4 I. WELCOME We would like to welcome you to Auburn Lakes, a very special and beautiful place to live. The objective of this booklet, is to provide COMMON SENSE GUIDELINES toward maintaining a commensurate quality of life, within our community. These guidelines (Rules) take into consideration the health, safety and comfort of our owners and tenants. This userfriendly interpretation of our Declarations and Bylaws, include basic information on subjects relating to Auburn Lakes Living. It s intent therefore, is not to replace, but to supplement the Declarations and Bylaws. Should there be an inadvertent discrepancy between what is expressed in this booklet and the recorded documents, the Declarations and/or Bylaws shall govern. Unit Owners receive a copy of each of the above mentioned materials, at the time of Unit Ownership. If you have not received a copy of each of the documents mentioned above, please contact your Association s on-site Property Manager ( ). 5 II. MANAGEMENT Board of Directors - Directors are elected at the Annual Meeting, held each year in October, and serve a three (3) year term. The Board consists of seven (7) members:. President. Vice President. Secretary. Treasurer. Members at Large (3) The Board, on behalf of the Association, retains the services of a professional management company, to handle the day-to-day operations. This company provides for an On-Site Manager, during normal working hours, Monday - Friday. Contact information may be found in your Auburn Lakes Telephone directory. MEETINGS - Regular meetings of the Board of Directors are held the Fourth Monday, of each month, typically at 7:00PM. Unit Owners are encouraged to attend all meetings. Time at each session is set aside for Resident Interaction. Notification of monthly meetings is posted in the community mail huts. Residents are notified by mail, however, regarding the Date and Time of our Fourth Quarter Annual Meeting. ON-SITE MANAGER - All Service Requests, Questions, and Resident Problems are to be directed to the attention of the on-site Property Manager ( ). Requests for Service may be made by phone or letter. Complaints are to be submitted in writing. III. DEFINITIONS COMMON ELEMENTS - Common Elements include everything except the Units, and they are collectively owned by the community s Unit Owners. The repair and maintenance of all the Common Elements, is accomplished via the Association s Operating / Reserve Expense Budgets. Unit Owners are NOT permitted to make any alterations to Common Elements, including the exterior portion of their Unit, without first obtaining written consent from the Board. Modifications / Additions which affect the exterior of a Unit, require 100% approval by the Association s Members. 1 of 15

DEFINITIONS (cont d) LIMITED COMMON ELEMENTS - Defined as those areas of Common Elements, which are maintained by the Association, but whose use is Limited to the individual Unit Owner, e.g., Decks, Docks and Driveways. UNIT - Each Unit consists of the space bounded by the interior (i.e., un-dry walled, or covered) surfaces of the perimeter walls, floors and ceilings. This area is owned exclusively by the purchaser of the Unit. Refer to the Declarations and Bylaws, for more specific detail. ASSOCIATION RESPONSIBILITIES - The Association is responsible for reasonably maintaining the following:. Exterior of Units e.g., Roofs, Gutters, Down Spouts, Trim and Siding Note: Windows, water facets and electrical outlets are the responsibility of the Owner.. Decks and Docks. Landscaping. Mailbox Housing (Mail Huts). Roads, Driveways, Parking Areas, Sidewalks and Walking Paths Note: Auburn Lakes Drive, from the Main Entrance to the cul-de-sac at Point Breeze, is maintained by the Township. All other roads are the Associations Property.. Signage (i.e., street and traffic). Lighting (i.e., street, facilities and grounds). Clubhouse. Swimming Pool. Tennis Courts. Ponds & Lake. Storage Units. Pest Control. Master Policy (Insurance) Note: Covers all Common Elements (i.e., Natural Spaces, Gardens, and Arbor), within the Association s 100+ Acres, and the exteriors (i.e., dr y wall out) of its 156 Units. It does NOT cover those areas defined above, as a UNIT. 2 of 15

7 IV. RULES and REGULATIONS (cont d) The Association s Common Elem ents have been designed for the use and enjoyment of all its residents. Everyone is required to be considerate in their behavior and protective of this environment. The following rules and regulations are intended for the express purpose of protecting these assets, and enhancing the livability of our Community. 1. CONTRACTORS - Unit Owners and residents must NOT give the Association s contractors instructions, with regard to work being done at a residence and / or elsewhere in the community. This requirement is necessary in order to ensure that work is performed in accordance with the Association s contractual agreements. 2. CLUBHOUSE - The Clubhouse is available to Unit Owners for private functions, and must be scheduled via the On-Site Manager. At the time of scheduling, the Unit Owner will be provided with a Usage Check List that covers the responsibilities of a Unit Owner. A Refundable Deposit is required, and a specific dollar amount will be invoiced, to cover the cost of cleaning the facility at the conclusion of its scheduled use. 3. CONTACT INFORMATION - Emergency, Utility, Committee and Director phone numbers, may be found in your current Auburn Lakes Telephone Directory. 4. CROSS COUNTRY/ OFF-ROAD VEHICLES - Use of cross country/offroad vehicles such as ATV s, Snow Mobiles and / or Trail Bikes is prohibited, EXCEPT to enter and exit the community through normal roadway access. 5. EXTERIOR Signage and Decorations - Signs of any type, including construction signs, must not be displayed in shrub/flower beds, or hung on any part of a Unit. Name plates of any kind are also prohibited. The following decorative items may be permanently affixed to any unit. a. Brass Door Knockers & Kick Plates b. Flag Holders* c. Wreaths *Note: Only National / State Flags may be displayed. Other decorative items, such as those listed below, for example, may not be displayed in the front of Units. a. Bird Feeders, Baths, or Houses b. Wind Chimes c. Trellis, or Statuary of any type 3 of 15

8 IV. RULES and REGULATIONS (cont d) 5. EXTERIOR Signage and Decorations (cont d) The following EXCEPTIONS apply to the above rules on signage. a. Real Estate Agents and Unit Owners are permitted to place an Open House sign at the street entrance and directional arrows at strategic points, the day of event, ONLY. b. One Security Protection Sign, not to exceed 2 feet in height, and 12 X12 in size, may be displayed in a front shrub area. NOTE: For Sale Signs are Prohibited on Association Property. 6. EXTERMINATION SERVICES - Pest Control Services are provided for common insects and other annoying nuisances, on the Interior/Exterior of a Unit. The cost for this service is included in your Quarterly Maintenance Fee. Scheduling takes place via the On-site Manager. 7. FIREWORKS - The use of fireworks is prohibited by law. 8. GARAGES - Replacement doors, openers, and mechanisms such as: motors, tracks, cables, springs, locks, etc., are the responsibility of the Unit Owner. Damaged doors must be replaced immediately and painted to match the color of the original door. Any changes to a garage door must have prior written approval. Doors must be closed when not in use. Hazardous, or Flammable items may not be stored in the garage. 9. GARBAGE/TRASH - Residents are provided a 90 gallon mobile cart by the trash removal service, contracted by the Association. Collection takes place on Monday, and containers should not be placed outside for pickup, earlier than dusk the day before. a. Containers are not permitted to be conspicuous, except on the day trash is collected b. Trash/Garbage Containers must be stored in the units garage at all times. c. Residents who are out of town on pickup day, must make arrangements with a neighbor to be responsible for their container. d. Collection timing may be effected by holiday schedules. e. The Association doesn t provide for a Recycling Service. f. For large items such as major appliances, phone the on-site manager, one week in advance. There will be an extra charge. g. Dismantled moving boxes will be picked up, (no extra charge), for a reasonable period. h. Garden refuse may be cut up and placed in your cart. 4 of 15

9 IV. RULES and REGULATIONS (cont d) 10. GEESE and DUCKS - The feeding of water foul is absolutely prohibited. In addition to issues caused by water foul, food placed on the ground, attracts rodents. 11. GOLF CARTS - Must.. a. Be driven ONLY by a Licensed Driver b. Have at least one (1) operational Headlight, and Reflectors affixed to its rear. c. NOT be Driven on Common Element Grassy Areas. Use the paths and roads provided. d. Park in spaces provided. Parking on Common Element Lawns, is PROHIBITED. e. Obey Motor Vehicle Regulations while operating within Auburn Lakes. 12. GRILLS - Must be used away from the units exterior walls, to prevent damage to the siding. Repairs required, due to smoke/heat, are the responsibility of the Unit Owner. 13. HOLIDAY DECORATIONS - Tasteful, temporary holiday decorations are permitted on the exterior of a Unit. Holiday decorations of any type, must be removed by no later than two (2) weeks, following the holiday being celebrated. 14. ICE MELTING COMPOUNDS - Because of possible contamination of the Wells, Lakes, and Ponds, Unit Owners must obtain written approval from the Board, before using Salt, or Other Chemical Compounds to melt snow or ice. Residents may use Kitty Litter / Sand for icing problems in their Limited Common Element space. 15. INSURANCE - a. The Association carries a Master Policy in accordance with it s Declarations. b. Unit Owners are required to assume the Deductible for any personal damage claims to the interior of their Unit. c. Only the Board may submit claims against the Master Insurance Policy. NOTE: It is highly recommended that the Unit Owner and their personal insurance company, understand the Declarations of the Associations Master Policy Coverage (i.e., Water Damage, etc.). Copies of the Auburn Lakes Policy Declarations are available from the on-site Property Manager. Refer to Unit, under Definitions. 16. KEYS and SECURITY CODES - Although not mandatory, Unit Owners are encouraged to file a spare House Key and personal Security System Code with the Manager. In addition, it is requested that the Unit Owner leave a Forwarding Address and Telephone Number with management, if planning to be away from their unit for an extended period. It is also advisable to inform a neighbor when you re away, in case of an emergency, when management is not on property, e.g., weekends / evenings. 5 of 15

10 IV. RULES and REGULATIONS (cont d) 17. LAKES - Use of the Associations Lakes and Ponds, are solely at the risk of the Unit Owner, his Tenant and/or Guests. a. All children (under age 14) and Guests, MUST be accompanied by a Unit Owner. b. Swimming by Non-lake Property residents, is ONLY permitted from the Beach area. c. Boating by Non-lake Property residents, is ONLY permitted on the Main Lake. d. Any Boat launched, may NOT be greater than 16 in length. e. Motorized Boats are prohibited, EXCEPT for those with Electric Motors. f. Fishing is permitted from Open Common Elements on all lakes/ponds, except where posted. PLEASE do not intrude on a resident s Limited Elements. 18. LANDSCAPE - Except as otherwise provided, the Association is responsible for reasonably maintaining/replacing landscaping. All trees, bushes, grasses and shrubbery, fall under the jurisdiction of the Association, and as such, any/all changes require the prior, written consent of the Board. Any Board Approved changes/additions are the responsibility of the Unit Owner to maintain. Authorized Association Contractors MUST have access to any/all arbor existing on Limited Common and Common Elements (i.e., ability to trim trees/shrubs determined to be too close to Units, etc.) Owners/Tenants are encouraged to water shrubs and trees in the immediate vicinity of their unit, during extreme drought periods, to save future replacement costs. Note: 1.Grass becomes dormant in hot, dry weather and will recover naturally. It is not necessary to provide grass with the same protective attention. 2. Reels for garden hose (of any type) may not be attached to a unit. 3. In ground sprinkler systems are not permitted. 19. LEASING - A Unit Owner: a. May not Lease less than the entire unit (e.g., A portion of his square footage). b. May not Lease for a period less than four (4) consecutive months. c. May not Lease to a Tenant that requires more than two (2) persons per bedroom. d. Must provide a copy of the Lease to the Association and have it approved in writing by the Board, prior to the commencement of the lease. e. Remains totally responsible for the unit, and for the conduct of his (her) tenant, and for making the tenant aware of the Rules and Regulations. f. Lease document must contain a clause making it subject to the covenants and restrictions in the Declarations, Bylaws, and Rules. g. Must provide the on-site Property Manager with: * Copy of the lease * Full name of the tenant(s) * Name of all occupants * Home and Business telephone number of tenant(s) 6 of 15

11 IV. RULES and REGULATIONS (cont d) 20. MAILBOXES - a. Unit Owners are responsible for their own mailbox keys and maintenance of the lock. Please contact the Bainbridge Post Office for repairs and replacements. b. If you are going away for more than two (2) delivery days, the Post Office requests that you have your mail Held at the Post Office, as our locked mailboxes are not large enough to hold several days mail. c. Social notices and other community information is often posted in the Mail Huts. 21. MAINTENANCE FEES - The Association s management company submits Maintenance Fee billing statements to all Auburn Lakes Residents, for payment on a Quarterly Basis. a. Payment is due on the first day of the quarter being billed. b An account is considered delinquent, if payment isn t received by the 10 th of the month c. Should delinquency occur, a 1.5% Late Fee will be charged. Note: See Cost of Collections and Liens 22. NUISANCES - Activities which may be annoying, or a nuisance to other residents, by penetrating a Unit Owner s Limited Common Elements, or physical confines of their Unit, are prohibited e.g., Loud radio/tv, instruments, generators, motors, chimes, etc. 23. OBSTRUCTION of COMMON ELEMENTS - a. In order to preserve the beauty of Auburn Lakes, and maintain consistency of appearance and respect for all Unit Owners throughout the community, residents are may NOT leave personal belongings such as: Machinery, Bicycles, Wagons, Toys, Benches/Chairs, Fire Wood, etc., in /on Common Elements. Landscapers will not accept the responsibility of moving personal property, to facilitate grass cutting. b. Items that cannot be stored within a Unit at night, or when not in use, are prohibited. c. The existence of any items, other than those that are a part of the Original Landscape, require the prior, written consent of the Board of Directors. d. Skateboards and Skateboard Ramps are strictly prohibited in Auburn Lakes. 7 of 15

12 IV. RULES and REGULATIONS (cont d) 24. PARKING - a. Residents must use their garage space, as their primary parking area. b. If a Unit Owner has more vehicles than can be stored in their garage at the same time, that vehicle (s) must be temporarily parked in the Unit Owners driveway, not in Guest Parking Areas, or on the street, etc.. c. It is strongly encouraged, that a resident make arrangements to park the additional vehicle (s) off-site. d. Vehicles too large to park in the garage, such as Campers, Mobile Homes, Buses, Boats/Trailers, etc., are Prohibited and must be stored off-site. Vehicles in violation may be towed and stored off-site, at the Unit Owners expense. e. Vehicles requiring a Truck License, may not be kept on the property overnight. f. All vehicles on the property must bear current/legal license tags. g. Disabled vehicles may not be left on the property for more than 72 hours. Additionally, if that vehicle is blocking an access way, it must be removed immediately. Notwithstanding other applicable association remedies, the vehicle may be towed and stored off-site, at the Unit Owners expense. h. Parking in an area designated as a Fire Lane, is prohibited. i. Overnight parking on the street is prohibited, under any / all circumstances. j. Parking, or driving on any grassy area, or lawn is prohibited at all times. k. Before entertaining several guests, at a scheduled function that may require parking beyond the Unit Owners driveway, PLEASE inform neighbors in advance. Guests need to be advised about not parking on the grass, but rather to park on the street and in the Guest Parking space provided. 8 of 15

The Board of Trustees has the right to restrict the size of pets, as well as the right to have any pet removed, if it is considered dangerous to residents, other pets, or it is found to be an unreasonable disturbance. b. Pets may not be bred within Auburn Lakes. c. No animals, rabbits, fowl, reptiles, livestock, or poultry of any kind (except Dogs / Cats), may be kept within the Condominium Property. d. A maximum of two (2) Dogs, or two (2) Cats, or one (1) of each is permitted in any unit. e. Unit Owners are required to have prior, written approval from the Board, if they are planning to accommodate guests with pets, for more than three (3) days. f. Invisible fencing is strictly prohibited. g. Dogs are not permitted outside a Unit, unless on a hand-held leash not to exceed six feet (6 ) in length. h. Pets (i.e., dogs and / or cats) are prohibited on the beach. i. Pet owners are liable for any / all damage by their pets (or their guest s pets) to any Common Elements, including, but limited to, shrubs, trees, grassy areas, etc.. j. Subject to notice and an opportunity for a hearing, a $50 penalty assessment may be levied against any Unit Owner who fails to clean up after their pets, immediately. This requirement, includes pet owner violations on Unit Decks and Docks. 26. RECREATIONAL FACILITIES - a. Use of these facilities are limited to Residents of Auburn Lakes and their Guests. b. All Guests must be accompanied by a Resident, when using recreational facilities. c. Facilities, by definition are: The Beach, Clubhouse, Lakes, Pool, Pitch-n-Putt, Tennis Courts and Walking Paths. d. Littering is prohibited. Any damage to the Common Elements, caused by an Owner, Resident, or a Guest, shall be repaired/replaced at the expense of the Unit Owner. 9 of 15

14 IV. RULES and REGULATIONS (cont d) 27. SALES a. Estate Sales require the prior written consent of the Board. b. Garage/Lawn Sales are not permitted. c. Signs are prohibited in a Units Window, or anywhere on the Units Exterior. d. Within fifteen (15) days of executing a purchase or sales agreement, the Unit Owner or real estate agent, must notify the on-site Property Manager to make arrangements for a maintenance fee update letter and certificate of insurance for the buyer. e. At the same time as above, the Unit Owner must provide the following: * Names of all occupants * Home and business phone numbers and mailing addresses * Name, business address and telephone number of any person managing the Unit on behalf of the Owner. * Sales price and Mortgagee Note: Any changes in this information, must be provided to the Board within thirty (30) days of the change. f. The on-site manager will coordinate the paperwork with banks, real estate agents, appraisers and escrow agents. A transfer fee for these services may be charged to the seller and paid out of escrow from proceeds due the seller, at the time of title transfer. g. The seller is responsible for providing the following information to the buyer: * Copy of Declarations and Bylaws, and any amendments * Copy of the Rules and Regulations * Keys for: Unit access, garage door, and mail box. * Garage door opener 28. SNOW REMOVAL - Any vehicle parked on a Unit s driveway must be removed before the snow plow contractor arrives, or the driveway will not be plowed. Salt is prohibited. Residents are encouraged to use sand on icy areas, near their Units. 10 of 15

15 IV. RULES AND REGULATIONS (cont d) 29. TELEVISION PROGRAMMING OPTIONS a. Unit Owners have the option of Cable and/or Satellite Systems. b. Arrangements for installation, or de-installation is the resident s re sponsibility. c. All costs associated with either Cable, or Satellite Services, are at the Owner s expense and will be billed directly to them, by the provider. d. While the Unit Owner may not elect either option, it must be noted that antennas on the exterior of a unit, or on property, are strictly prohibited. CABLE - Service is available within the community and it is provided by: * Adelphia * Ceebridge Cable SATELLITE - Local service varies. Selection is entirely at the resident s choice. a. A satellite dish measuring one meter, or less in diameter, may be installed within the Limited Common Element for the purposes of receiving video programming. b. Unit Owner (s) must submit a drawing to the Board, identifying the exact location, size and mounting method, for approval, in advance of installation. If camouflage is necessary to insure minimal visual intrusion for a neighbor, it s cost is the responsibility of the Unit Owner. c. The Resident is entirely responsible for the on-going maintenance required for the satellite dish, wiring, and related equipment. 30. TRAILS / PATHS - Surfaced pathways have been developed for the exclusive use of Auburn Lakes Residents. They were designed for: walking, jogging, bicycling and cross country skiing. Except for golf carts, all motorized vehicles are prohibited. 11 of 15

16 V. COLLECTION and LIENS a. Any cost, including attorney fees, recording costs, title reports and/or court costs incurred by the Association in the collection of delinquent maintenance fees, or Assessments, will be added to the amount owed by the delinquent Unit Owner. b. Past Due Maintenance Fees / Assessments, may cause a Lien and Foreclosure to be filed against the Unit Owner. Any payments made, shall be applied in the following order: * Interest and / or administrative late fees owed the Association * Collection costs and attorney s fees incurred by the Association * Principal amounts owed on the account for common expenses and assessments c. Any costs, including attorney s fees, recording costs, title reports and / or court co sts incurred by the Association in the collection of delinquent assessments, shall be added to the amount owed by the delinquent Unit Owner. d. If any Unit Owner, or his (her) tenant violates the Declarations, By-Laws, or Rules and Regulations in a manner which, by the determination of the Board, affects the rights of others, or their property, immediate legal action may, at the discretion of the Board, be initiated. Costs associated with the cure, incurred by the Association, shall be charged to and collected from, the Unit Owner. Any such amount will be deemed an additional assessment and shall be due and payable immediately following notification. The Association may obtain a lien for said amount, in the same Manner and extent, as if it were a lien for common expenses. e. If any Unit Owner is delinquent in the payment of fees for more than thirty (30) days, the Board may suspend the privileges of the Unit Owner to vote and / or use any of the Associations amenities. VI. EXTERIOR MODIFICATIONS The Board has adopted an objective policy and procedure for facilitating Unit Owners requests, involving exterior modifications, in accordance with Ohio Law. Owners must obtain a copy from the on-site Property Manager, before commencing with any projects. 12 of 15

17 VII. COMPLAINT PROCEDURE a. Complaints against anyone violating the rules, must be submitted to the on-site Property Manager in writing and must contain the date, signature, unit number and telephone number of the individual filing the complaint. b. The on-site Property Manager will, in most instances, contact the alleged responsible owner after receipt of each complaint, and a reasonable effort will be made to gain the owner s agreement to cease the violation. c. If the reasonable efforts to gain compliance are unsuccessful, the Unit Owner may be subject to a sanction, in accordance with the penalty provisions contained in the Enforcement Procedure. VIII. ENFORCEMENT PROCEDURE a. The Unit Owner shall be responsible for any violation of the Declarations, Bylaws, or Rules by the owner, guests, or occupants, including tenants, if any, of his / her Unit. b. Notwithstanding anything contained in these Rules, the Board shall have the right to proceed immediately or otherwise, with legal action for any violation of the Association s governing documents, as the Board, in its sole discretion may determine. The entire cost of effectuating a legal remedy to impose compliance, including court costs and attorney fees, shall be added to the account of the responsible owner. c. All costs for extra cleaning and / or repairs stemming from any violation, will also be added to the responsible owner s account. d. In addition to any action, and in accordance with the procedure outlined in Section E below, actual damages and / or an enforcement assessment of up to, but not exceeding $50.00 per occurrence, or if the violation is of an ongoing nature, per day, MAY be levied by the Board against an owner in violation. 13 of 15

18 VIII. ENFORCEMENT PROCEDURE (cont d) e. Prior to the imposition of an enforcement assessment for a violation, the following Procedure will be followed: 1. Written notice(s) will be served upon the alleged responsible owner specifying. * A reasonable date by which the owner must cure the violation to avoid the proposed charge, or assessment * A description of the property damage or violation, and * The amount of the proposed charge and / or enforcement assessment, and * A statement that the owner has a right to, and the procedures to, request a hearing before the Board, to contest the proposed charge and / or enforcement assessment. 2. To request a hearing, the owner must mail or deliver a written Request For A Hearing notice, which must be received by the Board not later than the tenth day, after receiving the notice required by Item E-1 above. * If an owners timely requests for a hearing, is at least seven (7) days prior to the hearing, the Board shall provide the owner with a written notice that includes the date, time, and location of the hearing. If the owner fails to make a timely request for a hearing, the right to that hearing is waived, and the charge for damages and / or an enforcement assessment will be immediately imposed; and * At the hearing, the Board and the alleged responsible owner will have the right to present any evidence. This hearing will be held in Executive Session and Proof of the hearing s evidence, or written notice to the owner to abate action, and intent to impose an enforcement assessment, shall become a part of the hearing minutes. The owner will then receive notice of the Board s decision and any enforcement assessment imposed, within thirty (30) days of the hearing. * The Association may file a lien for an enforcement assessment and / or damage charges, which remain unpaid for more than ten (10) days, when implemented through House Bill 135 Amendments. 14 of 15

19 IX. CHANNELS OF COMMUNICATION The Board of Directors consists of seven (7) individuals who are Unit Owners and are elected by their fellow Unit Owners. Board members serve without compensation and are responsible for making the decisions affecting our property. Decisions concerning the property are made during the Board s monthly meetings, generally held on the fourth (4th) Monday of each month, at 7:00PM. In between the monthly Board Meetings, the Association relies on the on-site Property Manager to carry out the Board s decisions and handle all the communications by and between the Association s owners, contractors and vendors. If you have quest ions or concerns about the maintenance of the property, please direct the matter to the on-site Property Manager. The Board requests and appreciates your cooperation in respecting that Board members are not employees and should not be contacted directly on Association related matters, outside of Board Meetings. Board members are not individually responsible for resolving Association matters and can only decide issues brought to their attention by the on-site Property Manager. The only exception is that if you should send a letter directly to a Board member, concerning issues that you may have with the on-site Property Manager. Again, all other communications must be directed through the on-site Property Manager, to assure that your concerns and questions are properly addressed and answered. 15 of 15
