Pick up a beach chair at Member Appreciation What s Happening at SDAR August 2015 SDAR Candidate Guide for Directors The online election of SDAR directors who will begin serving in 2016 takes place beginning August 24. Ten directors will be elected to serve two-year terms. Learn more about your participation in the election and get an introduction to the candidates with our Candidate Guide on PAGE 6. BOARD OFFICERS FOR 2016 The officers of the Greater San Diego Association of REALTORS for 2016 were appointed by the Board of Directors at their meeting in July. Joining 2016 President Cory Shepard (Coldwell Banker West) will be President-Elect Bob Kevane (The Kevane Company); Vice President Jim Taylor (Sperry Van Ness/Taylor Investment Properties); and Treasurer Glenn Bennett (Cowles Mountain Realty). Rounding out the 2016 team will be Chris Anderson and Leslie Kilpatrick as Past Presidents. PROTECT YOURSELF: An Overview of Self-Preservation for REALTORS By Jane A. Rheinheimer Looking ahead September is REALTOR Safety Month, and while the topic may seem lackluster, it shouldn t be. REALTORS are engaged in an unexpectedly dangerous profession, and ongoing dialogue about safety and self-preservation is never out of place. In this article, we ll review some of the obvious steps you can take to protect your person from harm, and we ll also examine some emerging potential threats to your business and livelihood. Personal Safety Considerations: Personal safety comes first, always. The nature of your business requires you to regularly engage in potentially risky activities. There is no way to sugar-coat this reality. Within the last year, an experienced REALTOR in Arkansas was callously murdered during the course of a routine property showing. She followed the rules, too, or at least a number of them. She let her husband know exactly where she was going. She locked her purse in the car to avoid having it stolen. She kept her cell phone on her person. Despite all this, something went terribly wrong. The alleged murderer later said that he targeted the victim because she was a woman that worked alone a rich broker. On July 22 of this year, a female real estate agent in Georgia was attacked by a prospective client who turned out to be a man dressed as a woman. The agent met the client at the home and realized quickly that it was a man wearing a dress and a woman s wig. She let the man go inside to view the house alone while she waited for him outside. When the prospect came out of the house, he grabbed the agent and started assaulting her on the porch. Thankfully, she was able to escape her attacker and run into the street to flag down help. In San Antonio, a REALTOR was hit with a tire thumper which her 71-yearold client (a man to whom she had shown several properties previously, by the way) pulled out of his boot. The assailant attacked the agent from behind, hitting her in the back of the head. Miraculously, the agent did not lose consciousness although she was knocked to the floor. Bleeding profusely, the agent started yelling at the client and asking him why he had hit her. He told the agent he needed $4,000. The agent was able to keep the man engaged in conversation for about 45 minutes until she was ultimately able to run out of the house and wave down a car full of teenage boys who apprehended the bad guy. Sadly, the news is full of stories of REALTORS who are robbed, assaulted, held hostage for money, or worse, and the frequency with which these incidents occurs seems to be on the up rise. Think about it your job often requires you to meet strangers, alone, in empty houses, sometimes in unfamiliar neighborhoods. Your business requires you to market extensively, and your photograph and other personal information is likely included in your advertising materials. People know who you are, how successful you are, and what you look like. So even though you ve probably seen this list before, or one like it, take a minute to read through it again. This is not a comprehensive list; we re just trying to hit the highlights here. Remember that you have families, friends, and colleagues who depend on you. You need to make sure you make it home at the end of the day. Quo Vadis? Know where you re going. Always preview properties page 7

2 CHRIS ANDERSON PRESIDENT S PERSPECTIVE 2015 PRESIDENT July s homes sales are stronger than a year ago, according to our month housing statistics report. Even though the month-over-month comparison of total sold listings dropped slightly, I m still very bullish on this housing market. Mortgage applications are still keeping us very busy this summer. Even if interest rates begin to rise gently later this year, I d be optimistic that the market is stable enough to sustain it. Sales of previously owned single-family homes in July were off about 11 percent compared to June, but were 12 percent higher than July of Similarly, condominiums and townhomes saw an 8 percent drop in sales in one month, but were 14 percent higher than July of last year. The median price of existing single-family homes hit $555,000 in July, an increase of nearly 2 percent month over month, while condos/townhomes dipped slightly to $341,000, a decrease of 3 percent in a month. Overall, prices of all properties that sold are up 7 percent for the year. Active listings on the Multiple Listing Service (MLS) are now over 7,200, but the inventory of housing stock remains stagnant at about 2.6 percent. (Five to six months is considered a healthy level.) Homes continue to be snapped up quickly, with escrows closing in an average of 35 days. In July, the zip codes in San Diego County with the most single-family sales were: (Carlsbad Southeast) with (Fallbrook) with (Oceanside North) with (Escondido East) with (Poway) with 56 SDAR s housing statistics are compiled monthly from the Multiple Listing Service (MLS). 3 FROM THE DESK OF THE CEO The American Dream of homeownership is for everyone. That s certainly understood by the Greater San Diego Association of REALTORS and its Housing Opportunities Committee (HOC). While San Diego has the reputation of being one of the least affordable housing markets among the nation s largest cities, that doesn t mean the demand is not there, or that people with limited resources or other barriers don t have the same dream of owning their own home to raise their families. The Housing Opportunities Committee is given the mission of seeking out opportunities to help residents of all means by developing relationships with community-based housing partners and setting up programs to advise residents from all backgrounds about the many avenues available to become homeowners. In recent years, the HOC has worked with national leaders like the Housing Opportunities Collaborative to offer free clinics with REALTOR counselors to assist distressed homeowners who saw dim prospects for keeping their homes due to the crash of the housing market. The HOC performed an important public service by presenting options for them to avoid foreclosure, if possible. The HOC has also partnered with government advocates like State Sen. Joel Anderson for first-time homebuyer workshops. At these events, a panel of experts present education resources to answer questions about becoming purchase-ready and learn about special down payment assistance programs, loan products, grants, and tax credits. Because different segments of the community have specialized questions about their prospects for homeownership, the HOC has also sponsored a first-time buyer workshop that was conducted in both English and Spanish, and a workshop that offered translations services in Asian languages including Chinese, Korean, and Tagalog. In addition, the HOC has conducted several workshops for first-time buyers who are active-duty military or veterans. These events assisted families with information about using their VA home loans in addition to becoming purchase-ready and choosing a REALTOR. Plans are also in the works to present a Senior Housing Fair this fall to assist older residents with decisions about selling their existing home or buying a property to suit their needs and lifestyles in their golden years. Currently, the HOC is coordinating the Better Block project in Barrio Logan, which is a demonstration tool that rebuilds an area using grassroots efforts to show the potential to create a great walkable, vibrant neighborhood center. The project is a living blueprint for the community to envision businesses, landscaping, parks, art, and entertainment for the area. City Councilman David Alvarez, along with residents and volunteers, community leaders, planners, clergy, teachers, students, artists, and businesses, came together recently for a community workshop. Feedback gathered at the workshop will be used by Team Better Block to plan, design and measure the impacts of better block as an alternative to the typical urban planning process. Volunteers will come together over two weekends (October 24th and November 7th) to carry out the plan to build the block. The unveiling and block party will take place on November 13th. 4 PROFESSIONAL DEVELOPMENT Is International Real Estate for You? By Helena Lopez Have you ever considered venturing into the international market? Here is a perspective. From April 2014 through March 2015, approximately 209,000 houses have been sold to foreign buyers estimated at $104 billing in sales. The average home price each foreign buyer purchased was $500,000 compared to the overall U.S. house price of about $256,000. The top five investment countries are Canada, China, Mexico, India and the United Kingdom, and the top four states for international sales are Florida, California, Texas and Arizona. So what are you waiting for? Here is a market niche in need of real estate professionals. What do you say? You cannot speak Chinese, Farsi, or Dutch? You don t have international relatives, friends or connections? No worries. Most international investors and their agents speak English. All you need is an interest, excitement and drive to learn about the global market. May I suggest you start by educating yourself. Fortunately, SDAR and the NAR are here to assist. This month and each year, SDAR offers a one week course called the Certified International Property Specialist (CIPS) course (CIPS, instructed by David Wyant an excellent instructor for the NAR s International Program. The course covers Global Transaction Tools, Global Real Estate and Local Markets, Asia/Pacific, European Markets as well as the Americas. After completion of the course, you will have all the resources at your fingertips to make the connections needed to be successful. If you missed this live course, take the CIPS course through SDAR s online learning at sdar. Learn from the Pro In November, when NAR hosts our International Real Estate Congress, you have the opportunity to meet other CIPS real estate professionals so you can make your connections. Upon completion of the CIPS course you will qualify for the CIPS pinning Ceremony. This is the year to make this decision; next year you will have to fly out of state to get the same results, Save some money and add this interesting designation it will change your perspective on real estate. To understand a bit more of the possibilities that lie ahead, I talked with Erik Noordam, a real estate broker in Amsterdam, the Netherlands. Noordam is a licensed REALTOR in Florida, a CIPS, and owner of Noordam Management B.V. in Amsterdam. He is associated with several well-known real estate companies active in real estate brokerage, appraising, insurance, and property management in the Netherlands and in Florida. As such, he is a member of Florida Association for REALTORS (FAR) and the Amsterdam Real Estate Brokers Association (MVA), the local chapter of NVM. He is President of the Dutch chapter of FIABCI (the International Real Estate Federation) and he is also an international member of the National Association of REALTORS NAR. Noordam deals daily with national and foreign real estate investors with varying investment property portfolios. The Dutch like to invest in Florida for a second home -- he calls them lifestyle clients -- as well as investors in real estate rental properties. He was interested in the international market right from the beginning, after his study of marketing at the HES Amsterdam with a major in international management. He studied financial control (post-graduate), commercial property management (post-graduate) and real estate asset management at the University of Amsterdam. Noordam has lived in the United States, Kenya, and Ecuador and traveled to more than 40 countries. He speaks Dutch, English, German and Spanish. Going the international route was a clear choice for him. When he has a client that is looking for a home in Florida, California, or anywhere else in the U.S., he needs an agent that knows the local market; language is obviously not going to be a problem. San Diego has a large community of Dutch families who are here for several years because of job transfers (engineers working for Sony, Qualcomm, etc). At some point they will return to Holland and are in need of a home. You can refer them to a CIPS designee, like Erik, in the Netherlands and in turn you will receive a referral fee. This same action happens when you are on the CIPS contact list as well as the CIPS exclusive website -- professionals in other countries may contact you to refer a client and in turn you may provide them with a referral fee upon closing of a home sale. Most countries will host international events; some are through their local organizations and some are through private initiatives. What a great way to combine that with your next vacation. The international events help you establish connections to help grow your international market. Pick one or two countries that interest you, get to know the market, complete your certification, establish your contacts, utilize your NAR event. This will be the most interesting NAR Conference and Expo due to its partnership with the Miami Association of REALTORS and our inclusion in the 21st Annual International Real Estate Congress. For the first time, attendees will attend the Congress in Miami from November 8-9 and then in San Diego on November Visit com/international. This is an exciting time to collaborate with international investors, developers and REALTORS. Once you have completed your CIPS designation and you want to maintain an active involvement in San Diego, I highly recommend you consider joining the International Real Estate Committee at the SDAR. 7 page 1 before you show them. This not only makes good business sense from a sales perspective, but it could also save your life. Familiarize yourself with the location of all external doorways and other exits. Make sure you know how to get out of the house quickly if necessary. Make sure you know how to get out of the back yard or the side yards if necessary. Determine if neighboring homes are occupied. If you expect the property to be on the market for a long time, introduce yourself to the neighbors. Also, check to make sure you have cell service at the location. You don t want to wait until there s an emergency to find out you have no coverage. What s the 411? Make it a requirement that before you start showing properties to a new client, you meet them at your office (not at your home office) and have them fill out a prospective client information sheet, including name, address, driver s license information, etc. Also obtain information about their vehicle(s), i.e. make, model, year and plate number. Keep this information in a centralized area that is accessible to office personnel, making sure you treat it with the same safeguards as you treat all other private client information. Note that this does not guarantee your safety - per the story of the agent in San Antonio, above, whose client was already a known quantity. Let your prospect know that this is required office policy. If a prospective client balks at the idea of providing you with this information, do you really want to go out alone and show this person property? No you don t. Don t go out in the dark - If you can possibly avoid it, don t show properties at night. If for some reason you absolutely must show a property after dark, make sure you leave the window shades up, the curtains open, and try to leave some windows open in case you need to yell for help. Turn on as many interior and exterior lights as possible. Put a good-quality portable light on your keychain. Stay in the driver s seat. Take your own car to property showings. If possible, have your client meet you there. Lock your car. Park on the street near the property if possible - in any event don t let your car get blocked in a driveway. If you have to block your client s car in the driveway, that s ok, but it s easier to get away quickly if you are parked on the street. Step away from the bling. Don t wear expensive jewelry to showings. Dress professionally, but simply. Lock your handbag in the trunk of your car to avoid getting robbed. Keep your cell phone and your car keys with you at all times. More about that shortly. Keep your phone charged and your tank full. This sounds rudimentary, but you do not want to be running on fumes or running out of battery should an emergency arise. Keep a car charger in your vehicle. There are also a number of wristlet wallets available that will keep your phone charged and ready to go. Leave the Jimmy Choos at home. When showing property, wear simple clothing and shoes that will not restrict your ability to move. Or run. Your casa is not their casa - Is your home address listed on the CalBRE license information website? Take a minute to check it; you d be amazed how many agents have this very private information hanging out there for all the world to see. If your home address appears on the website, change it to an office address or a P.O. Box address. Now. Be a follower, not a leader. Don t let anyone follow behind you when you are showing a property. To keep control of the situation, you need to adopt the habit of walking behind your prospect at all times. If you re not already accustomed to doing this, practice with a friend until it doesn t feel awkward. Or watch the Property Brothers on HGTV, they ve got it down. Share the love - Before you leave on a showing appointment, make sure that someone in your office knows where you are going (all properties you will be showing), who you are with, and when you expect to return. The client information sheet discussed above in #2 will already have been filled out and left at the office, right? If you are not returning to the office after your showing appointment has ended, at least check in to let them know you are safe and that the appointment is over. Savvy self-defense. Take a Krav Maga or similar self-defense class. Get a pepper spray keychain and learn how to use it (note that California law limits the allowable size of pepper spray containers to 2.5 ounces of active product). Consider downloading a panic button app to your phone - there are a number of products available. Some will alert people in your emergency phone contacts list that you are in trouble. Others will connect automatically with 911. Some will summon help as well as post your location to Facebook and Twitter. That s a wrap. For your primary work vehicle, consider a personalized license plate, magnetic car door signs, or a custom wrap job with your logo on it. The idea is that your vehicle should be easy to spot. Don t over-share. It is not necessary for your prospect to know what your plans are for the rest of the day, when you are going on vacation, or how much your daughter s upcoming wedding is costing you. Keep conversation directed away from the private details of your personal life. No vacancy. Never advertise a property as being vacant. Never advise Familiarize yourself with the location of all external doorways and other exits. Make sure you know how to get out of the house quickly if necessary. a prospect in advance that the property you will be taking them to is vacant. Take a buddy to your open house. Open houses are particularly problematic for a number of reasons. If there is any possible way that you can have another agent assist you with your open house (meaning that there are two agents in the house at all times), that is the best protocol to follow. It s not open til you say it s open. Keep the exterior doors locked while you are setting up a showing or open house - don t let anyone follow you into the property before the showing or open house starts. Out of sight, out of mind. When holding a house open, make sure that the homeowner/tenant has locked up all valuables, medications, personal information (credit card statements, etc.), firearms, laptops and so forth. Nobody loves a crowd. Beware a sudden crowd of people appearing at your open house, particularly at the end of the day. Sometimes bad guys will use this tactic - a couple of them engage you in conversation or otherwise distract you while the rest of the crew goes through the house looking for stuff to steal. No leftovers, please. When your open house is over, make sure everyone is out. Go through each room and make sure no one has stayed behind to surprise you. Lock first, clean second. After you are absolutely certain there is no one left in the house, lock the exterior doors before you start cleaning up after your open house, turning off lights and so forth. You do not want to be surprised by someone entering the home while you are in a back room shutting things down. Protect Your Electronic Self: Like we said, personal safety is always the most important thing. But while we re on the topic of self-preservation, don t forget that there are a lot of bad people out there in cyberspace. Protect your online presence - your social media and your accounts are all susceptible to tampering. You know the basics, but just for kicks we ll review again: Protect your identity at all times. This is a tough one because much of your marketing requires you to be active online. Just make sure you are not inadvertently giving out too much personal or financial information about yourself. Keep your malware and antivirus software up to date. And don t click on those virus warning / malware warning / technical support alerts that pop-up on your screen sometimes. Guess what those are? Use awesome passwords and don t use the same password on all your accounts. Change your passwords at least every six months. Never use a password that doesn t register strong when you create it. 11 GOVERNMENT AFFAIRS And the ipad Winner is Contributors to the REALTOR Action Fund (RAF) between April 1 and July 2 were entered into a sweepstakes to win an ipad Air 2. The winner, Vince Provenzano, president of Pacific Coast Commercial, and president-elect of the Commercial Real Estate Alliance of San Diego, was presented his ipad at the CRASD annual Night at PETCO Park by SDAR President Chris Anderson. The sweepstakes helped the REALTOR Political Action Committee (RPAC) raise over $7,000 and double the number of SDAR members who contribute to help protect the real estate industry. Local, State and National News SDAR s Government Affairs Department and Government Affairs Committee are actively involved in policies that affect local planning, land, building, and infrastructure issues. Currently we are inquiring about the City of San Diego s Climate Action Plan. Several items are of interest, especially strategies to help homebuyers educate themselves on the energy and water usage of a building before purchasing, without adding significant delay or cost to the home-buying process; and the goal to accomplish zero waste by While the plans sound great, in order to protect real estate sellers and buyers we are carefully looking at the details. Our State is Looking for Dollars There are several bills in the legislature trying to raise taxes on gasoline and vehicle registration fees. Governor Brown has called for a special session for a vote on SBX1-1 to raise the gas tax by 10 cents a gallon, diesel by 12 cents a gallon, and vehicle registration an additional $35. The legislature returns from summer recess August 17. AB 1335, raising transfer fees has not passed, it is currently set as an Urgency Bill, allowing it to be on the floor and voted on at any time. Both bills require a 2/3 vote of the Senate and Assembly. Fight Against Homebuyer Tax Contact your member of Congress, while they are on summer recess, and let them know it is not okay to add on a new mortgage tax. The U.S. Senate passed a long-term transportation funding bill that adds a fee until 2026 for all new mortgages to pay for transportation infrastructure. Using real numbers, buyers purchasing a median priced home of $489,560 using a typical conforming loan with a 20% down payment and a 4% interest rate will pay an additional $8,100. This tax on every conforming loan will further erode housing affordability. Call to Action: Stop Patent Trolls Please act today! Tell your U.S. Representative to support H.R. 9, the Innovation Act, to stop patent trolls and protect the real estate industry from frivolous lawsuits. REALTORS, brokerages and multiple listing services across the country receive threatening demand letters and lawsuits alleging patent infringement based on the use of common business tools such as drop-down menus or search alert functions on websites and the scanner function on a copier. These patent trolls buy vague patents and use them to turn everyday business practices into potential lawsuits. H.R. 9 is scheduled for House floor consideration later this summer. Congress must pass this commonsense comprehensive patent litigation reform to protect Main Street businesses and REALTORS from patent troll abuse. Find your Congress Member at htbin/findrep. COMMERCIAL ALLIANCE CRASD s Night at the Ballpark The Commercial Real Estate Alliance of San Diego (CRASD) hit another a homerun with its third annual Night at the Ballpark. The event featured the Padres versus the San Francisco Giants at Petco Park s exclusive VIP Skyline Patio. CRASD members, friends, and families had a VIP view of the game and an all-you-can-eat spread featuring all the favorite ballpark snacks. 12 TECHNOLOGY TOOLS Don t be Scammed by Hackers who Spear Phish By Sam Silverstein During the economic downturn, real estate pros were on high alert for scams by perpetrators who preyed on cash-strapped home owners desperate to stave off foreclosure. Today, a new wave of scammers is breaking into people's accounts to cull information about pending deals. The hackers posing as sellers, title company representatives, or even other real estate agents instruct buyers, agents, or attorneys to transfer funds related to the purchase to accounts belonging to the scammers, potentially swindling victims out of sizable sums. In addition, agents lately have been the target of ruses involving overseas cash "buyers" who ask for bank account information so they can All Phases of Termite Treatment and Repairs supposedly wire deposits. Whatever the technique, hackers are finding ways to trick buyers, sellers, and practitioners by or phone to hand over large amounts of money. In many cases, the heists could have been prevented if the victim had verified that the instructions were legitimate before proceeding. "For anyone involved in real estate transactions, the key is vigilance and making sure that what is happening should be happening," says Peter Bolac, trust account compliance counsel for the North Carolina State Bar, which has received multiple reports of fraud involving wired funds in real estate transactions, including one involving a loss of $200,000. "Everyone involved in handling [transactions] has a duty to be sure their accounts are secure" and the procedures they follow include safeguards to protect clients. Hacking incidents, sometimes referred to as "spear phishing," have disrupted transactions in a number of states, including California, New Jersey, and North Carolina. Any seeking a funds transfer from you or your client should be examined carefully. In one North Carolina case, the hacker used an address that varied from the actual seller s address by a single letter but the discrepancy went unnoticed until after the unsuspecting buyer had sent over money. "The nature of threats on the Internet is that you don t always know whether your systems are getting attacked," says Les Sease, information technology director for Carolina One Real Estate in Charleston, S.C., underscoring the importance of paying close attention to how you manage your accounts. One of the strategies Sease recommends for keeping intruders out of your involves two-step verification, which requires you to log in using a unique code provided by text message or through a mobile app in addition to your password. The advantage of this method is that even if a hacker is able to figure out your password, he or she won t be able to enter your account without also knowing the code. providers such as Google and Yahoo offer this option. Password strength is another factor to consider. Create passwords that are difficult to crack and change them often, says Robert Siciliano, a Bostonbased personal security and identity theft expert. In addition, resist the temptation to use the same password for more than one account, and use passcodes to protect your smartphone and other mobile devices, he says. Some real estate pros say reliance on electronic communications in business has contributed to the slackness. By contrast, the personal relationships that define the real estate industry are a powerful deterrent to fraud. Cameron Platt, owner of Platt Inc. Real Estate, in Oakland, Calif., says, when it comes to preventing information theft, "nothing beats face-to-face and voice contact" between parties in a transaction. Make sure you only use secure wireless networks, no matter where you are and no matter how badly you want/need to get online. If the network isn t secure, don t use it. Your task can wait until you re in a secure place. Don t click on anything suspicious. Trust your instincts. Warren Buffet isn t really trying to send you $1,500, Have a brilliant IT person in your contacts list. Don t cut corners, don t try to save a buck. If you have a problem or think you may have a problem, get someone who knows what they re doing in to look at it before your entire system is compromised. Protect Your Investment in E&O Insurance: While we re talking about safety and protection, let s talk about your E&O insurance. You spend a lot of money on it, right? Don t jeopardize your investment by failing to timely report possible claims. Don t wait until someone files a lawsuit against you. If you have a situation where someone threatens, either verbally or in any kind of writing, to take legal action against you or report you to the BRE, anything like that, report it immediately to your E&O carrier. It doesn t have to be a demand for money in order to qualify as a potential claim within the meaning of your insurance policy. Errors and omissions policies are typically written on a claims-made and reported basis. This requires that the claim be made and reported during the same policy period. For example, if your E&O policy year runs from January 1, 2015 to January 1, 2016, you would need to report all potential claims from that policy year to your carrier by December 31, If you wait until February 1, 2016 to advise your carrier of a potential claim that you had notice of back on December 1, 2015, coverage may well be denied. This is true even if you thought the claim was bogus or would never amount to anything. It is best practice to be over-inclusive in reporting possible claims within the defined reporting period. Keep a log of potential claims throughout the year and make sure they are all reported to the carrier in writing prior to the renewal date. Reporting a potential claim that never materializes should not adversely affect your loss run or your ability to renew coverage. The carrier will likely appreciate the fact that you can be relied upon to report all potential claims. Failure to timely report a claim which results in a denial of coverage, on the other hand, can be catastrophic to your business. Don t jeopardize your investment by trying to handle the problem yourself without notifying your carrier. It s a wild world out there. Be safe.
