3 Purpose These rules and regulations have been set forth to expand upon and detail the information found in the Condominium Declaration and Bylaws under which Harvest Glen, A Condominium, operates. All residents are expected to abide by these rules and regulations in order that the community will be a more attractive and harmonious place to live. LIMITED COMMON AREA For the purposes of these Rules & Regulations, the term Limited Common Area shall refer to all areas of the condominium outside of the unit, unit sidewalk, front landscape beds, and parking area directly in front of each garage. Personal Property All personal property, including but not limited to lawn chairs, bicycles and tables, must be stored inside the garage of a Unit or in the Unit s storage area above the garage of a Unit, when not in use. Garage doors should be kept closed so that garage contents are not visible from outside. Nothing may be hung or displayed, nor may signs (including For Sale, For Lease or For Rent signs), awnings, canopies, shutters, antennae or satellite dishes or any other device or ornament be affixed to or placed upon the exterior of a building without the prior written approval of the Board of Directors. Garden hoses may not be stored outside unless they are kept in an enclosed commercially available hose container. Only the garden hose container and/or one potted plant, in a pot no larger than 24 in diameter, may be placed in the corner by the water spigot. Patio umbrellas are permitted. One potted plant (no vegetables) in a pot no larger than 24 in diameter may be placed in the corner of the garage by the spigot. Herbs, vegetables and fruits may be grown on porch and patio areas. Landscape/walkway lights are permitted within the mulched area along the sidewalk, must be solar powered, black or bronze in color, maximum of 4 ½ in diameter, maximum height of 8 to 12, spaced a minimum of 12 apart on mulched sides of the walkway and must be maintained at the Unit Owner s expense. 4 Cooking on grills utilizing an open flame is not permitted in a Unit Owner s garage per the Virginia State Fire Code. Also, per the Fire Code, grills must be situated a minimum of 10 away from any combustible surface that is not served by a fire suppression system. This includes siding and porch, roofs or awnings. Electric grills that do not utilize an open flame may be operated on a covered or uncovered porch or patio. Decorative Items Any combination of the items below, not to exceed six, may be placed within the mulched area in front of the unit (no decorative items may be placed along the side of any unit): o No more than one (1) decorative garden flag (max 15 x 18 ) on a garden flag stand o No more than one (1) hummingbird feeder on a shepherd s staff o Potted plant(s) on a shepherd s staff or placed in the mulch o Decorative statuary/ornaments limited to 36 in height o Stepping Stones The following items are not permitted anywhere in the Community: Seeded birdfeeders of any type Bird baths Wall Plaques Wind Chimes Garden hose hangers Flowers/Landscaping Plants Shrubs and flowering shrubs/bushes, e.g. nandinas, azaleas, roses, etc., may only be planted in existing beds and with the written consent of the Board of Directors. Only plants of a species already in use in the community will be considered. These plants, at maturity, should not exceed the height of the bottom ledge of the lowest window adjoining a Unit. New plants approved by the Board of Directors will become the property of the Association, which will provide future mulching, pruning and fertilization. The mulch between the sidewalk and porch/patio or sidewalk and driveway (or both) may be replaced with 1-3 inch (size) river stone/river rock; it may extend 12 inches around the end of the porch/patio. The expense will be borne by the homeowner and no plants shall be removed. Page 4 of 13
5 COMMON AREA For the purposes of rules and regulations Common Area includes all turf areas, side landscape beds, landscape beds not adjacent to units, courtyard driveways and the Harvest House & Pool area. Common Area is for the use and enjoyment of all residents. Yard signs (except approved For Sale or For Rent signs), statue, statuette, yard or lawn ornament, artificial flowers, flower/plant pots, ornamental rocks or stones, cypress mulch, swing sets, garden hose hangers, laundry poles or clotheslines, or other such items may not be placed or installed in Common Area. Sports nets or equipment e.g. (soccer/hockey/basketball goals) may not be permanently installed or left overnight in Common Area. No Unit Owner shall obstruct any portion of Common Area or store anything upon any portion of Common Area other than in areas, if any, specifically designated for storage by the Board of Directors. The Board of Directors or the Managing Agent may remove any obstruction or stored item in violation with this Section without notice to the Unit Owner. UNIT EXTERIOR No alterations, additions, or improvements (including but not limited to fences, walls, patios, decks, etcetera) may be made to the exterior surface of the building. No trees or shrubs may be planted, transplanted or removed without the prior written approval of the Board of Directors. Any alteration, addition or improvement made without such approval may be removed and the affected area restored to its former condition by or on behalf of the Board of Directors without notice to the Unit Owner and at the sole cost and expense of the Unit Owner. FRONT DOORS Residents may paint their front doors using Benjamin Moore Aura Grand Entrance Door & Trim High Gloss Paint. Only colors from this brochure are allowed. If the door is painted, the homeowner will be responsible for the upkeep of the painted door. If the door is not maintained, the association will have the front door painted white. DOORBELL CAMERAS Residents are allowed to install doorbell cameras. STORM DOORS Residents may install a white metal storm door with clear glass at their own expense. Page 5 of 13
6 House Flags Only the flag of the United States of America, the Commonwealth of Virginia or the 911 Freedom Flag may be displayed following normal flag protocol only on wall-mounted flag brackets. The Board of Directors must approve the location of flag mounts and flag size. Holiday Decorations Providing no damage is done to the landscaping or unit, holiday lights and decorations are permitted to be placed within: (Items that were in paragraph form, but are now listed) landscape beds (shrubs and trees) on the front of the unit on windows and on the front and side of the unit, draped along the patio fence wrapped around porch columns. No decorations may be attached to the gutters, siding, chimneys or roofs or be placed in any Common Area. They may not be displayed before the Thanksgiving Day prior to Christmas and must be removed by no later than January 7th of the following year. Other holiday decorations, e.g. Halloween, Easter, etc., are permitted under the same guidelines, and may not be displayed more than one week before or one week after the holiday. Inflatable decorations are not permitted. The Board of Directors may require that such decorations be altered or removed if not in compliance with these guidelines or if they are inappropriate for the community. Windows and Window Coverings All window coverings, whether draperies, blinds (vertical or horizontal) or valances, must be white, offwhite, light beige or light gray on the exterior side and of a quality consistent with the community as a whole. On those Units which have glass sidelights beside the front door, simulated textured glass film of frosted shading, not colored stained-glass, may be affixed to said sidelights as a privacy issue. Signs No sign may be placed within a Unit so as to be visible from outside of the Unit. Only "For Sale" and "For Page 6 of 13
7 Rent" signs which comply with the following sign guidelines established by the Board of Directors may be displayed. One standard Realtor sign (see picture to the left) is allowed at the entrance to the courtyard drive and near the courtyard addresses sign. One standard Realtor sign For Sale or For Rent in a standard metal sign stand or a sign on a 4' X 4' white post and not greater than 24 x 24 is allowed in the mulch bed of the unit for sale or rent. A lead-in For Sale or For Rent sign may be placed at the Courthouse Road entrance. One (1) standard size security system decal per Unit, maximum size of 6" x 6", is permitted to be displayed on either the door or window of the Unit. Security signs on stakes within the mulch beds are allowed. Animals No more than two (2) household domestic pets, not bred or maintained for commercial purposes, may be kept in any Unit. No pet shall be tethered outside on any portion of Common Area. Cats may not be allowed to roam free. All pets, when outdoors, shall be under a person's command, maintained on a leash not more than eight (8) feet in length, and supervised by a responsible individual at all times, who shall be responsible for the immediate clean up of all pet litter. Pets should be limited to relieving themselves in the 2 strip of grass between the common walk and back of the curb of the road. No animal waste may be placed in the Harvest House garbage cans. A Unit Owner violating rules governing pets may be fined up to $50.00 for each offense at the discretion of the Board of Directors. If, in the opinion of the Board of Directors, any pet becomes a nuisance, or, in the event of repeated violations of such rules, the Unit Owner involved may be required to remove the pet from the community. Parking/Vehicles Except as set forth below, no boats, trailers, motor homes, trucks (larger than a 3/4 ton pickup), travel trailers, other vehicles used for recreation (for example, van conversion and/or recreational vehicles) or vehicles with commercial advertising may be parked on any street or driveway overnight. Vehicles used for recreation (for example, van conversion and/or recreational vehicles) that are too large to be parked within the garage attached to a Unit may be parked in the area directly in front of the owner s garage for not more than fortyeight (48) hours to allow for loading and unloading. Such vehicles must not block normal access of other residents. Commercial trucks, when in the area to perform service or repair work, are authorized exceptions to the foregoing. All commercial moving vans must park on the street. No vehicles shall be parked in any manner in violation of applicable ordinances of Chesterfield County, Virginia. Chesterfield County parking regulations prohibit on-street parking that is: ϒ Beyond the curb (i.e. no parking on grass between sidewalk and curb or on the sidewalks) Page 7 of 13
8 ϒ In front of a public or private driveway ϒ Within an intersection ϒ Within 15 feet of a fire hydrant or in any way that obstructs a fire hydrant ϒ On the roadway side of a vehicle parked at the edge of a curb or street (no double- parking) ϒ More than 18 inches away from the curb in areas where parking is permitted ϒ On or in any street, alley or parkway for the purpose of selling or offering the vehicle for sale or rent. No sign or lettering shall be attached or placed upon any automobile, truck, trailer or other vehicle parked in or upon any public street, alley or parkway in the county indicating that such vehicle is offered for sale or for rent ϒ In a manner that prevents the use of a curb ramp located on public property or on private property that is open to thepublic No disabled vehicles, vehicles without a current state license, or vehicles for the storage of commercial equipment, machinery or other equipment shall be parked other than inside garage appertaining to a Unit, the door(s) to which shall remain closed other than when opened for the purpose of vehicular ingress or egress or other ingress or egress reasonably required by the Unit Owner, his or her family members, employees, agents, tenants and/or invitees. All parking by residents or guests must be: (a) within the garage attached to a Unit, (b) in the parking area directly in front of the garage door, (c) in the parking spaces at Harvest House or other designated parking areas within the community, and (d) in such a manner so as not to block any other Unit Owner s access to his garage. No vehicle may be parked in the turnaround area or driveway entrance. No vehicle may be parked in the Harvest House parking area or any other designated parking area in the community for more than fortyeight (48) consecutive hours. Vehicles parked there for more than forty-eight (48) hours are subject to being towed at the Unit Owner s expense whether or not the towed vehicle is owned by the Unit Owner or the Unit Owner s invitee. No repair work may be performed on vehicles other than in garages the doors of which remain closed or otherwise in the event of emergency circumstances such as flat tires, dead batteries and similar situations. No motorized vehicles, including, without limitation, motorcycles and mopeds, may be driven or used in Common Area (except for paved roads, parking areas and driveways) without the prior written consent of the Board of Directors. The speed limit within the community is 15 mph. Swimming Pool The pool is for the exclusive use of the Unit Owners, family members living with the Unit Owner, and their guests. Any person in the pool area who cannot be identified as a Unit Owner, member of a Unit Owner s family living with the Unit Owner, Unit Owner s guest or, other than with respect to members of a Unit Owner s family living with the Unit Owner, who is not accompanied by a Unit Owner or member of a Unit Owner s family living with the Unit Owner, will be asked to leave the pool area. The pool rules, which are posted conspicuously in the pool area and set forth below, must be followed by all persons using the pool. The Board of Directors has the right to suspend the right of any person to use the pool as a result of any violation of such rules and to prohibit any person from using the pool as a result of repeated violation of such Page 8 of 13
9 rules or hazardous or unsafe conduct in the pool area that continues or is repeated after a warning to cease such behavior has been given. The pool rules are: All persons using the pool and pool facilities do so at their own risk and sole responsibility. There is no lifeguard. All children under the age of 18 must be accompanied by an adult resident age 18 or older. Guests are limited to four (4) per household, and must be accompanied by an Owner at all times. Guests will be asked to leave if an Owner is not present. Pool passes are required for Owners & Guests. Pool bracelets must be displayed on your person at all times (either worn as a bracelet or pinned/attached to a garment). Additional pool passes may be granted at the discretion of the Homeowners Association Board Members. If an exception is granted, one pass per additional person will be issued for a seven (7) day period and limited to a maximum of four (4) total passes in any given year. If the housing unit is rented, pool privileges and use of the Harvest House facilities must be assigned to the tenants OR retained by the owner. Both parties may not have the right to use the facilities. The following are prohibited in the poolarea: o Animals or pets o Glass or other breakable items o Running, diving or disruptive behavior o Excessive noise, splashing or radios unless sound production is limited solely to headphones o Private pool parties o All raft and body floats sling seats no larger than 24 and noodles are acceptable o Electricaldevices o Smoking The designated smoking area is near the trash can outside of pool on the same side as the mail boxes. Swimming is permitted only in garments sold as swim wear. Infants must also wear swim suits & swim diapers - non-swim diapers are not permitted in the water. Lounge chairs or tables may not be reserved and must be repositioned in the order intended (orderly fashion) after use. Umbrellas must be lowered and re-secured with bungee cord after use. The pool will be open daily during swimming season until 10:00 p.m. Page 9 of 13
10 Wet swim wear is not permitted in Harvest House with the exception of the back hallway and restrooms. The gas grill is to be operated by Unit Owners and only at community functions and cleaned up after each use. Harvest House The Harvest House may be used by Harvest Glen Owners and their guests (no more than 4 per household at any time and accompanied by the Owner(s) at all times) with the exception of the Fitness Room, which may only be used by Owners. No animals are allowed in Harvest House with the exception of service animals. It is available for rental to Unit Owners only, for non-profit parties or meetings, subject to such security deposit, rental and other guidelines as the Board of Directors may approve from time-to-time, including but not limited to the following: > Owner/Renter must be present for entire 5-hour rental period. > Harvest House may not be rented on Thanksgiving Day, Christmas Eve or Christmas Day, New Year s Eve or New Year s Day, and Easter. > A $ refundable security deposit and a $ rental fee will be required to rent the Harvest House. Rentals are allowed between the hours of 9:00 a.m. and 11:00 p.m. daily for up to 5 hours maximum per day. The 5 hours includes setup for the event (which includes setup by a caterer) and cleaning of the Harvest House at the end of the event. There is no extension of time before or after the 5-hour rental period. Reservations will be granted on a first request basis. A Rental Agreement will be required and is available from the Harvest House Coordinator. > Harvest House is available for Memorial Services of Harvest Glen owner(s) at no rental fee. Residents will be required to send a check for the $ refundable security deposit and pay for any damages if they occur. > The number of guests is limited to 75 total. > Children and teenage parties are prohibited. > The Renter will have exclusive use of the Great Room, Kitchen, Game Room, and Billiards Room. The terrace area immediately outside of the Kitchen and Great Room may not be used during Pool Season. The deck around the Pool may not be used at any time. The Fitness Center is not included in any rental. The Pool may not be reserved for any event. No party items will be furnished by the Association. > No food or alcohol/beverages will be left or put out before the scheduled event rental period. > The Renter will be responsible for all cleanup and trash/recyclable removal. If there is too much trash for the Harvest House trash can and the top/lid cannot close properly on the trash can, renter must take the trash home for disposal. Renters must provide all garbage bags for trash in Harvest House and restrooms. Cleanup must be Page 10 of 13
11 done completely the day of the event, immediately following the conclusion of the event and within the 5-hour rental period. Completion of a Cleanup Checklist will be required and will be reviewed by an Advisory Committee member prior to refund of any or all of the Security Deposit. > There are two thermostats located on each side of the Great Room. If they are changed during the rental period, they must be returned to the original settings of 77 degrees for Cool and 68 degrees for Heat. A $50 fee will apply if thermostats are not returned to the original settings. > Smoking is only allowed outside of Harvest House. Smokers must place all cigarette butts in the Smokers Outpost containers located outside. Do not dispose of cigarette butts in plastic bags and put in Harvest House trash can. > Renter is responsible for any loss or damage to the Harvest House or other Association property that occurs during the rental of the Harvest House. The cost of repair or replacement of any such loss or damage will be deducted from the security deposit. Renter will be responsible for reimbursement of any cost of repair or replacement of any such loss or damage, the cost of door lock replacement and/or additional cleanup cost incurred by the Association, which separately or collectively exceeds the amount of the security deposit and cleaning fee. In additional to all other remedies available to the Association, if prompt reimbursement is not made to the Association for any costs incurred for repair, replacement and/or cleanup, Renter s right to future rentals will be suspended or terminated at the option of the Association. > Parking for guests is limited to the Harvest House parking lot and adjacent streets only. No guests vehicles may be parked in private drives at any time. No guests or Renter are allowed to park in the Mail Only parking space during the rental period. A $50 fee will be assessed to the renter if anyone parks in that space. > All lights are to be turned off and all doors locked. If furniture is moved, it must be returned to its original location. Pictures or other items on the walls cannot be removed for any reason. Items cannot be taped, tacked or nailed to the walls, woodwork, doors, etc. No staple guns, hot glue guns, nails, thumb tacks, confetti or glitter are to be used to decorate the Harvest House. Use of any of these prohibited items or methods may result in the forfeiture of some or all of the security deposit. Any rental furniture/equipment or furniture/equipment used by a caterer or DJ will not be placed in Harvest House prior to the event and must be removed at the end of the event. Owner/Renter must be available at the Harvest House for both delivery and pickup of the furniture/equipment. > There will be a post-event inspection by an Advisory Committee member after the event and any deficiencies will be noted and reported to the renter. The security deposit will be returned within 7 days after the inspection if there are no deficiencies. > Renter shall hold the members, officers and directors of the Association harmless from any and all damages and/or liability, which may result from the conduct and/or activities of the Renter and/or renter s agents, servants, and guests. This hold-harmless provision shall include, but not be limited to, injuries, which are related to personal bodily injury and/or property damage. Renter agrees to assume all risk for any materials, goods, equipment, etc., placed in the Harvest House during the entire time said materials, goods, food, beverages, and equipment, etc., are in the Harvest House. 12 Trash and Recycling Collection All trash and recycling containers must have wheels and fixed lids. Securely tied plastic bags are accepted by the Trash Collection Company. Recycling Company only accepts containers with fixed lids and wheels. Containers shall be set out at the curb in front of Unit after 3:00 p.m. the afternoon before the day of collection, and removed from the curb by 7:00 p.m. the day of collection. Containers, when not set out for collection, must be kept inside the garage. Unit Residents/Owners are responsible for cleaning trash spilled from the containers. To sign up for recycling, call Chesterfield County at The Harvest Glen approved recycling bins are as follows: Ninety-six (96) gallon container purchased from CVWMA at $65.00 and will be delivered to your residence. Thirty-two (32) gallon model GRS or a fifty (50) gallon model FG9W2773BLUE can be purchased from Home Depot. Solicitation, Garage Sales & Bulletin Boards Solicitation by commercial enterprises is not authorized within the community. Garage sales and tag sales are specifically prohibited, unless approved by the Board of Directors as a planned community activity. The bulletin board located outside of the Harvest House near the mailboxes is for the exclusive use of the Harvest Glen Owners Association, Inc. for official notices, information and the calendar of events at the Harvest House. The bulletin board located in the restroom hallway may be used by Harvest Glen Owners only for personal ads including items for sale with a 30-day limit on ads placed on the board. Neither bulletin board may be used for commercial ads or any commercial purpose, i.e. outside vendors, etc. Condominium Sales A Unit Owner who sells his or her Unit is responsible for complying with the requirements of Section of the Condominium Act. A copy of such Section is available from the Association. Leasing of Condominium Units 1. All leases shall be on the current Virginia Association of Realtors Residential Lease which may be Page 12 of 13
13 obtained from a qualified realtor or from the Community Manager. 2. All leases shall be for a period of not less than six (6) months and list all occupants of the unit. 3. Per the Bylaws, Article 6, Section 6(a), no more than five (5) individuals may occupy a 2- Bedroom unit and no more than seven (7) individuals may occupy a 3-Bedroom unit. 4. Per the Harvest Glen Rules & Regulations, no more than two (2) domestic animals may be kept in any unit. 5. Per the Harvest Glen Rules & Regulations, if the condominium unit is leased, pool privileges and the use of Harvest House facilities must be assigned to the tenants OR retained by the owner. Both parties may not have the right to use the facilities. 6. All leases shall be subject to the tenant s(s ) compliance with all covenants, restrictions, rules, regulations and published policies of the Harvest Glen Owners Association. An addendum to the lease stating this shall be signed by the tenant & owner and attached to the lease. 7. All leases shall be delivered to the Community Manager upon execution along with an updated Owner Information Form. Uses Affecting Insurance Common Elements are all portions of the condominium which are not included within the unit or garage. They include building exteriors, roofs, drives, driveways, walks & yards. Nothing shall be done or kept in or upon any Unit or any portion of the Common Elements which will increase or in the opinion of the Board of Directors reasonably may be deemed to risk increasing the rate of insurance for the Condominium without the prior written consent of the Board of Directors, which consent the Board shall not be obligated to give and may condition upon the requesting Unit Owner(s) agreement to reimburse the Association upon demand for the increase in insurance premiums incurred by the Association. No Unit Owner shall do, cause or permit anything to be done or kept, cause to be kept or permit to be kept in his or her Unit or upon any portion of the Common Elements which results or in the opinion of the Board of Directors reasonably may be deemed to risk resulting in cancellation of insurance on the Condominium or any part thereof. No Unit Owner shall commit or cause or permit to be committed waste with respect to his Unit or any portion of the Common Elements. If the Board approves any request made pursuant to this Rule conditioned upon an agreement to reimburse the Association for increased insurance premiums incurred by the Association and the Unit Owner(s) default(s) in such obligation, the amount due shall be an assessment against the Unit(s) involved and shall constitute a continuing lien and obligation of the Unit Owner(s) as provided in the Bylaws and Section of the Condominium Act. Unlawful Uses No unlawful use shall be made of the Condominium or any portion thereof. Nuisances, Etcetera No Unit Owner shall conduct or cause or permit to be conducted any noxious or offensive trade or activity or activity constituting a nuisance within his or her Unit or on, over or across any portion of Common Area. Any dispute concerning whether or not an existing or proposed trade or activity is in violation of this rule shall be resolved by the Board of Directors, whose decision shall be final and binding upon the Association and all Unit Owners.
