ethics for Land Surveyors. METHODOLOGY - The seminar will lead off with a lecture period to direct the focus of the audience and conclude with an extended session of case studies that will be designed to actively involve the audience. Rather than trying to define ethics in terms of black & white or right and wrong, one of the prime goals of this seminar will be to show that ethics is a complete spectrum of conundrums that require the professional to apply appropriate reasoning to many different situations. HANDOUTS - The handouts will consist of several representative samples of ethical guidelines, various statements about ethics by recognized leaders of the profession & society, and additional references to stimulate thought & provoke a positive attitude about the subject at hand. Early Surveying Techniques and the Evolution of Surveying Equipment David Lee Ingram, RLS 1:00 PM - 5:00 PM A four hour presentation to examine early surveying techniques and the evolution of aids to surveyors including calculating devices, distance measurement equipment, and directional devices. The presentation will consist of a number of PowerPoint slides depicting the above items with comments by the presenter. Questions or additional comments from the audience will be encouraged. A sampling of the topical areas to be discussed include: A. Early methods of performing surveys in the field B. Methods of performing calculations including examples of early mathematical tables, graphic methods, and the evolution of calculating devices and machines. C. Various methods of measuring distance and the evolution of measurement tools. D. Various methods of determining direction and the evolution of directional devices. E. Other miscellaneous tools of the surveyor. The PowerPoint slides will depict actual equipment, text diagrams & tables, original patent diagrams, actual survey work, pictures of surveyors at work, and numerous other items that depict the life and work of the surveyor of yesterday. This seminar has been certified by ACSM and approved by several states as acceptable for continuing education credit. Recent Developments in MD Law Related to Surveying - Part 2 James Demma, Esq. 1:00 PM 5:00 PM A comparison of the Maryland regulations found in COMAR between the location drawing and the boundary survey, including a discussion of the important appeals court cases and statutes on adverse possession, easements, access, encroachments, condominium plats and boundary law, and how these legal topics relate to COMAR. Having a copy of The Law of Land Boundaries for the Maryland Surveyor and Related Materials (the Brown Book ) would be helpful for this discussion. 6

7 MSS 2011 MSS Fall Conference and Exhibition 7 The Instructors James Demma, Esq. has practiced law in Montgomery County, Maryland, for over 30 years. He has extensive practice dealing with boundary disputes, easements, real estate contracts, titles, conveyancing, title insurance, land patents, boundary disputes, quiet title actions and condominium developments. He is also a registered land surveyor in the State of Maryland. He has supervised and conducted over 10,000 real estate settlements for residential, commercial and industrial properties in Maryland and Washington, D.C., including the review of title examinations for those properties. He has represented purchasers, property owners, sellers and lenders in all phases of real estate development, including related litigation of the practice of land surveying. William Henning is a Registered Professional Land Surveyor with over 43 years of active experience in all phases of surveying technology. He has been the project lead for height modernization projects in support of GIS in the eastern U.S., where he planned, observed, adjusted and managed new geodetic network control systems. He has been actively involved with education/outreach to the geospatial community for almost 20 years, presenting over 80 talks and workshops on surveying and GNSS technology. He has 16 years experience working with various GNSS manufacturers real time positioning systems. Mr. Henning is Past President of the American Association for Geodetic Surveying (AAGS) and is an ACSM/AAGS Fellow. He has recently been presented with the NOAA Administrator s Award for outstanding accomplishment in producing real time GNSS positioning guidelines. He is currently employed by NOAA s National Geodetic Survey (NGS) as a Senior Geodesist, where he is helping to develop guidelines and support methodology for real time positioning with state, national and international organizations. David L. Ingram is a Licensed Land Surveyor in three states, having been first Licensed in West Virginia in 1975 and later that year in Virginia. Maryland registration was granted in He is a 1978 graduate of James Madison University holding degrees in Economics and Business Administration. Mr. Ingram is an active member of several state and national professional associations including the Virginia Association of Surveyors, West Virginia Society of Professional Surveyors, Maryland Society of Surveyors, and Surveyors Historical Society. He has held numerous positions in these organizations including Secretary / Treasurer of the National Society of Professional Surveyors for three terms, two terms as a member of the Board of Directors of the American Congress on Surveying and Mapping, multiple terms and past Secretary of the Board of Directors of the Surveyors Historical Society, Chapter President and member of the Board of Directors of the Virginia Association of Surveyors, and he has served as chairman of the Ethics Committee of NSPS for several years & served as a member of the ACSM Ethics Committee for several years. He has served as the ACSM TAC of ABET Commissioner and a program evaluator for the Accreditation Board for Engineering Technology (ABET). Mr. Ingram resides in Mount Crawford, Virginia, where he is the Managing Partner of the firm of Ingram - Hagen & Co., PLC, a firm offering surveying, engineering, land planning, and consulting forestry services. He is married to Regina and has one daughter, Amanda. Don Teter graduated in 1973 from Davis and Elkins College with a B.A. in History and Political Science and has been a West Virginia licensed surveyor since He is a former member of the Board of Directors of the Rich Mountain Battlefield Foundation, and has served as a surveying contractor and consultant for that organization for several years. He also serves as a consultant to Historic Beverly Preservation and the Staunton-Parkersburg Turnpike Alliance. He is a past-president of the West Virginia Society of Professional Surveyors, was Editor of The West Virginia Surveyor for ten years, serves on the Board of Directors of the national Surveyors Historical Society, and is a member of the National Society of Professional Surveyors and the National Museum of Surveying. In 1977 he published Goin Up Gandy, a history of the Dry Fork area of Randolph and Tucker Counties, West Virginia. In the early 1970 s he worked briefly as a reporter and writer for the weekly Allegheny Journal and during the late 1970 s he published numerous local history articles in the weekly Tygart Valley Press. For the past 29 years he has been self-employed surveying mostly rural properties, with a scattering of town and suburban work, and occasional topographic control and minor construction surveying. Don is a member of the licensing board s Complaint Review Committee and is a part-time investigator for the Board of Professional Surveyors.
