1 BY-LAW NUMBER :A OF 2000 OF THE CITY OF SARNIA "A By-law to designate the Imperial Oil Centre for the Performing Arts located at 160 & 168 Christina Street North, Sarnia, Ontario, as being of Historic or Architectural Value or Interest" WHEREAS Section 29 of the Ontario Heritage Act, R.S.O, 1990, c.o.i8 as amended, authorizes the Council of a municipality to enact By-laws to designate real property including all buildings and structures thereon, to be of historic or architectural value or interest; AND WHEREAS the Municipal Council of the Corporation of the City of Sarnia has caused to be served on the owners of the the Imperial Oil Centre for the Performing Arts located at 160 & 168 Christina Street North, Sarnia, Ontario, and upon the Ontario Heritage Foundation, notice of intention to designate the art deco features of the Imperial Oil Centre for the Performing Arts, including the Christina Street facade, the Foyer, sealing cove, cornice, hanging structure and metal dome adjacent to the stage and used for lighting and the ceiling of the auditorium and has caused such notice of intention to be published in a newspaper having a general circulation in the municipality once for four consecutive weeks; hereto; AND WHEREAS the reasons for designation are set out in Schedule "B" attached AND WHEREAS no notice of objection to the proposed designation has been served on the Clerk of the Municipality; NOW THEREFORE the Municipal Council of the Corporation of the City ofsarnia enacts as follows; 1. There is designated as being of historic or architectural value or interest the features of the real property more particularly described in Schedule "A" attached hereto, and known as the Imperial Oil center for the Performing Arts. 2. The City Solicitor is hereby authorized to cause a copy of this By-law to be registered in the proper Land registry Office against the lands described in Schedule "A" attached hereto, which are lands affected by this By-law. 3. The City Clerk is hereby authorized to cause a copy ofthis By-law to be served upon the owner of the aforesaid property and on the Ontario Heritage Foundation and to cause notice of the passing of this By-law to be published for each of three consecutive weeks in a newspaper having general circulation in the City of Sarnia. 4. This By-law comes into force and effect upon being finally passed. FINALLY PASSED this J Day of,2000

Lawton Gallery municipally known as 160 & 168 Christina Street North, in the City of Sarnia, County of Lambton, and more particularly described as follows: FIRSTLY: Lot 19 & Part of Lot 20, Registrar's Composite Plan No. 664 designated as Parts 29 and 30 on reference Plan 25R SECONDLY: Part of Lot 20, Registrar's Compiled Plan No. 664, being Part 31 on reference Plan 25R TOGETHER WITH a right-of-way over part of Lots 10 and 20 on Plan No. 664, being Parts 30 and 32 on reference Plan 25R-2807.

5 SCHEDULE "B" The Imperial Oil Centre for the Performing Arts building (formerly known as the Capital Theatre) was designed and built by Mandel Sprachman in The architectural style is described as "art deco or moderne" and is one of the only remaining building of this style of architecture in Sarnia. Members ofsarnia Heritage Committee (LACAC) are of the opinion that specific art de co features of the building that include the Christina Street facade, the Foyer, the sealing cove, cornice, hanging structure and metal dome adjacent to the stage and used for lighting and the ceiling of the auditorium are worthy of preservation by designating them as heritage features. By designating only these features of the building, the owners of the building would not have to seek the City's approval (through LACAC) for renovations to the building that does not include the aforementioned features that may be required in the future.

AIM: To request that Council approve a by-law to designate the Imperial Oil Centre for the Performing Arts located at 160 & 168 Christina Street North, under the Ontario Heritage Act. BACKGROUND & COMMENTS: At their December 6 1h, 1999 meeting, Council gave 1 51 and 2 nd reading to a by-law to designate the Imperial Oil Centre for the Performing Arts property under the Ontario Heritage Act, as requested by the Sarnia Heritage Committee (LACAC). However, concerns were raised by some members of Council regarding the description (Schedule "B" of the By-law) of parts of the building that are to be designated. The by-law was pulled from the Agenda without receiving third and final reading. The chairman oflacac has since clarified the concerns with the Councillors in question and the description in Schedule "B" of the By-law has been revised accordingly. For clarification purposes, the descriptions in Schedule "B" of the by-laws are as follows: Schedule "B" description to the By-law submitted on December 6 th, 1999 Agenda: "The Imperial Oil Centre for the Performing Arts building (formerly known as the Capital Theatre) was designed and built by Mandel Sprachman in The architectural style is described as '"art deco or moderne" and is one of the only remaining building of this style of architecture in Sarnia. Members of Sarnia Heritage Committee (LACAC) are of the opinion that specific art deco features of the building that include the Christina Street facade, the Foyer, the lighting at either side of the stage and the ceiling of the auditorium are worthy of preservation by designating them as heritage features.
