1 The Lakelands Community Home Owners Association Rules and Regulations The Lakelands Community Home Owners Association strives to set a high standard of quality for the protection of property values, and the enjoyment and safety of residents. The following outlines a set of rules/restrictions applicable to all residents of the Lakelands Community HOA (master association) and are an extension, but not a comprehensive list of the rules contained within, the Association Covenants and By- Laws. Generally, the LCHOA Board requires that all of the covenants, rules and restrictions referenced below must be strictly adhered to across the Community. These rules and regulations are accompanied by a schedule of fines/penalties that will be imposed to enforce compliance. The following exceptions may apply, at the Board s discretion: Where the rules of any sub- Association require stricter standards and/or greater enforcement, then the rules and restrictions of the sub- Association shall prevail. The LCHOA Board reserves the right to review and approve specific requests to grandfather existing exceptions only when the request is made in writing by the homeowner. The LCHOA Board will either approve or deny any exception request considering the best interest of the community as a whole. The LCHOA Board will publish, enforce and periodically amend as required a schedule of fines/penalties in connection with the above rules, covenants and restrictions. Violations of the following rules is considered a MINOR infraction subject to associated fines noted below: 1. APPEARANCE Both the lot and the dwelling must be maintained in a manner so as not to be unsightly when viewed from the street, lake or neighboring lots. The Architectural Review Committee is the arbitrator of acceptable appearance standards. Residents are strongly encouraged to review the Architectural Guidelines posted on the Lakelands website. a) Each owner, at the owner s expense or the individual sub- Association must maintain all improvements on the lot, including but not limited to the dwelling, fences, and driveways. Maintenance includes preventative maintenance, repair and/or replacement as needed. Each owner is expected to maintain his/her lot s improvements at a level, to a standard, and with an appearance that is commensurate with the neighborhood. Specifically, each owner must repair and replace worn, rotten, deteriorated, and unattractive materials, and must regularly repaint all painted or worn surfaces. b) All aspects of a visible yard are within the purview of the Architectural Review Board, including, without limitation, the shape of pruned shrubs, the number, shapes, and use of flower beds; and the integration of items such as wheel barrows, boulders and driftwood into the landscape design. Each owner, at the owner s expense or the individual sub- Association, must maintain the yards on the lot at a level, to a standard, and with an appearance that is commensurate with the neighborhood. Specifically, each owner must: Maintain an attractive ground cover or lawn on all yards. Edge the street curbs at regular intervals.

3 9. LAKE USE and SUBDIVISION AMENITIES Only residents in good standing are allowed to use the lake and any other amenities of the subdivision. Guests should be accompanied by homeowners at all time. Littering in the lake, on common property or resident lots is prohibited. 10. STORAGE Use of the driveway, streets or any and all common areas for storage of any purpose is strictly prohibited without the LCHOA board s prior approval for a defined time period. Specifically, these areas may not be used for storage purposes, including, storage of boats, trailers, recreational vehicles, campers, buses, commercial vehicles, inoperable vehicles, or any kind of storage container or any other vehicle or structure which the board deems to be a nuisance. This restriction does not apply to vehicles and equipment temporarily on the property in connection with the construction or maintenance of a dwelling and boats/trailers staged for Spring launch or winter storage. 11. TRASH Each resident will endeavor to keep the property clean and will dispose of all refuse in receptacles designated specifically by the Association or by the waste disposal contractor for that purpose. The trash containers may be in the designated pick- up area from dusk on the evening before trash pick- up until dusk on the day of trash pick- up. At all other times, trash containers must be kept inside the house or garage and may not be visible from the street or another lot. 12. PARKING No overnight parking is permitted on the streets. Residents are expected to park their vehicles in their garages, and use their driveways for overflow parking for a maximum of three vehicles. No business or commercial vehicle is allowed to park overnight in the driveways. 13. NOISE & ODOR A resident must exercise reasonable care to avoid making or permitting to be made a.) loud, disturbing, or objectionable noises, b.) harmful fumes, or c.) obnoxious odors that may disturb or annoy residents of neighboring lots. 14. AVOID DAMAGE An owner may not do any work or fail to do any work which, in the reasonable opinion of the board, would materially jeopardize the soundness and safety of the property, or impair any easement relating to the property. 15. RESPONSIBLE FOR DAMAGE An owner is responsible for his/her own willful or negligent acts and those of his or the resident s family, guests, agents, or contractors when those acts necessitate maintenance, repair, or replacement to the common areas or the property of another owner. 16. SIGNS - The use of signs on residential property should be limited. One sign, not to exceed five square feet may be posted as a for sale sign on residential property or lot. The for sale sign must be removed promptly after the close and transfer of the property. Signage for residential alarm systems is permitted. Signs for garage sales, election posters, and congratulatory expressions may be posted on a resident s property but may not be posted at entrances or on community common areas. It is the homeowner s responsibility to remove signage in a timely manner. Signs posted by a resident s contractor are permitted, but must be removed promptly after completion of the work. 17. ANTENNAS AND SATELLITE DISHES - Pursuant to the FCC regulations, Satellite Dishes of more than a meter (39.37 inches) are restricted from the community. Violations of the following rules is considered a MAJOR infraction subject to associated fines noted below: 1. EXTERIOR RENOVATIONS The Architectural Review Committee determines the colors and construction material standards acceptable to the Association. Earth tones are generally found acceptable. A change or addition of a color/material that is visible from the street, the lake, a common area, or another lot requires written approval of the Architectural Review Committee. Improvements using the same colors and/or materials do not require Committee approval. Contractors are prohibited from working on the exterior of homes on Sunday and holidays.
4 2. LANDSCAPING No person may perform landscaping, planting, or gardening on the common areas without the LCHOA Board s prior written authorization. Aside from seasonal plantings, any major change to a lot s landscape design requires the prior approval of the Architectural Committee. 3. RESDENTIAL USE The use of the house lot is limited exclusively to single family residential purposes. It may not be divided for rental by other occupants or used as a vacation exchange or vacation rental. 4. BUSINESS USE A resident may use a dwelling for personal business or professional pursuits provided that a.) uses are incidental to the primary use of the dwelling as a residence; b.) uses conform to applicable governmental ordinances; c.) uses do not entail visits to the lot by employees or the public; and d.) uses do not interfere with other residents use and enjoyment of neighboring lots. 5. OCCUPANCY Other than the completed principal dwelling, no thing or structure on a lot may be occupied as residence at any time by any person. The provision applies, without limitation, to the garage, mobile homes, campers, or any type of storage facility. 6. PROHIBITED VEHICLES - Vehicles that routinely transport hazardous or inflammatory or explosive cargo are strictly prohibited from the property or any common area at all times. 7. CARPORTS The use of carports are expressly prohibited on any lot or common area. 8. SWIMMING POOLS - It is prohibited to discharge swimming pool water into the lake; the Village of Plainfield sanitary sewer system should be used. 9. DISCHARGE AND DUMPING - The discharge of sewerage, chemicals, papers, boxes, wire, junk or other refuse of any nature and kind on or in the lake and/or common area is prohibited and the cost of removing same shall be borne by the party responsible or causing the same to be deposited thereon. 10. WILLFUL DAMAGE TO PROPERTY. Residents whose actions cause damage to Lakelands Association property thru willful intent will be reported to police. The resident will be responsible for the cost of repair or replacement plus fine as outlined under major offense. Minor Offense: Fine Structure First Offense: The unit owner will have seven (7) days to correct the violation. Failure to correct the violation within that time frame will result in the assessment of a $25.00 fine. Second Offense of the same violation: Immediate assessment of $45.00 fine and the unit owner will have seven (7) days to correct the violation. Subsequent Offenses of the same violation: Immediate assessment of a $ fine and/or initiate any other recourse allowed by the Declarations, By- Laws or applicable Illinois law, including but not limited to initiating legal action. Major Offense: First Offense: The unit owner will have seven (7) days to correct the violation. Failure to correct the violation within that timeframe, will result in the assessment of a $50.00 fine. Second Offense of the same violation: Immediate assessment of $ fine and the unit owner having seven (7) days to correct the violation.
5 Subsequent Offense of the same violation: Immediate assessment of $ fine and/or initiate any other recourse allowed by the Declaration, By- Laws or applicable Illinois law, including but not limited to initiating legal action. The Lakelands board, at it s discretion, may assess a fine of up to $500 plus cost of replacement or repair to any resident who is found to have intentionally damaged Lakelands Community Property. IF THE MAJOR OFFENSE COMMITTED VIOLATES NUMBERS 6 AND 9 OF THESE RULES AND REGULATIONS, OR IF AN OFFENSE CAUSES IMMEDIATE RISK TO INDIVIDUAL SAFETY OR VALUE OF THE ASSOCIATION PROPERTY, THE BOARD OF DIRECTORS CAN IMMEDIATELY ASSESS A $ FINE AND/OR INITIATE ANY OTHER RECOURSE ALLOWED BY THE DECLARATION, BY- LAWS OR APPLICABLE ILLINOIS LAW, INCLUDING BUT NOT LIMITED TO INITIATING LEGAL ACTION.
