Project Summary Brief The applicant requests to annex approximately 7.4 acres of South Dakota rail banked railroad right-of-way, South Dakota Highway 44 right-of-way, and the service road adjacent to and north of South Dakota Highway 44. The property is located adjacent to Orchard Meadows Subdivision on South Dakota Highway 44, east of Elk Vale Road. The applicant has requested the annexation of this right-of-way so that the property is located within a proposed tax increment district boundary. A South Dakota Department of Transportation (SD DOT) road construction project for the adjacent service road should be completed within the year. The service road is included within a newly developed road district. This district will may be responsible for future maintenance of the service road. 4 Relevant Case History Case/File# Date Request Action Planning Commission Criteria and Findings for Approval or Denial Pursuant to Section D of the Rapid City Municipal Code the Planning Commission shall consider the following criteria for a request to Rezone: Criteria 1. SDCL states that the City by resolution may annex a contiguous area if a written petition describing the boundaries of the area is signed by no less than three-fourths of the registered voters and by owners of no less than three-fourths of the value of the area to be annexed. Findings This petition appears to meet all requirements for consideration under the provisions for a voluntary annexation.
