1 PLANNING SERVICES MEMORANDUM March 27, 2017 TO: FROM: SUBJECT: City Council Brian Schweigl, Associate Planner First reading, refer to Plan Commission, and schedule a public hearing on a proposed ordinance rezoning property located along Beloit Avenue, Kellogg Court, and Pierce Street from,, and R1 to M1. (File Ordinance No ) Relates to Strategic Plan Strategic Goal - Economy The proposed rezoning would facilitate the construction of a new 58,000 square-foot assembly and distribution facility for PlayStar Incorporated, a manufacturer of playground equipment. Executive Summary Brian Zeilinger of PlayStar (developer) and James Johnson of Johnson-Ryan Partnership (current property owner) have requested to rezone property located north of and adjoining the existing PlayStar facility at 2104 Beloit Avenue from, Community Shopping District and, General Commercial District to M1, Light Industrial District. Adjoining right-of-way that is proposed for vacation and incorporation into the development site would be rezoned from R1, Single-Family and Two-Family Residence District to M1 as well. The proposed rezoning is necessary in order to permit the construction of a new 58,000 square-foot assembly and distribution facility for PlayStar adjacent to its existing facility. City Recommendation The City recommends that File Ordinance No be referred to the Plan Commission for review and recommendation and also that it be scheduled for City Council public hearing on May 8, Suggested Motion This item does not require a motion by the City Council; only a first reading of the proposed ordinance by the Clerk and an announcement of the public hearing date are required. Background The subject property is located north of 2104 Beloit Avenue and is bounded by Pierce Street, Kellogg Court, and Beloit Avenue (see Map 1). The site is comprised of existing lots and public right-of-way that total 3.8 acres of land. The property is currently undeveloped except for a 1

2 former gasoline service station and convenience store at its northeast corner. The applicants have also submitted a request to vacate the Kellogg Court right-of-way and incorporate that land into the development site. The recommended City Council and Plan Commission review schedule for that request will be concurrent with review of the proposed rezoning. Review of a certified survey map to consolidate the development site will also be required. Options First reading, refer to Plan Commission, and schedule the request for public hearing. Move to deny introduction of the proposed ordinance rezoning property located along Beloit Avenue, Kellogg Court, and Pierce Street. Analysis An analysis of the request will be provided by staff in advance of the City Council public hearing. Conclusions The proposed rezoning would facilitate the construction of a new 58,000 square-foot assembly and distribution facility for PlayStar Incorporated, a manufacturer of playground equipment. 3 ORDINANCE NO An ordinance changing the zoning classification of property bounded by Beloit Avenue, Kellogg Court, and Pierce Street from, Community Shopping District;, General Commercial District; and R1, Single-Family and Two-Family Residence District to M1, Light Industrial District, with a penalty and injunctive relief for a violation thereof as set forth in Section of the Code of General Ordinances of the City of Janesville. THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS: SECTION I. The zoning classification of the following described property is hereby changed from, Community Shopping District;, General Commercial District; and R1, Single-Family and Two-Family Residence District to M1, Light Industrial District: PART OF THE SE 1/4 OF THE NE 1/4 OF SECTION 12; ALL OR PART OF LOTS 1, 2, 3, 4, 5 AND 6, BLOCK 6, SUNDOWN ACRES AND A CERTIFIED SURVEY MAP RECORDED IN VOLUME 30, PAGES 205 THRU 207 OF CERTIFIED SURVEY MAPS OF ROCK COUNTY,WISCONSIN, AS DOCUMENT NO AND PART OF THE NE 1/4 OF THE SE 1/4 OF SECTION 12, ALL BEING IN T.2N., R.12E. OF THE 4TH P.M., CITY OF JANESVILLE, ROCK COUNTY, WISCONSIN. DESCRIBED AS FOLLOWS: Beginning at the East 1/4 Corner of said Section; thence Southerly, along the East Line of the SE 1/4 of said Section, 560 feet, more or less to the easterly extension of the South Line of said Block 6; thence N88 55'42"W along said easterly extension, said South Line and the westerly extension of said South Line, 377 feet, more or less to the centerline of Pierce Street; thence Northerly along said centerline, 517 feet more or less to the South Line of Kellogg Avenue as platted on Sundown Acres; thence continuing Northerly 90 feet, more or less to the reference line of relocated Kellogg Avenue; thence northeasterly along said reference line, 139 feet more or less to the reference of Reuther Way; thence Southeasterly along said reference line of Reuther Way, 303 feet more or less to the centerline of Beloit Avenue; thence Southerly 48 feet more or less to the place of beginning. SECTION II. The above rezoning is subject to the following conditions: 1. No more than one curb opening will be permitted from this property onto Pierce Avenue. Said curb opening shall be utilized for emergency purposes only and shall be in a location consistent with the approved development plans for the site. 2. Along the Pierce Street frontage of this property, installation of a permanent landscape buffer and fencing shall be installed to provide a visual screen between the industrial land use and the opposite residential district. The landscape buffer and fencing in this area shall be consistent with the approved landscaping plan for the site. No structure, parking, signage, or

This ordinance shall take effect immediately upon adoption by the Common Council, the public health, welfare, peace, tranquility, good order, public benefit, and police power so requiring.
