4 The Township Committee of the Township of Hillsborough met in a Regular Meeting on the above date at 8:00 PM. Those in attendance were as follows: Mayor Joseph Tricarico, Deputy Mayor Christine Jensen, Second Deputy Mayor John Gelardi, Committeewoman Sonya Martin, Committeeman Robert Mack, Township Attorney Emil Philibosian, and Township Clerk Gail W. McKane. Following Roll Call and Salute to the Flag, Mayor Joe Tricarico advised that notice of this Regular Meeting was given to the Township Clerk, posted on the bulletin board at Municipal Complex, and written notices sent to the Messenger Gazette, Hillsborough Beacon and the Courier News. All notices were given at least 48 hours in advance, and to the extent known, the items on the agenda. DISPOSITION OF MINUTES: Special Hearing Minutes of July 26, 2000 Second Deputy Mayor Jensen offered a motion to approve the Special Hearing Minutes of July 26, 2000 and dispense with the reading of the same. 5 PUBLIC HEARINGS: Ordinance : An Ordinance amending the Code of the Township of Hillsborough, New Jersey, Chapter , Schedule VIII, Through Streets (Designates Hillsborough Road from Route 206 to Amsterdam Drive and Amsterdam Drive form Millstone River Road to Millburn Drive as Through Streets) Chief of Police Robert Gazaway explained that this ordinance would designate these roads as Through Streets in order to make all cross-street intersections stop intersections. He added that all streets intersecting the through street would have a stop. Deputy Mayor Jensen offered a motion to open the public hearing for Ordinance Seconded by Second Deputy Mayor Gelardi. Art Zander, South Branch Road, asked how anyone would know that these were through streets. Attorney Philibosian replied that the "Through Street" designation meant that cross-streets accessing the through street would be signed for stop intersections. Deputy Mayor Jensen offered a motion to close the public hearing for Ordinance Seconded by Committeeman Mack. Second Deputy Mayor Gelardi offered a motion to adopt Ordinance Seconded by Committeewoman Martin. ORDINANCE AN ORDINANCE TO AMEND THE CODE OF THE TOWNSHIP OF HILLSBOROUGH, NEW JERSEY, CHAPTER , SCHEDULE VIII, THROUGH STREETS BE IT ORDAINED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey: 1. That Chapter , Schedule VIII, Through Streets, of the Code of Hillsborough Township, is amended as follows: Name of Street Hillsborough Road Amsterdam Drive Location From U.S. Route 206 to Amsterdam Drive From Millstone River Road (County Route 533) to a point 100 feet North of Millburn Drive 2. That all Traffic Controls shall be installed and maintained in accordance to the manual on uniform traffic control devices 3. This ordinance shall take effect upon adoption and approval by the New Jersey Department of Transportation 5

6 REPORTS FROM COMMITTEE LIAISONS: Mayor Tricarico Mayor Tricarico thanked Senior Citizens Group A that held a picnic last weekend, which the Mayor attended. Deputy Mayor Jensen Deputy Mayor Jensen advised that the Environmental Commission has drafted three separate ordinances that support regulations as suggested by the Township Committee at their August 9, 2000 meeting. She stated that she would be meeting with the chair of the Environmental Commission to review these proposals, and hopefully these would also be discussed at the Work Session of the Township Committee on September 27, Deputy Mayor Jensen asked Chief Gazaway to approach the dais and explain his new request for hiring a replacement crossing guard. Chief of Police Robert Gazaway advised that the Police have one position where a civilian is employed as a crossing guard, at New Amwell and Triangle Roads. He explained that the current crossing guard had just resigned, and the advertising pay rate of $8.00 per hour was not attracting job applicants. Chief Gazaway felt that the pay rate needed to be increased; and since there was only one crossing guard position, he recommended increasing the pay to $16.00 per hour. Deputy Mayor Jensen asked if any security companies could offer this service. Chief Gazaway replied that he researched this option and discovered that most security companies had gotten out of the crossing guard business. He noted that he did find one company; however, upon checking references with a neighboring town, discovered that they were not as reliable as Hillsborough required. Chief Gazaway commented he would rather spend money on a reliable candidate that would consistently show up for the job. Mayor Tricarico remarked that using a Police Officer for this position would be quite expensive. He pointed out that the school board has been under pressure to eliminate courtesy bussing, meaning that many children would now have to find other ways of getting to school, and some would walk requiring additional crossing guards. Mayor Tricarico expressed concern that if the pay rate was increased so dramatically, how would the Township fund additional crossing guards? Chief Gazaway replied that if a situation like that occurred, he probably would not be able to fill those positions, necessitating the use of a security company. Second Deputy Mayor Gelardi stated that under normal circumstances doubling a pay rate would be difficult for him to approve; however, the case has been made that the current salary is way below that required to attract qualified applicants. He expressed concern about the future possibility of additional crossing guards. Deputy Mayor Jensen commented that if a large adjunct force for crossing guards was needed, then a security company might be a better way to manage that. She also suggested the resolution authorizing this change in pay rate state specifically the crossing guard at this intersection. Mayor Tricarico read the resolution and asked if there were any questions from the public on this item. Walter Rodgers, Taylor Avenue, asked how many crossing guards were in question, and Mayor Tricarico answered one. Mr. Rodgers asked how many in Hillsborough, and Mayor Tricarico again answered one. Art Zander, South Branch Road, suggested that the three-hour per day requirement for this job be increased to a four-hour maximum to allow for emergencies. 6

7 Chief Gazaway did not think that was necessary because any emergency would require a police officer to be on the scene. Valerie Chaucer Levine asked which school this crossing served. Chief Gazaway answered that most of the students using this crossing go to the Triangle Road Middle School. Ms. Levine asked if a senior citizen might be a good candidate for this position, and Chief Gazaway said yes. Ms. Levine suggested the senior groups be contacted before the rate increase is approved. Deputy Mayor Jensen asked Chief Gazaway how long he has been trying to recruit for this position. Chief Gazaway explained that the position was advertised last month, and it was mentioned on his most recent television program. He added that Social Services Director Mary Ellen Stahley also passed the word around to senior citizens. Ms. Levine thought that want ads might not be the most effective way to find the right person for this position. Mayor Tricarico calculated that this would be a $4,800 increase and asked Chief Gazaway if he had money in his budget to cover the rest of this year. Chief Gazaway replied that he had sufficient money in this year's budget to cover the increase. Resolution authorizing Chief Gazaway to begin the search for a replacement Crossing Guard at South Triangle and New Amwell Roads at an hourly rate of $16. Committeewoman Martin offered a motion approving the above-referenced resolution. Seconded by Second Deputy Mayor Gelardi. Roll Call: Gelardi-yes; Mack-yes; Martin-yes; Jensen-yes; Tricarico-yes WHEREAS, there exists a vacancy in the position of Crossing Guard at South Triangle and New Amwell Road due to the resignation of Daniel Sughrue; and WHEREAS, Chief of Police Robert Gazaway has requested permission to advertise for a replacement for Mr. Sughrue; and WHEREAS, Chief of Police Robert Gazaway has determined that the current rate of $8 per hour for Crossing Guard has not been able to produce qualified candidates; and WHEREAS, Chief of Police Robert Gazaway recommends that the hourly rate for the Crossing Guard at South Triangle and New Amwell Roads be increased to $16 per hour and that he be authorized to recruit to fill the vacant Crossing Guard position at that rate. NOW, THEREFORE BE IT RESOLVED by the Township Committee of the Township of Hillsborough that the recommendation of Chief of Police Robert Gazaway be and hereby is accepted and approved and the hourly rate for the Crossing Guard at South Triangle and New Amwell Roads is raised to $16 per hour and Chief Gazaway is authorized to begin the search for a replacement. Second Deputy Mayor Gelardi Second Deputy Mayor Gelardi noted that the Cultural and Arts Commission announced the first event in their Sunday Afternoon Concert Series. He stated that the concert featuring One by Six and Brocade would be held on Sunday, October 22 nd from 2:00 to 4:00 PM in the multipurpose room at the Municipal Complex. Second Deputy Mayor Gelardi explained that One by Six was a classical guitar and vocal ensemble and Brocade was a women s ensemble 7

8 performing a four-part a cappella harmony, barbershop style. He added the concert is free and there will be a complimentary art show and refreshments. Committeewoman Martin Committeewoman Martin announced that the Somerset County Park System s Environmental Education Center is sponsoring nature walks at the Sourland Mountain Preserve on September 9 th from 10:00 AM Noon. Committeewoman Martin also noted that 31 new tables were ordered and delivered and are now in use in the multi-purpose room. She also announced that the New Jersey Department of Environmental Protection and the New Jersey Conservation Foundation had purchased 558 acres from Merck and Company, with over 100 of those located within the Hillsborough border. Committeewoman Martin stated that it is understood the purpose of the park is for wildlife preservation, but more information will be available at a later date. Mayor Tricarico interjected, saying this came as a surprise to him when he learned about the purchase in the newspaper. He emphasized that Hillsborough was not informed that any negotiations were taking place, and in fact Hunterdon County had taken the lead on this purchase because most of the Merck property was in Hunterdon County (East Amwell and Raritan Townships). Mayor Tricarico wrote a letter to the Hunterdon County Freeholders, who would oversee the management of the property, asking that whatever occurs on that property, Hillsborough be notified. Committeewoman Martin added that she loved to see land preserved in Hillsborough, especially when someone else pays for it. She was happy to see the state put money into preservation of land in Hillsborough. Committeewoman Martin stated that on September 18 th, there would be another senior citizen celebration, and she would provide more information at a later date. NEW BUSINESS FROM TOWNSHIP COMMITTEE: Mayor Tricarico Mayor Tricarico stated he wanted to explain the breakdown of taxes in Hillsborough. He explained that taxes were composed of four components: municipal taxes, which were decided by the Township Committee; educational taxes, which were controlled by the Board of Education; Somerset County taxes; and Fire District taxes. Mayor Tricarico explained that last year, municipal taxes did not increase, and County taxes were stable as well. He emphasized that the only two segments of local taxes that increased were education and fire taxes. Mayor Tricarico pointed out that these two taxes were voted on and approved by Hillsborough residents. Mayor Tricarico commented that he understood the difficulty some residents have in paying their taxes, but there were only two things that the Township Committee could do to try and control taxes: one, keep the municipal taxes stable, which was done this year; and two slow down residential development. He noted that the force behind these large tax increases was the need for additional school facilities, which is driven by residential development. Mayor Tricarico asserted that the Planning Board is moving towards limiting residential development in the Township, but it must stay focused on that task. He also encouraged Hillsborough s residents to write their State representatives requesting school-funding reform. Deputy Mayor Jensen Deputy Mayor Jensen mentioned that she has seen several comments on the Hillsborough website regarding the way trains blow their whistles at crossings, during the night. She explained that New Jersey law has changed, so if crossings are double-gated on both sides of the road, the train engineers do not have to blow their whistles from 10:00 PM 6:00 AM. Deputy Mayor Jensen stated that she would like the Township Committee to support a petition to the NJDOT to suggest that CSX (the railroad through Hillsborough) upgrade the crossings here so that train whistles are not needed at night. The consensus of the Township Committee was to direct Township Engineer Frank Scarantino to compose correspondence under the Township Committee s signature, reflecting Deputy Mayor Jensen s comments. 8

9 Committeewoman Martin Committeewoman Martin thanked the Senior Group A for the picnic they held, which she attended. BUSINESS FROM THE FLOOR FOR ITEMS ON THE AGENDA: Art Zander, South Branch Road, commented on Consideration Items 20, 21 and 22 (tuition reimbursements). He asked how these reimbursements were budgeted. Mr. Zander also thought the public should be aware of a police officer candidate s training before they are hired. He suggested that in future labor contracts, tuition reimbursement be contingent upon funds being available. Mayor Tricarico commented that he supported any training that would help employees and police officers do a better job, and the Township should be able to pay for that training because it helps all involved. Chief Gazaway explained that he always asks all of his officers what training they intend to take in the upcoming year, in order to budget properly. He added that all officers on the agenda tonight have had prior approval to take these courses. Chief Gazaway explained that the contract requires Township reimbursement for training if officers leave within a specified timeframe. Second Deputy Mayor Gelardi remarked that he was closely involved in the budgeting process for the Township this past year; and it would be rare to have an expenditure not included in the budget. Committeewoman Martin pointed out that the PBA contract is a legally binding document with the Police, and certain conditions must be met before tuition reimbursement is approved. She explained that first, the course taken must be of value to the Township in the employee s job function; and second, the employee must provide evidence that they are attending an approved institution of learning, and classes are scheduled during non-working hours. Committeewoman Martin noted that if the course is toward a degree, the degree must be relevant to their employment, prior approval must be obtained before taking the courses. Finally, there must be sufficient funds in the Township budget to cover the costs. She reiterated that if the employee terminates employment within a specific timeframe, the Township must be reimbursed for the costs of these courses. Committeewoman Martin commented to Chief Gazaway that she supported continuing education for Police Officers. Committeeman Mack asserted that Officer Mike Pineno, requesting tuition reimbursement under Consideration Item 22, was a valuable asset to not only the Police Department but other Municipal Departments as well because of his technical expertise with computers. He noted that Finance Officer Randy Bahr had commented that Officer Pineno was able to save the Township money because he could do work that would otherwise be done by an outside consultant at a rate of $110 per hour. Susanne Ochse, Willow Road, commented on Consideration Item 26 directing the Historic Preservation Commission to develop Historic Standards. As a member of the Historic Commission, she noted that the Township Code does establish standards for the Historic Commission. Ms. Ochse also mentioned that earlier in the year the Historic Preservation Commission had requested either money for a consultant or equivalent staff time to implement a plan to identify and preserve historic homes and structures. Mayor Tricarico explained that a Township Planner would be hired tonight, and an assistant planner would be hired soon afterward so that more staff time would be available for projects such as this. He emphasized that standards need to be developed to allow more homes to be protected, but at the same time not probibit homeowners from using their property. Mayor Tricarico suggested that some open space land be set aside as a depository for older homes that may be moved there as an alternative to destruction. 9

10 Walter Rodgers, Taylor Avenue, asked about Consideration Item 15, the acceptance of Woodfern Road Recreational Complex Phase A, if the drainage problems on Woodfern Road had been addressed. Mayor Tricarico replied that he had not seen any complaints recently. Walter Rodgers stated that he had seen a report in the Star Ledger. Deputy Mayor Jensen suggested that this item be acted upon at a later meeting once Township Engineer Frank Scarantino confirms the matter has been addressed. The consensus of the Township Committee is to table this item and readdress it once a report is received from Township Engineer Frank Scarantino concerning the drainage situation. Mr. Rodgers asked if Consideration Item 25 would create a tree ordinance. Mayor Tricarico replied that the ordinance has not been designed. Deputy Mayor Jensen commented that several model ordinances were being gathered and examined. Louise Nittolo, Brook Drive, asked about Mayor Tricarico s suggestion that an historical depository be used for homes that were in danger of being destroyed. She stated that having all of the historic homes in one location would detract from the character of the Hillsborough. Mayor Tricarico explained that he meant the developer should move the homes that were at risk of being destroyed, with no other option, to this site. Committeeman Mack remarked that the Township Committee and Planning Board learned a great deal from going through the Krame application. He stated the Township's actions were limited due to the lack of appropriate ordinances. Committeeman Mack pointed out there were are many historic homes in the Township, and homeowners may be reluctant to place these homes on the historic register because that would limit their options for the house. He agreed that if a home was going to be destroyed, it would be nice to have an option to place that house on a different site. Ms. Nittolo asked how the Township would acquire such land. Mayor Tricarico explained that the Township has several parcels now that could be used, but open space funds could also be used to purchase new property. Valerie Chaucer Levine commented on the previous discussion, and stated that the home on Route 206 that is going to be destroyed to make room for a car wash would take away from the look of the Township. She thought that some homes that are in danger would be better off in a place where they could be better utilized for public functions. CONSIDERATION: Consideration Item 1: Resolution authorizing the execution of the Detour of Traffic Plan for Replacement of County Bridge B0509, Three Bridges Road Deputy Mayor Jensen offered a resolution authorizing the execution of the Detour of Traffic Plan for replacement of County Bridge B0509, Three Bridges Road. Seconded by Second Deputy Mayor Gelardi. 10

11 WHEREAS, Somerset County finds it necessary to repair Bridge #B0509 located on Three Bridges Road in the Township of Hillsborough; and WHEREAS, the Somerset County Engineer s Office has requested that Hillsborough execute a Detour of Traffic plan regarding this project; and WHEREAS, Township Engineer Frank Scarantino has reviewed the proposed Detour of Traffic plan and finds it to be acceptable; and WHEREAS, Township Engineer Frank Scarantino recommends the Township Committee take action to execute the Detour of Traffic plan for Three Bridges Road and authorize a closure of Three Bridges Road in the vicinity of Bridge #B0509 in excess of 48 hours. NOW, THEREFORE BE IT RESOLVED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey that Three Bridges Road shall be closed to all vehicular traffic at Bridge #B0509, and a Detour of Traffic plan be put into effect; and BE IT FURTHER RESOLVED by the Township Committee of the Township of Hillsborough that the required barricades and signs shall be installed according to the Manual on Uniform Traffic Control Devices. Consideration Item 2: Resolution authorizing the transfer from Planning/Zoning Board Escrows to the Treasurer for period beginning February 1, 2000 and ending April 30, 2000 Committeewoman Martin offered a resolution authorizing the transfer from Planning/Zoning Board Escrows to the Treasurer for period beginning February 1, 2000 and ending April 30, Seconded by Deputy Mayor Jensen. BE IT RESOLVED, that in accordance with the attached six page summary of accrued engineering inspection charges related to the variously indicated projects, a total of $50, is to be transferred from the engineering inspection escrow accounts into the Township general account as indicated on the report. BE IT FURTHER RESOLVED, that each of the project line items has been verified against the Treasurer s Office account records through April 30, 2000 to insure that sufficient funds are available for these transfers for unanticipated revenues. WHEREAS, a request has been received from Hillsborough Radiology Group (Client #196) for the release of remaining escrow posted for Planning Board Review of File 97-PB-12; and WHEREAS, Township Engineer Frank Scarantino certifies that all work related to the Planning Board application has been completed; and WHEREAS, Township Engineer Frank Scarantino recommends the Township Committee take action to release the remaining $45.00 escrow posted, plus accrued interest, and at that time close the account. 19 Consideration Item 14: Resolution regarding a request from C & B Manufacturers for the acceptance of project, Willow Road Baseball Complex, Phase III Committeewoman Martin offered a resolution approving a request from C & B Manufacturers for the acceptance of project, Willow Road Baseball Complex, Phase III. Seconded by Deputy Mayor Jensen. WHEREAS, there has been received a request from C & B Manufacturers to accept Contract 99-12, Willow Road Baseball Complex, Phase III ; and WHEREAS, Township Engineer Frank Scarantino certifies that the project has been satisfactorily completed; and WHEREAS, Township Engineer Frank Scarantino recommends the Township Committee take action on the following: 1. Accept the project, Willow Road Baseball Complex, Phase III. 2. Release payment in full, less a 2% retainage in the amount of $4, Release the Performance Bond and begin the one year maintenance period. 4. Upon submission of acceptable Maintenance Surety, the retainage may be released. NOW, THEREFORE BE IT RESOLVED by the Township Committee of the Township of Hillsborough that the recommendation of Township Engineer Frank Scarantino be and hereby is accepted and approved. Consideration Item 15: Resolution regarding a request from Fischer Contracting for the acceptance of project, Willow Road Baseball Complex, Phase A Earthworks Mayor Tricarico suggested tabling the item until September 13 and a report from the Township Engineer was made regarding Woodfern Road drainage. The consensus of the Township Committee was to table this item. WHEREAS, there has been received a request from Fischer Contracting, Inc. to accept Contract , Woodfern Road Recreation Complex, Phase A - Earthworks and the acceptance of Maintenance Bond No. 400KE8239 from United States Fidelity and Guaranty Company; and WHEREAS, Township Engineer Frank Scarantino certifies that the project has been satisfactorily completed; and WHEREAS, Township Attorney Emil Philibosian has reviewed the submitted Maintenance Bond No. 400KE8239 from United States Fidelity and Guaranty Company in the amount of $37, and finds it to be acceptable; and WHEREAS, Township Engineer Frank Scarantino recommends the Township Committee take action on the following: Accept Maintenance Bond No. 400KE8239 from United States Fidelity and Guaranty Company in the amount of $37, Accept the project, Woodfern Road Recreation Complex, Phase A Earthworks. Approve a final as-built adjusted contract amount of $373, or a $1,500 reduction for the deletion of Item 13, Prime Coat and Item 14, Tack Coat. Release remaining payments and retainage, but retain $15, to guarantee germination and maintain mowing of areas that were seeded late. Release the Performance Bond. 19

20 NOW, THEREFORE BE IT RESOLVED by the Township Committee of the Township of Hillsborough that the recommendation of Township Engineer Frank Scarantino be and hereby is accepted and approved. Consideration Item 16: Resolution regarding a request from Hot Rails, Inc. for the acceptance of project, Skate Park Ramps and Equipment He noted several residents had questioned why bicycles are not allowed in the skate park. Mayor Tricarico explained that the facility had not been designed for bicycles; and, therefore, they would ruin the ramps and equipment. He commented that if a group is interested in a bike park, they should come forward to the Township Committee. Committeewoman Martin invited bicyclists to the Parks Commission meetings as well. Committeewoman Martin offered a resolution approving a request from Hot Rails, Inc. for the acceptance of project, Skate Park Ramps and Equipment. Seconded by Deputy Mayor Jensen. WHEREAS, there has been received a request from Hot Rails, Inc. to accept Contract , Skate Park Ramps and Equipment and the acceptance of Maintenance Bond No from Old Republic Insurance Company; and WHEREAS, Township Engineer Frank Scarantino certifies that the project has been satisfactorily completed; and WHEREAS, Township Attorney Emil Philibosian has reviewed the submitted Maintenance Bond No from Old Republic Insurance Company in the amount of $4, and finds it to be acceptable; and WHEREAS, Township Engineer Frank Scarantino recommends the Township Committee take action on the following: 5. Accept Maintenance Bond No from Old Republic Insurance Company in the amount of $4, Accept the project, Skate Park Ramps and Equipment. 7. Release payment in full ($43,100.00). 8.
