4 The Township Committee of the Township of Hillsborough met in a Regular Meeting on the above date at 8:00 PM. Those in attendance were as follows: Mayor Joseph Tricarico, Deputy Mayor Christine Jensen, Second Deputy Mayor John Gelardi, Committeewoman Sonya Martin, Committeeman Robert Mack, Township Attorney Emil Philibosian, and Township Clerk Gail W. McKane. Following Roll Call and Salute to the Flag, Mayor Joe Tricarico advised that notice of this Regular Meeting was given to the Township Clerk, posted on the bulletin board at Municipal Complex, and written notices sent to the Messenger Gazette, Hillsborough Beacon and the Courier News. All notices were given at least 48 hours in advance, and to the extent known, the items on the agenda. CERTIFICATE OF APPRECIATION: Nick Speciale, Chief Hillsborough Volunteer Fire Company No. 2 Mayor Tricarico read the following Certificate of Appreciation: The Members of the Hillsborough Township Committee do hereby join together to recognize Nick Speciale, Chief, Hillsborough Fire Company No. 2 for your quick and proper action on Monday, October 9, 2000 in response to a fire at Beekman Gardens. Your immediate assessment of the situation and life-saving effort to rescue a woman who was overcome by smoke is to be commended. With the assistance of Hillsborough Fire Companies No. 1 and No. 3 and the Hillsborough Rescue Squad, the fire was brought under control. Your willingness to assist another human being is to be applauded. We extend our appreciation to you for a job well done! Fire Chief Speciale was present to accept this Certificate of Appreciation. DISPOSITION OF MINUTES: Closed Minutes of September 13, 2000 Deputy Mayor Jensen offered a motion to approve the Closed Minutes of September 13, 2000 and dispense with the reading of the same. Seconded by Committeewoman Martin. Regular Minutes of September 27, 2000 Committeeman Mack noted a minor grammatical correction on page six, which was corrected by Clerk McKane. PUBLIC HEARINGS: Ordinance : An Ordinance to amend the Code of the Township of Hillsborough, New Jersey, Chapter , Schedule I, No Parking on South Branch Road Committeewoman Martin offered a motion to open the Public Hearing for Ordinance Seconded by Deputy Mayor Jensen. Art Zander, South Branch Road, felt that people would complain if they were not allowed to park next to the soccer fields (on the road) at the Municipal Complex. He suggested making the portion of South Branch Road from Beekman Lane to East Mountain Road one-way, and angled parking could be installed. Mr. Zander maintained that this would also eliminate a dangerous intersection at South Branch Road and Beekman Lane. Mayor Tricarico stated that all of the on-street parking at these fields caused a potentially dangerous situation with people darting in and out between parked cars and the Municipal Complex parking lots had enough room to accommodate these vehicles. Deputy Mayor Jensen offered a motion to close the public hearing for Ordinance Seconded by Committeewoman Martin. Second Deputy Mayor Gelardi offered a motion to adopt Ordinance Seconded by Committeewoman Martin. ORDINANCE AN ORDINANCE TO AMEND THE CODE OF THE TOWNSHIP OF HILLSBOROUGH, NEW JERSEY, CHAPTER , SCHEDULE I, NO PARKING BE IT ORDAINED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey as follows: 1. That Section , No Parking, Schedule I, of the Code of the Township of Hillsborough is amended as follows: A. Add the following: Name of Street Side Location South Branch Road Both From Marshall Road to the intersection of Clawson Avenue and South Branch Road B. Delete the third, fourth and fifth lines describing eastbound and westbound restrictions on Amwell Road [previously added by Ordinance 93-22] 5
6 C. Revise the three lines regarding South Branch River Road to River Road. 2. That regulatory signs shall be erected and maintained in accordance with the Manual on Uniform Traffic Control Devices 3. This ordinance shall take effect upon adoption and publication according to New Jersey law. ORDINANCE AN ORDINANCE AMENDING CHAPTER 12 (DRUG FREE SCHOOL ZONE MAPS) OF THE MUNICIPAL CODE OF THE TOWNSHIP OF HILLSBOROUGH, COUNTY OF SOMERSET, STATE OF NEW JERSEY SO AS TO AMEND SECTION 12-1 (ADOPTION OF MAPS) FOR THE PURPOSE OF AMENDING THE DRUG FREE SCHOOL ZONE SET OF MAPS TO REPLACE PREVIOUS MAPS WITH NEW COMBINED DRUG FREE ZONE MAPS DEPICTING DRUG FREE SCHOOL ZONES, DRUG FREE PARK ZONES AND DRUG FREE PUBLIC BUILDING ZONES THROUGHOUT HILLSBOROUGH TOWNSHIP BE IT ORDAINED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey that Section 12-1 (adoption of maps) shall have its subsections A thru D deleted in their entirety and replaced with the following: Section I. In accordance and pursuant to the authority of PL 9988c44 (N.J.S.A.2C:35-7) the Drug Free School Zone set of maps produced on or about December 4, 1988 by Chester Kurk, Municipal Engineer, is hereby superseded and replaced with a new set of maps produced on or about September 18, 2000 by Frank S. Scarantino, current Municipal Engineer. Said maps combined depict drug free school zones, drug free park zones and drug free public building zones throughout the Township of Hillsborough at a scale of 1 inch = 1,000 feet as follows: Exhibit A Quad Map 1 Northwest Hillsborough Township Exhibit B Quad Map 2 Northeast Hillsborough Township 6
7 Section II HILLSBOROUGH TOWNSHIP COMMITTEE REGULAR MEETING Exhibit C Quad Map 3 Southwest Hillsborough Township Exhibit D Quad Map 4 Southeast Hillsborough Township Said maps are hereby approved and adopted as an official finding and record of the locations and areas within the municipality of property which is used for school purposes and which are owned by or leased to any elementary or secondary school board and of the area on or within one thousand (1,000) feet of such school property, and the locations and areas within the municipality of property which is used for park and public building purposes and which are owned by or leased by the municipality and of the area on or within five hundred (500) feet of such park or public building property. The maps referenced herein above in Section I are hereby attached hereto as Exhibits A, B, C, and D. The within ordinance shall take effect upon adoption and publication in accordance with New Jersey Law. REPORTS FROM COMMITTEE LIAISONS: Mayor Tricarico Mayor Tricarico noted that this week was Red Ribbon Week. He stressed that while it is important to counsel young people concerning drug and alcohol abuse, setting an example is the best teacher. Mayor Tricarico congratulated Jessica Galli who competed in the Para-lympics in Sydney and won a silver medal. Mayor Tricarico stated that he presented the Mayor s Trophy at the band festival over the weekend and was impressed by the enthusiasm of the children and parents. He commended everyone involved in that festival. Mayor Tricarico noted that the Cultural and Arts Commission s first Sunday afternoon concert was very nice and well attended. Mayor Tricarico reported that earlier this evening Montgomery Township officials met with Hillsborough officials to discuss environmental issues concerning 3M. He stated that Hillsborough and Montgomery share many of the same concerns and hoped that these cooperative meetings could continue in the future. Deputy Mayor Jensen Deputy Mayor Jensen stated that on behalf of Committeewoman Martin, she attended the Postal Advisory Commission meeting, and reported that everything is on schedule with the new Post Office. She noted that the opening will be on November 20 th but the Grand Opening ceremony will be on December 5 th at 10:00 AM. Committeeman Mack Committeeman Mack reported that the Historic Preservation Commission met last night and approved the new Welcome to Hillsborough sign design and paint scheme. He advised that Peter Catelli would present the design to the Township Committee for their approval soon. Committeeman Mack added that the Historic Registry is moving along to meet the charge set forth earlier this year. Dan Bassuk, Chairman of the Historic Preservation Commission, came forward and read a letter thanking the Township Committee for their efforts in preserving the Whitenack House, which is depicted on an historic 1860 Farm Map of Hillsborough. 7

9 Committeewoman Martin HILLSBOROUGH TOWNSHIP COMMITTEE REGULAR MEETING Committeewoman Martin reported that the Veteran s Our Nation s Heroes event was well attended and a success. She stated that at the Somerset County Youth Commission Conference she had the opportunity to attend a seminar conducted by the Hillsborough Teens Against Tobacco Use and the Student Leadership Corps. Committeewoman Martin announced that she and Second Deputy Mayor Gelardi attended a Somerset County Freeholders meeting last week to receive a $20,000 Planning Partnership Grant for the continued planning of the Town Center concept. Committeewoman Martin also attended a Somerset County Parks Commission meeting that same night where they provided a Master Plan update. She noted that currently the County owns over 2,000 acres in the Sourland Mountain region and their projected goal is to own a total of 7,200 acres. Committeewoman Martin added that Somerset County was listed as the sixth most attractive place to live and work in the United States. Committeewoman Martin reported on the recent Joint Facilities Committee meeting and the status of the Township's park renovations. She stated that many user groups were represented at that meeting and all were encouraged to keep off of the fields while the renovations were occurring. Committeewoman Martin announced that on November 20 th the Township Committee was invited to attend a Somerset County meeting on controlling the deer population. NEW BUSINESS FROM TOWNSHIP COMMITTEE: Committeeman Mack Committeeman Mack advised that the Historic Commission is trying to obtain an historical archivist through the Federal Historic Register to develop Hillsborough s historic registry. Second Deputy Mayor Gelardi Second Deputy Mayor Gelardi stated that he would not normally discuss hiring personnel at this time; however, he felt that the public should know that interviews were proceeding for the new Director of Recreation and hopefully a candidate will be chosen in the near future. BUSINESS FROM THE FLOOR FOR ITEMS ON THE AGENDA: Art Zander, South Branch Road, questioned the tuition reimbursement resolutions on the agenda. He asked how many police officers were EMTs, if it was necessary for courses in the Spanish Language to be taken and how a Human Services Degree was useful or job related. Mayor Tricarico replied that he would determine how many officers were EMTs and said that it was necessary to have more Spanish-speaking officers on the police force and said that a degree in Human Services was very relevant to police work. CONSIDERATION: Consideration Item #1: Resolution granting conditional municipal consent for the installation and operation of a cable television system including an open video system by CDC TKR, Inc. 10 Second Deputy Mayor Gelardi offered a resolution granting conditional municipal consent for the installation and operation of a cable television system including an open video system by CDC TKR, Inc. (Cablevision) in the Township of Hillsborough. Seconded by Committeeman Mack. Committeeman Mack said that the Cable Advisory Committee s attorney is still working on the final agreement with Cablevision, and this should be ready soon. WHEREAS, Cablevision Lightpath-NJ, Inc. (Cablevision) a Delaware corporation qualified to do business in New Jersey wishes to install fiber-optic telecommunications facilities in the public rights-of-way of the Township of Hillsborough, by attaching such cable to poles owned by other public utilities located in the public rights-of-way in the Township of Hillsborough; and WHEREAS, Cablevision has sought permission to install such fiber optic facilities in the public rights-of-way of the Township of Hillsborough. Township of Hillsborough, County of Somerset, State of New Jersey as follows: 1. That permission is hereby granted to Cablevision to install fiber optic telecommunications facilities in and over the public rights-of-way subject to the following terms and conditions: A. The cable shall be connected to existing underground conduit and/or utility poles in the public rights-of-way. If any construction is required, it shall be at the sole expense of Cablevision, who shall be required to obtain any and all necessary permits and approvals required by regulations. Provided, however, that no new utility poles shall be constructed or installed in the public rights-of-way without the specific approval of the Board of Commissioners. B. Cablevision shall adhere to all applicable safety requirements in compliance with all applicable Federal, State and Township laws, ordinances and regulations. C. The permission and authority granted hereunder shall be for a fifteen (15) year term. D. Cablevision, its successors and/or assigns shall indemnify, defend and hold the Township harmless from any and all liability for damage to property or injury or death to any person, including but not limited to any payments made under workers compensation law, arising from the installation, construction, reconstruction, repair, operation, disconnection or removal of its fiber optic cable system in and over the right-of-ways located within the Township. E. Cablevision agrees to maintain and keep in force and effect at its sole cost at all times during the term of this consent, sufficient liability insurance naming the Township as an additional insured and insuring against loss by any such claims, suit, judgment, execution or demand in the minimum amounts of Five Million Dollars ($5,000,000.00) for bodily injury or death to any one person, and Five Million Dollars ($5,000,000.00) for bodily injury or death resulting from any one accident or occurrence stemming or arising out to the Company s exercise of its rights hereunder. 2. That a certified copy of this Resolution shall be transmitted to Cablevision and the Township Engineer for reference and information purposes. 10
11 3. That Cablevision is authorized to present the foregoing resolution to the New Jersey Board of Public Utilities for ratification pursuant to N.J.S.A. 48:2-14 if required. Consideration Item #2: Resolution denying a request from Country Classics for the release of Off-Site Contributions from the Paddocks, Phases I & II Deputy Mayor Jensen offered a resolution denying a request from Country Classics for the release of Off-Site Contributions from the Paddocks, Phases I & II. Seconded by Committeewoman Martin. WHEREAS, a request has been received from Country Classics for the refund of offsite contributions from the Paddocks, Phases I and II; and WHEREAS, the Township Engineer, Frank Scarantino, reports that the development known as the Paddocks, Phases I and II, was recently accepted by the Township Committee on January 26, 2000, initiating the two (2) year maintenance period which will run until January 26, 2002; and WHEREAS, the Township Engineer, Frank Scarantino, recommends that the Township Committee deny the request, since project acceptance initiated the five (5) year period in accordance with Section and 77-91(H) of the Development Regulations; Code of the Township of Hillsborough, during which the Township may budget, design and construct various off-site impact mitigations associated with the Paddocks development and other developments in this area, to include but not limited to significant upgrades and reconfiguration such as road widening, curbing, ingress and egress lanes, intersection realignment and potential signalization; and WHEREAS, it is premature at this time to authorize release or refund of off-site contributions; and NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey, that the recommendation of Township Engineer, Frank Scarantino, be and hereby is accepted and approved and the request from Country Classics for the refund of off-site contributions is denied. Consideration Item #3: Resolution to deny a request from Country Classics for the release of Engineering Inspection escrows posted for the Paddocks, Phases I & II Second Deputy Mayor Gelardi offered a resolution to deny a request from Country Classics for the release of Engineering Inspection escrows posted for the Paddocks, Phases I & II. Seconded by Committeewoman Martin. WHEREAS, a request has been received from Country Classics for the release of Engineering Inspection escrows for the Paddocks, Phases I & II; and WHEREAS, Township Engineer Frank Scarantino reports that this project is still on a two-year maintenance schedule; and WHEREAS, Township Engineer Frank Scarantino recommends that the Township Committee take action to deny the request for release of Engineering Inspection escrow. 11
12 Township of Hillsborough, County of Somerset, State of New Jersey that the recommendation of Township Engineer Frank Scarantino be and hereby is accepted and approved and the request from Country Classics for the release of Engineering Inspection escrows for the Paddocks, Phases I & II is hereby denied. Consideration Item #4: Resolution to deny a request from Country Classics 1-G for the release of Engineering Inspection escrows Committeewoman Martin offered a resolution to deny a request from Country Classics 1-G for the release of Engineering Inspection escrows. Seconded by Deputy Mayor Jensen. WHEREAS, a request has been received from Country Classics for the release of Engineering Inspection escrows and cash bonds for a detention basin located in Country Classics, Phase 1-G; and WHEREAS, Township Engineer Frank Scarantino certifies that the project is on a maintenance bond until December, 2001 and will require further inspections until that time; and WHEREAS, Township Engineer Frank Scarantino certifies that the project s scheduled maintenance period ends in April, 2001; and WHEREAS, Township Engineer Frank Scarantino recommends the Township Committee take action to deny these requests until respective maintenance requirements have been completed. Township of Hillsborough, County of Somerset, State of New Jersey that the recommendation of Township Engineer Frank Scarantino be and hereby is accepted and approved and the requests from Country Classics regarding the Phase 1-G detention basin are denied. Consideration Item #5: Resolution accepting deed of dedication from Savare for road widening along Montgomery Road at Block 164, Lot 12 (568 Montgomery Road) Committeewoman Martin offered a resolution accepting deed of dedication from Savare for road widening along Montgomery Road at Block 164, Lot 12. Seconded by Deputy Mayor Jensen. WHEREAS, as a condition of approval for application 99-PB-5-MR, the Savare family must provide Hillsborough Township a deed of dedication for road widening along Montgomery Road in the vicinity of Block 164, Lot 12; and WHEREAS, such a deed has been submitted and reviewed by Township Engineer Frank Scarantino, who finds the deed acceptable; and WHEREAS, Township Attorney Emil Philibosian has also reviewed the deed and finds it satisfactory; and 12
13 WHEREAS, Township Engineer Frank Scarantino recommends the Township Committee take action to accept the deed of dedication from the Savare family for road widening purposes along Montgomery Road.
