Seller agrees, on full payment of the purchase price in the manner herein specified, to make, execute, and deliver to purchaser a good and sufficient general warranty deed to the premises. 6. CLOSING. Closing will take place on or before, At the closing, seller will provide purchaser with the deed to the premises, and purchaser shall pay the unpaid balance of the purchase price by certified check to the order of seller. Following the closing, purchaser shall have the right to exclusive possession of the property. 7. DEFAULT BY PURCHASER. Time is of the essence of this contract. In the event purchaser fails to make any payment of the purchase price promptly when the same shall become due as herein specified, or promptly to perform any covenant or agreement herein contained, seller may elect to specifically enforce this agreement or to terminate this agreement and retain as liquidated damages any payments theretofore made hereunder by purchaser; provided that if such payments are inadequate to compensate seller for his damages or no payments have been made, seller may exercise his right to sue for damages for purchaser s default. Service of all demands, notices or other papers with respect to such termination and retention of payments made may be made by registered mail at the address set forth above, or at such other address as purchaser may indicate in writing to seller. Seller may elect to bring action, or actions, on any intermediate overdue installment or on any payment, or payments, made by seller and repayable by purchaser, it being stipulated that the covenant to pay intermediate installments, or to pay items repayable by purchaser, is independent of the covenant to make a deed, and that every such action is an action arising on contract for the recovery of money only, as if the promise to pay had been expressed in a different instrument, and that no such action shall constitute an election not to proceed otherwise as to any subsequent default. No waiver by seller of any default on the part of purchaser shall be construed as a waiver of any subsequent default. 8. DEFAULT BY SELLER. If seller is unable to convey title in accordance with the terms of this contract, the amount paid on account of the purchase price and the net cost of examining the title shall, at the option of purchaser, be returned to purchaser on demand; alternatively, purchaser shall have only the right of specific performance. Service of such demand may be made by registered mail at the address set forth above, or at such other address as seller may indicate in writing to purchaser. 9. CONDITION OF PREMISES.
