1 Memo FROM THE DESK OF THE ZONING ADMINISTRATOR To: ZBA Date: May 31, 2013 Re: June 5 Meeting Notes Sign Variances: Item 1, VRS 1679 This is for a side yard setback variance of 10. The required distance from the side is 20. In general, this separation helps avoid the problem of signs on adjacent properties blocking each other. This setback is more than the requirement for principal structures. The sign on the adjacent property closest to the sign is in place and there is not a conflict. The practical difficulty for the applicant has been demonstrated on the site plan, showing underground storm detention and other matters that made the original location of the sign impossible. This is an after the fact request. I recommend approval because there is no other viable location. Item 5, VRS 1683 This is for a directional sign for Mid Michigan Community College. They are phasing out the Pickard Road campus. They report that many people go to the wrong location. This is technically a Billboard, as it deals with information not related to an activity conducted on the premises. It is my opinion that it is appropriate to draw a distinction between a public institution and community asset and a commercial activity. I recommend approval. It is possible to limit the duration of the variance, requiring removal after a period of time. Occupancy Variances: The rental department will have a representative to offer comments on each case. Concerns they will cover will be adequate bedroom size, number of bathrooms, bedroom size, parking and other comments based on inspections already conducted in the rental program. Another concern for the ZBA would be the appropriateness of opening occupancy up for variances. I find it similar to the variance we granted for wall signs where they were not permitted. I checked with other townships that have a college presence similar to ours, Bath and Kalamazoo Townships both use occupancy variances to deal with student housing and have similar occupancy requirements as we do, not more than 3 unrelated persons per unit. 2 also controlled by SUP. When we instituted the Rental Housing Inspection Program, occupancy came to the forefront. The inspections include a count of tenants. Another problem is when homes are rezoned to commercial. They have lost their underlying zoning requirements and become a legal non conforming use. Also of note, the number of bedrooms is not a determination of occupancy. We cannot hold a traditional family to occupancy numbers, nor can we require home ownership verses rental. Most landlords seem to be under the impression that if a home is approved for 4 bedrooms the home is approved for 4 unrelated tenants. The requests before you are already occupying more than 3 unrelated, and most were under the impression they are already approved for more than 3. The township has determined to give landlords time to make requests for these variance prior to taking any action on over occupancy. Neighborhood concerns will also play a role in your decisions. Item 2, VRO 1680 This cluster of duplexes on Lincoln Road is surrounded by higher intensity uses of apartments, Industrial and Commercial and limited adjacent housing. The units are large and have ample parking. I am comfortable with the request as presented, one of the duplexes is requested to be 4 occupants, the rest are 5, giving consideration to the large master bedrooms. Item 3, VRO 1681 This is a farm home west of town on M20 that is not associated with the acreage anymore. It is two stories. The applicant wished to have one more tenant, for a total of 4 unrelated. The house is distanced from adjacent properties and located next to a grandfathered landscaping business with no residents. I recommend approval. Item 4, VRO 1682 This is a single family home on Silverberry Drive currently rented to students. They are requesting 4 occupants. This subdivision is located adjacent to Lexington Ridge Apartments. They have been renting to 4 students. This request is in a higher density location and maybe subject to more neighborhood concerns. I have had one call objecting to this variance. Item 6, VRO 1684 This is another farm house separated from its acreage and that acreage is now primarily apartments or commercial. The request is for 5 unrelated. It is a large home and can accommodate the extra persons. There are a few other homes along Isabella, which are also in commercial zoning now. They are separated by woods and other uses from this property. Item 7, VRO 1685 This and the following request are existing duplexes on Crawford Rd which were sold under the pretense they were approved for 4 per side. While this is technically not an excuse, it does not change the fact that they were purchased with an expectation of cash flow that would not support the purchase if only 3 per side are allowed. The house is adjacent to other single family homes with some other duplexes in the vicinity and maybe subject to neighborhood concerns. However, I support approval. 4 CHARTER TOWNSHIP OF UNION Zoning Board of Appeals Regular Meeting A regular meeting of the Charter Township of Union Zoning Board of Appeals was held on December 5, Meeting was called to order at 7:00 p.m. Roll Call Lyon, Warner, Newland, Henley present. Strachen absent. Others Present Woody Woodruff Approval of Minutes Lyon moved, Newland supported to approve as presented the September 5, 2012 regular meeting minutes. Ayes: All. Motion carried. Correspondence No correspondence was offered. Approval of Agenda Newland moved Henley supported to approve the agenda. Ayes: All. Motion carried. Public Comment No comments were offered OLD BUSINESS 1.) SCH 1575: Show Cause Hearing to address owner leaving upper oval portion illuminated after 12 midnight, and to verify the Electronic Center intensity decreases after sunset. Owner Fig Betty J Rev Trust At this informal hearing Jeremy Wallace, the manager of Riverwood explained how Riverwood has been having problems with the sign, to the extent of having to have the sign completely replaced. Riverwood is also under the assumption the variance stated the top portion of the sign could be lit past midnight. Public Comment Robert Whitehead of 1442 E Broomfield Rd commented about how bright the sign is and how obtrusive the illumination of the upper portion of the sign is when it is on after midnight. Marty Figg of 1313 E Broomfield Rd thought the variance discussed turning off the bottom portion of the sign at midnight but only reducing the illumination from the upper portion of the sign. Woodruff explained the Show Cause Hearing was just to clarify the intent of the decision of the board about the sign and the hours it is to be illuminated and the consequences of further violation of the variance. The ZBA cannot make a new decision. Newland discussed how the original variance was approved as one sign and Riverwood has two weeks to come into compliance. Compliance includes Riverwood s need to have reasonable illumination during the evening hours and to un-illuminate the entire sign by 12 midnight. 1

5 Lyon moved that the original variance was for one sign, (the oval and LED portion) and it was to be un-illuminated after 12 midnight. Newland supported. Ayes: Lyon, Newland, Warner. Nays: Henley. Motion carried. Newland motioned that to further pursuit of compliance to the variance, the neighbors, Riverwood, and Woodruff will meet to find a reasonable illumination of the LED portion of the sign. Lyon supported. Ayes: All. Motion carried. 2.) VRS 1591: Remove from the Table, a variance for a 32 SF second Freestanding Sign on an easement at the northerly service drive from the requirements for number of freestanding signs, and location on the parcel in a B5 Zone. Owner: Firstbank. Newland moved to take this variance off the table. Lyon supported. Ayes: All. Motion carried. 3.) VRS : Sign Variance of 32 SF second Freestanding Sign on an easement at the northerly service drive from the requirements for number of freestanding signs, and location on the parcel in a B5 Zone. Owner: Firstbank. Doug Ouellette, President and CEO of Firstbank requested a variance to replace the 2x2 foot sign on the northerly service drive with a 5.5 x 7 foot sign. The owners of the other two properties are in favor of the sign. Public Comment No Public Comment was offered. Newland moved to approve the variance as proposed with the understanding the other tenant(s) have the right to add an additional sign of equivalent quality and not to exceed a 42 in height and not to exceed 82 in width. Henley supported. Ayes: All. Motion carried. NEW BUSINESS 1.) VRS 1641: A Sign Variance of 149 SF for a total aggregate of 349 SF and 7 signs, which includes variances of 15 SF each for three wall signs to allow for 3) 65 SF wall signs, variance for a Projected Wall Directional Sign of 4.3 SF area and 1.17 height. Owner: Olive Garden Shawn Smith of Site Enhancement Services explained the need for the variance for the signs due to the unique location of the property. Public Comment A CMU student was there for a journalism class. Lyon moved to approve the variance as presented. Henley supported. Ayes: All. Motion carried. 2.) VSB 1642: A 30.5 Foot Front Yard variance from Section 21, Schedule of Lot Requirements to allow for a 19.5 Foot Front Yard in a B5 (Highway Business) District. Owner: Olive Garden Jack DeGagne of Darden Restaurants requested a variance due to the unique lot shape and location of the property to accommodate the restaurant. Public Comment No public comment was offered. 2

6 Lyon moved to approve the variance to allow for a setback of 19.5 Foot Front Yard in a B5 District. Newland supported. Ayes: All. Motion carried. Public Comment No Public comment was offered. Extended Public Comment No extended Public comment was offered. Other Business The election for new offices for 2013 will be held on the first Wednesday in March. An alternate is still needed. Other designated R-2A neighborhoods in Union Township are located on a quiet street leading to a cul-de-sac or circular egress route, unlike the property on Lincoln Road. A significant increase in business and commercial ventures recently built in this area has generated an increase in traffic, noise, light, and other physical nuisances that extend beyond the limits of their properties. As a result, this has created safety issues that have made my rental units undesirable for families with children, and as such, it is impossible for me to rent these units out to those for whom they were originally built. 7. The sizes of the bedrooms and living areas in four of the five duplexes have the ability to comfortably support 5 occupants per unit. c. None of these circumstances were created by the applicant. The circumstances and conditions are all a direct result of zoning and planning changes implemented by Union Township and the City of Mt. Pleasant.

28 d. Without variance approval, it will prevent me from generating the income necessary to cover the mortgage, property taxes, insurance, utilities, and proper maintenance/upkeep of these units. It also adversely impacts my ability to compete for tenants in a highly competitive rental market in the area. e. No. It simply allows flexibility for the Zoning Board of Appeals to consider this request based on the unique conditions of the immediate neighborhood area. Granting this variance will not endanger the safety and welfare of any of the neighborhood citizens. Given these considerations, I respectfully request that the ZBA grant my request for this variance. The rationale for granting this request includes the following: The owner is currently limited in using the property as currently zoned, due to the significant changes resulting from new developments in Union Township. Granting of this variance will not change the essential character of the area. Properties immediately adjoining the property in question will not be affected in any way from increases in traffic, noise, or other nuisances. The City of Mt Pleasant has the ability to allow by special use for occupancies above 3 tenants that are not tied to one another through some sort of family bond, and based on conditions of the area and the zoning district. My initial suggestion was that you draft an amendment to our zoning ordinance that would provide this flexibility as allowed under the Union Township Zoning Ordinance , Section 4.1.A. I have since brought this matter to our manager and rental inspection department. Union Township strives to keep regulations consistent with other surrounding municipalities. It is our consensus that the township will review the options to provide higher occupancy under certain conditions, recognize a wider range of housing types and make the appropriate amendments. Your letter will be forwarded to our Planning Commission with discussion in general at our December 19th meeting. I have been directed by the manager to begin the amendment process as a township initiative, rather than a citizen initiative. The zoning ordinance does not control bedroom SF, only dwelling SF. Footnote B in the schedule of lot requirements speaks of adding 100 SF to the dwelling minimum SF for each additional bedroom, but this is vague because there is not a base line to establish when you have an additional bedroom. The rental ordinance keys off the zoning for occupancy. We are working on details of using only one board to make this decision, not ZBA and then Rental Board, and having the rental ordinance recognize occupancy variance granted by the ZBA. When Randy and I talked today, it seems best to us both that a variance from the ZBA for occupancy should be all it takes. I guess it would be no harm to apply for 5 occupants, they can always approve less than what you requested. So plan on a variance request for March 6 ZBA. Application due Feb 15. Meanwhile we will be working on dovetailing the two ordinances so you (and any landlord) only have to apply to one board for a variance.
