1 Rules and Regulations Village Clubhouse 1. The clubhouse is for C.V.A. activities only. It is not to be used for personal use or for rental. 2. Scheduled activities will appear on the Clubhouse Bulletin Board and the Newsletter. 3. Only residents in good standing may post signs in the Clubhouse. Notices being posted must be approved by the Board of Trustees or the office staff. Personal ads must be no larger than 3x5 postcards. 4. The library and videos are for the use of residents and should be returned within ten (10) days. 5. Please keep our clubhouse neat and tidy, including the rest rooms. When using the clubhouse, please empty your litter in the garbage can containers before you leave the premises. Be sure that all lights and doors are shut and that the heat and air conditioner are off. Maintenance Fees, Administration Fees Fines and Late Fees Monthly Maintenance payments are due the first of each month. Statements are only sent when payment is late as a reminder. Payment made after the 15 th. of the month will incur a $15.00 late charge. An Administration Fee is required of each new resident before moving in. Any outstanding amounts owed to CVA will result in loss of services. Requirements for Leasing Units A unit must be an owners residence for at least 2 years before renting. No unit can be rented without the permission of the association. Because of the need of a control on the amount of renters in the village, all owners must apply for a slot in our existing list of rentals. All units that are rented must have a rental agreement that includes the CVA along with an informational form for our records. 1

2 Bus Guidelines 1. For the benefit of residents of Cheesequake Village, a bus is available for scheduled trips in the surrounding area. Reservations must be made by calling the CVA office ( ) between the hours of 8:00 AM and 3:00 PM Monday Friday. 2. When the bus is filled to capacity (20 people) only one person per unit will be permitted to ride so as to accommodate as many villagers as possible. 3. Riders should not engage in conversation with the bus driver, stand up or change seats while the bus is in motion. 4. Riders must take a seat immediately upon boarding and remain seated until the driver makes a complete stop. Use the side rails upon entering and exiting the bus. 5. Anyone going on a bus trip must return on the bus unless the driver is notified. 6. Each trip requires a small fee. Safety on the Streets 1. Drivers must obey the posted speed limits in the Village and also must stop at all stop signs. 2. License numbers will be taken of those who violate the speed limit of 20 miles an hour. Fines will be issued and the infraction will be reported to the police. 3. Pedestrians should walk on the left side of the road facing oncoming traffic. It is suggested that you carry a flashlight and wear light colored clothing when out after dark. 4. Bicycle riders should ride with the flow of traffic. Helmets should be worn as required by law. If riding after dark, reflectors should be used. 5. Visiting children are not to play, ride bicycles, roller blades or skateboards in the streets or parking areas of the village. 2

3 Vehicles 1. All vehicles must be registered with the CVA office. Upon sale or purchase of a new vehicle the CVA office must be notified so as to keep our records current. 2. All vehicles must be parked head-on. 3. The resident of each unit is entitled to one assigned parking space. No vehicle may be parked in any part of a neighbor s walkway, doorway or interfere with garbage collection or grass cutting. This includes cars of guests. No one else is allowed to park in someone else s assigned parking spot. We strongly suggest residents use assigned parking spots and not park on the main roads. "V" spots are for visitors. 4. Do not park on the grass. 5. Each unit will be allowed two (2) vehicles. In the event that a unit houses more than (2) two residents, additional vehicle parking must be approved by the Board of Trustees. Vehicles parked beyond the allotted time without authorization will be towed at the owners expense. In the event a vehicle remains in a visitor spot for an extended period of time, keys must be left at the office in case of an emergency. 6. If a guest of a resident requires the use of a visitor parking space beyond the 72 hour limit, the homeowner must make the request to the Board of Trustees in writing. 7. The speed limit in the Village is 20 MPH and must be adhered to. Exceeding the limit could result in a fine. 8. Car washing and repairing (ex. the changing of oil or grease) on the property is not allowed. 9. All vehicles must be legally registered. If registered with the state of NJ or any state that requires state inspection, the inspection sticker must be current. If not the vehicle will be towed. 10. No parking in any Fire Lane at any time. The Fire Dept. will be notified to issue a summons without warning to the violator. 11. Automobile Driver Training is not permitted within the Village although the trainer is permitted to pick up the student at his or her home. Lessons must be on public roads outside the Village. 12. No boat, motor home or trailer is allowed to be parked, for any length of time, on the premises of Cheesequake Village. There shall be no overnight parking of commercial vehicles unless approved by the board. 3

4 13. Motorcycles must have a muffler control quieter while riding in the village. Outside Appearance 1. There shall be no hanging of wash or airing of garments, blankets. rugs, etc. anywhere outside on bushes, chairs, trees or from windows. Wash may be hung from racks and lines in the rear of a unit except on Saturday, Sunday or Holidays. 2. Permanent clotheslines are not allowed, temporary lines are not allowed in front of the units. 3. All wash should be removed when dry and lines taken down by 5:00 PM. Monday through Friday. 4. Sheds are not allowed on common grounds unless ok'd by CVA. 5. Only one satellite dish is allowed and may not be installed without prior approval of the Board of Trustees. 6. Fences are not allowed. 7. All lawn ornaments must be placed within the 30 inches of unit building and be no higher than the windowsill. Any ornaments on common ground will be removed by the association and a fine could be issued. 8. Holiday decorations may be displayed no longer than 30 days and must be removed two weeks after the holiday. 9. Window air conditioners are not allowed in the front of the units. 10. Barbecue grills must be 10 feet away from the buildings. All cooking apparatus must never be on the balcony or patio. This is a mandate from the Fire Dept. Grills cannot be placed in front of units. 11. Fire Pits are banned by the association. 12. Car washing and repairing (ex. the changing of oil or grease) on the property is not allowed. Signs No sign of any kind shall be displayed to public view on any home or common area, except a family name sign of not more than 144 sq. Inches. A For Sale sign of no more than two (2) sq. feet can be displayed in the unit s window. 4

5 Lawn Care 1. Land outside the residents dwelling is the property of the association and is identified in our documents as Common Elements. 2. Residents are permitted to plant flowers, shrubs or bushes within the 30 inches from the outside wall of the unit. Any planting must not interfere with the neighbor s unit. This area becomes the sole responsibility of the homeowners. 3. If this area is not kept up and becomes unsightly, the unit owner will be notified and the board will arrange to clear the area. It will be returned to its original state and the unit owner will be billed. 4. Shrubs must be no higher than the window sill. 5. The association will not be responsible for any decoration that is placed on common ground. 6. No trees can be planted anywhere by individual owners as the rooting system may grow into your foundation and cause damage to your unit. Pool and Shuffleboard 1. A guest must be accompanied at the pool by a resident. 2. All sound devices (radios, CD players, etc.) must be adjusted so as not to disturb others. 3. Pool badges are assigned to individual residents. They must be worn and visible at all times. 4. Residents are responsible for the behavior of their guests. Maintenance fees must be current for the use of the pool. No exceptions. 5. Safety regulations are posted and must be followed as per the health dept phones are available and are located across from the kitchen in the clubhouse and the downstairs activity room. 7. No one under 18 years of age is permitted in the pool area. 8. Shuffleboard Bocce Ball is available on a first come bases. 9. Anyone using the recreation equipment is responsible to put away equipment after use. 5

6 10. No bicycles allowed in pool area. Pets 1. Members owning a dog or cat must register their animal with the Township and supply a copy of the license to the CVA office. The information must be recorded on the census form. 2. No more than one (1) pet is allowed per household, 35 lbs. or less. 3. The town ordinance requires that a dog be on a hand held leash no longer than six feet in length. 4. Loud and continuous barking of dogs inside or outside a unit day or night, whether the owner is home or not, cannot and will not be tolerated. Fines will be imposed by the CVA, the Township, or both if this is not corrected. 5. Dogs should be curbed. No pit bulls allowed in the village. 6. A written complaint from a resident must be presented to the board if there is an issue. 7. Children under 12 years of age are not permitted to walk a pet. 8. Feeding of birds, deer or any unlicensed animal is prohibited. 9. Violations of the above situations will apply to owners who fail to pick up after their pets or who do not keep pets on a leash when outside the home. The first fine will be applied and will double with each subsequent infraction. Snow 1. Main roads will be plowed first and kept plowed during the storm. 2. Side streets will be plowed after the main roads have been cleared. 3. Shovelers will clear a path from doorways to the roads. 4. Parking areas will be plowed only after items 2 and 3 have been taken care of. Under no circumstances should shovelers be asked to clear snow from the vehicles. We are paying them to clear walks. If a homeowner is observed paying our shovelers to clear their car, they will be fined. 5. CVA vehicles or equipment are NOT used to tow, jumpstart or push a resident s car. 6. Snow sticks should not be removed as they are needed to guide the plows and are used to identify curbs, garbage cans and lawn areas. 7. Moving cars on to main roads before being directed to do so creates havoc and stalls the clearing of the area. 6

7 8. Cars should only be moved if directed by phone system or if the plow is in your area. Electrical Repairs Homeowners 1. All electrical malfunctions in your unit are the homeowner s responsibility. 2. For sparking wall switches or outlets and circuit breaker malfunctions, call an electrician. 3. Be sure to check all your appliance cords regularly. 4. DO NOT use more than two electrical cords per outlet. 5. When using multiple plugs make sure you have a surge protector. 6. Repairs or alterations must be done by an insured and licensed electrician. You must have a permit from the Township and an alteration form from the office before starting the work. Plumbing 1. Stoppage in the interior plumbing (toilet, sink or tub) is the owner s responsibility. 2. Do not use liquid plumber in the pipelines. For clearing pipelines use vinegar and baking soda. It works very well and is not corrosive. 3. If the problem is in the sewer line, CVA Maintenance will attempt to clear it. If the problem persists, a plumber will be called and the responsibility for the bill will depend on the outcome of the job. 4. Alterations must be done by an insured licensed plumber and permit obtained from the Township. Alteration forms from the office must be completed and submitted prior to beginning the work. Business Commercial or Professional The by-laws of the Cheesequake Village Association prohibits any commercial or professional business from being conducted within the Village. 7

8 Garbage Collection 1. Garbage collection is on a twice a week schedule. (Tuesday and Friday) 2. All garbage must be placed in Plastic Bags and deposited in cans. Do not place garbage outside the cans except on garbage day. 3. Do not use garbage cans for grass cuttings or other garden refuse. 4. Garbage cans or recyclables are not to be stored on patios, in parking area, in front of units or in stairwells. 5. Residents must call the garbage company to have large objects picked up. 6. Call the garbage co. with complaints at Recyclables are NOT to be put out before 6:30 P.M. on Sundays and 5:30 during Eastern Standard Time. Violations and Appeal Process In the event a resident is in violation of a rule or regulation and is issued a fine for said infraction, or a complaint is received from a member of the community, the following procedures shall apply: 1. The aggrieved resident must send a written request for a hearing with the grievance committee. 2. The grievance committee will schedule a meeting within 14 days of receipt of the written request. 3. If the grievance committee fails to schedule a meeting within 14 days of receipt of said request, the homeowner may request a meeting with the Board of Trustees. 4. An altercation between residents is out of the realm of the Association. 5. Verbally or physically abusing an employee, committee or board member engaged in enforcing any existing regulation will be considered a violation and subject to a fine. 6. The aggrieved resident and the resident making the complaint, if applicable, shall attend the meeting. a) The committee will hear the complaint and provide a written recommendation to the Board of Trustees. If the complainant fails to attend the meeting, the complaint will be considered resolved. 8

9 b) If the complaint is relative to a fine issued to the resident, the grievance committee will hear and record the procedures and make a written recommendation to the Board of Trustees. Exterior Additions and Alterations 1. Prior to any permanent or temporary additions or alterations an Alteration Request Form must be obtained at the CVA office. All alteration forms must be returned to the office, with contractor s certificate of insurance and a drawing of the proposed alteration or change. Work shall not commence until it is reviewed and ok d by the Board of Trustees and the form is signed by a board member. 2. Alteration forms are needed for any changes including but not limited to the following: storage boxes, patios, patio coverings, awnings, color changing, replacement of window, walks, doors, enclosures, shrubs, gardens, etc. 3. Prior to beginning any work to the interior or exterior of any home, contractors must provide NJ licenses and certificate of insurance to include liability coverage and Workers Compensation as required by the township ordinance. 4. Township building permits must be acquired for the following but is not limited to: window replacement, when space is made either larger or smaller, air conditioners, replacement of hot water tanks or furnaces, new duct work, enclosing a patio or balcony, conversion from electric to gas, gas piping, upgrade or replacement of electrical service or replacement of shower valves. 5. All alterations or additions to the interior or exterior of any home or any maintenance to the alterations shall be the complete and sole responsibility of the homeowner. 6. Enclosures, additions, walks, patios or canopies shall have attached to the alteration form an Architectural sketch of the front view, elevation, side view, width, depth and length. Dimensions shall be shown in all details. Materials to be used must be indicated on drawing prior to approval. 7. Any installation without the signed permission on an alteration form will be considered unauthorized. Fines will be imposed and appropriate legal action will be taken to order the removal of any such unauthorized changes. 9

10 8. Balconies - No carpeting is allowed on newly refurbished balconies or on stairs or walkways that are not covered by an overhang or roof. 9. Individual generators for private units are not allowed. 10. Trees being planted by unit owners is not allowed. 11. Following are guidelines pertaining to alterations/additions: Manor/Townhouse: Upstairs balcony may be enclosed, rear ground level (end unit) may be enclosed. An extension on the entrance level, per committee s review and approval. Extension size to be determined upon inspection. Gettysburg (upper): No extensions. Existing balcony may be enclosed. A balcony support column must be installed on patio level. Gettysburg (ground level): Enclosure/addition permitted. May be extended not more than 8ft. from sliding glass doors and 12 ft. alongside of building measuring from utility room door. Williamsburg: Enclosure/addition permitted. May be extended not more than 8ft. from sliding glass doors and 12ft. along side of building measuring from utility room. Cheesequake(one bedroom): No extensions. An existing entranceway may be enclosed. NO CHANGES CAN BE MADE TO EXTERIOR WITHOUT THE EXPRESS PERMISSION OF THE BOARD OF TRUSTEES a) Material used in exterior construction of enclosures must be of non - maintenance type, such as vinyl, fiberglass, glass, brick, etc. b) Material used must match or complement existing building. c) Enclosures must be attached to existing structures, no freestanding summer houses are permitted. d) No outside structures are permitted such as tool sheds, toolboxes, kennels, storage sheds or dog houses unless ok'd by the board. e) Additions/Alterations become the sole responsibility of the homeowner and will pass on to the new owner in the event of a sale or change of ownership. This includes maintenance, upkeep, repair or insurance either inside or outside. f) Front doors must be white all other colors are in violation.. 10

11 Fines Any resident in violation of the Rules and Regulations will be issued a violation notice. Fines will be issued according to the severity of the violation. A resident issued a fine will be given 15 days from receipt of notification to pay the fine. Procedure Upon Collection of Late Assessments Any monies received from a delinquent owner shall be applied to outstanding sums due in the following order: 1) Outstanding fines 2) Outstanding late fees 3) Outstanding attorney s fees and cost 4) Outstanding interest 5) Outstanding assessments 6) Maintenance fees. Alternative Dispute Resolution The Condominium Act of New Jersey provides that an Association shall provide a fair and efficient procedure for the resolution of housing related disputes between individual unit owners and the association, which shall be available as an alternative to litigation. Guidelines pertaining to the ADR process may be obtained at the Association office. Maintenance Department All requests for service or repairs should be made directly to the office by phone or in writing. Employees OR BOARD MEMBERS should not be approached outside of the office. Reports must be in writing. Insurance 11

12 Unit Owners must carry Insurance covering "HO-6" with Cheesequake Village as an additional interested party on the Certificate of Insurance. This is for informational purposes only. Having the right insurance will benefit you when there is a problem. 12
