7 WHEREAS, Mrs. Gertrude Maxwell, formerly of Highland Park, now residing in Palm Beach, Florida, is the President and founder of SAVE-A-PET INC; and WHEREAS, the Village of Skokie was the first suburb to grant financial assistance to SAVE-A-PET; and WHEREAS, SAVE-A-PET, located in Palatine, Illinois, was formed to save animals from extermination and to place strays for adoption; and WHEREAS, August 2, 2012, SAVE-A-PET will celebrate its 41 st Anniversary. NOW, THEREFORE,the Mayor and Board of Trustees of the Village of Skokie, in recognition of these humane principles for which SAVE-A-PET was created, and recognizing the dedication and affirmative action displayed by SAVE-A-PET to the needless destruction of helpless animals, and in further recognition of the fact that many of our Skokie citizens have had their pets returned to them as a result of the SAVE-A-PET Program, do hereby proclaim the month of August as "SAVE-A-PET MONTH" and urge all of our citizens to recognize and support the program. 18 WHEREAS, the reclassification of the Subject Property to the CX Core Mixed-use district in order will make the zoning of the properties along the east and west sides of Skokie Boulevard between Main Street and Oakton Street consistent; and WHEREAS, the Subject Property is surrounded by the CTA Yellow Line Oakton- Skokie station, a short-term municipal parking lot with a proposed walk-up ATM, hightension overhead power lines and towers, and various service/office uses; and WHEREAS, the land use trend in the general area within the past 25 years has been towards commercial and mixed uses along Skokie Boulevard, transportation uses along the CTA Yellow Line between Searle Parkway and Oakton Street, and research and development uses to the west of the Subject Property; and WHEREAS, the Community Development Department staff is supportive of the zoning changes, as it better reflects the intent of the Village s Comprehensive Plan for Sector A; and WHEREAS, the Skokie Plan Commission, at a public hearing duly held on April 19, 2012, at which no interested parties testified, (a) determined that proper notice had been given; (b) made the appropriate findings of fact in the affirmative as required under Section of the Skokie Village Code, and (c) voted to recommend to the Mayor and Board of Trustees that the requested zoning reclassification be granted and the Official Zoning Map of the Village of Skokie be amended to reflect this reclassification; and WHEREAS, the Mayor and Board of Trustees, after public meeting duly held on June 4, 2012, concurred in the aforesaid recommendation of the Plan Commission; NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Skokie, Cook County, Illinois: Section 1: That the Subject Property, legally described above and commonly known as 8120 Skokie Boulevard, Skokie, Illinois, be and the same is hereby classified as CX Core Mixed-Use district. Section 2: That the Official Zoning Map of the Village of Skokie be and the same is amended to reflect this classification. Section 3: That a notice of approval of this Ordinance incorporating the conditions contained herein shall be executed by the owners of the property in writing and duly recorded with the Cook County Recorder of Deeds office at the owners expense. Section 4: That this Ordinance shall be in full force and effect from and after its passage approval and recordation as provided by law. No ATM signs shall be allowed on the site, other than those on the ATM; 3. The ATM shall be operated in compliance with all requirements of the contract with the Village; 4. Any outdoor sound systems shall at all times maintain audio levels that are compliant with the Village Code; 5. All public sidewalks damaged due to the implementation of this plan shall be replaced; 6. The proposed ATM and any alterations shall meet current International Building, Electrical, and NFPA Life Safety Codes and state requirements as amended; 7. All modifications to the ATM elevations, signage, and landscaping shall be subject to the review and approval of the Skokie Appearance Commission; 8. Prior to the issuance of building permits, the ATM owner/provider shall submit to the Planning Division of the Community Development Department the name, address, and telephone number of the company and contact person responsible for the ATM maintenance in compliance with the special use permit; 9. If work is to be performed on public property or if public property is utilized or impacted during construction and/or development, the owner shall provide, or shall cause the ATM owner/provider to provide, the Village of Skokie with a certificate of insurance naming the Village of Skokie as additionally insured for any and all claims related to any and all work. Failure to abide by any and all terms of this Ordinance shall be cause for the Village to initiate hearings to determine whether the subject Ordinance, as well as any applicable business licenses, should be revised or revoked. The ATM owner/provider shall pay all costs related to any hearings conducted as a result of non-compliance with any of the provisions of the enabling ordinance. The costs shall include but not be limited to court reporter fees, attorney fees, and staff time required researching and conducting said hearing. Section 2: That a notice of the approval of this Ordinance incorporating the conditions contained herein shall be executed by the owner of the property in writing and duly recorded with the Cook County Recorder of Deeds Office at the owner s expense. 58 F JPH: 7/2/12 Manager s Report *7/16/12 THIS ORDINANCE MAY BE CITED AS VILLAGE ORDINANCE NUMBER 12-7-C- AN ORDINANCE GRANTING RELIEF FROM CHAPTER 10, ARTICLE I, SECTION OF THE SKOKIE VILLAGE CODE PERTAINING TO THE TEMPORARY SALE AND CONSUMPTION OF LIQUOR ON THE PUBLIC RIGHT OF WAY AND MUNICIPAL PROPERTY WHEREAS, Chapter 10, Article I, Section of the Skokie Village Code prohibits the possession and consumption of liquor on Village of Skokie (hereinafter Village ) owned property; and WHEREAS, the Skokie Park District, in conjunction with various organizations, will be presenting the 6 th Annual Backlot Bash, (hereinafter Bash ) which will take place on August 24, 25, and 26, 2012; and WHEREAS, the Bash is comprised of concerts, games, food and a carnival, which will utilize Village owned parking lots and a portion of the public ways at and around the intersection of Floral Avenue and Oakton Street; and WHEREAS, the Skokie Park District has a temporary permit, authorized pursuant to Section of the Code, for a special event liquor license for the 2 and ½ day event; and WHEREAS, the Skokie Park District intends to restrict and limit the consumption of alcohol to a defined and fenced-in area located on a portion of the public right of way of Oakton Street, the Village Green, and a portion of the Village Hall parking lot (hereinafter Beer Area ), as depicted on the Proposed 2012 Site Plan, attached hereto as Exhibit 1 ; and WHEREAS, the Mayor, in his role as Liquor Control Commissioner and the Corporation Counsel recommend to the Board of Trustees that relief from Section of the Code be granted to the Skokie Park District; NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Board of Trustees of the Village of Skokie, Cook County, Illinois; Section 1: That the Skokie Park District, or its specified agents, are authorized and permitted to sell alcoholic liquor and to allow its consumption within the Beer Area. To the extent necessary, relief from Section of the Code is granted as part of this permission. This permission to sell alcoholic liquor in the Beer Area is subject to the following conditions: 1) The Skokie Park District shall have a Temporary Permit to sell alcoholic liquor from the Local Liquor Commissioner; 2) The Skokie Park District shall have obtained any license, permit or other necessary approvals from the State of Illinois to sell alcoholic liquor; Page 1 of 2 VOSDOCS-# v1- Ordinance Code_Amendment Chapter_10 Temporary_Sale_of_Liquor_on_ROW Backlot_Bash 2012

59 ) The area in which the sale of alcoholic liquor takes place shall be enclosed with a fence, access shall be restricted and consumption shall be limited to the self contained designated area. No consumption or sale of alcoholic liquor shall be allowed on any other publicly owned property or any public right of way; 4) That any and all necessary authorization is granted from local, county or state agencies, for the closure of certain public rights of way including but not limited to Floral Avenue and Oakton Street. 5) The sale of alcoholic liquors shall only take place during the following times: 6:00 p.m. to 10:00 p.m. on August 24, 2012; 11:00 a.m. to 10:00 p.m. on August 25, 2012; and 10:00 a.m. to 8:00 p.m. on August 26, 2012; 6) Only alcoholic liquor sold by the Skokie Park District, or its approved vendor(s), may be sold, consumed or possessed in the designated area of the Beer Area. No alcoholic liquor may be brought in from outside of the designated area; 7) The Skokie Park District, the Youth Foundation and the Village shall enter into an Intergovernmental Agreement upon terms negotiated by the Village Manager, or designee, and the Corporation Counsel, subject to final approval by the Mayor and Board of Trustees; and 8) The Skokie Park District, and its vendor(s), shall comply with the Village Code, and all ordinances, rules and regulations of the Village. Section 2: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. 64 G JPH: 7/16/12 1 st Reading 8/6/12 2 nd Reading THIS ORDINANCE MAY BE CITED AS VILLAGE ORDINANCE NUMBER 12-8-Z- AN ORDINANCE PROVIDING FOR THE REPEAL OF VARIOUS ORDINANCES GRANTING SPECIAL USE PERMITS AND SITE PLAN APPPROVALS AT MULTIPLE LOCATIONS WITHIN THE VILLAGE OF SKOKIE WHEREAS, from time to time, the Mayor and Board of Trustees of the Village of Skokie have adopted various ordinances granting special use permits (hereinafter SUP ) and site plan approvals (hereinafter SPA ) at different locations within the Village of Skokie; and WHEREAS, many of these uses for which the aforementioned SUPs and SPAs were granted no longer exist or were never constructed and therefore should be repealed; and WHEREAS, the Community Development Department staff has conducted a detailed review of SUPs and SPAs. It has been determined that 19 are no longer applicable because the properties are not being used in a manner consistent with the approving ordinance. A brief description of the SUP and SPA Ordinances to be repealed is attached hereto as Exhibit 1 ; and WHEREAS, notices were sent to the property taxpayers of record for the properties affected by the 19 SUP and SPA Ordinances informing them: (i) the ordinance granting their respective SUP or SPA was going to be repealed due to inactivity; and (2) they should contact the Community Development Department if they objected to the repeal. No responses were received; and WHEREAS, the Director of Community Development and the Corporation Counsel recommended to the Mayor and Board of Trustees that the 19 ordinances as outlined in Exhibit 1, granting SUPs and SPAs for uses which no longer exist, or were never constructed, be repealed; and WHEREAS, the repeal of these ordinances will reduce the number of active ordinances resulting in improved enforcement; and WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on July 16, 2012, concurred in the aforesaid recommendation; NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Skokie, Cook County, Illinois: Section 1: That the following Village Ordinances, listed by Village Ordinance Numbers, be and the same are hereby repealed: Page 1 of 4 VOSDOCS-# v1-Ordinance Repeal_of_Inactive_Special_Use_Permit_Ordinances 2012
