Debbie Fisher and Justin Berrens, Public Works Director (both excused) Others Present: Brennan Kane, Development Director PUBLIC NOTICE SPECIAL USE PERMIT CITY OF WAUPACA YOU ARE HEREBY NOTIFIED that PIP Holdings, LLC has made application to the City Plan Commission requesting a Special Use Permit in accordance with Section 7.240(2)(c)(2) of the Municipal Code, I-2 Heavy Industrial District, Special Uses, to allow for outside storage, more fully described as follows, to wit: 234 Wendt Drive Lot 2 of Certified Survey Map No. 7688, recorded in the office of the Register of Deeds for Waupaca County, Wisconsin in Volume 3 of Certified Survey Maps on page 69, as Document No , located in part of the Northwest /4 of the Northwest /4 and in part of the Southwest /4 of the Northwest /4, Section 27, Town 22 North, Range 2 East, City of Waupaca, Waupaca County, Wisconsin. 3 City Plan Public Hearing December 4, 206 Mayor Smith asked Mr. Kane to review the purpose of the hearing. Mr. Kane said the hearing is for a Special Use Permit for Performance Industrial Products (PIP) to have outdoor storage within the I-2 District. PIP Holdings has purchased the former Faulks Bros. building and will be the new operations location for his facility. Mayor Smith asked for testimony in favor of the subject and limit comments to 3 minutes or less. Mayor Smith asked for testimony in opposition of the subject and limit comments to 3 minutes or less. MOTION CARRIED on a voice vote. 4. SPECIAL USE PERMIT / PIP HOLDINGS, LLC, 234 WENDT DRIVE a. Special Use Permit PIP Holdings, LLC, 234 Wendt Drive b. Site Plan Review PIP Holdings, LLC, 234 Wendt Drive Mr. Kane said he will review both the Special Use Permit and the Site Plan Review at the same time. He said each item would need a separate motion. Mr. Kane said this property is unique because the property location does not fall under any restrictive covenants or design standards. He said in working with the applicant, staff looked at enhancement of the building through the façade improvement and landscaping improvements on the site, while understanding this is an existing building. He said the applicant s main concern with the Executive Summary is under Elevations, no., requiring the 3-4 of brick or stone on the bottom north, south and east elevations. Mr. Chris Robbins came forward and said his concern is the cost to reface the bottom 3-4. He plans to paint the concrete surrounding the building in the spring and added that he is on board to improve the quality of the property. Mayor Smith asked the commissioners for their opinion regarding painting the bottom of the building in spring. The commissioner s general consensus is painting the concrete is an acceptable alternative.

5 City Plan Commission Meeting December 4, 206 Mr. Kane asked Mr. Robbins if he plans to paint the entire building. Mr. Robbins said he does not intend to paint the metal siding but will replace any mismatched panels as closely as possible and also match the paint for the concrete to the fencing. Mr. Kane agreed to a contrasting color for the concrete such as tan. There was general discussion that wording for Site Plan, item No. 3 needs to be changed to reflect that submission and approval of fire sprinkler system plans submitted and approved by the State of Wisconsin are acceptable to the City of Waupaca. There was general discussion regarding the driveway. Mr. Kane said Mr. Robbins negotiated a new driveway with Faulks Bros. which is gravel as part of the sale. Mr. Kane said the City requires the driveway to be paved which was also required of the propane facility. Comm. Phair asked what type of outdoor storage will be used. Mr. Robbins said some of the dyes, which is a large steel tube, stays outside until it is needed. He said he currently has a large inventory which are neatly on racks. He said fencing works well for the facility and will cover garbage containers. Mr. Kane said they will work with Mr. Robbins regarding the type of materials that will be used for the fencing which may be a combination of chain link and solid material. MOVED by Comm. Phair SECONDED by Ald. Kjelland to RECOMMEND to Council with modifications as discussed the Special Use Permit PIP Holdings, LLC, 234 Wendt Drive. 5 ayes, 0 nays, 2 absent. Development Update Mr. Kane said the November report is drastically different due to utilization of the new software program. This format will be the new reporting for future meetings. 2

6 City Plan Commission Meeting December 4, 206 Mr. Kane said the Bethany Home project is continuing to move forward. He said a request will come forward in January or February of 207 due to their request to delay the requirement to hold a neighborhood meeting within one year of approval for their project to discuss the back access driveway. He will bring the request forward at the next meeting and said Bethany Home is committed to have the neighborhood meeting. Bethany Home expects to move into their 3 story building in February or March of 207 and is continuing to work on the interior of the new building. Mr. Kane said Little Wolf Automotive is moving forward and close to completion. Mr. Kane said there is positive news regarding Main Street. We are starting to see more inquiries from people to move potential night life types of businesses into the area. He expects to see more Main Street projects coming forward in 207. He said the Main Street project is moving along and they are working with the Wisconsin DOT. He is planning to hold an open house for the project in January or February of next year. The consultants were here a couple of weeks ago and met with a group of artists and different business owners. Alliance Industries is postponing their project until spring and Presto Products is up and operational. Mr. Kane said if everything goes well, Burger King is slated to open right before the New Year. He said Bonnie s Bloomers is planning to be open by Mother s Day 207. He said the Doc Atty s project is moving forward. MOVED by Ald. Olson, SECONDED by Ald. 7 City of WAUPACA Community & Economic Development Department EXECUTIVE SUMMARY ACTION REQUEST: Certified Survey Map (CSM) PROJECT DESCRIPTION: Applicant: Owner: Property Address: Michael J. Fulton Street B-4 Strip Commercial District Retail Lot : Retail space Lot 2: Multi-tenant retail space B-4 Strip Commercial District, B-3 Commercial District, and R-3 Multi-Family Residence District, commercial businesses and multi-family residential uses The subject property was purchased by the current owner in The western most large retail space was converted into a Shopko Hometown Retail Store in 202. The balance of the property currently remains as multitenant space. The applicant is seeking to subdivide off the existing Shopko Hometown storefront in preparation of a sale to a private owner, while maintaining their existing ownership with the rest of the Waupaca Woods Mall and leased tenants. The applicant received a variance on January 24, 207 to allow for a zero foot (0 ) lot line setback between the existing Shopko Hometown and the currently leased Waupaca Equipment Rental Center. The current City of Waupaca Zoning Ordinances required a minimum twenty foot (20 ) side yard setback from property boundaries. Therefore, staff could not process the proposed Certified Survey Map (CSM) until a decision was determined by the ZBOA. It is not uncommon for multi-tenant buildings to be subdivided from time to time and independent parcels or portions of the multi-tenant buildings be sold to private investors/owners. A similar request came before the ZBOA in 2004 (Case #40) where the Goodwill tenant space was subdivided off from the existing Waupaca Woods Mall parcel. Similarly, the applicant came before the ZBOA seeking a zero foot (0 ) side yard setback in order to sell the tenant space to a private investor/owner. S. Main Street Waupaca, WI 5498 Page of 2

8 City of WAUPACA Community & Economic Development Department RECOMMENDATION The Community & Economic Development Department recommends Approval of the Certified Survey Map for the CSC, LLC et al, subject to the following conditions:. The future independent parcel/building (Lot ) shall comply with all State and Local Building and Fire Codes. This includes, separation of utilities, electrical, fire suppression systems, etc. to be independently owned and operated by the future owner of the Shopko Hometown. In the 2004 variance request a fire separation wall was required to be constructed between the two independently divided structures. 2. The applicant shall prepare a draft shared parking agreement. The draft easement agreement shall be submitted to the Community & Economic Development Department for review/approval prior to recording of the agreement at the Waupaca County Register of Deeds Office. A recorded copy shall be submitted to the City Clerk. 3. The applicant shall draft a shared cross access easement agreement. The draft easement agreement shall be submitted to the Community & Economic Development Department for review/approval prior to recording of the agreement at the Waupaca County Register of Deeds Office. A recorded copy shall be submitted to the City Clerk. 4. The applicant shall provide to staff an Alta Survey that denotes all public and private utilities, ingress/egress easements, and existing footprint/setback of buildings to lot lines prior to the signing of the CSM by the City Clerk. 5. The applicant shall provide to staff prior to recording of the proposed CSM the new Condo Doc s for review/approval. 6. The applicant shall review with staff existing and proposed new signage for the entire center. 7. Payment of all outstanding assessments, taxes, or right of recovery is required prior to the City Clerk signing of the C.S.M. 8. Future development/site improvements are subject to review and approval by the Community and Economic Development Department, and may require Site Plan Review by Plan Commission, prior to the issuance of any permits. 9. The applicant shall record the City Council approved C.S.M. with the Waupaca County Register of Deeds office within thirty (30) days of City Council approval. 0. A new C.S.M. application and fee shall be required if all of the aforementioned conditions have not been met within thirty (30) days of City Council approval. S.
