2 BIDDER'S FORM CRUSHING & STOCKPILING AGGREGATE FOR MOUNTRAIL COUNTY 1. The undersigned being familiar with the local conditions affecting the cost of the work and the Special Provisions for the crushing and stockpiling of aggregate, hereby propose to furnish all labor, materials and equipment required for the crushing and stockpiling of aggregate in connection therewith. 4 2. For County leased sites, the contract will be awarded on the lowest bid as submitted and based on the contractor's availability at the time of need by Mountrail County. For Contractor leased sites, the contract will be awarded based on location and contractor s availability at the time of need by Mountrail County. Contractor agrees bid is valid for a period of one year from bid acceptance unless a thirty (30) day written notice is sent to the County Engineer, PO Box 275, Stanley, ND to withdraw such bid. Contractor will be obligated to bid price for any job award(s) prior to withdrawal. 3. For County leased site only, a one-time mobilization fee will be paid from shortest distance to locate contractor s equipment (includes all equipment) to crushing site location. Fee will be based on cost per mile. Total miles to be paid to mobilize must be agreed upon in writing between contractor and the Mountrail County Engineer prior to awarding job. Mountrail County does not pay for demobilization. No mobilization fees will be paid on contractor leased sites. 4. If contract is awarded, contractor will be required to: Sign agreement with Mountrail County and obtain access agreement with landowner. Agreement form will be furnished by the Mountrail County Road & Bridge Department. Provide Road and Bridge department with a copy of approved conditional use permit for proper zoning of gravel pit. Provide Road and Bridge department with a copy of approved Haul Route agreement from gravel pit site to nearest county or state roadway. 5. In submitting this bid it is understood that the right is reserved by the owner to reject any and all such bids and to waive irregularities, and it is agreed that this bid may not be withdrawn for a period of thirty (30) days from this opening thereof. 6. No bid security will be required with the Bid. 7. For all new gravel crushing bids, a Certificate of Liability Insurance with Mountrail County listed as Certificate Holder will be required PRIOR to any work being awarded. (Copy of most recent Liability Insurance) 8. 5 SPECIAL PROVISIONS FOR CRUSHING AND STOCKPILING AGGREGATE 1. Pit Information For County Leased Sites A. Pit locations will be throughout the County and will be determined by the Board of Mountrail County Commissioners. B. The topsoil to be removed from the pit shall be stockpiled adjacent to the area. When excavation is completed, the sides of the borrow pit will be neatly sloped below the natural angle of the repose and the topsoil will be spread over the bottom and slopes of the pit. C. After leveling the bottom and shaping the slopes of the borrow pit, the areas shall be re-vegetated as follows: a. Grazing Land Crested Wheatgrass Western Wheatgrass Slender Wheatgrass TOTAL 5 lbs./p.l.s. Acre 5 lbs./p.l.s. Acre 2 lbs./p.l.s. Acre 12 lbs./p.l.s. Acre b. Cultivated Land No seeding required. 2. Incidental Items The price bid for crushing and stockpiling aggregate shall include the following: A. Stripping, stockpiling and replacement of topsoil and overburden. B. Crushing and stockpiling of aggregate material C. Provide adequate and proper drainage D. Bed preparation and seeding 3. Aggregate Requirements Mountrail County Surface Gravel Specifications A. The required gradation for the stockpile of Mountrail County Surface Gravel as shown below (these specifications must be met on new and existing stockpiles): Page 5 of 7

The plasticity index shall be from Tests will be run in accordance to AASHTO-T90. C. LA Abrasion of less than 40% D. A maximum allowable percentage of Shale 12% E. There will be a minimum of 50% fractured faces, at least 1 fractured face, NDDOT method. 4. Testing A. The Contractor will be required to provide one test per 5,000 cubic yards of material produced for sieve analysis, plasticity index and fractured faces. Tests must be run by an approved testing agency. Final acceptance of the produced pile will be contingent upon test results received by the Board of Mountrail County Commissioners. Page 6 of 7

7 B. All tests must be taken from the belt or stockpile. 5. Measurement and Payment A. The final quantity shall be determined by actual field measurements of the stockpile accepted and in place. County will perform required measurements. B. Payment shall be made according to the price bid per cubic yard for the material accepted and in place. Page 7 of 7
