The Planning Act states that a zoning by-law must prescribe permitted and conditional uses for land and prescribe general development requirements. The existing by-law does not prescribe parking requirements for a wide range of multi-family use and is currently limited to row housing with no common parking, multi-family developments for senior citizens or handicapped persons, and requirements for the RMF- Serviced Multi-Family Residential Zone and the RMF-2 Serviced Multi-Family Residential Zone. This By-Law proposes to incorporate landscaping standards that will protect and enhance the natural environment/greenspace. BL P is not site-specific in scope, it affects all multifamily use. Those sites that may not be able to adhere to minimum requirements may seek variance approval in accordance with The Planning Act. The application generally meets the provisions of the Development Plan and Secondary Plan. Therefore the Red River Planning District Office recommends minor amendment prior to Second Reading of By-Law P. A report outlining policy compliance, comments received, analysis, options and recommendations for Council s consideration follow this summary. Page of 5
4 SECTION 2 - INTENT: To amend the RM of West St. Paul Zoning By-law No. 2/99 P to amend Table 5: Parking Space Table to specify the required stalls per unit for multi-family dwelling uses, conduct related housekeeping within the by-law, and to provide required landscaping provisions related to multi-family residential developments. SECTION 3 - BACKGROUND: The purpose of this application is to amend the required parking stalls per residential unit in multi-family dwelling uses. By-law P amended Table 5: Residential Uses to include the requirement of at least 2 parking spaces in the RMF- zone, and at least.5 parking spaces in the RMF-2 zone. Currently, Table 5 requires only parking space per dwelling unit for row dwelling with no common parking area, and parking space per 5 dwelling units for multiple family dwellings for senior citizens or for those needing handicap parking. By-law P originally proposed.5 parking stalls per unit for all multi-family developments, unless otherwise specified. By-law P was then amended, recirculated, and re-advertised to propose 2 parking stalls per unit for all multifamily developments as per the direction of Council. Planning Staff had recommended approval to both.5 and 2 parking stalls. The amendment was appealed and defeated by the Planning District. SECTION 4 CIRCULATION FOR COMMENT This zoning by-law amendment application has been circulated for comments as per The Planning Act to Provincial Departments and adjacent municipalities with instructions to forward any comments to the Red River Planning District prior to the public hearing, and, that no response by the date of the public hearing will be interpreted as having no concerns. The application has been circulated in order to afford Provincial Departments an opportunity to ensure that the application conforms to provincial policies, and to afford adjacent municipalities an opportunity to comment on any negative impacts that the application may have on their municipality. SECTION 5 - ANALYSIS: Section 68 of The Planning Act outlines that a zoning by-law must be generally consistent with the development plan by-law and any secondary plan by-law in effect in the municipality. In this case, the RRPD reviews the intent of the Development Plan and applicable Secondary Plans to determine if the proposal is consistent. The lands that would be typically developed with multi-family within the Municipality are located within the Middlechurch Secondary Plan, which is designated as Settlement Center in the Development Plan. Middlechurch is noted as the fastest growing settlement center in the Planning District. Policy 5 of Settlement Center notes residential areas shall be developed and maintained with a view to creating a high quality of life for residents and a safe and pleasant living environment with high quality public spaces for community service, recreation and alternative transportation facilities such as school sites, parks, playgrounds and the like. Adequate on-site parking is a component of high quality of life and safety for future and adjacent residents. The proposed amendment appears to be in line the Development Plan. The secondary plan by-law specifically states Multifamily development is to include sufficient off-street vehicle parking for residents and visitors (p. 8). Including minimum parking spaces per unit to ensure adequate parking off-street complies with this policy. Page 4 of 5
7 There are no concerns noted by commenting agencies, except for a recommendation from Community & Regional Planning to amend three (3) clauses within the by-law, prior to Second Reading, for the purposes of clarity, as follows:. SECTION 6 OPTIONS : Please be advised that Council has the following options: (a) give the by-law second and third reading; or (b) pass a resolution not to proceed with the by-law. Should there be objection received, Council may not give Third Reading until such time as any objections have been confirmed as required under The Planning Act. SECTION 7 - RECOMMENDATIONS: As already noted, Section 68 of The Planning Act outlines that a zoning by-law must be generally consistent with the development plan by-law and any secondary plan by-law in effect in the municipality. Based on the above-noted information, the proposed zoning by-law amendment conforms to, and is supported by, the Red River Planning District s Development Plan and the applicable secondary plan, and is consistent with The Planning Act. Therefore, staff recommends minor amendment prior to Second Reading for the R.M. of West St. Paul Zoning By-law Amendment No P. cc: MR CRPB Page 5 of 5
8 RM OF THE RM OF WEST ST. PAUL BY-LAW NO P BEING A BY-LAW OF THE RM OF WEST ST. PAUL TO AMEND THE RM OF WEST ST PAUL ZONING BY-LAW NO. 2/99P, AS AMENDED. WHEREAS Section 80() of The Planning Act, and amendments thereto (the Act ) provides that a Zoning By-Law may be amended; AND WHEREAS it is deemed necessary and expedient to amend the RURAL MUNICIPALITY OF WEST ST PAUL ZONING BY LAW 2/99 P, as amended; NOW THEREFORE, the Council of the RM of West St. Paul, in a meeting duly assembled, enacts as follows:. Add to the General Provisions under Section 3.6 Landscape Features the following: Landscaping in Residential Zones (except for Single Housing Dwelling or Two Housing Dwelling) Landscaping in Multi-Family Residential Zones: A landscaping plan is required and no landscaping work shall be commenced unless the landscaping plan is approved by the Designated Officer A landscaping plan shall contain the following information for the site and adjacent boulevards: a) all physical features, existing or proposed, including vegetation, berm contours, walls, fences, outdoor furniture and fixtures, surface utilities, garbage & recycling collection, and paving; b) all shrubs and trees, whether existing or proposed, labelled by their common name, botanical name, and size; and c) a description of the compatibility of all physical features, existing or proposed, with adjacent sites Notwithstanding the provisions of Section (b) above, the Designated Officer may consider an application if, in the Designated Officer s opinion, the development is of such a nature as to enable the decision to be made on the application without all of the information In the event that planting material required in an approved development is inappropriate or fails to survive, the Designated Officer may allow or require alternative materials to be substituted The owner shall be responsible for landscaping and proper maintenance. The Designated Officer may require, as a condition of approval, that the applicant provide an irrevocable letter of credit in the amount of percent of the estimated landscaping cost, the condition of the said irrevocable letter of credit being that if the landscaping is not completed in accordance with this By-law and the plan within one growing season after the completion of the development, then the amount required to complete the landscaping shall be paid to the Municipality from the said irrevocable letter of credit Where landscaping is required to be provided on a site in any residential zone, trees shall be provided on the basis of a minimum one tree for each 4.8 sq. m. ( sq. ft.) of any required yard at grade. Page of 4
9 Where landscaping is required to be provided on the site of a residential zone all required yards and all open spaces, excluding parking spaces, onsite circulation, outdoor storage, display and service areas, shall be landscaped in accordance with the landscaping plan. This shall include appropriate screening of utility facilities All plant material required shall be hardy to the location on the site where they are planted. The horticultural standards of the Canadian Nursery Trades Association shall be used as a reference in selecting plants Deciduous trees shall be at least mm. (2.00 in.) caliper when planted and evergreen trees shall have a minimum height of 2.44 m. (8.00 ft.) when planted Plant materials located within 6.0 m. (20.00 ft.) of a public street must be of a salt- tolerant species The owners shall maintain all landscaping and buffering areas required by this By-law free from refuse and debris and with a neat appearance, and shall maintain plant materials including lawns and naturalized landscaping, in a healthy condition. The owner shall replace any plant material required by this By-law that dies or becomes diseased Landscaping for Parking and Storage Areas in Residential Zones (except for Single Housing Dwelling or Two Housing Dwelling) Landscaping for Parking and Storage Areas in Multi-Family Residential Zones: Where off-street parking for fifty or more vehicles is provided at grade on a site, there shall be landscaped open space within the parking area. Landscaped open space in the parking areas shall be provided in the minimum amount of.50 sq. m. (6.5 sq. ft.) for each parking space. The required landscaping shall not be located in one area, and shall be placed within the parking area so as to break up large areas of parking and to provide visual relief A parking area having eight or more parking spaces and which is visible from an abutting site in a residential district, shall be fenced or have a screen planting. The location, length, thickness and height of such fence or screen planting shall be in accordance with the landscaping plan. Figure : Parking Page 2 of 4
10 Garbage collection, loading, storage or outdoor service areas shall be fenced or have a screen planting, consisting of evergreen trees or shrubs, or flowering trees or shrubs, or a combination thereof, in accordance with the landscaping plan and: a) shall be located to the rear of a line adjacent to and parallel with the front wall of the principal building; and b) shall be maintained to provide effective screening from any public roadway or adjacent sites Where, because of conditions not conducive to good horticultural practices, a screen planting cannot reasonably be expected to survive, the Designated Officer shall require a masonry wall, wood fence or earth berm, or combination thereof, to be substituted for the requirements of Section above Any screen planting required shall consist of evergreen trees or shrubs, or flowering trees or shrubs, or both. All screen plantings shall be maintained to provide effective screening from the ground to a height of 2.00 m. (6.56 ft.), unless located in a front yard where all screen plantings shall be maintained to provide effective screening from the ground to a height of.22 m. (4.00 ft.) Notwithstanding any of the above requirements, the landscaping plan shall take into account requirements for Flood Prone or Hazard Prone Lands, and, shall seek to protect and/or enhance any related Flood Prone or Hazard Prone Lands, and may be subject to Geotechnical Reports. And, renumber subsequent provisions accordingly; 2.
