2 RULES AND REGULATIONS The Board of Directors of Troon Ridge Estates II is charged with the responsibility of managing the assets of the Association in relation to maintaining the standards of the community. This manual is not intended to be a substitute for each owner having a copy of the recorded documents pertaining to their property. The recorded documents are the CC&R s, the Bylaws, and the Articles of Incorporation. The goal of this manual is to be a quick reference to use in addressing issues and submitting questions. Please see the recorded documents for complete information on all subjects. The Management Company is an extension of the Board of Directors. The Management Company is charged with the task of fulfilling the duties assigned to it by the Board. All calls are to be directed to the Property Management Company. ADDITIONS/MODIFICATIONS: No addition, building, fence, wall or other structural alterations shall be commenced, erected or maintained upon the property until the plans and specifications have been submitted to and approved, by the Troon Ridge Estates II Architectural Review Committee. Homeowners should be aware that in addition to approval by the Troon Ridge Estates II Architectural Committee and the Board of Directors, the City of Scottsdale might also impose requirements for approval and permits. An architectural review request is attached. ANIMALS: No pet shall be allowed to make any unreasonable amount of noise or become a nuisance. Pets must be kept on a leash when not confined in the owner s home or yard. No owner shall permit pets to create unsanitary conditions anywhere in the community or common areas. The owner shall clean up dog droppings immediately. Sec 6.2 Feeding or providing water by any Owner for large animals such as mountain lions (cougar), bobcats, Javelina or coyotes is strictly forbidden. Feeding of birds is permitted to the extent that it does not provide a nuisance to neighbors. ANTENNAS / Satellite Dish: Any communication-receiving device (antennas, satellite dish, microwave receivers, etc.) must be installed in accordance with Federal Guidelines. Please consult the Architectural Review Committee prior to any installation. Placement of dish needs to be in the least conspicuous place location. No fee is charged for this consultation. ART: (Seasonal Decorative Holiday) See attached amendment to Architectural Guidelines dated November 3, COMPLIANCE: All Board of Directors, homeowners, their family and guests and tenants of owners of Troon Ridge Estates II must abide by the CC&R s, Bylaws and Rules and Regulations. 2
3 COMPLAINTS: Arizona State Statutes require all complaints must be in writing, signed by the complainant and delivered to the Management Company via US mail, fax or for presentation to the Board of Directors at their next regular meeting for action by the Board. CONSTRUCTION GUIDELINES: The Board of Directors has developed a set of construction guidelines concerning construction times, parking, noise, etc. A copy is attached for your reference. DUES: Dues are billed annually and are due on or before January 15 th. Dues are deemed late if unpaid after the 21 th of the month in which they are due and a late fee charge will be placed on the account. The late fee will be based on the greater of $15.00 or 10% of the unpaid balance or such other amount that might be authorized by Arizona Statutes. In the event dues are not received within 60 days of the due date, the account may be turned over to the Association s attorney for collection and a lien placed against the property. A lien will stay in place against the property until such time as the account is paid in full. All legal and collection costs will be charged to the property owner. GARAGE DOORS: Garage doors shall be kept closed at all times except for ingress and egress of vehicles or during times of house or yard maintenance. GARBAGE: No garbage, garbage can or trash shall be kept, maintained, or contained on any lot so as to be visible from any other lot or any common area. No incinerator shall be kept or maintained on any lot. Garbage cans should be placed on the driveway for pick-up not before the evening preceding the day of collection and removed no later than the evening of the day of collection. (Black trash bins for Wednesday collection and Pink recycle bin for Friday collection.) All garbage cans are to be stored either in the garage, behind the fence or in an approved enclosure and not be visible by any neighbor, street or common area. No refuse pile or other unsightly objects shall be placed, accumulated or maintained anywhere on any lot. No landscape trimmings and clippings, dead trees, construction debris, etc., shall be deposited in the washes or other common areas. The City of Scottsdale provides pick up of landscape debris and bulk items once per month. The City of Scottsdale provides the schedule annually in your water bill or it can be obtained by calling them. Landscape trimmings can be set out for monthly pick-up 9 days prior to the Monday of the scheduled week of pick-up. All bulk items (i.e. construction, large household items) may be put out any earlier than the Saturday prior to the Monday of the scheduled week of pick-up. The cost of cleanup by the Association of any violations will be billed to the offending homeowner. GATES: Safeguard Security maintains the gates. It is the responsibility of each homeowner to contact Safeguard Security at or visit for access codes and remote controls. Personal access codes should not be given to vendors such as landscape maintenance, pool maintenance, maids, etc. Special limited gate codes are also available for parties by using or by contacting Safeguard. This special code will only work on the day of the party and can be included 3
4 on your invitation. If you feel your personal code has been compromised, contact Safeguard to have a new one issued and the old one deleted. If you change vendors, it is also a good idea to change your vendor code. It requires cooperation by everyone to keep the community as secure as possible. FEES: New construction Architectural Review Fee of $ non refundable $3500 refundable at completion of construction $300 RE-Submittal Fee non refundable Residential Additions $1500 non-refundable for review of plans. Exterior Modifications & Major Re-landscaping $750 non refundable Upon sale of an existing home, the fees are: $400 for preparation of the disclosure documents (payable to the management company) $1000 Tο the Reserve fund of the Homeowner s Association The title company at the close of escrow collects fees on a resale. All fees must be paid to the Troon Ridge Estates II HOA c/o Management Company prior to Association s Architect reviewing the plans. No construction may be started until the Architect has given the Property Owner approval in writing. LANDSCAPING: Landscaping shall be maintained in good condition, neatly trimmed and free of weeds and debris. Each owner has the responsibility for maintenance of the NAOS (Natural Area Open Space) portion of his lot (including washes) in its natural, undeveloped desert state and in such condition that will satisfy the City of Scottsdale s ordinances applicable to such property designated as Natural Area Open Space. Landscaping changes and improvements must be submitted for Architectural Review in advance and follow the approved plant list No tree, shrub, or planting on any lot shall be allowed to overhang or otherwise encroach upon any sidewalk, street, pedestrian way or other similar area from ground level to a height of eight (8) feet. LEASING (RENTING): Leases must have a minimum term of three (3) consecutive months duration, shall be for the entire residence/lot, and must be consistent with the current market price of the time period involved. This provision shall not preclude temporary occupancy by members of the owner s family. Any lease or rental agreement must be in writing and in compliance with the CC&R s, Rules and Regulations, and the policies of the community and on file with the Property Management Company. Owners may use the Tenant Registration Form. In the event there are issues, concerns, or violations, the owner will be notified and will be responsible for correcting the infractions and paying any applicable fines. The owner must provide a copy of the pertinent documents to the lessee: the rental agreement, CC&R s and Rules and Regulations. LIGHTING: Exterior lights are allowed to the only to the extent that they do not interfere or compete with the nighttime views of the desert and surrounding mountains, as 4
5 determined by the Architectural Committee. All lighting must be directed downward and not directly visible to neighbors, street or the NAOS. Landscape lighting should be low voltage. Light fixtures attached to any structure must be enclosed so as to not make the bulb visible. An entry pylon providing lighted identification of the address is required. Garage Door lights may be a maximum of 40 watts. MAINTENANCE: Homeowners are responsible for maintaining the house s exterior stucco, trim, driveways, walkways, perimeter walls in good condition. MEETINGS: Annual Meeting: The Board of Directors shall set the date and place for the Annual Meeting. All owners will be notified at least ten (10) days and not more than fifty (50) prior to the meeting. A Board of Directors shall be elected at each Annual Meeting. Voting can be in person or by absentee ballot. Board Members are elected for a twoyear term in order to create a staggered Board. Two Members are elected one year and three are elected in the alternate year. Board of Director s Meetings: The Board of Directors usually meets on a monthly basis. All Board Meetings (except Executive Meetings) are open to all residents. The date, time and location are posted on the bulletin board at the mailbox at least 48 hours prior to the meeting. NUISANCE AND OFFENSIVE ACTIVITIES: No activity shall be conducted on any property that will in any way unreasonably disturb the owner or resident in any other home. No activity shall be conducted that may endanger the health or welfare of the owner or resident in any other home. PAINTING: The Association has developed a list of approved colors to be used when repainting your home exterior and retaining walls. The Architectural Committee must have prior notification of your intent and must approve any variance from the approved list before starting your project. The appropriate forms can be obtained from the management company or on the website. There is no fee charged for this submittal. PARKING: All vehicles must be parked within the garage. No overnight parking is permitted on the driveway by homeowners. In the event overnight guests may be parked on the driveway, the management company must be notified of the dates that these vehicles will be parked on the driveway. PENALTIES/FINES: SEE ATTACHED FINE SCHEDULE Any violation not corrected will be turned over to the Association s attorney for enforcement and all legal costs charged to the homeowner. Any unpaid fines will be turned over to the Association s attorney for collection and all legal costs charged to the homeowner. 5
6 POOLS: Water from back washing of a pool s filter must be disposed of on the owner s lot. Back washing cannot be directed into the NAOS, over walls or into common areas. Pool equipment must be hidden from the view of neighbors and streets. ROOFS: All roofs must conform to the regulations including the color of the roof or roof coating, which may not be reflective or white. Please contact the Architectural Committee for assistance. SAFETY SPEED LIMITS: Please observe the posted speed limit of 20 mph. Remember ONLY YOU CAN PREVENT SPEED HUMPS. SIGNS: Must follow applicable governmental regulations. WATER LEAKS: If an irrigation water leak is noticed in a neighbor s yard, please attempt to contact the homeowner directly. If unsuccessful, call the management company. Water main leaks should be reported immediately to the City of Scottsdale at YARD SALES / GARAGE SALES: Yard sales and garage sales are not permitted. 8 AMENDMENT TO ARCHITECTURAL GUIDELINES NOVEMBER 3, 2010 DECORATIVE ART: This guideline applies to the installation of any decorative art or objects that will be visible from other Lots or Common Areas. Homeowners must submit an application to the Architectural Review Committee (ARC) for approval prior to the installation of any decorative art or object(s). The application must include dimensions and location of the art or object on the Lot. Decorative objects should be constructed of materials and in such a style as to complement the Sonoran Desert environment of Troon Ridge Estates II. The colors of decorative objects should complement the color of the home and the Sonoran Desert environment of Troon Ridge Estates II. Approved colors include muted earth and desert tones. NOTE: This guidance is not meant to govern Holiday decorations. HOLIDAY DECORATIONS: Temporary Holiday decorations may be displayed from 30 days prior to the Holiday and must be removed within fourteen (14) days following the Holiday.
9 TROON RIDGE ESTATES II FINE SCHEDULE Effective August 15, 2008 PROCEDURE ON FINES FOR ALL VIOLATIONS 1. Warning letter to comply within 15 days of notice 2. $50 for non-compliance on 16 th day 3. $75 for non-compliance on the following 16 th day 4. $100 for non-compliance on the following 16 th day 5. Lien on property ARCHITECURAL VIOLATIONS This includes but is not limited to antennas, clotheslines, outside lighting, encroachments, easements, repairs, storage units, structures, construction activities walls, fencing, signs, commercial activities, illegal structures all of which will carry a fine according to guidelines above. Similar violations during a 12 month period will not require notice of violation for Board to impose a fine. LANDSCAPING This includes but is not limited to a failure to maintain landscape maintenance of trees, grass and any plantings, keeping property free of weeds, installation of materials without application and approval of which will carry a fine according to the guidelines above. Similar violations during a 12 month period will not require notice of violation for Board to impose a fine. LEASING Failure to provide the HOA with a copy of the lease and evidence that the tenant has been provided a copy of the CC&R s as required by the CC&R s will carry a fine of $200 per occurrence. Similar violations during a 12 month period will not require notice of violation for Board to impose a fine.
10 TRASH RECEPTACLES Garbage or recycle receptacles must be removed per the CC&R s after pick-up. Failure to store the bins either in an enclosed area or along the side of the house behind the front plane of the garage with all lids completely closed will carry a fine according to the guidelines above. Similar violations during a 12 month period will not require notice of violation for Board to impose a fine. Please note: The Board of Directors may adjust the fine imposed for persistent or flagrant violations. Failure to comply and pay fines can result in a lien on your property which will add greater costs to the homeowner.
