GENERAL INFORMATION A. APPLICANT: Papillion La Vista School District # S. Washington St. Papillion, NE B. PROPERTY OWNER: Papillion La Vista School District # S. Washington St. Papillion, NE C. LEGAL DESCRIPTION: Lots 1 through 12, Block 7 and Lots 1 through 12, Block 8 all in South Papillion, an Addition to the City of Papillion, together with Tax Lots 16A2, 16A1A, and 16A1B in Section 26, T14N, R12E of the 6th P.M. all in Sarpy County, NE E. REQUESTED ACTION: Approval of a preliminary plat, final plat, and special use permit to allow Secondary Educational Facilities F. EXISTING ZONING AND LAND USE: Urban Family Residential (R-3), Secondary Educational Facilities (Papillion Junior High) G. SIZE OF SITE: acres II. BACKGROUND INFORMATION A. COMPREHENSIVE PLAN SPECIFICATIONS: The Future Land Use map identifies the area as Urban Corridor. The pending update to the Future Land Use map also identifies the area as Schools.

2 2 B. EXISTING CONDITION OF SITE: The application area is developed as Papillion Junior High, which is classified as Secondary Educational Facilities. C. GENERAL VICINITY AND LAND USE: The area to the north is zoned GC (General Commercial) and is developed with a mix of commercial uses. The area to the east is zoned R-3 (Urban Family Residential) and is developed with the Papillion Junior High athletic field and Halleck Park. The area to the west is zoned GC (General Commercial) and R-4 (Multiple-Family Residential) and is developed with the Papillion La Vista School District offices and a mix of office uses and single-family residential. The area to the south is zoned R-3 (Urban Family Residential), R-4 (Multiple-Family Residential), and LC (Limited Commercial) and is developed with a mix of civic, commercial, and residential uses. D. RELEVANT CASE HISTORY: Papillion Junior High is an existing school. It operates under an assumed special use permit. E. APPLICABLE ORDINANCES AND REGULATIONS: Zoning and Subdivision Regulations and Comprehensive Plan. III. ANALYSIS AND DEVELOPMENT ALTERNATIVES STAFF COMMENTS: A. REQUEST: 1. This is a request for a preliminary plat, final plat, and special use permit for Secondary Educational Facilities. 2. The site is already developed with Papillion Junior High. The area that is being replatted into Lot 1 is currently a mix of of platted lots, unplatted tax lots, and vacated right-of-way. The property is required to be replatted at this time because the School District is proposing a building addition that will span multiple lots and vacated right-of-way. 3. A special use permit is required for the building addition and the new parking lot. A change of zone is not applicable because Secondary Educational Facilities is not permitted by right in any district. B. LAND USE/COMPREHENSIVE PLAN: 1. The proposed land use is consistent with the designated future land use of School. C. TRAFFIC AND ACCESS: 1. An additional 10 of right-of-way is being dedicated for Monroe Street. The dedication will match the right-of-way width to the south. 2. The applicant is proposing to replace the existing parking lot to the east of the building. The existing parking lot has a single access to December 17, 2014 Planning Commission PP ; FP ; SUP

3 3 Grant Street and a single access to Monroe Street. The new parking lot will have two accesses to Monroe Street. The access to Grant Street will be eliminated. The configuration of the new parking lot and the addition of a second access to Monroe Street will enhance circulation within the parking lot. 3. The drive that connects from Grant Street to the southern end of the school will be shortened to allow for the new building addition. D. SPECIAL USE PERMIT: 1. The special use permit is required because the applicant is proposing to construct additions to the building (both now and in the future) and to replace the existing parking lot to the east of the building. 2. The applicant is proposing to construct an 18,070 square feet addition to the Papillion Junior High. In addition to the upcoming addition, a future building addition is also shown. A conceptual elevation for the new addition was provided. The building materials will be complimentary to the existing structure. 3. The applicant is proposing to replace the existing 60 stall parking lot with a new 86 stall parking lot. 4. Given that more than 5,000 SF of impervious coverage is being created by the addition and the parking lot, the applicant is required to comply with the Post-Construction Stormwater Management regulations. The applicant is proposing to install a bio-retention rain garden for Post-Construction Stormwater Management. 5. The applicant is requesting that the Special Use Permit amendment be permanent rather than renewable. Staff supports this request because Papillion Junior High is an existing school and the applicant is making a significant investment with respect to the addition and the parking lot replacement. E. GENERAL: 1. The plat will consolidate the existing platted lots, unplatted tax lots, and vacated right-of-way into a single lot. Tax Lot 16B2 is not included in the replat. It is developed with an access drive that serves the property to the south and is subject to an access easement for that property. Staff concurs with leaving Tax Lot 16B2 as it exists today given the encumbrances on the property. It will also allow the applicant to sell the property in the future if desired. 2. The applicant shall revise the preliminary and final plats as follows: a. The Flood Zone detail refers to Douglas County. Replace all references with Sarpy County. 3. Fill within the floodplain is limited to 25%. The proposed floodplain fill is being calculated on a campus basis that includes school district property east of Monroe Street that is not part of this application. The December 17, 2014 Planning Commission PP ; FP ; SUP

4 4 applicant shall acknowledge within the subdivision agreement that fill of the property east of Monroe Street will be limited due to this method. Currently, the site plan shows that 21% of the total floodplain is being filled. This means that only 4% fill would be permitted in the future within the area east of Monroe Street. 4. Impervious coverage is limited to 60% in the R-3 District. The new addition and parking lot will increase the impervious coverage on Lot 1 beyond 60%. Impervious coverage is being calculated on a campus basis that includes school district property east of Monroe Street that is not part of this application. The applicant shall acknowledge within the subdivision agreement that impervious coverage on the property east of Monroe Street will be limited due to this method. Currently, the site plan shows that the impervious coverage will be 42% including the school district property east of Monroe Street. 5. As part of this request, the applicant is dedicating an easement to the City of Papillion and the Nebraska Department of Roads (NDOR) for an area that includes the Washington Street pedestrian overpass within Lot The applicant shall record a separate instrument with prescription outlining the rights and terms of the sanitary sewer, storm sewer, and overpass easements shown on the preliminary and final plats. 7. The School District will be required to enter into a subdivision agreement. A subdivision agreement will be required with the final plat because portions of this property have never been platted and there is not an active Subdivision Agreement for the Papillion South subdivision due to the original platting date. Items to be addressed include, but are not limited to, responsibility for Public Improvements, previously granted fee waivers, deferment of Watershed Fees, and use of a campus wide calculation for floodplain fill and impervious coverage. 8. The Papio-Missouri NRD provided no comment. IV. RECOMMENDATION The Planning Department recommends approval based on: 1. Consistency with the Comprehensive Plan. 2. Compliance with the Subdivision Regulations. 3. Compliance with the Zoning Regulations. The recommendation for approval is contingent upon the applicant: 1. Revising the preliminary and final plats per Section III, E, Agreeing to enter into a Subdivision Agreement that addresses Sections III, E, 3, 4, and Agreeing to record separate instruments for easements as described in Section III, E, 6.
