3 PAGE PLANNING AND ZONING COMMISSION REGUALR MEETING MINUTES May 8, 2018 A Regular Meeting of the Page Planning and Zoning Commission was held at 5:30 p.m. on, May 8, 2018, in the Council Chambers at City Hall in Page, Arizona. Chair Lyle Dimbatt presided. Vice Chair Bubba Ketchersid, Commissioners Shelley Johnstone, and LeRoy Wicklund were present. Commissioner John Mayes was absent. City Council Liaison, Mark Cormier was present. Chair Lyle Dimbatt called the meeting to order at 5:30 p.m. Staff members present: City Attorney Josh Smith, Planner/GIS Technician Maryam Moeinian, and Community Development Coordinator Robin Crowther. CALL TO ORDER PRIORITY LIST None MINUTES Planning and Zoning Commission Special Meeting-May 1, 2018 Motion made by Vice Chair Bubba Ketchersid to approve the minutes. The motion was duly seconded by Commissioner LeRoy Wicklund and passed upon a unanimous vote. Motion made by Commissioner LeRoy Wicklund to deny CUP The motion was duly seconded by Commissioner Shelley Johnstone and died with a vote of 2-2 with Chair Lyle Dimbatt and Vice Chair Bubba Ketchersid voting against and Commissioners Shelley Johnstone and LeRoy Wicklund voting in favor. The applicant is requesting a Conditional Use Permit to allow an Outdoor Vending Sales in a CBD (Central Business District) Zone. The Parcel is located at 55 S. S Lake Powell BLVD. and described as Page Townsite: Block: 25 Lots: Sixteenth: NE Quarter: NE Section: 31 Township: 41N Range: 09E according to the Coconino County Assessor. ZONING: Central Business District (CBD) This district provides an office, retail and business services area that serves the entire community. Uses are allowed which complement the downtown area and are suited to high traffic areas and a central location. The CBD should also be a focal point for meeting the needs of tourists visiting the community and provide a strong community identity through main street activities. CUP REQUIREMENTS: In granting a Conditional Use Permit for an Outdoor Vending the following items are required in accordance with the Zoning Ordinance. Property has to have established commercial use. Compliant

8 All signs shall be affixed to the vending cart, stand or stall. Compliant, see pictures Vending carts, stands or stalls shall not block a driveway, sidewalk or other point of emergency vehicular access. They have met the requirements of Section 5.6 Outdoor Vending of the City of Page Zoning Ordinance. FINDINGS: 1. The use will not adversely affect the health, safety or general welfare of the public in the general vicinity of the proposed Conditional Use Permit. RECOMMENDATION: 2. The use is compatible with the area and does not negatively affect the properties in the general vicinity. 3. The proposed use complies with the requirements of Section 5.6 Outdoor Vending of the City of Page Zoning Ordinance. Staff recommends approval of an Outdoor Vending Conditional Use Permit for 55 S. S Lake Powell Blvd. with the following 11 conditions:

9 CONDITIONS OF APPROVAL: POSSIBLE MOTIONS: 1. Development and use of the property shall comply with the approved Site Plan Sketch, attached. 2. A City of Page Business Registration shall be maintained for the property. 3. The Conditional Use Permit is valid for one year from the date of approval and must be renewed annually subject to all applicable fees. 4. Violation of any of the requirements of the Conditional Use Permit may result in revocation of the Conditional Use Permit. 5. Any changes to or variation from the approved site plan shall require processing of a new Conditional Use Permit. 6. The applicant shall have a current food handler permit for the operation and all workers. 7. The applicant shall provide the City of Page with a copy of the Health Department Inspection and Certification Report 8. Properly dispose of gray waste water at the Ranch House 9. Provide an accessible table and seating 10. Protect exposed electrical cords from pedestrian trip hazards and vehicle damage 11. Water supply shall not be directly connected to a hose bib or garden hose. Based on the findings noted in the staff report, I move to approve Outdoor Vending Conditional Use Permit (CUP 19-1) for Cody and Jody Talbot, subject to the conditions noted in the staff report. 40 PLANNING DEPARTMENT MEMORANDUM TO: FROM: Planning and Zoning Commission Tom Avant, City Zoning Engineer MEETING DATE: September 11, 2018 SUBJECT: ATTACHMENTS: APPLICANT: REQUEST: LOCATION: Discussion and possible action regarding the Preliminary and/or Final Plat for the Major Subdivision of Lot 5 and 4-A and Tract E of Block 272 (SPR 19-3) Plat Alliant Gas is the Applicant with the City of Page being the property owner. The applicant is requesting a Major Subdivision of Lot 5, the adjustment of Lot 4 and Dedication of Tract E as an extension of Tunnel Access Road. Tunnel Access Road west of Honey Draw Road. ZONING: Planned Development (PD) Public Utility Facilities are allowed in all zones including PD. REVIEW: The recommendation of approval of the Preliminary and Final Plat are to be made to and approved by the City Council. The City Council has already passed an ordinance for the sale of the new Lot 5 to Alliant Gas. Section 412 states that the Planning Commission and/or City Council may hold a public hearing or meeting. The City Council has already passed by Ordinance for the sale of this parcel. The Ordinance had a first and second reading at prior City Council meetings, with no public comments. Therefore, Staff does not believe that a public hearing is needed for this action. As the City and Alliant Gas are moving quickly towards the closing of the sale and the simplistic nature of this project, it is recommended that the Planning Commission take up the Preliminary and Final Plat in the same meeting.

41 Staff has reviewed the submittals and recommends that the Planning Commission recommend approval of the Preliminary and Final Plat to the City Council. FINDINGS: 1. The use will not adversely affect the health, safety or general welfare of the public in the general vicinity of the proposed Conditional Use Permit. RECOMMENDATION: 2. The use is compatible with the area and does not negatively affect the properties in the general vicinity. 3. The proposed Major Subdivision complies with the requirements of Articles 4 (Preliminary Plat) and Article 5 (Final Plat) of the General Development and Subdivision Regulations. Staff recommends that recommendations to the City Council are made to approve both the Preliminary and Final Plats with the following 3 conditions: CONDITIONS OF APPROVAL: POSSIBLE MOTIONS: 1. That final revisions are made to the Plat prior to City Council. 2. That Alliant Gas provide financial assurance that the road improvements will be made to the City Street. 3. Final Deed are provided for review. 1. Based on the findings noted in the staff report, I move to recommend Approval of the Preliminary Plat to the City Council of the Major Subdivision Plat for Lots 5 and 4-A and Tract E of Block 272 of the Page Townsite, subject to the conditions noted in the staff report.
