Davis, Conroe, TX In an attempt to conserve resources, the City is requesting one bid proposal that includes all projects/homes listed above. The City will award one contractor all projects listed on this announcement in anticipation of a turn-key and timely completion. Bidding documents must be submitted individually for each property, however, one final cost, including all work and costs for all properties, should be totaled and clearly submitted on the provided forms. Required bidding forms, specifications, and plans, may be viewed and printed from the City Website at under the Purchasing Department, Bid Opportunities, CDBG Housing Specification Book and Plans. Davis, Conroe, TX Bids from contractors who do not attend this meeting will not be accepted. This project will be funded in whole or in part, with Federal dollars from the U.S. Department of Housing and Urban Development (HUD), Community Development Block Grant Program, (CDBG) administered through the CDBG Department of the City of Conroe, TX. Successful Bidder may be utilized for up to Five (5) years for additional projects related to the Housing Program and neighborhood revitalization. The City of Conroe is an Equal Opportunity Employer. Consideration will be given to all Historically Underutilized Businesses (HUBs). Disadvantaged Business Enterprise (DBE) firms must have appropriate certification and provide the certification at the time of submitting their proposal. Policy It is the policy of HUD that Disadvantaged Business Enterprises (DBE) have the maximum opportunity to participate in the performance of contracts financed in whole or part with Federal funds. The contractor agrees to ensure that DBE s have the maximum opportunity to participate in the performance of contracts and subcontracts financed in whole or in part with Federal funds. The contractor shall not discriminate on the basis of race, color, national origin, sex, sexual preference, creed, religion, ancestry, disability or other handicap, age, marital/family status with regard to public assistance in

4 award and performance of contracts funded in whole or in part with Federal funds. The City of Conroe seeks and supports Section 3, HUB, and DBE firms and encourages their bid submission. The work to be performed under this bid, is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u (Section 3). The City of Conroe supports and promotes Equal and Fair Housing. Where applicable the successful contractor must: Comply with Title VI of the Civil Rights Act of 1964 (P.L ) as amended; Title VIII of the Civil Rights Act of 1968 as amended; the Fair Housing Act (P.L ); Section 504 of the Rehabilitation Act of 1973; the Americans with Disabilities Act of 1990; The Age Discrimination Act of 1975; Executive Order as amended by Executive Order 12259; and with Executive Order as amended by Executive Orders 11375, 11478, 12806, and 12107; Comply with any Federal Regulations issued pursuant to compliance with Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. 794), which prohibits discrimination against the handicapped in any Federal funded contract; Comply with Affirmative Action and Executive Order of September 24, Compliance with the provisions of Section 3, the regulations set forth in 24 CFR 135, and all applicable rules and orders issued there under; Comply with the Hatch Act; Comply with the provisions of 24 CFR , relating to Conflicts of Interest; Comply with Texas HB 1295, Section ; and the filing of Form 1295 located on the Ethics Commission website, An original Form 1295 should be notarized and included with the bid response. Ensure compliance with and manage Davis Bacon Act requirements, if, and where applicable, including; throughout the construction phases, such as but not limited to, certified payrolls, etc. Comply with the Copeland Act, Fair Labor Standards and Contract Work, Hours and Safety Standards Act, and Minority/Women Business Entity Priority. The City of Conroe has adopted Fair Housing Policies. Definitions Disadvantaged Business Enterprises (DBE) means a small business concern: (1) which is at least 51 percent owned by one or more socially and economically disadvantaged individuals, or in the case of any publicly owned business, at least 52 percent of the stock of which is owned by one or more socially and economically disadvantaged individuals; and (2) whose management is daily economically disadvantaged individuals who own it, as certified.

5 Contractors and sub-contractors participating in federally funded programs, such as this project, must not be listed in the Excluded Parties List System as debarred or listed as debarred with the System Award Management System, or other such contractor listing system. Contractors may be required to register with the federal System Award Management System and are required to have a DUNS number. Contractors and subcontractors must be legitimately operating and insurance will be required, as per the bid documents. The successful proposer may be required to provide a Letter of Credit in the amount of 10% of the contract price from a Surety Company holding a permit in the State of Texas and approved by the Federal Government, or other approved creditor. No statement may in any way qualify, modify, substitute or change any part of the instructions to respondents. The City of Conroe reserves the right to reject any and all statements and to award this bid to the proposer that offers the best value to the City, and the homeowner, taking certain evaluation factors into consideration as set forth in the corresponding bidding forms, specifications, and other information provided in the bid packet. 16 INSTRUCTIONS TO BIDDERS SECTION 1 DEFINITIONS 1.1 "City" means the City of Conroe, Texas, which is also sometimes referred to in the Contract Documents as Sponsor. 1.2 "Contractor" means the bidder who is awarded the project. 1.3 Owner means the person identified in the bidding documents as the owner of the site upon which the Project will be constructed. 1.4 "Project" means the Demolition or Construction of new or existing single-family residences, lot clearance, tree removal and fencing, as described in the accompanying contract documents. The project includes all labor, materials, services, equipment and appliances necessary to complete the work in accordance with the project specifications. If indicated in the Invitation to Bidders the project also includes demolition and removal of an existing structure or structures on the property. SECTION 2 INSTRUCTIONS TO BIDDERS 2.1 Examination of Bid Documents and Work Site. Before submitting a bid the bidder shall examine carefully all bid documents including the form of the contract and other documents to be executed. In addition the bidder shall examine the site(s) of the work and fully inform themselves as to all conditions and matters which can in any way affect the costs thereof. The submission of a bid by bidder shall be conclusive evidence that bidder has complied with this requirement. 2.2 Preparation of Bid. The bidder shall submit its bid on the prescribed form accompanying the bid documents. The bid form shall be executed with ink in the complete and correct name of the individual, firm, corporation or combination thereof making the bid and shall be signed by a person authorized to contractually obligate the bidder. All bids must be submitted to the City Secretary by the prescribed deadline in a sealed opaque envelope prominently marked with the bidders name, the project title and the notation SEALED BID - DO NOT OPEN IN MAIL ROOM prominently displayed thereon. 2.3 Withdrawal of Bid Prior to Opening. A bid may be withdrawn by the bidder for any reason without penalty at any time prior to the deadline for bid submission. A bidder desiring to withdraw a bid must do so by written notice delivered to the City Secretary prior to the deadline for submission. 2.4 Firm Offer Following Opening. Once the deadline for bid submission has passed, a bid remains open and may not be withdrawn but may be accepted by Owner and City for a period of sixty (60) days following the date of opening, regardless of whether or not a notice of award has been previously issued to another bidder. SECTION 3 CONTRACT AWARD AND EXECUTION OF DOCUMENTS 3.1 Award of Contract. Award of the contract for the proposed: 8 Demolition bids and the proposed 9 Reconstruction bids, lot clearance, tree removal, and fencing, shall be made to the bidder that provides the best value to the City and the Owner. The award will be made to the overall lowest responsible bidder acceptable to both the Owner and City. Factors determining responsible and acceptable bidders include, but are not limited to; low bid, work quality, timeframe, references, accountability, EPLS eligibility and project management. The Owner and City may reject any and all bids or may proceed to award the contract to the

17 next lowest bidder if for any reason it is determined that the low bidder is not responsible. The Owner and City reserve the right to waive any formality or irregularity in the bids. 3.2 Execution of Contract Documents. Execution of the contract documents (the Closing ) shall be in the offices of the City of Conroe, Texas at a time designated by City. The execution of documents shall be scheduled for a time not later than ten (10) days following notice of award to the successful bidder. The document forms to be executed accompany these Instructions to Bidders. After award these documents will be conformed to include the names of the parties, the Contract Sum, the legal description of properties and other required information. The Project will be financed by the City of Conroe utilizing Community Development Block Grant funds. In connection with the execution of the Contract Documents the Owner will grant a contractual mechanic s lien to Contractor and will execute a Mechanic s Lien Note in the amount of the Contract Sum. The Contractor will be required to assign its Mechanic s Lien and endorse the Mechanic s Lien Note to City which will advance the Contract Sum on behalf of the Owner as provided in a separate Residential Construction Contract to be executed by Owner, Contractor and City. Contractor will be required to execute the following documents at Closing: Contractor s Disclosure Statement for Residential Construction Contractor s List of Subcontractors and Suppliers Mechanic s Lien Contract Endorsement of Mechanic s Lien Note (Previously executed by Owner) Transfer of Lien Residential Construction Contract Award of the contract is not final until all documents required by this paragraph have been submitted and accepted by City and Owner. 3.3 The Contract is subject to a mandatory cooling off period and may be terminated at any time before midnight of the third business day after the date of the closing.
