1 PUBLIC WORKS COMMITTEE REGULAR MEETING The Public Works Committee met at the Columbia St. Mary s Center at the Fairgrounds. Present: Supervisors Geracie, Winker, Buntrock, Jobs, and Haeuser. Cedarburg, Wisconsin April 17, 2013 Staff: County Administrator Meaux, Assistant Public Works Director Edgren, Building Superintendent Hicks, and County Clerk Winkelhorst. Others Present: Supervisor Richart, Harald Tomesch, Allan Haas, and Dale Gierach. Call to Order/Proper Notice/Adoption of Agenda: Meeting called to order by Chairperson Geracie at 11:30 AM. Ms. Winkelhorst assured that the meeting was properly noticed. Motion made by Supervisor Winker, seconded by Supervisor Buntrock to adopt the agenda as presented. Motion carried. (5-0) Public Comments/Correspondence/Communications: Supervisor Buntrock received a communication from a Town of Cedarburg Supervisor with regards to engine braking north on CTH NN and Granville Road. This communication will be forwarded to the Public Works Director. Supervisor Jobs inquired about survey monument maintenance issues. Mr. Edgren noted that the Southeastern Wisconsin Regional Planning Commission (SEWRPC) is in the process of monument maintenance since being hired by the county as the deputy surveyors. Approve Minutes from the March 14, 20 and April 3 Meetings: Motion made by Supervisor Winker, seconded by Supervisor Buntrock to approve the minutes from the March 14, 20, and April 3 meetings as submitted. Motion carried. (5-0) Mr. Edgren requested to move the variance request forward to accommodate the guests in attendance. There were no objections. Highway Department: Action Item: Review/Approve Request for a Variance to County Code of Ordinances Section 6.04(7)(n) & (q) Requiring a Type 2 Access with Bypass Lane: Chiselled Grape Winery is planning to move from the northwest corner of CTH W (Port Washington Road) & CTH T (Lakefield Road) to North Port Washington Road (CTH W). The new location is currently a residential property, but has obtained a Conditional Use permit to operate a winery. Improvements to the driveway and addition of parking to the parcel are scheduled as part of the new business. Mr. Edgren explained that Harold Tomesch, the owner, submitted the access permit to the Highway Department. Staff reviewed the permit noting the following design standards per Ozaukee County Ordinances Section Highway Access Control: (7) DESIGN STANDARDS. Driveways and roads with access onto a C.T.H. must comply with the following design standards: (n) Type 2 access standards must be used for residential uses with 3-20 units and commercial or industrial driveways with up to 25,000 square feet.
2 (q) Far side passing (bypass) lane will be required when the ADT of the C.T.H. is 2,500 or more for a Type 2 access and 1,000 or more for a Type 3 access or when in the judgment of the Department, peak traffic demand and/or location of access warrant it. Also, the Wisconsin Department of Transportation estimates daily traffic in the area around 7,900 vehicles per day. Based on the requirements of the design standards staff required the owner to put in Type 2 access with bypass lanes. Mr. Tomesch has requested to appeal this decision to the committee. Mr. Tomesch explained that he has been given a conditional use permit on this residential property that will be the location of his home and business. He further explained that as a new business, to meet the requirements by the City of Mequon to widen the ingress and egress and add additional parking estimated at $42,000, is a large expense. Mr. Tomesch reviewed the actual two year chart of turns into the property based on point of sales. Mr. Tomesch further noted that a worst case scenario would be if the County would consider allowing them to wait until the road expansion, as was done with another business further down on Port Washington Road, to minimize the expense to a new business. Mr. Edgren stated that it is based on safety standards and there are several properties along Port Washington Road that do not have those accesses; however, the Access Control Policy was developed in the late 1990 s grandfathering those properties. Mr. Edgren has spoken with City of Mequon and in addition to the requirements on the parking, ingress and egress, it was also recognized that the residential home will need to meet, as a commercial use, all the building code requirements. Variances can be granted in the case of a hardship, but not self-imposed hardship. As the Access Control Design Standards are based upon public safety and the request for variance is based upon a self-imposed hardship, the Highway Department recommends denying the variance. Supervisor Buntrock stated that he is in agreement with Mr. Tomesch that there are other businesses that have more traffic and do not have the access required. Chairperson Geracie suggested providing the variance and relooking at it again in two years. Mr. Edgren noted that variances have not been given in the past unless there is an undue hardship such as wetland issues etc. To allow a variance due to the cost that it affects the business, it is Mr. Edgren s understanding that it has never been done. Mr. Tomesch commented that in addition to the $42,000, the cost would be approximately $22,000. The business has created six jobs in the area, detailed statistics were presented on limited access, and growth expected in outside sales. Mr. Tomesch stated that as a good citizen, if the business felt that there was a safety issue, they would come forward to make a change. Supervisor Buntrock does not see a safety issue there, but expects that will change over the years and the business will have to make an adjustment. Mr. Edgren noted that there have been discussions, but no current plans to update that section of the road. Discussion on granting a variance for two years. Supervisor Jobs is concerned that the County is setting precedence, financial impact which is a self-imposed hardship should not be considered, and inquired as to how this would be tracked. Motion made by Supervisor Winker, seconded by Supervisor Buntrock to grant the Chiselled Grape Winery a two year variance and to revisit at that time. Motion carried. (4-1) Jobs opposed. Mr. Edgren will note the two year revisit on the variance and contact the owners in 1 ½ years. Chairperson Geracie reverted back to the order of the agenda. Page 2 of 5
3 Facilities Management: Action Items: Review/Approve Administration Center Roof Rehabilitation Bid: The Facilities Department identified roof rehabilitation required on the Administration Center, and budgeted $150,000 in funds to complete the task. Alternate bids were requested for a permanent safety railing system along the perimeter of the roof. This request was more for information on the cost. The low bid for the alternate was $26,250 and was deemed not necessary. Six base bids were received: 1) PHD Roof Doctor s, Inc. - $143,000; 2) Performance Roofing Systems, Inc. - $145,978; 3) Langer Roofing & Sheet Metal, Inc. - $153, 500; 4) C&K Services, Inc. - $160,910; 5) H.I.S. Corporation - $169,718; and 6) Paul Crandall & Associates, Inc. - $174,282. Staff recommendation is to award the contract to PHD Roof Doctor s Inc. Motion made by Supervisor Buntrock, seconded by Supervisor Jobs to authorize Facilities Management to contract with PHD Roof Doctor s Inc. for the Base Bid only with a total contract of $143,000. Motion carried. (5-0) Review/Approve County Fairgrounds Fencing Selection and Bid: As part of the Ozaukee County Fairground Improvements - Phase 2, Ozaukee County received bids to purchase and install vinyl, privacy fence along some of the Fairground s lot lines. However, it was later decided to delete the item from the contract. Now, in the interest of completing the final landscaping plans as approved by the City of Cedarburg s Planning Commission, the Highway Department requested quotes for vinyl fencing materials. It is proposed that the fencing materials would be installed by Highway Department staff. Mr. Edgren noted that on March 22, 2012 the fence that was approved was a tan Majestic fence. The bid request included three styles of fencing and is for 2,000 feet of fencing. Mr. Edgren further noted that three types of fence were included in the original specs and the committee chose Majestic instead of off brands. Majestic $69,731 Supervisor Haeuser inquired about the lattice on the fence with regards to privacy and the sturdiness of the fence should people try to climb over if in the future there was a charge for the fair. Motion made by Supervisor Winker, seconded by Supervisor Buntrock to approve the purchase of the Lexington w/lattice tan fencing material for the $44,965, installed by the Highway Department and to remove existing fence that is in front of the new fencing and leave to property owner to dispose or dispose of at their request. Motion carried. (4-1) Haeuser opposed. Chairperson Geracie and Mr. Meaux will hold a meeting with the north and west side property owners to discuss the fencing installation and removal of existing. 4 Management/Financial/Informational Reports: No discussion. Transit Services Management/Financial/Informational Reports: No discussion. Highways cont. Action Items: Review/Approve Maintenance Agreement: Guaranteed Work Partnership Implementation: The Committee now needs to implement the requirements contained in the Resolution through the Annual Maintenance Agreements. The first component is the selection of an implementation date. The current extended Maintenance Contract with the towns expire the end of June. It should be noted that the 2013 budget did not include any of the newly established billing changes, so the County would need to recognize the Highway Department s losses within the existing General Levy. Furthermore, the required minimum contract charges would have to be determined for only 6-months during 2013 and a full year for The committee would like to maintain the current contract until the end of the year and begin the new contract on January 1, Mr. Edgren would notify the towns of maintaining the current contract and in the fall the county will implement a new two year maintenance agreement. The remainder of the terms of the Maintenance Contract will be discussed at another meeting. Motion made by Supervisor Winker, seconded by Supervisor Haeuser to extend the current Maintenance Contracts through December 2013 directing staff to notify the Towns. Motion carried. (5-0) Review/Approve Asphalt Oil Bids: The Highway Department annually requests quotes for bituminous materials for asphaltic paving and sealcoating projects. Two quotes were received as follows: Henry G. Meigs, LLC Flint Hills Resources PG Asphalt $545.00/ton $548.00/ton HFRS-2 & CRS-2 Emulsion $1.88/gal $1.76/gal Application Charges $0.12/gal $0.25/gal (by Pearson Bros.) Total $2.00/gal $2.01/gal Ozaukee County has maintained a long-term, successful relationship with Meigs. Additionally, Meigs is the only supplier to agree to the Flexible Pricing as requested in the Request for Quotes (RFQ). Flexible Pricing ensures reasonable asphalt costs by adjusting the bid prices if the Argus Asphalt Report shows asphalt pricing increasing or decreasing by more than 5%. Ozaukee County has received reduced bituminous materials prices over the last several years due to falling asphalt prices during the summer. Finally, Meigs provides a surface treatment warranty as the sole supplier of the emulsion and application services. Motion made by Supervisor Buntrock, seconded by Supervisor Winker to approve awarding the bid to Henry G. Miegs, LLC. Motion carried. (5-0) Review/Approve CTH W Meijer Development Memorandum of Understanding with the Village of Grafton: The Village of Grafton has approved the construction of a Meijer development along CTH W (Port Washington Road), south of STH 60. As part of the approval, the Village of Grafton has Page 4 of 5
5 required Meijer to pay for most (+/-80%) of the upgrade to CTH W to meet the urban, 4-lane design as constructed by the Costco and Target. By law, the County is responsible for the center 22-feet or through lanes of a County Highway. In past projects, the policy has been to split the local share (20%) of costs for projects with 80% funding. It has been proposed that the Village of Grafton and Ozaukee County split the 20% share of improvement costs. Ozaukee County has already approved $90,000 in the 2013 budget for this purpose. Supervisor Richart inquired as to the financial responsibility of the proposed signals at Hunters Lane, the improvement at the Hwy 60 intersection and improvements at the Falls Road intersections. Mr. Edgren s understanding from the Village of Grafton is that those intersections are covered 100% by Meijer. Motion made by Supervisor Jobs, seconded by Supervisor Haeuser to authorize the Highway Commissioner to sign the Memorandum of Understanding with the Village of Grafton. Motion carried. (5-0) Management/Financials/Informational Reports: Project updates: There will be some bridges redone throughout Ozaukee County on I43 starting in July; CTH D & LL started last week but there were some rain delays; STH 181 roundabouts on the western edge of Cedarburg will begin soon; a preconstruction meeting was held. Supervisor Winker would like to continue discussions on a cell phone policy.
