1 TURKEY CREEK FOREST 55 PLUS COMMUNITY TURKEY CREEK FOREST OWNERS' ASSOCIATION, INC. GUIDELINES FOR COOPERATIVE LIVING AMENDED MAY 8, 2010 It is important to the well being of the residents of Turkey Creek Forest Owners' Association, Inc. (TCFOA) that rules be set regarding our community and the use of common facilities. Certain rules and regulation are hereby set forth and will be enforced by TCFOA. These rules and regulations are designed to protect the rights of our neighbors and of TCFOA and to enhance the enjoyment of our community and its facilities. The following rules and regulations shall be observed by all residents, visitors, and guests. A. Dress Code and General Conduct 1. Dress Code: Covering tops are required of everyone except in a private yard or the pool area. (Small children are excepted.) 2. No offensive, loud, or unruly conduct will be permitted. 3. Residents must exercise special care regarding excessive noise caused by TVs,radios, tools, equipment, loud autos, fireworks, and the like between the hours of 10:00 PM and 8:00 AM. B. Guests: Guests shall be defined as invited, nonresident family and friends. Residents shall be responsible for adherence to all rules and regulations by their guests. 1. All common areas and recreational facilities shall be available to TCF residents and their invited guests for the use intended for such common areas and recreational facilities. 2. Residents' guests who are under 18 years of age must be accompanied and supervised by a resident or other responsible adult when using any common areas or recreational facilities. 3. Each member of TCFOA shall be liable for the expenses of any maintenance to the common area and its improvements for repair and replacement rendered 1/10
2 necessary by his/her act, neglect, carelessness, or by the negligence of any member of his/her family, or their guests, employees, or agents. Such liability shall be limited to the extent that such expense is not recoverable from the insurance carrier by TCFOA (from TCF By-Laws X.C). 4. TCFOA shall have the right to suspend the enjoyment rights (except egress and ingress) of any member, their visitors, and guest during the period of such member's delinquency in payment of assessments pursuant to the TCF Covenants (from TCF Covenants Article III Section 1.B). 5. TCFOA shall have the right to evict persons deemed undesirable from any recreational or common areas after prior warning has been given to the owner or resident. Violations of the Covenants, By-Laws, or Guidelines shall be considered sufficient cause for such action. Guests and all residents have the same obligation to obey the rules as TCF property owners. B. Home Sites 1. The only items allowed to be stored in carports are licensed vehicles, outside furniture, bicycles, barbecue grills, hose reels, non-riding lawn mowers, and trash containers. All other items, including lawn equipment, must be kept in a garage, storage shed, utility room, or outside and hidden from view. 2. Clotheslines or any other facility for laundry drying, whether fixed or portable, should be hidden from street view, if at all possible. 3. The only signs permitted on a resident's personal property shall be the resident's name and/or address, one small "no dog" sign, one small "security" sign, contractor's signs while work is in progress, estate sale signs, political signs, and real estate signs. No signs shall exceed four square feet. Garage sale signs will only be allowed during approved TCF events. Any exceptions must be approved by the Rules and Regulations Committee. 4. Removal of trees shall be done only in accordance with City of Gainesville's tree ordinances. 5. Mailboxes and stands shall be maintained by TCFOA in a uniform fashion and color. Any damage caused by a resident or guest will be repaired or replaced by TCFOA and paid for by the homeowner. C. Pets Household pets are permitted provided that such pets are on a leash at all times or confined within a fenced area. Pets except service dogs are not permitted in the clubhouse or recreation areas except during a declared emergency. In the event of a "Declared Emergency," residents with pets may take shelter with their pets in the arts and crafts room of the TCF clubhouse as long as the pets are in portable pet containers. It is the pet owners' responsibility to clean up any feces left by their pets on private property or TCF common property. There is a local ordinance and a community rule against barking dogs disturbing neighbors. D. Vehicles and Pedestrians 1. Vehicles shall not be parked on grass areas at any time. This includes common grass areas as well as the lawn of any homeowner's private property. All residents and visitors shall park in the garage, carport, or driveway. When all driveway space is utilized, residents and visitors may park on the street during daylight hours, taking care not to block the street for emergency vehicles. 2/10
3 2. Residents and visitors may park at the clubhouse during daylight hours. Clubhouse parking is available for residents' and visitors' vehicles, on a limited basis, with special permission for a Board member when driveway space is not adequate. The special written permit must be displayed and visible in the windshield at all times. Any vehicle illegally parked on common grass, on the street, or at the clubhouse may be towed at the owner's expense after one written 24-hour notice. 3. Recreational vehicles, boats, and trailers are not to be parked or stored at individual residences or in the guest parking area for more than a 24-hour period without special permission. 4. Speed limit is 15 MPH and shall be observed by everyone at all times. 5. Bicycles, skate boards, etc., shall not be used in recreational areas, including the pool area, clubhouse, tennis and shuffleboard courts. Bicycles shall not be parked on sidewalks, walkways, or inside the clubhouse. Bicycle racks are provided. Remember, all children must be supervised by an adult when riding in the streets. 6. Bicycle riders shall observed all traffic rules that are followed by automobile drivers. Bikers should always ride on the right side of the road with traffic, single file. Walkers should always walk on the left side of the road, facing traffic. All traffic regulations are to be observed. Walkers and bikers should use flashlights after dark. 7. Decals: All residents, including renters, must display a valid TCF decal in the windshield of each of their vehicles. Each household is limited to three decals. Additional vehicles must be issued temporary passes. 8. Temporary Passes: Residents may secure a visitor's pass from the office for frequent visitors to display in their windshield when the enter TCF. a. Long Term (Blue): Primarily for relatives and caregivers whose frequency of entry requires a longer period of time. Uses of long term passes will be issued a 6- month pass for the first request. This may be changed to a 12-month pass at subsequent requests. b. Short Term (White): Primarily for relatives, friends, and guests for shorter duration visits. They may be issued for days, weeks, or any time up to 6 months. 9. All vehicles should dim their headlights at night and stop at the guardhouse to facilitate proper identification whenever security is on duty. 10. NO ONE SHOULD PARK ON THE STREETS OVERNIGHT. (Our streets are too narrow to permit access to emergency vehicles if cars are double parked or staggered on both sides of the street.) E. Refuse 3/10
4 1. Garbage and recycling containers may be placed at street side no earlier than the day preceding collection days in accordance with city regulations. 2. No trash or refuse may be disposed of in any common area within the Forest, oradjacent to the Forest except in receptacles provided by TCFOA. F. Recreational Facilities and Common Areas 1. Court Facilities a. Court facilities including (but not limited to) tennis courts, basketball court, shuffleboard courts, and horse shoe pits are available on a first come, first served basis for residents and their guests. b. The hours, 8:00 AM to dusk, shall be observed for all court facilities. c. Tennis shoes are required footwear on the tennis and basketball courts. d. In the event of overcrowding, first priority will be given to residents of TCF. Players should work cooperatively to assure that everyone who wishes to use the courts may do so. 2. Swimming Pool a. Each household shall be given one pool pass. Residents are encouraged to greet and identify other resident and guests by their pass. Individuals not possessing a pool pass may be asked to leave. b. All residents and guest must abide by the pool hours and rules as posted at the pool. c. In the event of the pool capacity (40) being exceeded, first priority will be given to residents of TCF. d. Children who are guests of TCF residents are welcome to use the pool between 10:00 AM and 1:00 PM and after 5:00 PM until 10:00 PM. Children must be accompanied by a resident or other responsible adult to supervise conduct and adherence to posted rules. e. Children who are not toilet trained must wear special swim diapers in the pool. f. The buoy line must be in place when minors are in the pool according to County regulations. g. Wet swim wear and bare feet are not permitted in the clubhouse, arts and crafts room, or game room. 3. Clubhouse a. Recurring Turkey Creek Forest Activities (e.g., calendar events such as quilting, Bingo, cards, exercise, yoga, etc.): These activities shall be 4/10
5 announced in the community calendar and posted on the community bulletin board. Residents may invite guests to participate in these activities as long as the majority of participants are TCF residents. b. Meetings (e.g., Friends of the Forest, Board meetings, committee meetings, S.WA.T., book study groups, etc.): Whenever possible, these events shall be announced in the community calendar and posted on the community bulletin board. When possible, meetings should not conflict with recurring TCF scheduled activities. Residents may invite guests to participate in these activities as long as the majority of participants are TCF residents. c. Special Events (l) Events sponsored by the TCF Social Committee (e.g., monthly social events, etc.): These events shall be announced in the calendar, posted on the community bulletin board, and open to all residents. Residents may invite guests to participate in these event as long as the majority of participants are TCF residents. (2) One-time events (e.g., birthday celebrations, memorials, tributes, anniversaries, etc.): These events may be hosted by residents to honor or pay tribute only to Turkey Creek Forest residents. Written requests for reservations must be made in advance and approved by the Social Chairman and shall not conflict with regularly scheduled TCF events. The event must be announced on the community bulletin board. TCF residents shall not be excluded from use of the clubhouse during these events. (3) Occasional small group activities (e.g., TV, jigsaw puzzles, impromptu table games, pool, etc.): TCF residents and guests may use the clubhouse main room, game, and arts and crafts rooms for small group activities on an as-needed, space-available basis. While these activities need not be on the calendar or scheduled, residents are asked to work cooperatively with any scheduled activities. 4. Kitchen: The kitchen shall be used only for TCF events. Residents shall not use the kitchen facilities to prepare for outside activities, events or groups, or for their own personal use. Everyone who uses the TCF kitchen should take care to clean up after use, return all equipment to its proper place (there is a chart posted in the kitchen) and place trash/garbage in the proper receptacles. (Full trash bags shall be put in the proper receptacles in the compound adjacent to the clubhouse.) Special care should be taken not to overload circuitry in the kitchen. Diagrams for recommended use are posted in the kitchen. G. Rentals For rules and regulations, refer to the TCFOA Amended Declaration of Covenants, Conditions, and Restrictions, Article II, and TCFOA By-Laws, Article XI. H. Complaint Procedure The TCFOA Complain Procedure is attached as Addendum I. 5/10
6 I. Architectural Requests Architectural request procedures are outlined in Addendum II. J. Miscellaneous 1. Solicitors, vendors, or peddlers shall not be permitted in Turkey Creek Forest. 2. Petitioning (gathering or requesting of signatures) is permitted only by TCFOAresidents as part of our democratic process. Petitioning should be done in a nonharassing and non-intimidating manner. ADDENDUM I C CComplaint Procedure The following guidelines for the TCFOA Complaint Procedure are intended to further the congenial atmosphere of the Forest and to promote a sense of responsibility and cooperation among residents and toward the community as a whole. Legal proceedings, which are adversarial, difficult, and expensive to all residents, will be utilized as a last resort. All residents (owners and renters) and their guests are expected to comply with the TCFOA By-Laws, Declaration of Covenants, Conditions and Restrictions, and the Guidelines for Cooperative Living. In the event that a dispute cannot be settled personally by a resident, then he/she may elect to file a complaint and the following procedures should be followed. 1. The complaint should be typed or handwritten, signed, and dated by the complaining resident. It should include as many details as possible to describe the complaint. 2. The complaint should be dropped off at the office. 3. The Secretary will notify the President or his/her designee. 4. The President or designee will appoint the Rules and Regulations Chairman to investigate and validate the complaint, and attempt to resolve it with the individual named. The violator will be notified of the complaint by letter or by a phone call from the Rules and Regulations Chairman. If resolved, the complaining resident will be advised of the action taken. 5. If a complaint cannot be resolved in the above manner, it will be referred to the full Board of Directors. The President and the Board will appoint a three-member panel, selected from the membership, to investigate, make recommendations, and institute resolution of the complaint, and report to the Board of Directors. 6. If the three-member panel cannot resolve the complaint, the Board of Directors will invite the individuals involved to present their arguments to a closed Board meeting, and the Board will make a final decision and assess fines if appropriate. Fines begin at $25 per violation, not to exceed a total of $100 per violation. 7. If it is necessary, the Board of Directors will refer the matter to the TCFOA legal counsel. In the event that a Director is cognizant of an owner, renter, or guest not adhering to the Declaration of Covenants, Conditions and Restrictions, By-Laws, or Guidelines for Cooperative Living, the procedure may be instituted by the Director 6/10
7 beginning with Step #3. ADDENDUM II Architectural Requests Guidelines for Architectural Request by Owner A. Fences 1. Architectural Committee approval is required. 2. Height must be limited to 48 inches above the ground level. 3. Fences cannot extend beyond front of house or porch. 4. Fences must be constructed of treated wood. 5. Fences must be 6 inches inside the property line. If property abuts common perimeter fence owned by TCFOA, new fence can abut; no changes can be made to TCFOA fence. 6. Property within fenced area must be maintained by homeowner. 7. Finished side of fence must face street and/or neighboring property. B. Patios, Slabs, and Decks 1. These structures must abut existing residence and be of suitable material. 2. Drainage must not affect other properties. 3. Enclosure of patios, slabs, and decks must be approved by the Architectural Committee. 4. Architectural Committee approval is required for all additions. C. Porches and Screen Rooms 1. Windows may be installed to replace screening. 2. No application is required. D. Additions Architectural Committee approval is required. 7/10
8 E. Sheds 1. Sheds must abut house. 2. Architectural Committee Approval is required. F. Carports 1. Enclosing carport requires Architectural Committee approval. 2. Carports cannot be extended beyond front of house or porch. 3. Lattice work placed within the uprights of carport does not require approval. If it is extended beyond uprights, application must be made and approval obtained. G. Skylights, Solar Panels, Awnings, and Canopies All require Architectural Committee approval. H. Downspouts and Gutters 1. These do not require Architectural Committee approval. 2. Installation must not adversely affect neighbors' property. I. Home Replacement Policy As recorded on page one of the Amended Declaration of Covenants, Conditions and Restrictions for Turkey Creek Forest, A Planned Unit Development, "WHEREAS, Turkey Creek Forest is comprised of single family residents built on small lots with minimal setbacks, resulting in a close proximity of houses, limited parking space, a lack of sidewalks, narrow streets, low speed limits, one story buildings and central facilities located, constructed, and adapted to accommodate the needs of older persons, and other significant facilities and services specially designed to meet the physical and social needs of older persons as required under Section 807(b)(2) of the Fair Housing Act, with a goal of providing housing for persons aged fifty-five (55) years or older." In keeping with this declaration, the following guidelines have been established for the replacement of homes in Turkey Creek Forest: 1. Architectural Committee approval is required. 2. Applications should contain complete basic home plans, specifications, and site plans. 3. Owner is responsible for all city permits when required. 8/10
9 4. Rules for replacement will follow these guidelines: a. Replacement must be new and a single story structure. b. Replacement must meet set back requirements as established by the City of Gainesville and must coincide with neighboring structures. c. New building must be either factory built or on-site construction. d. No single-wide factory-built home will be allowed. e. Site-built homes may not be replaced by manufactured homes. f. Manufactured homes may be replaced by site-built homes or by new manufactured homes. 5. Completion must be done within six months of approval.
