1 THE FOLLOWING RULES AND REGULATIONS ARE INTENDED FOR THE COMFORT, WELFARE AND SAFETY OF MARINER COVE MEMBERS. RENTERS, AND THEIR GUESTS/ VISITORS. THESE RULES ARE FOCUSED ON MAINTAINING THE APPEARANCE AND REPUTATION OF OUR COMMUNITY. MARINER S COVE IS PRIVATELY OWNED AND WE ARE REQUIRED BY LAW TO ABIDE BY CERTAIN STANDARDS. MANY OF OUR RULES AND REGULATIONS ARE BASED ON WHAT IS REQUIRED BY LAW. THE FOLLOWING RULES AND REGULATIONS ARE PUBLISHED TO ADDITIONALLY PROTECT LIFE, PROPERTY AND PRIVACY. THESE RULES AND REGULATIONS MAY BE AMENDED FROM TIME TO TIME TO ACHIEVE THIS PURPOSE. PLEASE READ THIS PAPER CAREFULLY. 1. ACCEPTANCE/ BUYING OR SELLING OF PROPERTY 1.1. TO RECEIVE A SELLER/ BUYER PACKAGE AN APPLICATION FOR RESIDENCY MUST BE MADE WITH MARINER S COVE HOMEOWNERS ASSOCIATION OF LEE COUNTY INC COPIES OF OCCUPANT PICTURE AND PROOF OF AGE DOCUMENTS ARE REQUIRED TO BE KEPT ON FILE IN THE PARK OFFICE THERE IS A FEE CHARGED BY MARINERS COVE PARK AND OUR MANAGEMENT COMPANY TO COVER ADMINISTRATION WORK ASSOCIATED WITH THE TRANSFER OF MEMBERSHIP (SEE MARINERS COVE BYLAWS FOR FURTHER DETAILS). 2. THE MOBILE HOME 2.1. MOBILE HOMES SHALL BE ATTRACTIVELY MAINTAINED BY THE OWNER AND NEED TO COMPLY WITH APPLICABLE LAWS, ORDINANCES AND REGULATIONS OF THE STATE, COUNTY, CITY AND COMMUNITY. SINCE THESE REGULATIONS CAN CHANGE FROM TIME TO TIME OUR PARK RULES AND REGULATIONS WILL VARY ACCORDINGLY MOBILE SKIRTING IS REQUIRED WITHIN 60 DAYS AFTER NEW MOBILES ARRIVE AT MARINER S COVE. SKIRTING HAS TO BE APPROVED BY THE ARCHITECTURAL REVIEW COMMITTEE (A.R.C) WITH THE APPROVAL OF THE A.R.C., T.V. ANTENNAS AND SATELLITE DISHES SHALL BE ALLOWED IN THE PARK, THEY MUST BE PLACED ON THE REAR TWO-THIRDS OF THE PROPERTY PERSONS WANTING TO INSTALL AWNINGS, STORAGE STRUCTURES, CABANAS, SCREENED ENCLOSURES, AIR CONDITIONERS, PERMANENT PLANTING, OR ANY OTHER ADDITIONS MUST CHECK WITH THE MARINER S COVE ARCHITECTURAL REVIEW COMMITTEE (A.R.C) BEFORE INSTALLING THEM. CHANGES MUST BE APPROVED IN WRITING BY THE A.R.C. ALL CHANGES ARE TO BE MADE IN ACCORDANCE TO STATE AND COUNTY REGULATIONS 2.5. IF A UNIT IS TO BE DEMOLISHED AND REMOVED, THE OWNER IS RESPONSIBLE FOR A TERMITE INSPECTION AND TREATMENT, IF NECESSARY, TO THE ENTIRE LOT. AN INSPECTION REPORT MUST BE SUBMITTED TO AND APPROVED BY THE A.R.C. BEFORE ANY CHANGE IS TO BE MADE TO THE PROPERTY.
2 3. AGE REQUIREMENTS 3.1. THIS COMMUNITY IS INTENDED AND OPERATED FOR PERSONS AGE 55 AND OLDER VISITING CHILDREN ARE WELCOME, WE DO ASK HOWEVER THAT THEIR BEHAVIOR NOT INCONVENIENCE OTHER PARK TENANTS. THERE ARE LIMITS ON THE LENGTH OF STAY AND DURATION. VISITORS, RELATIVES AND CHILDREN MUST BE SIGNED INTO THE VISITOR REGISTER LOT OWNERS OR PARENTS OF VISITING CHILDREN WILL BE HELD RESPONSIBLE FOR DAMAGE CAUSED BY THEIR CHILDREN TO PRIVATE PROPERTY CHILDREN WHO ARE (16) YEARS OF AGE AND UNDER ARE NOT PERMITTED IN THE POOL, SHUFFLEBOARD COURT, CLUBHOUSE FACILITIES, AND/OR WITHIN (15) FEET OF THE WATER UNLESS THEY ARE ACCOMPANIED BY A RESPONSIBLE ADULT. 4. THE MOBILE HOME SITE 4.1. THE LOT OWNER IS RESPONSIBLE FOR THE OVERALL APPEARANCE OF THEIR HOME SITE. IT SHALL BE KEPT ORDERLY, NEAT, AND FREE OF LITTER. THE MANAGEMENT WILL SEE THAT THE GRASS IS MOWED AND PALM TREES ON THE STREET SIDE ARE TRIMMED. IF THE OWNER DOES NOT MAINTAIN THE PROPERTY, THE VIOLATION COMMITTEE WILL TAKE ACTION NO ONE IS PERMITTED TO HANG TOWELS, RUGS, OR APPAREL FROM THEIR MOBILE HOME, AWNINGS ETC NO VEGETABLE GROWING IS PERMITTED, EXCEPT IN THE REAR OF THE LOT, OR IN SECLUDED AREAS FROM THE VIEW OF THE STREET ANY CHANGES TO THE UTILITY SERVICES TO MEET OWNER REQUIREMENTS WILL BE DONE AT THE OWNERS EXPENSE ALL UTILITY CONNECTIONS MUST COMPLY WITH THE GOVERNING ORDINANCES BEFORE DIGGING/ SINKING PEGS OR POSTS ANYWHERE ON YOUR PROPERTY, CHECK FIRST WITH THE A.R.C. COMMITTEE BEFORE STARTING. PLEASE NOTE THAT FENCES ARE NOT ALLOWED REPAIRS TO AUTOMOBILES, MOTORCYCLES, OR OTHER MOTOR VEHICLES (EXCEPT BOAT MOTORS) ARE NOT ALLOWED TO BE MADE IN THE PARK AUTOMOBILES LEFT BEHIND WHEN YOU LEAVE MUST DISPLAY A LICENSE PLATE AND BE PARKED UNDER A CARPORT, OR ON THE PATIO NO SIGNS MAY BE PLACED ANYWHERE OTHER THAN IN THE FLOWERBED OR WINDOW OF THE MOBILE ALL HOME UNITS MUST HAVE LOT NUMBERS AND THE STREET ADDRESS ON THE FRONT OF THEIR HOMES SO THAT THEY CAN BE READILY SEEN FROM THE STREET. THE LOT NUMBER MUST ALSO BE VISIBLE ON THE REAR OF THE MOBILE AND THE ASSOCIATED ELECTRICAL BOX. THE RECOMMENDED SIZE FOR SIGN NUMBERS IS 3 INCHES. 5. RECREATION FACILITIES 5.1. RECREATION FACILITIES ARE PROVIDED FOR LOT OWNERS AND THEIR GUESTS EQUIPMENT AND FACILITIES ARE TO BE USED AT YOUR OWN RISK.
3 6. GUESTS 6.1. UPON ARRIVAL OWNERS MUST REGISTER THEIR OVERNIGHT GUESTS IN THE GUEST REGISTER BOOK LOCATED IN THE CLUBHOUSE ALL OWNERS AND GUESTS ARE WELCOME TO PARTICIPATE IN ANY AND ALL ACTIVITIES SPONSORED BY MARINER'S COVE. 7. VEHICLES, TRAFFIC, TRAILERS AND BOATS 7.1. THE SAFETY OF EVERYONE IN THE COMMUNITY DEPENDS UPON OUR OBSERVANCE OF BASIC TRAFFIC COURTESIES. THE MAXIMUM SPEED IS 10 MILES PER HOUR IN THE PARK AND DRIVERS ARE EXPECTED TO DRIVE IN CONGESTED AREAS USING DUE CAUTION. MEMBERS MUST PARK ON THEIR OWN PROPERTY PEDESTRIANS AND BICYCLES HAVE THE RIGHT OF WAY. NO SKATEBOARDS ARE ALLOWED NO COMMERCIAL-TYPE VEHICLE SHALL BE PARKED AT HOME SITES ON A PERMANENT BASIS BOAT TRAILERS MUST BE KEPT ON A CONCRETE SLAB. MEMBERS AND RENTERS ARE NOT PERMITTED TO STORE CAMPERS, UTILITY TRAILERS OR TRAVEL TRAILERS IN THE PARK ALL GOLF CARTS MUST BE POWERED BY ELECTRICITY AND HAVE THE REQUIRED EQUIPMENT. ONLY PERSONS 16 YEARS OF AGE OR OLDER ARE ALLOWED TO OPERATE THE CART. ALL LIABILITY WILL BE THE SOLE RESPONSIBILITY OF THE OWNER. SEE THE MARINER'S COVE GOLF CART REGISTRATION AND REGULATION FORM FOR SPECIFICS. THIS FORM ALONG WITH MANY OTHER FORMS ARE AVAILABLE ON THE MARINERS COVE PARK S WEB-SITE RIDING A BICYCLE IS NOT PERMITTED ON THE PAVED, OR CEMENT WALKWAY PATHS. MEMBERS MAY HOWEVER RIDE THEIR BICYCLES TO ACCESS THEIR BOATS ALONG THE RIVER S EDGE. 8. LAUNDRY 8.1. THE LAUNDROMAT IS OPEN DAILY FROM 8:00 A.M. TO 9:00 P.M. PLEASE FOLLOW THE RULES POSTED IN LAUNDRY. 9. POOL 9.1. THE POSTED RULES TO BE FOLLOWED ARE LOCATED IN THE POOL AREA THE POOL DOORS ARE TO BE KEPT CLOSED WHEN THEY ARE NOT IN USE. THEY ARE TO BE KEPT LOCKED OVERNIGHT AND WHEN NO-ONE IS PRESENT IN THE POOL AREA IF DOORS, OR DOOR LOCKS, BECOME DEFECTIVE THEY MUST BE REPORTED IMMEDIATELY TO THE PARK.
4 10. REFUSE EACH LOT OWNER HAS A RESPONSlBILITY TO HELP KEEP THE COMMUNITY CLEAN AND NEAT. GARBAGE COLLECTION IS AT THE DUMPSTER. ALL GARBAGE MUST BE KEPT IN PLASTIC BAGS AND PLACED IN THE DUMPSTER NO BURNING OF TRASH, LEAVES OR OTHER MATERIAL IS ALLOWED. 11. SELLING, SOLICITING AND SUB-LETTING ALL SOLICITING, COMMERCIAL OR OTHERWISE, IS BANNED WITH EXCEPTION THAT THE PARK LOT OWNERS HAVE THE RIGHT TO CANVASS OR SOLICIT AS ALLOWED PURSUANT TO SECTION F.S ALL NEW OWNERS ARE TO BE APPROVED BY THE MANAGEMENT COMPANY AND MARINER'S COVE HOMEOWNER ASSOCIATION BEFORE ANY SALE IS CONSUMMATED MANAGEMENT ASKS THAT YOU BRING ALL THE INFORMATION ON YOUR MOBILE HOME TO THE OFFICE, IF AND WHEN YOU SELL, DUE TO THE FACT THAT THE OFFICE RECEIVES CALLS AND LETTERS FROM PEOPLE INQUIRING ABOUT MOBILE HOMES FOR SALE BEFORE CLOSING A SALE, SELLORS AND NEW OWNERS ARE TO COMPLETE AN APPLICATION FOR APPROVAL OF SALE FORM WHEN PURCHASING AND SELLING PROPERTY OR A MOBILE OWNERS HAVE THE RIGHT TO RENT THEIR MOBILE HOMES, WHEN DOING SO BE SURE TO NOTIFY THE OFFICE AND THE MANAGEMENT COMPANY, GIVING THE NAMES AND DURATION OF THE PARTY RENTING. NO DWELLING UNIT MAY BE LEASED OR RENTED MORE THAN EIGHT (8) TIMES IN A TWELVE (12) MONTH PERIOD (QUOTED FROM AMENDED AND RESTATED DEED OF RESTRICTIONS SECTION DATED OCT 3, 2007) OWNERS ARE TO ENSURE THAT AT LEAST ONE OF THE RENTERS OCCUPYING THEIR UNITS ARE 55 YEARS OF AGE OR OLDER. RENTERS ARE TO BE REGISTERED WITH THE PARK OFFICE BEFORE THE RENTAL PERIOD COMMENCES RENTERS HAVE ACCESS TO AMENITIES WITHIN THE PARK, WITH THE EXCEPTION OF THE BOAT SLIPS AND BASIN WALL BOAT SPACES. ACCESS TO THE BOAT RAMP IS PERMITTED. 12. RESPONSIBILITIES MARINER'S COVE HOMEOWNERS ASSOCIATION SHALL NOT BE RESPONSIBLE FOR LOSS OR DAMAGE CAUSED BY ACCIDENT, FIRE, THEFT OR AN ACT OF GOD TO ANY MOBILE HOME OR PERSONAL PROPERTY LEFT BY THE LOT OWNER, OR THEIR GUEST, ON THEIR PREMISES MARINER'S COVE SHALL NOT BE LIABLE FOR ACCIDENT OR INJURY THROUGH THE USE OF RECREATIONAL FACILITIES. LOT OWNERS AND THEIR GUESTS AVAIL THEMSELVES OF THESE FACILITIES AT THEIR OWN RISK MARINER'S COVE SHALL NOT BE RESPONSIBLE FOR REPAIRS OF UTILITIES BEYOND THE PROVIDED CONNECTIONS OF WATER AND SEWER. SAID CONNECTIONS AND EXTENSIONS ON THE MOBILE HOME ARE THE RESPONSIBILITY OF THE LOT OWNER. ELECTRIC METERS OR SWITCH BOXES AND SERVICES TO THE MOBILE HOME ARE THE SOLE RESPONSIBILITY OF THE LOT OWNER.
5 13. MISCELLANEOUS QUIET TIME IN THE PARK IS FROM 11:00 P.M. TO 7:00 A.M. COURTESY SHOULD BE SHOWN TO YOUR NEIGHBORS REGARDING THE USE OF TV, RADIOS, STEREOS, OR WHEN MAKING LOUD NOISES. TRESPASSING IN OTHER YARDS WITHOUT PERMISSION OF LOT OWNERS CAN BE ANNOYING AS THEIR SLEEPING HABITS, HEALTH, ETC. MAY BE AFFECTED BY THE DISTURBANCES. 16. LEGITIMATE COMPLAINTS SHOULD BE REPORTED TO THE MARINER'S COVE HOMEOWNERS ASSOCIATION MANAGEMENT. ALL COMPLAINTS MUST BE IN WRITING AND MUST BE SIGNED RULES AND REGULATIONS MAY BE AMENDED IN WRITING WITH 30 DAYS NOTICE TO MEMBERS BY LAW, MARINER'S COVE HOMEOWNERS ASSOCIATION MAY EVICT ANY LOT OWNER FOR THE FOLLOWING REASONS: NON-PAYMENT OF MAINTANCE FEES; CONVICTION OR VIOLATION OF FEDERAL, STATE OR LOCAL ORDINANCES, WHICH VIOLATION MAY BE DEEMED DETRIMENTAL TO THE HEALTH, SAFETY, OR WELFARE OF OTHER RESIDENCES OF THE PARK; OR VIOLATION OF ANY WRITTEN RULE OR REGULATION ESTABLISHED BY THE ASSOCIATION ONE PARK WIDE INDIVIDUAL YARD/ GARAGE SALE IS ALLOWED AT A DESIGNATED DATE AND TIME. 14. TREES, PLANTS AND WATERING TREES PRESENT SPECIAL PROBLEMS TO SEWERS, UNDERGROUND WIRES AND STATE AND LOCAL REGULATIONS. PERMISSION MUST BE OBTAINED FROM THE A.R.C. COMMITTEE BEFORE ANY TREES CAN BE PLANTED OR REMOVED LOT OWNERS ARE NOT ALLOWED TO WATER THEIR LAWNS AS PER COUNTY LAW, EXCEPT THROUGH THE USE OF HAND-HELD SPRAYERS. PLEASE DON'T LEAVE HOSES UNATTENDED WHEN WATERING SHRUBS. COUNTY WATER RESTRICTIONS TAKE PRECEDENT OVER THE PARK RULES. 15. FISH AND FISH CLEANING DOCKS ALL FISH MUST BE CLEANED AT THE FISH CLEANING DOCK EACH INDIVIDUAL USING THE DOCK MUST CLEAN UP THE FACILITIES AFTER USING THEM A FISHING DOCK IS PROVIDED NEXT TO THE FISH CLEANING DOCK. THIS SPECIFIC DOCK AREA IS THE ONLY AREA TO BE USED FOR FISHING FROM THE DOCKS. 16. PETS PETS ARE NOT ALLOWED IN THE PARK AT ANY TIME THE BAITING, TRAPPING AND SHOOTING OF ANIMALS (EXCEPT MICE, RATS AND POISONOUS SNAKES) IS ILLEGAL IN THE STATE OF FLORIDA. OFFENDERS WILL BE REPORTED TO THE SHERIFF'S DEPARTMENT. IF YOU ARE HAVING A PROBLEM WITH ANIMALS, NOTIFY PARK MANAGEMENT OR THE HUMANE SOCIETY OR THE WILDLIFE AUTHORITIES.
6 17. MAINTENANCE FEES FEES ARE DUE IN ADVANCE ON, OR BEFORE, THE I ST DAY OF EACH MONTH AND COVER THE PERIOD THROUGH THE LAST DAY OF THE MONTH. OWNERS NEED TO MAIL THEIR CHECKS TO: MARINER'S COVE HOA CIO GULF BREEZE MANAGEMENT SERVICES OF S/W FLORIDA, LLC 8910 TERRENE COURT, SUITE 200 BONITA SPRINGS, FL SMALL GAMES OF CHANCE SMALL GAMES OF CHANCE ARE PERMITTED IN THE RECREATIONAL HALL AT MARINER'S COVE. THESE SMALL GAMES OF CHANCE SHALL INCLUDE, BUT ARE NOT LIMITED TO, BINGO, EUCHRE, POKER AND CRIBBAGE. THE STATE OF FLORIDA'S LAW ON SMALL GAMES OF CHANCE SHALL GOVERN ALL MONEY AND SIZE OF WINNINGS AS IT PERTAINS TO CONDUCTING SMALL GAMES OF CHANCE AT A RESIDENTIAL HOMEOWNER S SETTING THE BOARD OF DIRECTORS IS FREE TO PROMULGATE ADDITIONAL RULES AND REGULATIONS TO CURTAIL THE BEHAVIOR OR CONDUCT OF THOSE PARTICIPATING, WHICH IS UNDULY BURDENSOME TO THE OTHERS DESIRING TO PARTICIPATE IN THESE SMALL GAMES OF CHANCE. 19. ALCOHOLIC BEVERAGES AT THE CLUB HOUSE THE ASSOCIATION CANNOT LAWFULLY DISPENSE ALCOHOLIC BEVERAGES TO ITS MEMBERS OR GUESTS. NOTWITHSTANDING HOWEVER, ANY MEMBER DESIRING TO BRING AN ALCOHOLIC BEVERAGE OF THEIR CHOICE TO THE CLUBHOUSE DURING AN ORGANIZED SOCIAL GATHERING OF THE MEMBERS SHALL BE PERMITTED, SUBJECT TO OTHER REASONABLE RULES AND REGULATIONS AS MAY BE PROMULGATED BY THE BOARD OF DIRECTORS FROM TIME TO TIME.
