1 DELAWARE KNOX MARION MORROW SOLID WASTE DISTRICT Request for Bids for the Purchase of Used 40-Yard Recycling Containers The Delaware, Knox, Marion, Morrow Solid Waste District (DKMM) is accepting bids for the purchase of nine standard closed top, steel, 40 yard roll off containers with a 35% - 65% divide. Each container has four doors with two doors in each compartment. The containers have been used for a dual stream residential recycling program and are no longer needed for the program. The containers will be sold as an entire lot of nine containers at a minimum starting bid of $5,700 (bid option 1) or individually with a minimum starting bid of $700 each (bid option 2). All bids must be submitted on the Bid Form included as Attachment B. All blank spaces on the Bid Form must be completed in full, in ink or typewritten. Any bid may be withdrawn prior to the opening of the responses. Any bid received after the time and date set for the bid opening shall not be considered. All submitted bids must include the Cover Page, included as Attachment A, and the Bid Form provided as Attachment B. DKMM reserves the right to reject any or all bids. DKMM reserves the right to waive any irregularities and technicalities. Receipt and Opening of Bids. Bids will be received on or before November 16, 2018 at 10:00 a.m. at the DKMM Solid Waste District office at which time they will be publicly opened. Bids must be submitted in a sealed envelope labeled CONTAINER BID. Bids must be submitted via postal service or hand delivered to the DKMM office. Faxed and ed bids will not be accepted. The description of the containers is based on the best information available. DKMM makes no warranty, express or implied, as to the description of any of the containers, except as set forth otherwise in this document. The containers were purchased between and have been maintained as needed. Bins are currently in need of maintenance but are in useable condition at this time. Pictures for each available container can be found as Attachment C. The technical specifications that the 40-Cubic yard tub style containers were built are listed below. DKMM makes no representations on the condition and specifications of each individual container. Interested buyers are invited to inspect the containers prior to bidding. Claims for Adjustment. The submission of a Bid shall constitute conclusive evidence that the Bidder has investigated all technical specifications, site inspections, the manner and environment in which the containers will be used and is aware of circumstances, procedures, and requirements affecting the containers to be purchased. The attention of the Bidder is specifically directed to, and Bidder will be conclusively presumed to have read and become familiar with, all available information. No claim for adjustment, and particularly of the fees to be paid by the Bidder, shall be honored. Transportation of Containers. Buyer must provide all of the necessary equipment and labor to remove the containers from the premises at Sim s Brothers Recycling, 1011 South Prospect Street, Marion, Ohio within thirty (30) days of the bid award which is anticipated to be made on December 18, Terms of Payment. Payment of the purchase price must be made in full within fifteen (15) days after the bid award for all containers purchased by Buyer. Payment must be received by DKMM before containers can be removed from the site. Bank certified checks or cash only, no personal checks will be accepted.

3 Failure to Perform. In the event Buyer fails to make payment within fifteen (15) days, or fails to remove containers within the 30-day period, Buyer agrees that Buyer will: lose all right, title and interest which Buyer might otherwise have acquired in and to the containers. Indemnity. Buyer indemnifies DKMM and Sim s Brothers who is storing the containers, and holds DKMM and Sim s Brothers harmless against all liability or loss of all persons for injury, sickness, and/or death and for property damage caused by the containers, except for that solely attributable to DKMM's and/or Sim s Brothers negligence. Warranty. DKMM and Buyer agree that all containers to be sold are sold on an "AS IS, WHERE IS, WITH ALL FAULTS" basis. DKMM MAKES NO REPRESENTATION OR WARRANTY, STATUTORY, EXPRESS OR IMPLIED WITH RESPECT TO THE CONTAINERS INCLUDING MAKING NO WARRANTY THAT THE CONTAINERS WILL BE MERCHANTABLE OR FIT FOR ANY PARTICULAR PURPOSE. THE ONLY WARRANTY OR REPRESENTATION MADE BY DKMM IS A WARRANTY THAT DKMM IS THE OWNER OF THE CONTAINERS. Buyer assumes all risks and liability whatsoever resulting from the possession, use or disposition of the containers. DKMM will have no liability with respect to the containers sold to Buyer, including having no liability for indirect, incidental or consequential damages.
