4 WORKSHOPS Friday, October 1st Welcome and Keynote Address 7:30 AM - 8:00 AM Curtis Sumner, Executive Director of ACSM will discuss The Evolution of a National Voice ~ The Future of the National Society of Professional Surveyors Water Boundaries Jeffery Lucas 8:00 AM - 5:00 PM This seminar will cover the basic concepts behind water boundaries and how those concepts affect the private practice land surveyor. The history of water boundaries will be discussed including the equal footing doctrine, navigability, submerged lands, mean high tide, high water mark, low water mark, and other issues affecting the identification and location of the boundary between the upland owner and submerged lands belonging to the sovereign. Necessary to any discussion of water boundaries is the commerce power of the Federal Government and the concepts of public and private waters. Non-navigable and man-made waters will also be discussed. The riparian and littoral rights of the upland owner and the problems facing the boundary surveyor will be studied. At least six court cases will be studied on the issue of water boundaries. 8 A-Level CPC EXAM PREP TRACK 1: Fundamentals of Surveying (FS) & Principles and Practice (PS) Exams 8:00 AM - 5:00 PM This comprehensive and intensive exam preparation course is intended for prospective land surveyors who already possess the skills and knowledge required to qualify to sit for the professional land surveyors licensing exam. The course will cover topics encountered on the NCEES Fundamentals of Surveying exam and NCEES Principles and Practices of Surveying exam. Emphasis will be placed on topics which are included on the NCEES exams but are not encountered regularly in surveying practice. Handouts will be provided in a three ring binder which can be used for the professional land surveyors licensing exam. Participants should bring an NCEES approved Calculator (HP33s or HP35s is recommended). TRACK 1 and TRACK 2 will also cover: It is recommended that participants also purchase the following reference materials: Definitions of Surveying and Associated Terms (ACSM) NCEES Sample Questions Fundamentals of Surveying 8 A-Level CPC Modernization of the National Spatial Reference System by the National Geodetic Survey David Doyle 8:00 AM - 12:00 Noon This presentation will detail the efforts of the National Geodetic Survey to enhance the quality of and availability to the high accuracy positioning elements of the National Spatial Reference System as outlined in the 10-year plan published in These include; Enhancements to the On Line Positioning User Service (OPUS), Gravity for the Redefinition of the American Vertical Datum (GRAV-D) (geopotential) datums for the United States targeted to be completed by New ALTA/ACSM Standards for Land Title Surveys Curtis Sumner 1:00 PM - 5:00 PM 4 A-Level CPC The first ALTA/ACSM Standards were promulgated in 1962 and subsequently revised in 1986, 1988, 1992, 1999 and Each revision has resulted in incremental improvements to the Standards. These changes are the result of a broad range of input from the title industry and the surveying and legal professions. This course will preview the proposed changes to the 2011 Standards. 4 A-Level CPC 4

5 WORKSHOPS Saturday, October 2nd The Land Surveyor in Court and Mock Trial Jeffery Lucas 8:00 AM - 5:00 PM This seminar will explore the world of civil litigation and the land surveyor s role as an expert witness. Trial and testimony basics will be discussed in the morning, followed immediately by the mock trial. This seminar requires audience participation. Volunteers will be asked to play the roles of attorneys, landowners, lay witnesses and expert land surveyor witnesses; the seminar leader plays the judge. The remainder of the audience will be divided into jury pools, each with a foreman spokesperson. The of the remaining audience. The trial is loosely based on a combination of several real court cases. The trial will be held and the juries will deliberate. Following deliberation, each jury will then render their verdict, and discuss their reasoning. Each jury will have to field questions from the trial participants and other juries, and defend their verdict. This seminar is designed to demystify the litigation process and explain the rules of engagement that will be used in court. 8 A-Level CPC EXAM PREP TRACK 2: Maryland Law and Ethical Issues; Road Grade & Storm Drain Design 8:00 AM - 5:00 PM This comprehensive and intensive exam preparation course is intended for prospective land surveyors who already possess the skills and knowledge required to qualify to sit for the professional land surveyors licensing exam. It is not a course in the basics of road grade and storm drain design or Maryland land surveying law. The course will cover topics encountered on the Maryland state specific Law & Ethical Issues exam and Road Grade and Storm Drain Design exam. Handouts will be provided in a three ring binder which can be used for the professional land surveyors licensing exam. It is recommended that participants also purchase the following reference materials: Definitions of Surveying and Associated Terms (ACSM) Maryland State Highway Administration Drainage Manual 8 A-Level CPC Ethics for the Land Surveyor Michael Early 8:00 AM - 12:00 Noon This workshop will consist of a review of the Code of Ethics required by the Maryland Board for Professional Land Surveyors and Delaware Board as promoted by NCEES. The presenter will involve all participants in discussions which will generate some very spirited debate. The session will include a pre-test (to test your ethical outlook) and an outcome assessment. Actual situations will be discussed that cover a variety of potential issues. 4 A-Level CPC Best Methods for Real Time GNSS Positioning: A Field Guide William Henning 1:00 PM - 5:00 PM Maryland Surveyors use Real Time GNSS (RT) technology because it s a fast, efficient (labor saving) positioning tool that can yield survey grade coordinates used in a wide variety of applications. But, how good do you feel about the data you are producing with your real time gear? It is all black box technology after all. Are the data collector position quality values displaying precision or are they displaying accuracy and at what confidence level? What position deltas would you expect if you get another shot at a different time or with different weather? What are the factors that might be affecting your data, anyway? Would it be better to use one of the four new real time network (RTN) in Maryland to get your data? Is there any way to have real confidence with a RT established position? As we can see, there are a lot of questions with this technology and the answer to all of them is: It depends. That s why NOAA s National Geodetic Survey (NGS) has produced a set of single base RT user guidelines that recently left draft status to become an official NGS document. This workshop will discuss how you can have real confidence with real time work and go over the important criteria for the surveyor to achieve successful field campaigns based on the guidelines. Topics of discussion for best methods for the field include: constraining local monumentation, DOP, weather conditions, data collection parameters, multipath, how RT works, how RT doesn t of interest. 4 A-Level CPC 5

Please call MSS for more details at Annual Awards Dinner The Instructors David Doyle is a Senior Geodesist in the Spatial Reference System Division, National Geodetic Survey where he is responsible for technical standards for quality control of GPS and leveling field operations programs, and provides technical assistance on geodesy to International, Federal, State and local surveying and mapping agencies. Michael J. Early, PLS, is a professional land surveyor in Delaware, Maryland, Pennsylvania and New Jersey with over 35 years of experience. He has served as the president of the Delaware Association of Surveyors, Inc. ( ) and was a member of the State Board of Registration for Land Surveyors in Delaware. William Henning is a Professional Land Surveyor in Maryland with over 38 years of active experience in all phases of surveying technology. Mr. Henning is currently employed with the National Geodetic Survey, where he is a real time kinematic (RTK) specialist. Jeffery N. Lucas is in private practice in Birmingham, Alabama. He has been in the surveying business since 1976 and a licensed professional since Jeff is a licensed land surveyor registered in Alabama, Florida, Georgia, Mississippi and Tennessee, as well as a licensed attorney and member of the Alabama State Bar. He is a mediator registered on the Alabama State Court Mediator Roster, specializing in adverse possession, boundary disputes, professional liability, real property, and zoning and land use. In addition he has authored many articles on surveying and boundary issues that have been published in state and national professional journals. He currently has a regular monthly legal column in P.O.B. magazine, Traversing the Law, and has been writing for the magazine since Curtis W. Sumner is the Executive Director of the American Congress on Surveying and Mapping headquartered in Gaithersburg, MD.
