1 CITY OF GARDEN GROVE COMMUNITY AND ECONOMIC DEVELOPMENT DEPARTMENT ACACIA PARKWAY GARDEN GROVE, CA PLANNING DIVISION (714) BUILDING DIVISION (714) ACCESSORY DWELLING UNIT PLAN CHECK SUBMITTAL REQUIREMENTS Notice to Property Owner(s) and Applicants: The plan check process for Accessory Dwelling Units (ADUs) is a 120-day period from the date a complete plan check application is submitted to the Building Services Division to the date permits are issued. ADU plan check reviews, which are not completed within the 120-day period, will be denied. It is the responsibility of the property owner to ensure that a complete ADU application, including plans and supporting documentation, is submitted to the Building Services Division. ADU applications, which do not meet all the minimum development standards and the plan check submittal requirements, will not be accepted for plan check. It is the responsibility of the property owner to ensure that all subsequent plan re-checks are submitted to the Building Services Division within two weeks of receiving corrections. The requirements to submit an ADU project to the City of Garden Grove for plan check review are listed below. Please review the checklist and contact the Planning Division at (714) for questions regarding zoning requirements, or the Building Services Division at (714) for questions regarding plan check requirements. Prior to submitting an ADU application to the City, the property owner/applicant is encouraged to contact the Planning Services Division to verify if the proposed ADU project complies with all applicable zoning requirements. PLEASE PROVIDE ALL OF THE FOLLOWING INFORMATION: Completed and signed Accessory Dwelling Unit Application Submit copy of the legal description of the property Submit reduced copies of the site plan and floor plan on 8-1/2 by 11 Completed Building Plan Check Application Four (4) sets of plans (see Plan Requirement section) Two (2) sets of supporting reports and calculations, including Title 24 (see page 2) If fire sprinklers are required for the ADU, submit five (5) sets of plans ADU Conversion Permit Verification: Submit copies of building permits for the existing structure Verification of sewer capacity with the Water Services Division at (714) If the property is located in the flood zone, comply with all flood zone requirements 1
2 PLAN REQUIREMENTS PLANS SHALL INCLUDE ALL APPLICABLE INFORMATION AS DESCRIBED BELOW Site Plan- The site plan shall be fully dimensioned and drawn to scale, and shall include a north arrow, property lines, a street centerline and/or edge of curb, all existing and proposed buildings, the driveway, and the drive approach. All setbacks and distances between buildings shall be indicated. Also indicate finished floor, finished grade elevations, and drainage flow. Floor Plan- The floor plan shall be complete, fully dimensioned and drawn to a scale of not less than ¼ =1. The use of each room and space must be identified. All walls and partitions shall be clearly identified as proposed, existing to remain, or existing to be demolished. A complete floor plan of the existing residence is required. Roof Plan- Indicate all slopes and roofing materials. Foundation/Floor Framing Plan and Ceiling/Roof Framing Plan- The sizes, spacing, and directions of all framing members shall be identified. Relevant details and specifications shall be provided. Building Cross Section(s)- Provide sections at structurally critical locations and all structural members and connections shall be identified at the section s location, or appropriate details shall be referenced. Elevations- Identify all wall/roof coverings, exterior materials, and building heights. Current Title 24 Energy Compliance Forms (incorporated into plans) Structural Calculations- Provide two sets of structural calculations if the project does not comply with the conventional framing/bracing provisions of the Building Code. Calculations must be stamped and signed by an architect, civil engineer, or structural engineer currently licensed in the State of California. California Green Building Standards (CGBS)- Incorporate all mandatory measures into plans. The property owner shall comply with all provisions of Section of Title 9 of the Garden Grove Municipal Code for Accessory Dwelling Units, including: The property owner shall reside on the property and occupy one of the units. There shall be no short-term rental of either the primary residence or the ADU. The ADU shall be served by the same water, sewer, and other utility connections serving the primary unit, and no separate utility meters will be permitted. There shall be no separate address for the ADU. The ADU shall not require fire sprinklers unless fire sprinklers are required for the primary residence. A land use restriction shall be recorded by the property owner prior to issuance of building permits for the ADU (see example) 2

I/we have applied for approval from the City of Garden Grove (hereinafter City ) to construct an accessory dwelling unit (the Accessory Dwelling Unit or ADU ) on the Property. The size, location, orientation, and floor plan of the Accessory Dwelling Unit are more specifically depicted on the Site Plan and Floor Plan attached hereto as Exhibits A and B, respectively, which Exhibits are incorporated herein by reference. The attributes of said Accessory Dwelling Unit generally include: Type (Check One): Attached Detached Within Existing Structure Size of: (1) ADU sq. ft. (2) Porch/Patio sq. ft. (3) Garage sq. ft. Sleeping Rooms (Check One): Efficiency Studio 1 BR 2 BR Number of Additional On-Site Parking Spaces Required For ADU: Pursuant to the Garden Grove Municipal Code, as a condition to City s issuance of a building permit for said Accessory Dwelling Unit and any associated porch, patio, or garage, I/we do hereby covenant and agree for ourselves, heirs, assigns, transferees and successors, with the City of Garden Grove as follows: 1. That the Accessory Dwelling Unit and any associated porch, patio, or garage shall be designed, constructed, and maintained in a manner consistent with the attributes listed above, the Site Plan and Floor Plan attached hereto, the building permit(s) issued by the City, and the provisions of Subsection (L) of the Garden Grove Municipal Code pertaining to Accessory Dwelling Units, as it may be amended from time to time. 2. That, the Accessory Dwelling Unit shall not be sold or owned separately from the primary dwelling unit, and the Property shall not be subdivided in any manner which would authorize such separate sale or ownership. 3
4 3. That the Accessory Dwelling Unit shall not be rented for a term of less than thirty (30) days. 4. That the required number of parking spaces identified above shall be provided for the Accessory Dwelling Unit at all times, in addition to the required parking spaces provided for the primary dwelling unit. Said parking space(s) may be provided (a) within an approved garage, (b) as tandem parking on the existing driveway, or (c) within the approved setback areas depicted on the Site Plan attached at Exhibit A. 5. That the Accessory Dwelling Unit shall be considered a legal unit only so long as either the primary dwelling unit, or the Accessory Dwelling Unit, is occupied by an owner of record of the Property as his or her principal residence. In the event an owner of the Property shall cease to occupy a unit on the Property, the Accessory Dwelling Unit shall automatically become on-habitable space, shall not be used as a dwelling unit, and shall not be rented or leased for any purpose. This Covenant and Agreement shall run with the land and shall be binding upon ourselves, future owners, their heirs, and successors and assignees and shall continue in effect until and unless approved otherwise by the City of Garden Grove, acting through its City Manager. It is specifically intended that the benefits and burdens of this Covenant and Agreement run with the land. Lack of compliance with this Covenant and Agreement shall be good cause for legal action against the owner(s) of the Property to enforce compliance. If the City is required to bring legal action to enforce this Covenant and Agreement, then the City shall be entitled to its attorney fees and court costs. In the event of any conflict between the provisions of this Covenant and Agreement and the provisions of city, state, or federal law, the provisions of city, state, or federal law shall govern.
