CALL TO ORDER/PLEDGE OF ALLEGIANCE Chairman Valentine called the meeting to order at 7:00 pm. The meeting began with the Pledge of Allegiance. 2. MINUTES OF PREVIOUS MEETING: Commissioner Rintelman moved and Commissioner Luedtke seconded a motion to approve the minutes of the regular meeting on January 15, The motion carried unanimously. Commissioner Waldo then moved to take items 5a and 5b ahead of item 4a. Commissioner Rintelman seconded, and the Plan Commission moved to item 5a. 3. PUBLIC HEARING a. None 4. OLD BUSINESS a. Discussion and possible recommendation on design guidelines* The Plan Commission discussed this item at each of their monthly meetings from August - December Following the December meeting, staff sought input from Independent Inspections (the new Town Building Inspection company). Their input is seen as important since the Building Inspector will, as preferred by the Plan Commission, review building permit applications and ensure design guideline compliance. Their company also has experience implementing design guidelines in other communities. Staff also asked the Commission how they would like to address plant materials. The Commission discussed the guidelines, noting the size of plantings is important, but were in favor of allowing the developer decide what plant materials to install. The Commission directed staff to proceed with the next required steps toward adopting the guidelines. The Commission then moved to item #6. 5. NEW BUSINESS a. Discussion and possible recommendation on an application to rezone land and amend the Zoning Map for property owned by the Irene A. Kloehn Living Trust located at 5019 Pleasant Valley Road from A-2 Prime Agricultural to CR-A Countryside Residential A and leaving C-1 Conservancy lands unchanged (two parcels totaling 120 acres) with Tax Key #s ( & ) [Petitioner: Kenneth Fleck, NW & NE ¼ Sec. 11, 120 acres total]* Attorney Kenneth Fleck has submitted a rezone application for 120 total acres of property currently zoned A-2 Prime Agricultural and C-1 Conservancy located at 5019 Pleasant Valley Road. Robert Tillmann has an offer to purchase the property from the current owner; Irene A. Kloehn Living Trust. The application follows a rezone concept plan reviewed by the Plan Commission at their January 15 th meeting, at which the Commission was favorable to the idea of residential uses on this land. A rezone is the next step toward a major land division application to come at some undetermined time in the future. 1

3 TOWN OF CEDARBURG PLAN COMMISSION MINUTES February 19, 2014 The Plan Commission discussed the application. Commissioner Rintelman had no objections to the rezone petition, noting the Town would take up the specifics of the layout of the subdivision in the future at the time of a major land division application. Commission Waldo also had no objections to the petition. Commission Downey asked how the existing homestead would be addressed. Attorney Fleck noted that would be addressed in in future land division application, and not at this time; Town Attorney Hoeft concurred with this statement. Commissioner Waldo then moved that the Plan Commission recommend the Town Board approve the proposed application to rezone land and amend the Zoning Map for property owned by the Irene A. Kloehn Living Trust located at 5019 Pleasant Valley Road from A-2 Prime Agricultural to CR-A Countryside Residential A and leaving C-1 Conservancy lands unchanged. Commissioner Luedtke seconded. Chairman Valentine then clarified that Section of the Town Code notes, no change in the A-2 Prime Agricultural District shall be recommended unless the Plan Commission finds that: (a) Adequate facilities in accordance with all Town requirements and ordinances exist or will be provided within a reasonable time. (b) The land proposed for rezoning is suitable for development, and development will not result in undue water and air pollution, cause unreasonable soil erosion or have an unreasonably adverse effect on rare or irreplaceable natural resources. (c) Provision of public facilities to accommodate development will not place an unreasonable burden on the ability of affected local units of government to provide them. Commissioner Waldo amended his motion to include these findings. Commissioner Luedtke seconded, and the motion passed unanimously. b. Discussion on the size of accessory buildings within Transitional Residential and Countryside Residential zoning classifications* This item is on the agenda at the request of Supervisor Rintelman, who noted Dan Miller of 2320 Meadowridge Court is interested in erecting an accessory structure on his lot zoned TR Transitional Residential that would exceed the size currently allowed by Zoning Code. Mr. Miller (1.58 acre property) would like to erect a structure that is somewhere between 1,000 and 1,500 square feet to house his recreational vehicle and other property. The TR district allows 600 square feet maximum for the first acre, plus 100 square feet for each additional ¼ acre, up to 1,000 square feet maximum in terms of accessory space; therefore Mr. Miller would be allowed just over 800 square feet. Mr. Miller prefers to construct a detached accessory structure instead of adding onto the principal structure because it would be more cost effective. In general, Mr. Miller explained he would like to see the Countryside Residential A, Countryside Residential B, TR Transitional Residential, and TR-2 Transitional Residential 2 be allowed at least 1,000 square feet maximum of accessory structure size, as allowed in the R-1, R-2 and R-3 Single-Family Residential districts. He feels this would allow him to maximize the use of his property. Mr. Miller also felt his neighbors would rather see vehicles and other items inside a storage building than left outside. The Commission discussed setbacks and accessory building size for various residential districts. Commissioner Waldo proposed a maximum of 1,000 square feet of accessory building space for the first acre, plus 100 square feet of additional space per quarter acre up to a maximum of 1,500 square feet in the TR district. The Commission also discussed the issue of accessory structure height in various residential districts, as Mr. Miller was interested in increasing that as well. Commissioner Rintelman noted a few residents had come forward with this concern recently, and felt there is a need for larger accessory structures among residents. Commissioner Rintelman then 2

4 TOWN OF CEDARBURG PLAN COMMISSION MINUTES February 19, 2014 directed staff to initiate drafting a text amendment to accomplish the following: increase the allowed size for accessory structures in the CR-A, TR and TR-2 districts to a maximum of 1,000 square feet for the first acre and an additional 100 square feet for each additional quarter acre up to a maximum of 1,500 square feet. The only proposed height change is to the CR-A district; it is to change the maximum height to 15 feet tall, or up to 25 feet tall to match the pitch of the roof on the principal structure (and the accessory structures cannot be taller than the home). This would make the CR-A height consistent with the R-1, R-2, R-3, TR, and TR-2 districts. The Commission then moved to item 4a. 6. ADJOURNMENT Commissioner Rintelman moved to adjourn the meeting.
