Berthold Township has responded with approval with no further comment. The Ward County Water Resource Board returned the plat without objection, and with the usual recommendation. D. 3 Minutes of the Ward County Planning Commission October 18, 2018 The meeting was called to order at 7:00 p.m. by Chairman Kossan. Present were Commissioners Fegley, Fjeldahl, Koop, Livingston, and Weppler. Also present were Planning & Zoning Administrator Nancy Simpson, Robert Vallie, Roza Larson, Bruce Johnson (MAFB), Tiffany Grosche and Sarah Walker, Secretary. Moved by Comm. Weppler, seconded by Comm. Koop, to approve the Planning Commission Meeting Minutes from September 20, All voted aye; motion carried. Regular Agenda: 1. Matthew and Anne Williamson: Second Reading Application for a subdivision for the following described property: Proposed Towery s 2nd Addition Lots 1 & 2, Rice Lake Township The plat application is for splitting Towery Subdivision Lot 2 to two new lots. Rice Lake Township has responded with approval with no further comment. The Ward County Resource Board returned the plat without objection, and with the usual recommendation. Nancy Simpson pointed out a change to the center lot line to even out the lot sizes to have equal acreage. Moved by Comm. Weppler, seconded by Comm. Fjeldahl, to approve the application for a subdivision for Matthew and Anne Williamson with the usual recommendations. Roll call; all voted yes; motion carried. Comm. Hanson arrived at 7:05pm. 2. Derrick Miller Application for a plat for the following described property: Proposed Outlot 7 NE ¼, , Sundre Township The plat application is for creating an outlot surrounding an existing farmstead due to the bank requiring the home be on fewer than 10 acres. Sundre Township has responded with approval with no further comment. The Ward County Water Resource Board returned the plat without objection, and with the usual recommendations. Moved by Comm. Weppler, seconded by Comm. Koop, to approve the plat application for Derrick Miller with the usual recommendations. Roll Call; all voted yes; motion carried. 3. Norman Sollid on behalf of Harold & Elayne Wald Application for a plat for the following described property: Proposed Outlot 2 SW ¼ SW ¼, , Surrey Township

4 The plat application is for creating an outlot surrounding an existing farmstead. Surrey Township has responded with no objection and with approval. The Ward County Water Resource Board returned the plat without objection, and with the usual recommendations. Moved by Comm. Koop, seconded by Comm. Weppler, to approve the plat application for Norman Sollid on behalf of Harlod & Elayne Wald with the usual recommendations. Roll Call; all yes; motion carried. 4. Norman Sollid on behalf of Amy C. Beuchler Estate Application for a plat for the following described property: Proposed Outlot 1 SW ¼ SW ¼, , Willis Township The plat application is for creating an outlot surrounding an existing farmstead. Willis Township has responded with approval and questions whom will be occupying the home, farmer or resident. The Ward County Water Resource Board returned the plat without objection, and with the usual recommendation Moved by Comm. Weppler, seconded by Comm. Hanson to approve the plat application for Norman Sollid on behalf of Amy Beuchler Estate with the usual recommendations. Roll Call; all yes; motion carried. Other Business: Welcomed Tiffany Grosche new secretary Comprehensive Plan The steering committee met on October 5. Next steps will be a final survey to ensure the direction we are taking with the Comprehensive Plan aligns with what residents see for the future of the County. We the committee will be attending the Township Officers Association meeting. The date is currently TBD but is probably going to be the week of October 22 or 29. Comm. Fegley had an individual who spoke with him about a township in the Williston are that approved a subdivision around farmland, because the subdivision had more voters than the township the farmers lost their voices and stopped farming as a result. He wanted to be sure this wouldn t happen with the new Comprehensive Plan. Ms. Simpson assured the group that the plan is Ag friendly. Hagen Current legal description: NE ¼ NE ¼, Proposed legal description: Outlot 1, NE ¼ NE ¼, Address: (if applicable) N/A Township: Berthold Current Zoning: A-1 Zoning Ordinance Reference: Ward County Zoning District 6 Item #: 1 Recommendations Staff: Approval w/conditions Township: Approval Water Board: Approval w/conditions PROJECT DESCRIPTION: The applicant is requesting an outlot be created to surround an existing farmstead. There are no plans to change the current use. RECOMMENDATION: Staff recommends approval based on the findings of fact and Township and Water Board recommendations and the following condition: 1. The surveyor update the plat to reflect previously purchased ROW. 2. The surveyor update the legal description. FINDINGS OF FACT: 1. The proposed outlot is acres. 2. 6 40 ROW 75 ROW North PLANNING AND ZONING CONSIDERATIONS: The proposed outlot is surrounded by farmland. There are outloted farmsteads.5 miles to the north and 1.5 mile to the southeast. HIGHWAY ENGINEERING CONSIDERATIONS: The property currently has access from County Road 9. The surveyor would need to update the plat to show the previously acquired ROW along County Road 9. In 2001 Ward County acquired an additional 42 ft. Based on the included recorded document, Ward County acquired the East 75.0 ft. of the NE ¼ of Sec. 31, Twp. 156N, Rge. 86W, except all that portion lying within 33 feet of the section lines. Tract containing 2.51 acres, more or less." TOWNSHIP RECOMMENDATION: Township has responded with the conclusion that these outlots should be approved. No further comments were given. WATERBOARD RECOMMENDATION: Based upon review and recommendation of the Water Resource Board Engineer, the plat is returned without objection but with the following recommendations: 1. A storm water management plan may be required if the subject property: -has applied for a special use permit 2.
