1 Note to the Owner, Applicant & Agent: The Nye County Planning Department does not accept incomplete Zoning Review Applications. Please see highlighted requirements below PRIOR to submitting. The Zoning Review Application (ZR) has been implemented for the review of projects for compliance to current zoning regulations. We DO NOT check for compliance with any other agencies, County departments, Home Owners Associations (HOA), or private organizations. Your Zoning Review Application may be approved by the Nye County Planning Department; you are still required to ensure your project is in full compliance with any other established requirements of other public or private agencies, departments and organizations. These may include, but are not limited to the following: Covenants, Codes, & Restrictions (CC&R s) (Can be obtained at the Nye County Recorder s office or your Title Company.) Utility Company or other Easement (each utility company must sign off on your site plan, prior to submitting your application) Federal, State, County or Town regulations. Every Zoning Review Application must include the following: Completed Application & Notarized by the Property Owner. Forms of Payment Accepted: Check, Money Order, Cashiers Check, Visa, Mastercard, American Express & Discover. Every Site Plan must be drawn to scale and must include the following: o All existing and proposed structures, additions, buildings, wells, septic tanks and leach fields. o All proposed setbacks and existing dimensions. o All easements, their locations and widths. o All existing and/or proposed right of ways. o Area of disturbance in acres. o North Arrow o Driveways o Streets Proof of ownership (A copy of Deed can be obtained at the Nye County Recorder s office.) Completed Dust Control Plan. Encroachment Permit (if applicable) from the Nye County Public Works Department. An Assessor s Parcel Map (Can be obtained at the Nye County Assessor s office.) Approval letter from utility company regarding the type of service available. (Utility tariff map is viewable on our website or in our office.) Site plans must be drawn to scale, submitted on 8.5 x 11 or 11 x 17 paper, and contain the following information: North arrow, property dimensions, existing and proposed structures/uses, proposed finished floor elevation, setbacks, highest adjacent grade, driveways/sizes and locations, clear-sight zones, drainage facilities, well, septic, leach fields, or public water and sewer, public or private easements for utilities and streets, names of adjoining streets, area of disturbance for dust control, and any other information that is necessary for the Zoning Administrator to evaluate the request. Assessor sketches will not be accepted. For Multi-Family projects of four units or less require the following additional information and must comply with the Development Standards outlined in Article 6 of the Zoning Ordinance: number of bedrooms, size and number of parking spaces, routes of vehicular access, driveway sizes and locations, location of signs, landscaping, trash enclosures with an approval letter from Pahrump Valley Disposal, lighting, group delivery mail boxes, and any other information that is necessary for the Zoning Administrator to evaluate the request. 3. If ownership has recently changed and the property ownership is not the same as shown on the assessor s records, a copy of the grant bargain/sale or quitclaim deed must be submitted. 4. Required if located within the public utility tariff area for water and/or sewer service. 5. If the proposed development is commercial or industrial and not served by the public utility tariff area for water and/or sewer, then the applicant must attach proper verification demonstrating commercial water rights have been applied for and an engineered commercial septic system has been installed. ALL commercial septic systems, installed after January 1, 2007, must be mechanical systems and comply with the Nevada Division of Environmental Protection s standards. 6. The most recent copy of the Assessor s Parcel Map page must be submitted with the application: 7. Encroachment Permit from Nye County Public Works. NCC : Permit Required 8. Dust Control Plan required per NCC : Construction Activities Procedures and Standards for Zoning Review Applications: A. A Zoning Review Application must be submitted to the Planning Department prior to the construction of any building, including the placement of a manufactured home; and any construction that involves modifications or expansion of an existing building; or prior to establishing any other land use which may not require a building permit. B. A Zoning Review Application approval is valid for 180 days from the date of approval, and will expire if not commenced for the proposed use or plan of development for which the Zoning Review was obtained. The Zoning Administrator may extend a Zoning Review Application for good cause. Upon the issuance of a building permit or approval to construct from other federal, state or county agencies the Zoning Review must track along the same expiration timeframes and policies as the building permit or other approval. 5 C. If the property is a corner lot and the proposed plan of development would change the property s current assigned address (addresses are based on the building s street frontage), a separate application to change the address must be approved by the Nye County Planning Department. D. The Nye County Planning Department may have approved your Zoning Review application; however, you must refer to any restrictive covenants (CCR s, Declaration, etc.) of record that may prohibit the proposed use on this lot or which may require adherence to stricter development standards. The Nye County Planning Department does not provide legal or business advice. Any approval issued by the Planning Department is related only to the land use and the proposed development as described on the approved application. You must comply with any and all Federal, State, County or Town regulations that may pertain to your business. There are additional requirements for liquor licensing, fireworks, brothels, gaming, etc. E. A Zoning Review Approval by Nye County Planning Department does not correlate to an approval by any organized Homeowner s Association/Architectural Review Committee. Anyone developing within an area that may be governed by any such organized Homeowner s Association/Architectural Review Committee should contact that organization. F. The Nye County Planning Department may have approved your Zoning Review application; however if you are in the tariff area of a utility company and applying for an Individual Sewer Disposal System (ISDS) on this application, you must contact the utility company and comply with Nevada Administrative Code (NAC) regarding the installation of that ISDS before the actual installation of that ISDS. G. The operation of an ISDS on the property must be discontinued within 90 days after receipt of notice from either Nye County or UICN that sewer service is immediately available to serve the property. Such notice must be sent via U.S. mail to the owner of record. Sewer service must be deemed to be immediately available to the property when the sewer system is within 400 feet of the nearest property line (NAC ) and such facilities can be accessed by a gravity flow line. Structures = (overall length + 20ft) x (overall width + 20 ft) Example A structure 100 x 50 would equal 8400sqft (120 x 70) 2. Trenching for water & Power = 20ft wide x the length. 3. THE COST OF THIS PERMIT IS $75.00, AND AT THE TIME OF PERMIT PURCHASE YOU WILL BE REQUIRED TO PAY THE $1,600 SCHOOL TAX RECENTLY ADOPTED BY THE BOARD OF COUNTY COMMISSIONERS. THE PURPOSE OF THIS PERMIT IS SO THAT THE INSTALLATION CAN BE INSPECTED BY THE BUILDING INSPECTOR TO ENSURE THAT THE INSTALLATION IS IN CONFORMANCE WITH THE SITE / PLOT PLAN; AND THE INSPECTION WILL INCLUDE SETBACKS, ELEVATIONS, ELECTRICAL CLEARANCE, GRADING AND DRAINAGE; AND TO ENSURE THAT THE HOME IS NOT A PRE-HUD HOME (OLDER THAN JULY, 1976), WHICH ARE NOT ALLOWED TO BE INSTALLED EXCEPT IN A MOBILE HOME PARK (an information sheet concerning pre-hud mobile homes is available at the Planning Counter).
