OF2005 OF THE CITY OF SARNIA "A By-Law to Dedicate Land in the City of Sarnia as part of Murphy Road" (Re: 1151, 1153, 1157 Murphy Road) WHEREAS The Corporation of the City of Samia has acquired certain lands in the City of Samia and deems it expedient to dedicate these lands as public highway fonning part of Murphy Road in the City of Samia. NOW THEREFORE the Municipal Council of The Corporation of the City of Samia enacts as follows: 1. The lands described in Schedule "A" hereto having been acquired by The Corporation of the City of Samia, the same are hereby dedicated as a public highway and fonn part of Murphy Road in the City of Samia. 2. 3 SCHEDULE "A" ALL AND SINGULAR that certain parcel or tract ofland and premises, situate, lying and being in the City of Samia, in the County of Lambton, and being composed of part of Lot 19, Concession 7, Geographic Township of Samia, City of Samia, boundaries of said parcel being more particularly described as follows: COMMENCING at a point in the westerly limit of Murphy Road, being the road allowance between Lots 18 and 19, Concession 7, distant feet measured N 1 0 9' 30" E from the southerly limit of Lot 19, Concession 7; THENCE CONTINUING Nl 09' 30" E along the westerly limit of Murphy Road aforesaid, a distance of feet; THENCE N ' 30" W a distance of 10 feet; THENCE S 1 () 9' 30" W a distance of feet; THENCE S 88 30" E a distance of 10 feet to the point of commencement. Knott, City Solicitor/Clerk DATE: November 16,2005 SUBJECT: Dedication of Road Widening - Murphy Road RECOMMENDATIONS: It is recommended that: 1. Samia City Council dedicate a ten foot strip ofland on the west side of Murphy Road adjacent to 1151, 1153 and 1157 Murphy Road as public highway. BACKGROUND: On December 29 th, 1958 the City of Sarnia was granted a ten foot by one hundred seventy eight point one seven foot strip of land for road widening purposes. This strip of land was inadvertently not dedicated as public highway. A copy of the diagram that was attached to the deed is attached to this memo for Council's information. COMMENTS: Correspondence was received in the Planning Department from a local lawyer requesting a dedicating by-law be registered with respect to the ten foot widening of Murphy Road along the east limit of 1153 Murphy Road to facilitate a real estate transaction. As this is simply a housekeeping matter, Council's approval is respectfully requested. CONSULTATION: Planning staff and the City Engineer, David Fielding, have been consulted and they are in agreement with this report. FINANCIAL IMPLICATIONS: The cost of registering the dedicating by-law is the only financial implication....12
