The owner bought Lots 41, 43 as one Lot and Lots 45, 47 as another separate lot under the assumption that he would have two buildable lots. Both lots have separate tax account numbers and each lot has separate sewer service that has been brought to each lot. The deed refers to the lots as Parcel 1 and Parcel 2 which seems to indicate that these are 2 separate parcels. 5 VARIANCE LETTER OF EXPLANATION 1220 Hawthorne Street, Shady Side, MD TM 69, P 87, Lots 41 and 43, BK 24, SC A Tax Account Number Edison.Enterprises, LLC (the "Applicant") is requesting variances to allow construction of a single-family detached dwelling on a lot which does not comply with the minimum a?ea requirement and which is contiguous to and under the same ownership as an abutting, unimproved lot. A variance is also requested to the maximum density allowance in the LDA Critical Area classification. Specifically, variances are requested to Code sections (b), and The subject site consists of 5,000 square feet and is located with 50 feet of frontage on the north side of Hawthorne Street, 780 feet west of Linden Street. It is zoned -Residential and has a Critical Area designation oflda. It was acquired by the applicant, together with the abutting 5,000 square foot lot, by Deed dated February 28, 2017, recorded among the Land Records of Anne Arundel County, Maryland in Liber 30741, folio 392. Public sewer is available but not public water, which will be supplied by a private well. In connection with the proposed dwelling, variances of 2,000 square feet to the R-5, 7,000 minimum lot standard, and a variance of 4. 7 dwelling units per acre to the 4 unit maximum density are required. The unique physical condition inherent in this particular lot is its proximity to established dwelling units on similarly sized lots on both sides of Hawthorne Street and in the immediate neighborhood. In fact, much of the development in Avalon Shores, which was platted in 1932, has occurred on two lot combinations with 5, 000 square foot areas. Since public sewer was available at the time of the original Critical Area mapping and, given the extent of residential development existing at that time, the correctness of the LDA designation is questionable. The intensity of that development establishes that denial of the requested variances will deprive the Applicant of rights commonly enjoyed by many other properties in this subdivision. Similarly, no special privilege would be conferred on the Applicant by granting the variances. This property and the immediately abutting property, for which the same variances are sought in a companion case, were acquired by the Applicant as separate building parcels. Both properties were conveyed from Avalon Shores, Inc. to separate owners as separate sites (Lots 41 and 43, Liber 2429, page 203 and Lots 45 and 47, Liber J.H. H. 224, page 215) and, notwithstanding subsequent common ownership, were conveyed thereafter by separate deeds or as separate parcels to reflect the intention to keep them separate. Since common ownership of the parcels coinmenced in 1971, well prior to the Applicant's acquisition of the properties in February, 2017, the variance request is not based on conditions or circumstances resulting from actions by the

6 Applicant. Construction and maintenance of the proposed dwellings will be accomplished with strict regard to current stormwater management requirements and practices. Additionally, since the dwellings will be located some 500 feet from tidal waters and separated from those waters by numerous improved and unimproved properties and the street improvements to Lerch Drive, there will be no adverse effect on water quality or fish, wildlife or plant habitat within the County's Critical Area. As noted, the exceptional circumstances necessary to avoid practical difficulties are present in the number of dwellings constructed on 5, 000 square foot lots in immediate proximity to the Applicant's properties. Development of all four lots as a single building site would be impracticable and infeasible, and would result in a dwelling and property size completely out of character with the surrounding neighborhood. As proposed, construction of two dwellings on lots of 5, 000 square feet, each, will be harmonious with the existing character of the neighborhood and contribute favorably to the appropriate use and development of adjacent properties. Given the location of the properties and the nature of surrounding development, the Applicant's request for relief is justifiable and the variances sought are the minimum necessary to afford that relief.
