3 FREQUENTLY ASKED QUESTIONS 1. What is a homeowners association? Automatic and mandatory homeowners associations are part of an overall concept of residential property ownership. Purchase of a home or lot brings with it membership in the association which provides the structure for operation and management of the residential community concept. Membership includes certain mandatory obligations, financial responsibilities and rules of the association. 2. What is the overall purpose of the HOA? The community association gives continuity to the community, preserves the architectural integrity, maintains the common properties, and promotes the community concept while protecting the community s property values. 3. What is the purpose of the governing documents? The purpose of a community association s governing documents is to provide for the legal structure and operation of the community. The documents: Define the rights and obligations of both the association and its owners Create a binding relationship between each owner and the association Establish the mechanisms for governing and funding the association s operations Set forth rules and standards for the: o Protection of both owners and the community o Enhancement of property values o Promotion of harmonious living 4. What do my dues cover? All community associations have fees or dues (assessments) that must be paid to the association. Depending on the association, the assessments may be paid monthly, quarterly, or annually and may cover such costs as: Landscape and maintenance of common areas Repairs and maintenance of amenities (pool, clubhouse, exercise room, tennis courts, etc.) Social activities Police patrol Insurance 5. What doesn t the HOA do? Your HOA management team is there to serve the residents. However, it cannot resolve domestic disputes or disagreements between neighbors, act as a substitute for police or law enforcement, supply security services or attempt to control county or city services. 6. What are the CC&R s? The Covenants, Conditions & Restrictions are guidelines that were established to ensure a level of design consistency and help establish an overall character for the community. All residents are required to familiarize themselves with these documents and receive the necessary review and approvals to comply with the terms of the CC&R s in the event you wish to make any changes or improvements to the exterior of your home or lot. Builders are typically responsible for initial construction.
4 7. What is the role of the Board of Directors? The board manages the community. The role and scope of authority of the board may be broad or specific, depending on the association s governing documents and the law. Examples of the powers generally granted by the governing documents and state law to the board include: The authority to set goals, standards, and policies for the association Enforcing the governing documents Maintaining the property Maintaining the association s financial stability Purchasing adequate insurance Entering into contracts for services Creating and supervising committees Conducting annual meetings and board meetings 8. Why do we need FirstService Residential if we have a Board? FirstService Residential specializes in managing community properties and provides expertise in all areas of fiscal service including financial preparation, collections, administrative, record keeping, transfer and resale certificates, governing document compliance, common area maintenance, board of director and committee development, resident services, newsletter preparation, and more. In addition, boards are not accustomed to serving as a contact with repair contractors, developers, local politicians, city/county or state government agencies, and other offices with which community associations need to work. 9. What is my role as a homeowner and member of the HOA? Members of the homeowners association have two responsibilities, one to themselves and to their individually owned property and one to the association and the community concept. Apathy by individual members can render the association ineffective and can destroy the community concept. To maintain the quality of life that accompanies a well-maintained residential community, each individual member must do his or her part. The success of the homeowners association will depend on how well each member meets and keeps the responsibilities that are established by the covenants creating the overall community concept. 10. How else can we foster the community concept? Resident involvement in community associations is increased when owners partner with the management team and become actively involved as volunteers to create fun programming that fosters community spirit and creates lifelong friendships among neighbors. Community spirit means pride in a community. And spirited communities, like safe neighborhoods, have higher resale values. Community spirit also creates an emotional equity that sets communities apart from the rest.
5 Mistletoe Hill Homeowners Association Mistletoe Hill is proud to partner with FirstService Residential and its HOA management team to provide excellent customer service to Mistletoe Hill homeowners. FirstService is dedicated to placing proper emphasis on those elements that are the essence of a great community specializing in resident relations and enriching the lifestyles of our homeowners. In addition, FirstService maintains a tradition of excellence and commitment to quality in providing maintenance and upkeep of our public and private open spaces, community amenities and diligent enforcement of community covenants. Homeownership is one of the most important decisions you will make. As a Mistletoe Hill resident, you will want to familiarize yourself with the HOA Guidelines as soon as possible. As a reminder, you are encouraged to thoroughly read through all of the HOA documents received during the closing sale of your home. With your investment in mind, here are just a few of the common topics asked by new homeowners. Exterior Home Modifications As stated in your community documents, before making any changes or improvements to the exterior of your new home you must get written approval by filling out a Mistletoe Hill HOA Architectural Control Committee (ACC) Request Form and submitting it to the Association for approval. This document can be found on your community website, under the forms tab. Examples of changes that require prior approval are landscaping (planting new trees and shrubs, flower bed edging), gutters, storm doors, arbors, patios, pools, playground equipment, sheds, etc. Trash and Recycling Receptacles Trash may go out at dusk on the evening before trash pick-up day and must be stored by dusk on the day of trash pick-up. Trash and recycling containers must be kept inside the house, garage, or fenced yard and may not be visible from the street. Vehicles Commercial, inoperable, recreational, trailers, boats and other watercraft, may not be parked, kept or stored on any lot or street unless stored or placed within the garage; or screened from view of the general public. If you need an exception for a short period of time, call us ( ). Lawn Care Maintenance Regular maintenance such as mowing, edging of turf areas, weeding of plant beds, fertilizing, weed control and watering of turf and landscape are required. Diseased or dead plants and/or trees must be removed and replaced within a reasonable time frame. Please remember the above information is a brief outline. Please refer to your Covenant, Conditions and Restrictions for a full guide on rules and regulations.

I (we) understand that any violation of the rules may result in discontinued pool privileges. I (we) further understand that I (we) are responsible for my family and/or guests and that if any damages are incurred as a result of the actions of our family members and/or guests, I (we) will reimburse the Homeowners Association for any and all costs incurred. The pool rules for the Mistletoe Hill community are as follows: Mistletoe Hill Pool Rules - HOURS: 10:00AM 9:00PM NO LIFEGUARD ON DUTY ACCESS / GUESTS: Access to the pool/amenities area is for members of the Homeowners Association and their guests only. Guests must be accompanied by a homeowner. Large groups or parties should contact the management company for reservations contact via at fwreservations.tx@fsresidential.com RULES: 1. You must be at least 16 years old in order to enter the pool area without adult supervision. 2. All children ages 4 and under MUST wear only the Swim Diaper 2-Layer System in pool or spa. Do not change diapers in the pool area (restrooms only) 3. Everyone must get out of both pools for the Pool/Patron Break when whistle is blown. 4. No eating or drinking while in the pool or pool deck area. Food and beverage may be consumed in the Cabana area only 5. No glass containers in or near the pool or amenity center 6. Must dispose of all trash in containers 7. No animals allowed in pool or enclosure area 8. Persons with infectious diseases should not use the pool 9. Swimming alone is NOT recommended 10. Children in baby pool must be supervised by an adult at all times 11. No running or rough housing 12. Swim wear only (no jeans or street clothes allowed) 13. No abusive language, loud radio or excessive noise 14. The Homeowners Association assumes no responsibility for any personal injury or loss, theft or damage to personal property or effects left in pool area 15. No rafts or other large floatation devices allowed 16. Swimmers must shower before entering pool/spa 17. Alcohol not to be consumed while using these facilities in or near the facility 18. Communications Committee: This committee s aim is to keep the community informed about all activities and functions of the association through our website; Landscape Committee: This committee helps select seasonal color changes, contributes ideas for long and short term landscape improvement and assists the management company in overseeing the landscape contractor s maintenance upkeep. They also select and oversee the yard of the month as well as Halloween/Christmas decorating contests. Decorations Committee: This committee s function is to oversee holiday decorations for the community as well as assembling volunteers to put up/down decorations accordingly. Pool Committee: This committee s function is to oversee our largest amenity by helping to keep the pool area safe and free of vandalism. They also handle any and all concerns that are associated with the pool, pool rules & regulations, and pool parking lot. Safety Committee: This committee s function is to organize the neighborhood Crime Watch program and to inform the neighborhood of any criminal activity in the area. They often work with the local police department and receive watch reports from BPD. This committee also reports any safety issues within the community and supports the Neighborhood Block Captains.
